Tuesday, December 10, 1996
The Board of County Commissioners of Indian River County,
Florida, met in County Commission Chambers, 1840 25th Street, Vero
Beach, Florida, on Tuesday, December 10, 1996, at 9:00 a.m.
Present were Fran B. Adams, Chairman; Carolyn K. Eggert, Vice
Chairman; Caroline D. Ginn; Kenneth R. Macht; and John W. Tippin.
Also present were James E. Chandler, County Administrator; Charles
P. Vitunac, County Attorney; and Patricia Ridgely, Deputy Clerk.
The Chairman called the meeting to order and Reverend Bill
Kelly gave the Invocation. Administrator Chandler led the Pledge
of Allegiance to the Flag.
ADDITIONS TO THE AGENDA/EMERGENCY ITEMS
Chairman Adams announced two additions to the Consent Agenda:
7M - Approval of Surety Bonds for Hospital District Board
Members Allen Seed, Donna Skinner and Broadus Sowell
7N - Corrective Memo - Escambia Housing Industrial
Revenue Bonds.
Commissioner Ginn requested removal of her item 13C, Discuss
Establishment of a Utilities Advisory Committee.
ON MOTION by Commissioner Eggert, SECONDED by
Commissioner Tippin, the Board unanimously
added/deleted the above items to/from the
Agenda.
APPROVAL OF MINUTES
The Chairman asked if there were any additions or corrections
to the Minutes of the Regular Meeting of November 5, 1996. There
were none.
ON MOTION by Commissioner Eggert, SECONDED by
Commissioner Tippin, the Board approved the
Minutes of the Regular Meeting of November 5,
1996, as written.

Secretary of State Sandra Mortham has issued the directive
that through the Florida public libraries all citizens in
Florida, especially children, will have free and equal
access to the World Wide Web. Library Services and
Construction Act (LSCA) funds have been made available for
this state-wide project. Thirty three public libraries
will receive grants of $3,000.00 each, and six libraries
will receive grants of $30,000.00. The Indian River County
Library System was the number one applicant and will
receive one of the $30,000.00 grant awards. No matching
funds are required. -
ANALYSIS:
The Chairman of the Board of County Commissioners'
signature is required on the two FloriNet grant agreements
(attached).
RECOMMENDATIONS:
Staff respectfully requests that the Board authorize its
Chairman to sign the grant agreements and return to the
Library Services Director to be forwarded to the
appropriate State Library staff.

RECOMMENDATION
Staff recommends that the Board of County Commissioners authorize
the Chairman to execute the attached contract with Ron Garl Golf
Course Architect.
Commissioner Ginn requested an explanation as to why the work
had not been done originally, and Golf Club Director Bob Komarinetz
advised that the first time bids came in over budget. Staff went
out for bids again and again the bids came in over budget. Staff
went back to the architect who told them it was way over budget.
The funds that had been set aside were used for golf carts.
Commissioner Ginn appreciated being brought up to date.

Background
For several years, the County's excess insurance coverages have been with the Florida League of Cities' Public
Risk Services pools, formerly known as the Florida Municipal Insurance Trust for liability and property
coverages and the Florida Municipal Self Insurers Fund for workers' compensation. Effective October 1, 1996,
the Board of Trustees of the workers' compensation fund and the health insurance fund, in which Indian River
County does not participate, elected to transfer their assets, liabilities, management and operations to the
Florida Municipal Insurance Trusk This merger strengthens the pool, consolidates administrative functions for
Its management, and makes it more competitive in the market Al coverages, policies and practices will remain
unchanged. To continue participation, each member entity has been asked to execute an application for the
newly merged pool.
Recommendation
Staff recommends that the Board approve ongoing participation in the Fund, and authorize the chairman's
signature on three (3) original applications.

document for retroactive approval in order to allow Safespace to meet the grant deadline.
The Safespace grant is for capital improvements and operating costs for their facility in Indian River
County which houses battered women and homeless women with children. Safespace was not
requesting any funds to offset the grant.
RECOMMENDATION -

ANALYSIS
The Agreement states that the Indian River County Department of
Utility Services shall provide temporary water service to Mr. and
Mrs. Rubio until such time that a water line may be constructed on
2nd Square, SW, in Forest Lake by assessment. They agree to pay
all fees required to make this connection. They further agree to
participate in the assessment and to reconnect to this water line
as required by the Indian River County Department of Utility
Services.
RECOMMENDATION
The Department of Utility Services recommends that the Board of
County Commissioners approve the attached Agreement with Miguel E.
and Martha O. Rubio on the Consent Agenda.

On December 3, 1996 the City of Vero Beach at its regular meeting
abandoned the alley between the Courthouse and the annex.
Everything is in order for a closing in the immediate future.
Staff recommends that the Board authorize the Chairman to execute the
attached deeds or similar deeds conveying the property. The
Purchasers have not decided exactly how title should be taken. It is
important that we move ahead so that we can have a closing in
December 1996.

William R Hough & Company, underwriter, has approached Indian River County to see if they are
interested in participating in the Escambia Single Family Housing Program for low to moderate
income single family housing. This program involves utilization of Industrial Revenue Bonds.
Industrial Revenue bond allocations are released by districts each year beginning in January on a first
come first serve basis. Indian River County is in district 9B with St. Lucie, Martin and Okeechobee
Counties and the allocation should be over $9.5 million.
St. Lucie County has already committed to the Escambia Family Housing Program. Indian River
County would be sharing the allocation with St. Lucie County, which we have done in the past. With
St. Lucie County and Indian River County participating in the same program, local participating
lenders can move the money between counties after the first 120 days of the program. William R.
Hough and Company is requesting we waive the $1,000 administrative fee plus the .5% of the face
value of the bonds (.5% up to a maximum of $10,000) because this will be passed on to the lending
institutions and then eventually to the person attempting to obtain the loan.
Indian River County must hold a TEFRA (Tax Equity Fiscal Responsibility Act) public hearing and
pass a resolution. Escambia Housing would like to hold the TEFRA hearing on Tuesday, December
17, 1996.
RECOMMENDATION
Staff recommends the Board of County Commissioners waive only the .5% per bond fee and approve
the Inducement Resolution and Inter -local agreement with Escambia Housing.

It is requested that the data herein presented be given formal
consideration by the Board of County Commissioners at its regular
meeting of December 10, 1996.
DESCRIPTION AND CONDITIONS
Majestic Partners of Vero Beach, Ltd., current developers of the
Sea Oaks residential development on South Jungle Trail, are
planning a new phase of construction in an area of Sea Oaks known
to contain a portion of an archaeological site. The archaeological
site is known as the "Blue Goose Midden," and the proposed
construction phase, called Sea Oaks River Villas Phase III, is
located adjacent to Jungle Trail just south of the County's Water
Treatment Plant access road (see attached general map). This matter
is presented for the Board of County Commissioners' approval of a
proposed archaeological site development mitigation plan.
Historic Resources Advisory Committee
Review & Recommendations
In accordance with the County's Historic and Archaeological
Resources Protection Ordinance (County Code Chapter 933), the
County Historic Resources Advisory Committee (HRAC) reviewed the
proposed development plan concerning protection of the
archaeological site in conjunction with proposed site development.
On June 12, 1996, HRAC recommended that the developer retain a bona
fide archaeologist to conduct a "Phase 2" survey of the site and
report back to the Committee.
Subsequently, the developer retained Storm L. Richards and
Associates, Inc., which conducted a Phase 2 evaluation of the
property. Attached is a copy of a letter dated September 6, 1996
from Dr. Richards to the developer, providing survey results and
recommendations concerning protection of the midden.
On November 14, 1996, HRAC reviewed Dr. Richard's archaeological
survey and voted to recommend that the Board of County
Commissioners approve the developer's site plan proposal. As
structured, this proposal would confine impacts to approximately
10% of the identified archaeological middens on the River Villas
Phase III development site. The proposal corresponds to the
recommendations as described in archaeologist Storm Richards'
letter of September 6, 1996, and summarized herein. In addition,
HRAC recommended that the developer be required to execute a
conservation easement relating to the to be preserved midden areas.
ANALYSIS
In February, 1988, the overall west half of the Sea Oaks
development along Jungle Trail received conceptual plan approval by
the Board of County Commissioners. The conceptual plan generally
depicts the River Villas Phase III development proposal (see
attached graphic).
Although conceptual approval has occurred, each phase of
development must undergo a separate site plan approval process.
Submittal of a formal site plan application for River Villas Phase
III at the location of the Blue Goose midden has not yet occurred,
but is expected in the near future.
Archaeological Midden Description
Storm L. Richards & Associates, Inc. identified two separate
remnant middens where River Villas Phase III is proposed, and
refers to them as the North Midden and the South Midden (see survey
map). The North Midden is described as partially disturbed,

approximately 2,500 square feet in size, and located on the east -
central portion of the proposed development site. The South Midden
is densely forested and relatively intact, is approximately 14,400
square feet in size, and runs virtually the entire length of the
development site near Jungle Trail. According to the survey, the
South Midden contains indigenous ceramic pottery and shell tools.
No evidence of human remains was found on the overall site.
Impacts
The archaeological consultant indicates that the proposed River
Villas Phase III development will have minimal impact on the South
Midden. Approximately 1,800 square feet of the North Midden,
however, falls within the footprint of a proposed 24 -unit building.
More specifically, the top two feet of the midden within the
footprint of the building will be disturbed, with the remainder
undisturbed except by compaction. The consultant indicates that
although the North Midden will undergo some disturbance (as
described), this represents only +10% of the total North and South
Middens. For this reason, the proposed development would not
substantially affect the overall archaeological value of the
remnant middens, since future analysis could occur on the remaining
preserved portions (90%) of the middens.
Archaeologist's Recommendations
Following is a summary of recommendations made by Storm L. Richards
and Associates, Inc. concerning protection of the remnant middens
in conjunction with development of River Villas Phase III.
Preserve and discourage excavation of the 90%
portion of the identified middens that will be
unimpacted by the proposed development. This
should be accomplished by covering the area
with soil and "light" landscaping to protect
the archaeological materials and to discourage
further unauthorized removal of artifacts.
• Have a certified archaeologist, employed by
the developer, on site as needed during
construction excavation to identify and
retrieve any significant artifacts.
The developer should formally request the
return of artifacts removed from the property -
by local collectors.
The developer should identify the location of
the middens with signage and display certain
retrieved artifacts, and possibly prepare a
brochure about the Blue Goose Midden for
educational purposes.
It is county staff's position that these recommendations are
appropriate, and that the developer should be allowed to impact
approximately 10% of the identified midden area as described,
conditioned upon the archaeologist's recommendations listed above.
Further, staff feels it is appropriate to require that the
developer execute a conservation easement with Indian River County
that would overlay the preserved midden areas. This conservation
easement would be worded to limit only those activities that would
be detrimental to the archaeological resource.
At its meeting on November 14th, HRAC concurred with the
archaeologist's and staff's recommendations, as reflected in HRAC's

recommendations to the Board. As part of the Committee's vote,
however, the Committee clarified that any landscape and soil
placement to protect the preserved midden should occur prior to
construction (rather than post -construction), in order to minimize
impacts that might otherwise occur during the construction process.
RECOMMENDATION
Staff recommends that the Board of County Commissioners approve the
Historic Resources Advisory Committee's recommendation to allow
approximately 10% impact to the identified archaeological middens
on the River Villas Phase III development site, as described in
archaeologist Storm Richards' letter of September 6, 1996,
conditioned upon the recommendations contained in that letter and
summarized herein. In addition, staff and HRAC recommend that the
Board require the developer to execute a conservation easement
applicable to the preserved midden areas.

Chairman Adams was concerned that signage might draw attention
and attract people to dig there and disturb the artifacts.
The Board unanimously agreed with her concern. They briefly
discussed alternative suggestions such as using the Library or
Center for the Arts to display the historical artifacts. Also
mentioned was reserving the artifacts for a later display near
Jungle Trail in connection with the ISTEA program.
Commissioner Eggert and Commissioner Ginn felt the Library
would be ideal because of a program already in place on the Indian
tribes of this area and because that is where people would look for
information.
Commissioner Eggert pointed out that landscaping and soil
placement (to protect the midden) should be done prior to
construction and wanted that clearly understood as part of the
(first bullet) recommendation.
MOTION WAS MADE by Commissioner Eggert, SECONDED BY
Commissioner Ginn, for discussion, to approve
staff's recommendation as set forth in the
memorandum.
Under discussion, Commissioner Ginn suggested that the
recommendation be changed to eliminate signage and to display the
artifacts in another location to be determined at a later date.
Discussion ensued and it was decided to change the wording to
"developer should NOT identify the location ... ".
Dean Luethje, an engineer with Carter Associates representing
Majestic Partners, asked for clarification on the elimination of
the signage and the location of the artifacts.
Commissioner Eggert suggested addition of "in the future
displays of certain retrieved artifacts and possible preparation of
a brochure will be done."
Mr. Luethje was concerned about the stewardship of the
artifacts, and Commissioner Macht felt they should be safeguarded
somewhere.
Chairman Adams proposed that Mr. DeBlois come back to the
Board with a recommendation after he confers with Mr. Luethje.
Mr. DeBlois thought it might be a good idea for the developer
to coordinate with the Indian River Historical Society to make
artifacts available for the Society's display.
Commissioner Ginn suggested they change the wording to "shall"
turn over any artifacts.

Mr. Luethje was concerned what that might entail and did not
want to have to build a special building, and he was assured that
was not the understanding.
Commissioner Macht believed it important to catalog the
findings and recalled that a few years back a box of pottery shards
was recovered and given to the educational department of the Center
for the Arts. The shards were used as models for the ceramic
artists in the area.
Chairman Adams preferred that the Historical Society give
input and felt that was their purpose.
Mr. Luethje wanted to know where the Historical Society would
store the artifacts until such time as a permanent site was
selected; he believed that some of the Historical Society members
had some artifacts in their homes for safekeeping.
Commissioner Eggert AMENDED her motion to
include all that had been discussed: namely,
that the developer shall not identify the
location of the middens with signage and that
Mr. DeBlois shall report to the Board the
recommendation concerning the artifacts.
Commissioner Ginn SECONDED the amended motion.
THE CHAIRMAN CALLED THE QUESTION and the motion
carried unanimously.
ESTABLISHMENT OF A UTILITIES ADVISORY COMMITTEE
DISCUSSION

Chairman Adams announced that immediately upon adjournment,
the Board would reconvene sitting as the Commissioners of the Solid
Waste Disposal District.

A brief discussion was held and by CONSENSUS there will not be
a Board of County Commissioners meeting on either Tuesday, December
24 or December 31, 1996. A regular meeting will be held on
December 17 and a Workshop on Communication Towers will be held
December 19.
