HomeMy WebLinkAbout2026-012ORDINANCE NO. 2026-012 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR APPROXIMATELY 10.4 ACRES LOCATED ON THE EAST SIDE OF U.S. HIGHWAY 1, SOUTH OF AND ADJACENT TO 61sT STREET, FROM RS -3, SINGLE-FAMILY RESIDENTIAL DISTRICT, TO RM -3, MULTIPLE - FAMILY RESIDENTIAL DISTRICT; AND PROVIDING FOR CODIFICATION, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; and WHEREAS, the Board of County Commissioners determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, is changed rezoning from RS -3, Single -Family Residential District, to RM -3, Multiple -Family Residential District: THAT PART OF THE NORTH 1/2 OF THE NORTHEAST 1/4 OF THE NORTHEAST 1/4 OF SECTION 15, TOWNSHIP 32 SOUTH, RANGE 39 EAST, LYING EAST OF THE EASTERN BOUNDARY OF THE RIGHT-OF-WAY OF U.S. HIGHWAY 1, SAID LAND LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA. AND THAT PART OF THE SOUTH (1/2) OF THE NORTHEAST (1/4) OF THE NORTHEAST (1/4) OF SECTION 15, TOWNSHIP 32 SOUTH, RANGE 39 EAST, LYING EAST OF THE EASTERN BOUNDARY OF THE RIGHT-OF-WAY OF U.S. HIGHWAY 1, SAID LAND LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA. AND THE NORTH 97.05 FEET OF THE SOUTHEAST QUARTER (1/4) OF THE NORTHEAST QUARTER (1/4) OF SECTION 15, TOWNSHIP 32 SOUTH, RANGE 39 EAST, LYING EAST OF NEW U.S. HIGHWAY #1, INDIAN RIVER COUNTY, FLORIDA. LESS AND EXCEPT THAT PORTION CONTAINED IN OFFICIAL RECORDS BOOK 2755, PAGE 1559, PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA. AND ORDINANCE NO. 2026- 012 THE SOUTH 187.92 FEET OF THE NORTH 284.97 FEET OF THE SOUTHEAST QUARTER (1/4) OF THE NORTHEAST QUARTER (1/4), SECTION 15, TOWNSHIP 32 SOUTH, RANGE 39 EAST, LYING EAST OF NEW U.S. HIGHWAY #1, AS IN BOOK 339, PAGE 521, LESS THE WEST 500 FEET OF THE NORTH 75 FEET AS IN O.R. BOOK 372, PAGE 429, LESS THE SOUTH 35.39 FEET OF THE EAST 200 FEET THEREOF, INDIAN RIVER COUNTY, FLORIDA. AND LESS AND EXCEPT THE FOLLOWING AS DESCRIBED IN OFFICIAL RECORDS BOOK 2755, PAGE 1559: COMMENCING AT THE NORTHEAST CORNER OF THE SOUTHEAST 1/4 OF THE NORTHEAST 1/4 OF SECTION 15, TOWNSHIP 32 SOUTH, RANGE 39 EAST, THENCE RUN SOUTH 00 DEGREES 21'27" WEST A DISTANCE OF 96.02 FEET TO THE POINT OF BEGINNING, THENCE CONTINUE SOUTH 69 DEGREES 33'28" WEST A DISTANCE OF 177.19 FEET; THENCE SOUTH 28 DEGREES 29'15" WEST A DISTANCE OF 246.17 FEET; THENCE SOUTH 89 DEGREES 59'09" EAST 81.71 FEET; THENCE NORTH 00 DEGREES 21'27" EAST 125 FEET; THENCE NORTH 89 DEGREES 59'09" EAST 200 FEET; THENCE NORTH 00 DEGREES 21'27" EAST 153.18 FEET TO THE POINT OF BEGINNING. All with the meaning and intent and as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 4u' day of August 2026. This ordinance was advertised in the Press -Journal on the lo' day of June 2026, for a public hearing to be held on the 4' day of August 2026, at which time it was moved for adoption by Commissioner Earman , seconded by Commissioner Flescher , and adopted by the following vote: Deryl Loar, Chairman AYE Laura Moss, Vice -Chairman AYE Susan Adams, Commissioner AYE Joseph H.
