AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF
INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTIONS 312.05
(EXEMPTIONS FROM PERMITTING), 312.06 (PROHIBITED ACTIVITY),
312.08 (PERMIT APPLICATION PROCESS), 312.11 (PERFORMANCE
SECURITY), AND 312.19 (RIGHT OF WAY DRAWINGS) OF CHAPTER 312
(RIGHTS OF WAY) OF THE CODE OF INDIAN RIVER COUNTY, FLORIDA IN
ORDER TO UPDATE DRAWINGS AND COMPLY WITH FLORIDA STATUTE
SECTION 337.401 AND PROVIDING FOR CODIFICATION, SEVERABILITY,
REPEAL OF CONFLICTING PROVISIONS, AND AN EFFECTIVE DATE.
WHEREAS, Indian River County adopted a Chapter 312 of the Indian Rive County Code
of Ordinances under its police powers to help assist in public safety and welfare in managing
the creation, use, and maintenance of rights -of -way; and
WHEREAS, time has passed and an update to the code sections of Chapter 312 is
needed to update the drawings in the section to bring them up to date with current construction
standards; and
WHEREAS, changes to the code are also necessary to remain compliant with newly
passed legislation that will go into effect starting October 1, 2026;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA THAT:
Section 1. Enactment Authority.
Article VIII, section 1 of the Florida Constitution and chapter 125, Florida Statutes vest broad
home rule powers in counties to enact ordinances, not inconsistent with general or special law,
for the purpose of protecting the public health, safety and welfare of the residents of the county.
The Indian River County Board of County Commissioners specifically determines that the
enactment of this ordinance is necessary to protect the health, safety and welfare of the
residents of Indian River County.
Section 2. Amendment of Section 312.05 (Exemptions from permitting), Section 312.06
(Prohibited activity), Section 312.08 (Permit application procedure), Section 312.11
(Performance security), and 312.19 (Right of way drawings) of Chapter 312 (Rights -Of -
Way).

Section 312.05 (Exemptions from permitting), Section 312.06 (Prohibited activity), Section
312.08 (Permit application procedure), Section 312.11 (Performance security), and 312.19
(Right of way drawings) of the Code of Indian River County, Florida are hereby amended to
read as follows:
CHAPTER 312. RIGHTS -OF -WAY.
Section 312.05. Exemptions from permitting.
(2) Emergency exemption.
(c) In the event that any utility or governmental entity including their authorized
contractors must perform emergency repairs which should require a permit
under this chapter, then that entity may begin those emergency repairs
provided:
1. The public works director is notified in person or by telephone that such
repairs must be initiated on an emergency basis.
2. A right-of-way permit is obtained as soon as practicable after the
emergency repairs are begun, but in no event later than ten (10) days
after the emergency repairs began.
3. Failure to notify the public works director in writing or obtain the required
right-of-way permit shall be prohibited.

Section 312.06. — Prohibited activity.
1. Except as provided in section 312.05, it shall be unlawful and subject to penalties
provided herein for any person, corporation, or utility company, public or private
to:
(g) Install any unauthorized sign, utility, shrub, obstruction or structure within
four (4) feet of the curb line or fourteen (14) feet from edge of uncurbed
pavement or if those limitations cannot be met then the installation shall
be as far from the edge of the pavement as possible but shall be within the
right-of-way. SeFiguree 1� section 312.19.

Section 312.08. Permit application procedures.
Reference material. The application form as provided by the department of public works
shall be used for all types of permits. The conditions specified on the reverse side of the
application form shall be adhered to as part of this chapter. Applicants should refer to
the drawings in section 312.19 as well as the following publications for proper
construction specifications and procedures:
d. Florida Department of Transportation "Manual of Uniform Minimum Standards for
Design, Construction and Maintenance for Streets and Highways" latest edition.
e. Florida Department of Transportation "Utility Accommodation Manual" latest edition.
2. Type of permits and required information.
A. Driveways. The following will be required prior to construction of any driveway
in the county right-of-way:
(3) Three (3) sets of plans showing the driveway design plan and profile view.
The following criteria shall be met:
a. That portion of any driveway constructed within the county right-of-way
shall be constructed as required by shown in section 312.19 Figures 3
through 10 2,and 3.
C. Utility construction within the right-of-way. All utility work will require a right-of-
way construction permit. Utility companies having a valid franchise to operate in
Indian River County will not be required to pay a right-of-way permit fee. Utility
companies not having a valid franchise may be required to pay a user fee to be
determined by the board of county commissioners via resolution director of
public works. The permit application shall be submitted along with the following
information:

d. Pavement cut and restoration, where approved, shall be as follows:
1. Pipe bedding, backfill and compaction shall conform to standards
specified in the references indicated in section 312.08.1 (a) and
(c). Open cut restoration shall meet specifications detailed in
drawing No.6 section 312.19. Density testing shall be performed

by an approved independent testing laboratory and reports
submitted to the public works director prior to permanent patch. A
temporary asphalt patch shall be applied within twenty-four (24)
hours after backfill and compaction. The finish surface of the
temporary asphalt patch shall be within one -quarter (Y4) inch of
the elevation of the existing roadway surface.
10. The appropriate fee and charges as required by Resolution 99-75
as amended is required

e. In addition to the above, all communication/fiber utility companies are
required to:
1. Stake out the County owned right-of-way consistent with Florida
Statute Section 337.401 prior to the start of construction.
2. Register with the County.
i. Renew registration every five (5) years.
ii. If information changes during the five (5) year period the
registration needs to be updated within ninety (90) days of
changes.
3. Provide the location of at -grade communications facilities within
fifty(50) feet of the proposed installation location for the placement
of at -grade communication facilities.
D. Other right-of-way permits.
3. Permit review. The board of county commissioners hereby authorizes
and empowers the public works department division to receive and
review permit applications, collect fees, and issue permits allowing the
permittee to enter onto the public right-of-way within county road system
to perform specified construction or installation. In reviewing the permit
application, the public works director shall determine whether the
proposed construction conforms to all requirements of the county
engineering standards, laws, and ordinances. Permits shall be issued or
denied with reasons clearly stated in writing within thirty (30) working

days of receipt by the public works director. In all cases every application
is subject to review and recommendation by the director of public works.
a. Communication/fiber utility comoanv bundled permits will not be
issued until all permit plans in the bundle are approved. The
permits in a bundle under this section and pursuant to Florida
Statute Section 337.401 shall be closed out within forty-five (45)
days after the provider's completion of work. Failure to close out
the permits within forty-five (45) days after the provider's
completion of work shall be a violation of this code.
Section 312.11. Performance security.
A. Security bond shall be posted to secure completion of all construction or
installation commenced, pursuant to a permit under this chapter, except for
construction of driveways not requiring a roadway modification, for utility
placement by utility companies having a valid franchise to operate in Indian
River County, for drainage structures serving single family residences located in
ditches parallel to the roadway, and pedestrian bike path facilities. Security
bond shall be posted in the amount of one hundred fifteen (115) percent of the
estimated costs of the proposed improvements in the right-of-way. The estimate
shall be prepared by an engineer registered in the State of Florida to practice
professional engineering. Upon completion and approval by the public works
director of all required improvements, ninety (90) percent of the posted security
will be released by the public works director. A ten (10) percent warranty
security will be held for an additional twelve (12) months, following which time, if
all improvements are free of defects due to faulty field engineering,
workmanship, or materials, this ten (10) percent security will be released by the
public works director.
For cable/fiber utility providers consistent with Florida Statute Section
337.401, more than one permit may be linked to a single form of security.
Once a form of security is put into place the form of security may not be
substituted and will not be released until all permits in association with
the security pass inspection and are closed out. Security may be in the
form of a bond underwritten by a security insurer with an A.M. Best's
rating of A -VI or greater and authorized to transact such business in this
state; a letter of credit in accordance with Indian River County Code
Section 312.11.B; or cash along with a cash and escrow deposit

agreement approved as to form and sufficiency by the county attorney's
office.
a. Permits linked to the single form of security cannot be swapped out
and/or exchanged once the security is in place.

construction within the county right-of-way. Detailed specifications, methods and procedures
may be found in the publications listed in section 312.08 of this chapter.

ORDINANCE NO. 2026- 014
Section 3. Codification. It is the intention of the Board of County Commissioners that the
provision of this ordinance shall become and be made part of the Indian River County Code,
and that the sections of this ordinance may be renumbered or re -lettered and the word
ordinance may be changed to section, article or such other appropriate word or phrase in order
to accomplish such intention.
Section 4. Severability. If any part of this ordinance is held to be invalid or unconstitutional
by a court of competent jurisdiction, the remainder of this ordinance shall not be affected by
such holding and shall remain in full force and effect.
Section 5. Conflict. All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
Section 6. Effective Date. This ordinance shall become effective upon adoption by the Board
of County Commissioners and filing with the Department of State.
This ordinance was advertised in the Indian River Press Journal on the 4th day of September
2026, for a public hearing to be held on the 15th day of September, 2026, at which time it was
moved for adoption by Commissioner �,e, F. , seconded by Commissioner
