The Board of County Commissioners of Indian River County, Florida, met in Regular
Session at the County Commission Chambers, 1840 25' Street, Vero Beach, Florida, on
Tuesday, February 3, 1998. Present were John W. Tippin, Chairman: Kenneth R. Macht,
Vice Chairman; Fran B. Adams; Carolyn K. Eggert and Caroline D. Ginn. Also present were
James E. Chandler, County Administrator; Charles P. Vitunac, County Attorney; and Patricia
Ridgely, Deputy Clerk.
1. CALL TO ORDER
The Chairman called the meeting to order at 9:00 a.m.
2. INVOCATION
Rev. Bill Kelly of Westminster Presbyterian delivered the invocation.
3. PLEDGE OF ALLEGIANCE
Commissioner Eggert led the Pledge to the Flag.
4. ADDITIONS TO THE AGENDA
Chairman Tippin requested the addition of two items:
5. Proclamation to Vero Beach Concert Association and
13.A. Resolution Directing County Depositories to Honor
Certain Authorized Signatures on County Warrants and Other
Orders for Payment.
Commissioner Adams requested the addition of Item 13.C. Treasure Coast Regional
Planning Council - Add City of Sebastian as a Full Time Voting Member.
Vice Chairman Macht requested the addition of Item 13.B. Comment on Upcoming
NACo meeting in Washington, D.C.
Commissioner Eggert requested the addition of Item 13.D. Recommendation of the
Emergency Services District Advisory Committee Concerning North A1A Station.

5.A. PROCLAMATION - VERO BEACH CONCERT ASSOCIATION
Chairman Tippin read the following and presented it to Cora Witten.
PROCLAMATION
DESIGNATING FEBRUARY 17,1998
AS VERO BEACH CONCERT
ASSOCIATION DAY IN
INDIAN RIVER COUNTY
WHEREAS, this year the Vero Beach Concert Association celebrates its 30th consecutive
year bringing quality music and dance to its many patrons along the Treasure Coast and
WHEREAS, the Vero Beach Concert Association is the oldest continuing presenting arts
organization in Indian River County; and
WHEREAS, the Vero Beach Concert Association has presented over 125 live
performances by symphony orchestras, chamber ensembles, soloists, classical ballet and
contemporary dance troupes before enthusiastic local audiences; and
WHEREAS, each year, the members of the Vero Beach Concert Association have
generously provided at least one free concert for area students to hear and see live performances by
distinguished artists:
NOW, THEREFORE, BE IT PROCLAIIM BY THE BOARD OF COUNTY
CONWSSIONERS OF INDIAN RIVER COUNTY, FLORIDA that February 17, 1998 be
designated as
VERO BEACH CONCERT ASSOCIATION DAY
in Indian River County.
Presented this 3rd day of February, 1998 to Cora Witten, President of the Vero Beach
Concert Association, in gratitude to all the volunteer board members and contributors, past and
present, who have given so generously of their time and money to bring quality music and dance to
Indian River County for the enjoyment of many area residents.

5.B. INTRODUCTION OF NEW UTILITIES DEPARTMENT
DIRECTOR DON HUBBS
Administrator Chandler introduced the new Utilities Department Director Don Hubbs
to the members of the Board of County Commissioners saying that he was delighted to have
Mr. Hubbs join the Indian River County administration.
Commissioners welcomed Mr. Hubbs and allowed that Public Works Director James
Davis and General Services Director H.T. "Sonny" Dean were no doubt happy to welcome
him also.

DESCRIPTION AND CONDITIONS
It is required, as part of the Transportation Disadvantaged (TD) Planning Grant contract between the
Indian River County Board of County Commissioners (BCC) as the Designated Official Planning
Agency (DOPA) and the State of Florida Commission for the Transportation Disadvantaged (CTD),
that periodic progress reports and reimbursement invoices be submitted. To comply with the CTD's
requirements, staff has prepared a progress report and invoice for the period from October 1, 1997
to December 31, 1997.
For the 1997 planning grant period, the invoice and progress report represent the fourth and final
submittal. This progress report and applicable finished products, such as the Local Coordinating
Board (LCB) meeting agenda items, CTC reports, etc., are required to accompany all reimbursement
invoices.
On January 22, 1998, the Transportation Disadvantaged Local Coordinating Board (TDLCB)
reviewed and approved the attached progress report and invoice. At that time, the TDLCB
recommended that the Board of County Commissioners, in its capacity as the Transportation
Disadvantaged Program Designated Official Planning Agency (DOPA), approve the attached
progress report and invoice and forward these to the CTD.
ALTERNATIVES AND ANALYSIS
Attached is a copy of the progress report and invoice for the October 1, 1997 to December 31, 1997
period.
Finished products such as TDLCB meeting agenda items, CTC reports, and other pertinent reports
are required to accompany all reimbursement invoices. These materials will be submitted to the state
along with the reimbursement invoice and the progress report.
The BCC/DOPA's alternatives are either to approve the transmittal of the Progress Report and
reimbursement invoice as submitted, to approve transmittal of the Progress Report and invoice with
revisions, or to deny the transmittal of the Progress Report and reimbursement invoice to the state.
Choosing the last alternative could affect the county's reimbursement of staff time expended for
transportation disadvantaged planning related services.
The TDLCB and the staff recommend that the Board of County Commissioners/DOPA approve
Progress Report and reimbursement invoice #4, and direct staff to transmit the report and the invoice
to the State of Florida Commission for the Transportation Disadvantaged (CTD).

SUBJECT: Idlewyld Corporation Inc.'s Request for Final Plat Approval for the Sanctuary
Planned Development (PD)
It is requested that the data herein presented be given formal consideration by the Board of County
Commissioners at its regular meeting of February 3, 1998.
DESCRIPTION AND CONDITIONS:
The Sanctuary PD is the subdivision of a 37.05 acre parcel into 109 residential lots and 5 tracts. The
tracts will be used for recreation, stormwater management, landscaping, and future right-of-way.
The subject property is located on the north side of 33rd Street, '/Z mile west of 58th Avenue.
At its regular meeting of November 21, 1996, the Planning and Zoning Commission granted
preliminary plat approval for the subdivision. That plat was in conformance with the conceptual PD
plan approved by the Board of County Commissioners at its December 17, 1996 meeting.
Subsequently, a land development permit was issued, and construction commenced. The developer
has now constructed most of the required improvements and is requesting final plat approval by
bonding -out for construction of the remaining required subdivision improvements. The owner,
Idlewyld Corporation Inc., through its agent Knight, McGuire & Associates, Inc., is now requesting
final plat approval and has submitted the following:
1. A final PD plat in conformance with the approved preliminary PD plat.
2. A cost estimate for the remaining required subdivision improvements.
3. A contract for construction for the remaining required subdivision improvements.
4. A letter of credit to guarantee construction of the required improvements.
5. A warranty and maintenance agreement for publicly dedicated improvements.

6. A cost estimate for the completed publicly dedicated improvements.
7. A letter of credit to secure the warranty maintenance agreement.
ANALYSIS:
At this time, most of the required subdivision improvements have been completed. A contract for
construction for all of the remaining required subdivision improvements, along with a letter of credit
to secure the contract, has been submitted by the applicant. In addition, a warranty maintenance
agreement with a letter of credit have been submitted to warranty publicly dedicated improvements
which have been constructed. Both the county engineering division and the utility services
department have approved the cost estimates and have verified that the letter of credit amounts are
adequate to cover the estimated cost of the remaining required improvements and improvement
warranty. The county attorney's office has approved the construction contract and the warranty
maintenance agreement for legal form and sufficiency and has approved the format of the letters of
credit.
Pursuant to the county's LDRs, the applicant will be required to obtain a certificate of completion
after construction of the required improvements. At that time, the applicant will warranty the utility
improvements via a Utility Services Department Bill of Sale. No other warranties are required. All
applicable requirements regarding final plat approval have been satisfied.
RECOMMENDATION:
Based on the above analysis, staff recommends that the Board of County Commissioners grant final
plat approval for the Sanctuary Planned Development and authorize the chairman to sign the contract
for construction and accept the letters of credit and the warranty maintenance agreement.

.Between Indian River County and Logistic Systems, Inc.
On July 15, 1997, the Board of County Commissioners approved and awarded a contract in the
amount of $358,950 with Logistic Systems, Inc., to provide a computer aided dispatch (CAD)
system for the 9-1-1 Communications Center.
Recent discussions with the vendor have resulted in the County receiving upgrades to the CAD
hardware due to reduced market prices. The items identified with an asterisk * have been
upgraded to the new hardware.
There is no change in the price of the equipment and the upgrades do not affect the total project
cost originally approved by the Board as a result of this change order.
RECOMMENDATION:
Staff recommends approval of Change Order No. 1 with Logistic Systems, Inc.

BACKGROUND
The owner is constructing a new residence, and he has requested temporary service be
installed from the water line on 20th Avenue to service the property at 916 21st
Avenue, Vero Beach, Florida prior to the installation of a water main on 21st Avenue in
the Block Villa Subdivision.
ANALYSIS
The Agreement states that the Indian River County Department of Utility Services shall
provide temporary water service to Mr. Thomas Reno until such time that a water line
may be constructed on 20th Avenue in the Block Villa Subdivision by assessment. He
agrees to pay all fees required to make this connection. He further agrees to
participate in the assessment and to reconnect to this water line as required by the
Indian River County Department of Utility Services.
RECOMMENDATION
The Department of Utility Services recommends that the Board of County
Commissioners approve the attached Agreement with Thomas M. Reno on the Consent
Agenda.
ON MOTION by Commissioner Macht, SECONDED BY
Commissioner Eggert, the Board unanimously approved the
Agreement with Thomas M. Reno for Temporary Water Service
at 916 2 V Avenue, as recommended in the Memorandum.

As a condition of site plan approval, the landscape improvements along Home
Depot's 58th Avenue frontage are to be installed by Home Depot after
completion of Phase I of the County's 58th Avenue paving project. A Contract
for Construction of Required Improvements has been executed by Home Depot,
and a $34,500.00 Performance Bond is in place to guarantee the installation of
the landscape improvements.
RECOMMENDATION:
Approve the attached Contract for Construction of Required Improvements and
Performance Bond and authorize the Chairman of the Board of County
Commissioners to execute the Contract for Construction of Required
Improvements on behalf of the County.

extension. Therefore Change Order No. 3 to the Wabasso Area CDBG
Improvements contract (original contract is $715.546.30) is proposed to increase
the project cost by $18.068.44 bringing the total to $677.664.74.
RECOMMENDATIONS AND FUNDING
Staff recommends approval of Change Order No. 3. Funding to be from CDBG
Grant Fund 129-149-513-033.19.

County Commissioners at its regular meeting of February 3, 1998.
DESCRIPTION & CONDITIONS
At a public hearing on October 14, 1997, the Board of County Commissioners approved County
purchase of the ±37.6 acre Flinn Tract on south Indian River Boulevard, contingent upon the County
securing cost -share funding from the St. Johns River Water Management District (SJRWMD) and
the Florida Inland Navigation District (FIND) (see attached minutes).
Since that time, both the SJRWMD Governing Board and the FIND Commission have formally
approved their cost -share participation. Attached is a Participation Agreement for each agency to
execute as part of the Flinn Tract closing. The Agreement reflects the level of cost -share participation

presented for the Board approval consideration.
RECOMMENDATION
Staff recommends that the Board of County Commissioners approve the attached Participation
Agreement and authorize the Board Chairman to execute said Agreement.

capability and willingness to undertake this project; and
WHEREAS, it would be in the public interest to have the State of Florida
through its Department of Transportation do this project,

COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that:
1. The Chairman is authorized to execute on behalf of the Board of

The attached budget amendment is to appropriate funding for the following:
1. During the 1997/98 budget hearing, the Budget Director underestimated the new positions cost
of the Main Library by $7,121.00. The attached entry appropriates funding.
2. On November 10, 1997, the Board of County Commissioners approved opening the Main Library
on Sundays. The partial year costs for opening on Sunday are $88,192 and on an annual basis
it is $118,640. The attached entry appropriates funding on an annual basis.

3. The Main Library has received $8,598 in donations and the North County Library $2,665 in
donations. The attached entry appropriates funding.
4. The Indian River County Library received State Aid in the amount of $231,700 for fiscal year
1997/98. Budget staff had estimated $180,000. This entry appropriates the $51,700 additional
state aid.
5. At the December 9, 1997 Board of County Commissioners meeting the Board approved
amending the Sheriffs budget by $115,920 for the November 1997 Broward prisoner revenue.
6. At the January 20, 1998 Board of County Commissioners meeting the Board approved amending
the Sheriffs budget by $130,335 for the December 1997 Broward prisoner revenue.
7. At the Budget Workshop the Board of County Commissioners approved increasing the Clerk of
Circuit Courts budget by $43,816 for the 1997/98 fiscal year when the Clerk returned excess fees
for the 1996/97 FY. The attached entry appropriates the funds.
8. The Utility Department has Road and Bridge Department do pavement patching on their behalf.
They reimburse Road and Bridge for the cost of these repairs.
9. Indian River County received a $159,000 grant from the Florida Department of Agriculture to
construct an Agriculture Arena building at the fairgrounds.
Staff recommends that the Board of County Commissioners approve the attached budget amendment.

Sidney W. Turner, 8775 20' Street advised that he was back with more information
he had found since his last presentation. Vero Beach City Manager Rex Taylor contacted
him after his last appearance advising that he could inspect the City's Water & Sewer
Department files in order to obtain answers to his specific questions. Mr. Turner's main
objective was to determine if there was a health hazard when TCE was initially discovered
in 1978, and whether contaminated water supplied at that time could be affecting the health
of local citizens to this day. He described his findings as "shocking".
Mr. Turner stated that in June 1978 a local newspaper reported the City had finally
traced TCE while monitoring the flow from Well #15, one of the City's best producers
located along 27'h Avenue near Piper. The City immediately closed down Well # 15. At that
time, the City Manager assured the public that TCE had never reached the city's homes and
businesses. In October 1978, Dr. T.C. Wang, a chemical engineer at Harbor Branch
Foundation, Inc., a Ft. Pierce scientific research foundation, wrote to the Superintendent of
the Water Treatment Plant of Vero Beach and informed him that he had recently tested the
drinking water of two homes in Vero Beach, his own on the barrier island and a co-worker's
on the mainland. An analysis of the water from both homes revealed a high content of TCE

in the drinking water. Because the City had only one water treatment plant, it could be
assumed that water supplied to other parts of the city and parts of the county may have been
similarly contaminated during that period for an unknown length of time. A small, but
critical area of the county was affected: Mueller Center of Indian River Community College
and also the Tropicolony Subdivision. A local newspaper in June 1979 reported that City
officials were admitting that some water contaminated with TCE did reach some residences
and businesses. They acknowledged they did not know how long the substance leaked from
the tank before its closure. A letter from Department of Environmental Regulation (DER)
to the City's Water & Sewer (W & S) Department determined that the maximum contaminant
level allowable for TCE in the local supply exceeded criteria stated in the Federal Register.
In June 1979 the Manager of the W&S Department wrote Dr. Wang expressing his
appreciation for the identification of TCE in the City's water supply and further stated that
Dr. Wang's communication led to the discovery at Piper of an underground tank leaking
TCE. He quoted portions of a letter of March 1981 from the General Manager of Piper to
the Vero Beach City Manager which stated that it was imperative to take all necessary steps
to stop any further infiltration of TCE into the City of Vero Beach wells.
Mr. Turner noted that three years had elapsed from the first notice; concluding that
a health hazard was present during that period would be quite logical. At a meeting in March
1981, the City Manager discussed the fact that the City had its whole water supply in
jeopardy and were running tremendous risks with the water supply. Mr. Turner was amazed
that in discussing this with City officials (who were there during those years), none were
aware of any health study conducted at the time of the initial spill or to this day. Local
health officials have not concerned themselves with the initial spill.
Mr. Turner felt it vital that the City and County conduct a study going back to 1978
to determine the possibility that citizens living today may have or eventually could become
victims of cancer from the exposure to the TCE contaminated drinking water during that
period.
Mr. Turner stated he did not advocate vast amounts of tax dollars be used for the
investigation. He believed an accounting should be compiled to determine how much Piper
did contribute to the cleanup from 1978 to the present. He believed that Piper should bear
the full costs of any such investigation. From an analysis provided by the Manager of
Environmental and Plant Operations, he was convinced that city water now meets acceptable
standards and is safe to drink. His concern was the past and what appeared to be a coverup

of a health hazard situation.
Commissioner Ginn asked if Mr. Turner knew when the tank was buried in the
ground, and Mr. Turner thought he had records with that information but not with him. He
had copies of all the records he had gotten from W & S Department and offered to provide
them to her.
Commissioner Eggert advised that she thought the Environmental Health Department
had been provided those copies also.
Frank L. Zorc, 2004 DeLeon Avenue, read from the following prepared information:
Thank you for this second opportunity to discuss -(above topic). Mr. Turner has just
presented a chronological list of information we learned of since we were here 3 weeks
ago. I have a few points of emphasis, and seek your deliberation.
On Jan. 13th. - other speakers were invited to our "Matters by the Public" presentation.
Although that was unusual, I have no problem since the topic is not only highly unusual
but perhaps a bit toxic like the TCE Chemical itself. The invited speakers were from
several agencies. The public was clearly not noticed or invited because of a failure to

One concern I have about the other speakers on Jan. 13th. is that their obvious motive
whether solicited by any county official or not, was nearly exclusively to diminish any
concerns for the "present day safeness" of City water used in Vero Beach and Indian
River County. That was not, nor is now the primary concern of Mr. Turner and myself.
The stress on todays safeness was a good idea, just as a Press journal Editorial had
suggested earlier to keep calmness on the issue. I agree that Erroneous information
could cause emotional fears with the general public.
On the other hand a most important factor brought out by Mr. Mike Galanis Director
of Environmental Health was- completely omitted from your official minutes.
Mr. Galanis rightly praised Pipers clean up efforts- (as were required or imposed by the
State of Fla. and the EPA) But the very significant existing economic problem that may
exist for years and cause damage or abnormal expense to property owners was excluded
Mr. Galanis said: Because of the Piper TCE Chemical Spill- Quote: "This whole area
here is now "delineated area" and thats an area- most of the aiMgrt and the first few
residential streets just south of the airport, includingthi_ty administration
building, and the health department building It's called the delineated area (with an
official map of said area of record) and when a well goes into this area it has to have
special construction aspects- example- grout all the waw down and suecial permits by St.
John Water management. Mr. Galanis has control.All special permits go thru his offices
This clearly is a economic hardship and may cloud title to property causing damage to
anyone in this delineated area who must adhere to these costly standards for a well

because of Pipers TCE contamination spill. Should not- any added cost factor, current
or future to anyone be Pipers responsibility? They are the "Primary Responsible Party",
PRP- in E.P.A. language. I request Mr. Galanis's comments be make part of todays
minutes for permanent public reference. ,
BUT MUCH MORE SO OF COURSE On Jan 13th. - Othec Commissioner Macht
and Ginn, the response was sots concern by this commission- which did not begin to
address the concerns Mr. Turner wrote to Vero's City Manager about, and received
NO real answer. These are the same concerns we emphasized to you three weeks ago.
I must repeat: What was the health affects during the time the TCE Chemical spill had
not yet been detected, prior to 1978, then during the 3 years after detection where
records show nothing was accomplished. , and then during a time from when Piper was
attempting some clean up. Although the TCE levels are substantially lower & tests can
show safe water. AGAIN what might the situation been during the est. 15 year period
when we may not have evidence of absolutely safe water. 1975 to 1990.
You must take Into consideration City Attorney Robert Sechen recently proclaimed to a
City Council during secret closed meetings he called and directed::
"There are alot of rights that the City of Vero Beach COULD HAVE FOUGHT PIPER
OVER, every step of the way, BUT YOU ALL (THE CITY) DIDN'T DO THAT, you
wanted to help them and work with them. End Quote:
Since Piper did in fact cooperate with attempts to "clean up", it is logic that perhaps the
City did not look into the PUBLIC HEALTH DANGER, and environmental damages.
Why do they refuse to produce evidence of any such research and the results.
Beyond health concerns, City owned properties had marketability affected in several
ways by the Piper chemical spill. Certainly back then when the Good Old Boy form of
government was prevalent, friendships with Piper with 3000 employees may have
prevented anyone from upsetting the "Golden Apple", and perhaps- eyes were not very
wide open, or perhaps the City deliberately did not pursue things that might harm Piper
as the City Attorney quite boldly has recently stated.
Again— this is a county issue as covered in my 3 page presentation three weeks ago.
There are obvious reasons the City is choosing- AGAIN to keep their head in the sand.
Legal processes relating to these issues with regard to actions they illegally discussed
and voted on pertaining to these VERY Issues— contamination, public health and
environmental harm, at closed secret meetings where the public and media was kept out.
Therefore, they are extremely hostile, defensive, and angry because they are being called
on these actions, and therefore refuse to do anything today against Piper.
You- do not have- the City's dilemma, and this problem and the contamination did
affect this county also.
Just last week Mr. Turner and I had discussion with Dr. Wang, of Harbor Branch
Scientific research foundation. He is credited with finding the trichloroethylene and
clororoform, contamination from Piper. One astounding revelation from.him in a
written public record document is that high level (apparently 68 ppb) was found in two
Vero Beach homes In 1978. One on the barrier Island and one on mainland.
The further fright in this find is quite simple. One water treatment plant furnished all
water users in the City and County. How many other households had TCE in their
drinking water ? 100 ? 1000 ? or even every single water user ?
Water then served the Mueller college and Tropicolony subdivision. There may be no
problem to find today- but that Is the point- it was back then when un detected health
hazards may have been overlooked or intentionally ignored.
Since out discussion three weeks ago we found massive and startling documents.
Example 1. A former City Manager wrote: Quote: "I would ask that the Well # 15
matter remain CONFIDENTIAL (I ask. why confidential), until we have concluded our

investigations and reached a meeting of the minds with DER and Piper on the future of
this well. My reason for commenting is to impress on you the potential magnitude of
such problems and to convince you that they can and have happened here.(underlined) "
End Quote.
So just what has the City done about g_otential public health concerns at that time, or
today. The present City Manager Taylor-- wont answer.
Example 2. In a letter in 1979, W. Bosteick Jr. State of Fla. Dept. Environmental
Regulation wrote: "As stated in the Register, for the MAXIMUM PROTECTION OF
HUMAN HEATH from potential carcino-genic effects of exposure to trichloroethylene
through ingestion of water- and contaminated aquatic organisms, the ambient water
concentration if ZERO" End Ouote: etc. Please read this letter in full.
In 1979 Elliot Grosh Vero's Water Sewer manager thanks Dr. Wang from Harbor
Branch for 'IDENTIFYING TRICHLOROETHYLENE IN THE CITYS WATER SUPPLY
The groundwater contamination then resulted in the LOSS of our LARGEST WATER
SUPPLY WELL. (other wells were threatened also).
There is so much more history I cannot cover today so I plea to you to obtain complete
sets of the documents and include in a complete study.
Example 3. My last reference today will be a letter in 1981 from the Gen. Mgr. of Piper.
"It is imperative that we take all necessary steps to stop any further infiltration of
trichloroethylene in the aquifer- and wells. IT IS DOUBLY URGENT SINCE LITTLE
OR NOTHING HAS BEEN ACCOMPLISHED SINCE THE PRESENCE OF TICE IN
VERO BEACH CITY WATER OCT. 1978 by Dr. Wang. (3 years)
Mr. Turner and I had a conference with Dr. Wang and his superior N. Myron Gunsalus
Jr, Harbor Branch Director. He gave me permission for a statement to this commission.
Harbor Branch would consider new studies to evaluate what TCE effects may have
occurred since Dr. Wang made the discovery in 1978, IF YOU REQUEST IT.
What more can I say. Yes w are reasonable sure City water is safe today, BUT in my
opinion it is nothing less that imperative that you research all the records and take up
Harbor Branch's offer to research past potential health effects. Please do not just give
up rights you may also have against Piper the Primary Responsible Party. Nationwide
there is accountability going on for environmental damages done many years ago.

Commissioner Eggert advised that the Public Health Primary Care Committee had met
recently and agreed that it is necessary to look back at all the Public Health medical records,
both adult and children. The committee had not previously concentrated on adults. This
investigation is on-going.
Commissioner Ginn wanted to hear more about Harbor Branch's offer, and Mr. Zorc
indicated that he was interested in having Harbor Branch do research for the Board, and it
would not cost to talk to them.
Vice Chairman Macht thought it would be valuable to know the affect of that level
of TCE over a period of time. He wanted the information dispatched to the American Brain
Tumor Association to see what they might say about it since, in his opinion, there is a high
incidence of a particular type of cancer in the county.
Commissioner Eggert thought it would be a good idea to invite Dr. Wang of Harbor
Branch to see what their study would encompass.
Commissioner Adams wondered where this would lead and was not sure what the
County's jurisdiction is on City wells. She felt the County should not assume the financial
liability for the costs of whatever they decide to do.
Commissioner Eggert pointed out that they could go under Public Health and felt it
was the County's responsibility to look into it.
Commissioner Adams indicated that was what she was looking for; also that there is
some accountability down the road. She thought the County should not be absolving and not
assuming all the responsibility.
Commissioner Eggert agreed but felt it was important to learn what scope of help the
County should be seeking and from whom.
Vice Chairman Macht added that many county residents are on city water.
Environmental Health Director Michael J. Galanis confirmed that there were a
number of years where there was some contamination in Well #15 in the late 1970's, he
believed. There have been no studies on the effects of it. TCE is aotp ential cancer-causing
contaminant. He explained that the delineated area is an area established around all "super -
fund" sites in the United States, and the delineated areas specify special well construction
as a safety measure. He was not sure there was an indication of a necessity for a long term
study. As he had stated previously, that is one of many other incidents in Indian River
County, but it happens to have affected a large well and a large number of people.

Mr. Galanis thought that Harbor Branch was primarily an environmental laboratory.
He was unsure of their capabilities with regard to medical problems. He offered to assist
Harbor Branch in anything they do in this matter.
Mr. Galanis stated that there is quite a bit of well -monitoring going on presently at
the Piper site as well as city water testing. He believed that additional water monitoring type
projects should not be undertaken or funded. He wondered what Harbor Branch would do.
Mr. Zorc thought that it certainly would not hurt to have the Director of Harbor
Branch's Environmental Laboratory come to consult with them, since Harbor Branch is
world-renowned. He felt some research needed to be done.
Chairman Tippin wished to state his observation. He understood the welfare of the
people was part of the responsibility of the Board of County Commissioners, but he was also
concerned and wondered how broad the scope might be. He recounted how during World
War II, the Navy brought DDT into the area to take care of mosquitos. It was used quite a
bit and was very effective. Then, all of a sudden, it became an "absolute carcinogenic that
was going to kill us all". While it was good this problem with DDT was discovered, he
pointed out that his older brothers were all still alive and he and they are all pretty healthy.
He expressed his confidence in the Health Department, but if the Board wished to meet with
the gentlemen from Harbor Branch, it was okay with him.
Commissioner Adams asked if staff could get together to discuss this to come back
to the Board with a recommendation, but Commissioner Ginn insisted she wanted the Harbor
Branch people to report directly to the Board.
MOTION WAS MADE by Commissioner Eggert, SECONDED
BY Commissioner Ginn, to invite Mr. Myron Gunsalus
(Director of Environmental Laboratory) and Dr. T. C. Wang
from Harbor Branch to consult with appropriate staff concerning
what they may be able to do regarding a study of the 1978 TCE
spill in Indian River County and report directly to the Board of
County Commissioners on what services they might render and
at what cost.
Under discussion, Vice Chairman Macht thought this study should be for seeking
information, not placement of blame. Commissioner Eggert agreed.

DESCRIPTION AND CONDITIONS
Staff has negotiated an Agreement with Dunkelberger Engineering and Testing, Inc. for
construction materials testing services during the construction of 58"' Avenue
Improvements. Dunkelberger Engineering served as the Geotechnical Consultant during
the design phase of the project as a subconsultant to the Engineering Consultant, Kimley-
Horn and Associates, Inc.
The Kings Highway corridor has very poor soil conditions. The roadway design includes
a geosynthetic reinforced roadway base and geosynthetic reinforced soil slopes along the
west side of the Lateral °B" Canal. The design of the roadway and canal banks was based
on recommendations of the Geotechnical Consultant to the Engineering Consultant. Staff
would like to utilize the testing services of Dunkleberger Engineering during the
construction phase to ensure that construction adheres to their design recommendations.
The attached agreement outlines the specific services to be provided. Compensation will
be on a unit price basis for the actual amount of testing provided and technical time
expended up to a total "Not to Exceed" budget of $95,000.

The Treasure Coast Regional Planning Council, during its December meeting, announced its
voting membership for the 1998 year. As you know, the City of Vero Beach along with the
County Commisioners hold the permanent voting position with the Regional Planning Council.#
The other voting membership is shared by the three remaining cities, Town of Indian Raver
Shores, Fellesmere, and Sebastian The City of Sebastian was a part of the Council's 1997
voting membership and has since been removed, being replaced by Indian River Shores. At the
last meeting I talked to Mike Busha ,:Executive Director for the council and asked if there would
be a problem in keeping the City of Sebastian a voting member since the city is the second largest
city in the county. Mr. Busha stated he could see no reason why the Council could not allow
Indian River County to have another full time voting member. He also stated that it would be up
to the County Commisioners to authorize the additional voting member. If Sebastian holds a full
time voting position, then the other two cities would serve as alternates,there by providing
opportunity for more input and views shared by the county with the council. Growth is rapidly
changing our cities andthis would prevent the three cities from feeling as if they have no input
until their scheduled year on Council.
I respectfully request haat the City of Sebastian be made a permanent voting member of the
Treasure Coast Regional Planning Council, and that Mr. Michael Busha be notified of this
request at the next regularly scheduled meeting.

Commissioner Eggert had a problem with this because she understood that the City
of Vero Beach does not have a permanent position on the TCRPC, but both Chairman Tippin
and Commissioner Ginn believed that the City of Vero Beach does have a permanent
position.
ON MOTION by Commissioner Ginn, SECONDED BY
Commissioner Adams, the Board unanimously approved asking
the Treasure Coast Regional Planning Council to add the City
of Sebastian as a permanent voting member.
B.D. NORTH COUNTY FIRE/EMS STATION - EMERGENCY
SERVICES DISTRICT ADVISORY COMMITTEE
RECOMMENDATION
Commissioner Eggert advised that the Emergency Services District Advisory
Committee has met and recommended the Board consider purchase of a particular parcel,
which is "absolutely perfect", as the site of a future Fire/EMS station in the north part of the
County. The parcel has met with the approval of ISO (Insurance Service Office). The
parcel owned by the Liers has been offered as a site for such a station at a price of $115,000.
A station in that location will improve emergency response time to all north county locations
and will also improve the County's insurance rating.
Commissioner Eggert asked the Board to approve inviting the owner to prepare a
contract for the Board's future consideration.
ON MOTION by Commissioner Macht, SECONDED BY
Commissioner Ginn, the Board unanimously approved inviting
the Liers to submit a contract for the Board's consideration for
the purchase of property as a site for a future Fire and EMS
Station.
