HomeMy WebLinkAbout2026-006RESOLUTION NO. 2026- 006 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AUTHORIZING THE CHAIRMAN TO EXECUTE AMENDED MEMORANDUM OF AGREEMENT (MOA) WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR ACQUISITION OF RIGHT OF WAY FOR THE CONSTRUCTION OF 82ND AVENUE/CR 619 FROM 26TH STREET TO 69TH STREET WHEREAS, FDOT is authorized by Florida Statutes and Federal funding provisions to undertake projects within the geographical limits of Indian River County; and WHEREAS, on April 8, 2025, the Indian River County Board of County Commissioners approved the original Memorandum of Agreement (MOA) with the Florida Department of Transportation for Acquisition on Right of Way for the Construction of 82nd Avenue/CR619 from 26th Street to 60 Street; and WHEREAS, the State of Florida, Department of Transportation, has requested that Indian River County execute and deliver the Amended Memorandum of Agreement with the Florida Department of Transportation for Acquisition on Right of Way for the Construction of 82hhd Avenue/CR619 from 26th Street to 69th Street to reflect coordination between IRC and Sebastian River Improvement District (SRID) with FDOT to ensure consistent language in Attachment A, specifically regarding the legend describing future maintenance responsibilities between IRC and SRID upon project completion. In addition, a statement was added to the amended MOA noting that the executed SRID MOA and IRC Amended MOA will be recorded in the public records to ensure availability for future staff of all agencies. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that the Chairman of the Board is hereby authorized to execute and deliver to the State of Florida, Department of Transportation, the Amended Memorandum of Agreement (amended MOA) with the Florida Department of Transportation for Acquisition on Right of Way for the Construction of 82°d Avenue/CR619 from 26th Street to 69th Street The resolution was moved for adoption by Commissioner Flescher , and the motion was seconded by Commissioner Adams , and, upon being put to a vote, the vote was as follows: RESOLUTION NO. 2026-006 Deryl Loar, Chairman AYE Laura Moss, Vice Chairman AYF Susan Adams AYE Joseph H.
