Pursuant to Indian River County Code Section 201.22 D, this is a final settlement
agreement in lieu of foreclosure entered between the parties of case 312024CA000666.
Indian River County Department of Utility Services shall accept payment of $2500 as
settlement in full for the current account balance totaling $152,590.93 related to the
delinquent account listed above. After execution of this agreement and payment of the
settlement amount above, the outstanding balance for the account shall be $0.00.
Payments shall be made quarterly over the next 365 days.
Further, by execution of this settlement agreement, Account Holder voluntarily
relinquishes the account impact fee (ERU) on the account listed above. Impact Fees
previously paid related to the relinquished ERUs are non-refundable. If Account Holder
seeks to re-establish water utility services at a later date for this property, Account Holder
(or their successor) shall be required to purchase new Impact Fees at the current rate at
the time of the new purchase.
Be advised that this settlement agreement is intended to settle all outstanding matters..
Upon approval of this Settlement Agreement and final payment, Indian River County shall
dismiss the case with prejudice and release the lien currently encumbering the property.
Each party shall be responsible for their own attorney's fees and costs.
Signature below represents that I understand and agree to the above terms of this
Settlement in Lieu of Foreclosure agreement.
