Home My WebLink About2026-105AMENDMENTS TO WORK ORDER 1 HOBART PARK BASEBALL FIELDS — IRC -1759 This Amendment 5 to Work Order Number 1 is entered into as of thisl6thday of June 12026 pursuant to that certain Continuing Contract Agreement, dated April 17, 2018, renewed and amended as of May 18, 2021 (collectively referred to as the "Agreement"), by and between INDIAN RIVER COUNTY, a political subdivision of the State of Florida ("COUNTY") and Masteller & Moler, Inc. ("Consultant"). 1. The COUNTY has selected the Consultant to perform the professional services set forth in existing Work Order Number 1, Effective Date July 2, 2019. 2. The COUNTY and the Consultant desire to amend this Work Order as set forth on Exhibit A (Scope of Work) attached to this Amendment and made part hereof by this reference. The professional services will be performed by the Consultant for the fee schedule set forth in Exhibit B (Fee Schedule), and within the timeframe more particularly set forth in Exhibit C (Time Schedule), all in accordance with the terms and provisions set forth in the Agreement. 3. From and after the Effective Date of this Amendment, the above -referenced Work Order is amended as set forth in this Amendment. Pursuant to paragraph 1.4 of the Agreement, nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein. It understood the IRC Parks, Recreation, and Conservation Department has decided to replace the existing two (2) dugouts for the existing south field along with installation of a triple -lane batting cage to the west of the under construction north baseball field. This Amendment is intended to provide for the following scope of services to allow for construction of these additional features: Scope of Work: Task A—Site Construction Plan Modification: As requested by the Parks, Recreation & Conservation Department, we will add to the Site Construction Plans a pair of new dugouts to replace the existing dugouts for the existing southwest field. It is understood the new dugouts shall be fabricated and installed on behalf of Proctor Construction by Rep Services, Inc. of Longwood, Florida and be the same as for the two (2) new fields already under construction. It is understood the new dugouts shall be erected in the same location as the existing dugouts to be removed. Our services do not include the structural design, permitting, review, nor approvals for the slab and vertical elements of the dugouts. In addition, we shall depict the location for a tri -lane batting cage facility to be provided and installed on behalf of Proctor Construction by Daniels Fence Corp of Stuart, Florida. It is understood Daniels Fence will provide the structural design for the batting cage facility suitable for acquisition of a building permit. Our services do not include the structural design, permitting, review, nor approvals for the slab and vertical elements of the tri -lane batting cage facility. Task B — Approvals / Permits: In order to obtain authorization for the dugouts and batting cage facility to be constructed, we shall submit an application for an Indian River County Planning & Development Services Department Administrative Approval (AA) along with the $400.00 review fee. We will prepare the Administrative Approval application form for execution by the County Parks, Recreation & Conservation Department. Once executed, we will submit the form, cover letter, fee, and civil plans to the County Planning & Development Services Department for approval. Our services do not include coordination with the Building Department's review and/or approval. The $400.00 review fee is included. No other permitting services nor review fees are included within our fees. Task C — Responses to Comments: Following submittal of the AA application, we will respond to reasonable comments (if any) pertaining to the proposed modifications to assist to secure a favorable AA process. Task D — Notice of Plan Change: Following the successful AA process, we shall prepare a Notice of Plan Change to be issued to the project Contractor, Proctor Construction, such that the Contractor may construct the dugouts and batting cage facility in conformance with the approved revised design.
