HomeMy WebLinkAbout2026-007ORDINANCE NO. 2026- 007 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR APPROXIMATELY 7.79 ACRES LOCATED ON THE NORTH SIDE OF 45TH STREET, APPROXIMATELY 0.45 MILES EAST OF 58TH AVENUE, FROM RS -6, SINGLE-FAMILY RESIDENTIAL DISTRICT, AND RMH-8, RESIDENTIAL MOBILE HOME DISTRICT, TO RM -6, MULTIPLE -FAMILY RESIDENTIAL DISTRICT; AND PROVIDING FOR CODIFICATION, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; and WHEREAS, the Board of County Commissioners determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, is changed rezoning from RS -6, Single -Family Residential District, and RMH-8, Residential Mobile Home District, to RM -6, Multiple -Family Residential District: PARCEL 1 THE EAST 10 ACRES OF TRACT 14, SECTION 21, TOWNSHIP 32 SOUTH, RANGE 39 EAST, ACCORDING TO THE PLAT OF INDIAN RIVER FARMS COMPANY, FILED IN PLAT BOOK 2, PAGE 25, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA; SAID LAND NOW LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA. LESS THE NORTH 525 FEET OF THE WEST 165 FEET, AND ALSO LESS THE SOUTH 274.90 FEET OF THE EAST 135 FEET, AND LESS ALL ROAD RIGHTS OF WAY OF RECORD. PARCEL 2 THE SOUTH 274.90 FEET OF THE EAST 135 FEET OF THE EAST 10 ACRES OF TRACT 14, SECTION 21, TOWNSHIP 32 SOUTH, RANGE 39 EAST, ACCORDING TO PLAT OF INDIAN RIVER FARMS COMPANY, FILED IN PLAT BOOK 2, PAGE 25, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA; SAID LAND NOW SITUATE IN INDIAN RIVER COUNTY, FLORIDA; LESS THE NORTH 7.66 ACRES THEREOF, AND THE NORTH GIFFORD ROAD RIGHT-OF-WAY. ORDINANCE NO. 2026- 007 All with the meaning and intent and as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 50' day of May 2026. This ordinance was advertised in the Press -Journal on the 25th day of March 2026, for a public hearing to be held on the 5th day of May 2026, at which time it was moved for adoption by Commissioner Flescher , seconded by Commissioner Earman , and adopted by the following vote: Deryl Loar, Chairman AYE Laura Moss, Vice -Chairman AYE Susan Adams, Commissioner A.YE Joseph H.
