Present were John W. Tippin, Chairman; Kenneth R. Macht, Vice Chairman; Fran B. Adams; Carolyn K. Eggert and Caroline D. Ginn. Also present were James E. Chandler, County Administrator; Charles P. Vitunac, CountyAttorney; and Patricia Ridgely, Deputy Clerk. 1. CALL TO ORDER The Chairman called the meeting to order at 9:00 a.m. 2. INVOCATION Chairman Tippin delivered the invocation. 3. PLEDGE OF ALLEGIANCE Commissioner Ginn led the Pledge to the Flag. 4. ADDITIONS TO THE AGENDA Commissioner Eggert requested that item I I.A.2. be heard prior to the 9.A.2. public hearing. On March 31, 1998, after PrimeCo had a study and survey completed on Hobart Tower which determined the tower was insufficient for their needs, the Board approved an amendment to the Tower Space Lease. The amendment provided, among other things, that PrimeCo would build a new 250'tower at the same location of an old 150' tower adjacent to the 405' Hobart Tower which the County would own and PrimeCo would began paying rent in the amount of $10,800 commencing the eleventh year of the Lease. DESCRIPTION AND CONDITIONS: Carter Associates, Inc., on behalf of Robert Cook, has submitted an application for minor site plan and special exception use approval for an agricultural business involving a grove maintenance service and accessory sales and service of spray equipment. The subject 38 acre site is located on the north side of 26'' Street approximately'/4 of a mile west of 70 Avenue. The subject property is zoned A-1, Agricultural (up to 1 unit per 5 acres) and is located outside the Urban Service Area. An agricultural business is a commercial operation that is related to processing or servicing of bona fide agricultural production (i.e. citrus, farming, ranching, etc.). The proposed agricultural business is allowed in the A-1 zoning district by special exception use approval, subject to the specific land use criteria of section 971.08 of the county's land development regulations. At its regular meeting of June 25, 1998, the Planning and Zoning Commission recommended that the Board grant special exception use approval with the conditions stated at the end of this report and approved the associated minor site plan application for the project, subject to the Board granting special exception use approval. The Board is to now act on the special exception use request and approve, approve with conditions, or deny the special exception use request. Pursuant to section 971.05 of the LDRs, the Board is to consider the appropriateness of the requested use for the subject site and surrounding area. The county may attach any conditions and safeguards necessary to mitigate impacts and to ensure compatibility of the use with the surrounding area. ANALYSIS: 1. The LDRs allow such improvements to be unpaved for projects, such as this one, that generate fewer than 100 daily trips and that are outside the Urban Service Area. The traffic engineering division has reviewed and approved the proposed 26' Street driveway and on- site traffic circulation plan. 11. Stormwater Management: The public works department has reviewed and approved the project's stormwater plan. 12. Utilities: The project will have an on-site well and septic tank. These provisions have been approved by the Utility Services and Environmental Health Departments. 13. Dedications & Improvements: Even though the physical roadway along the site's south boundary is designated as 26' Street, the road is actually located within Indian River Farms Water Control District canal right-of-way. In order to comply with county local roadway 60' minimum right-of-way requirements, development of the subject site will require 26" Street right-of-way dedication from the site. Because the Indian River Farms Water Control District canal right-of-way cannot be used to satisfy the 60' minimum right-of-way requirements, and because the presence of the canal is a physical impediment to future roadway expansion to the south, the entire 60' of 26' Street right-of-way must be dedicated from the subject site. Therefore, 60' of 26' Street right-of-way is required from the site without compensation. The ultimate road right-of-way width for 26h Street is 80', 20' beyond the local road requirement. Public works has determined that it will not purchase the last 20' at this time. Even so, the proposed site plan accommodates the 80' ultimate right-of-way. July 14, 1998 WV Prior to release of the approved site plan, the applicant shall dedicate without compensation 60' of 26' Street right-of-way from the site. Since the proposed development is a low traffic generator/attractor and is outside of the Urban Service Area, the applicant is not required to pave 26' Street or provide sidewalks or bikeways. 14. Concurrency: The applicant has obtained a conditional concurrency certificate. This satisfies concurrency requirements for minor site plan special exception uses. Therefore, all concurrency requirements related to the minor site plan and special exception use approval have been satisfied. 15. Environmental Issues: Since the site is over 5 acres, the native upland set-aside requirements of section 929.05 potentially could apply. However, the county's environmental planning staff has determined that no native upland habitat exists on the site. Therefore, no native upland habitat preservation requirements apply. 16. Buffers and Setbacks: Because the surrounding area is presently used for agricultural purposes, no special buffering is required under the planned development LDRs. However, staff has recommended and the plan proposes a 65' building setback from the nearest adjacent property (to the west) and a setback of about 98' from the existing 26' Street roadway. Along the development area's 26' Street boundary, a Type "C" buffer with 3' opaque feature is being provided for buffering. 17. Specific Land Use Criteria: The applicant must satisfy all applicable criteria for an agricultural business. The agricultural business criteria are as follows: Additional information requirements: 1. A site plan meeting all of the requirements of Chapter 914; 2. A statement describing the nature of the business and the rationale for its location within an agricultural district. Note: The applicant has provided a statement detailing the scope and nature of the proposed grove service and equipment to be sold and serviced on the site (see attachment #4). Criteria for agricultural business: 1. Agricultural businesses may be allowed to locate within the A-1, A-2, or A-3 districts only upon finding by the reviewing body that such businesses are directly related to or provide services for active agricultural operations and that such uses would not be more appropriately located in a commercial or industrial zoning district; 2. Agricultural businesses shall include but not be limited to: Agricultural business offices; and sales of agricultural equipment, products and supplies, such as grove maintenance services, or livestock facilities; 3. Agricultural businesses shall not be interpreted to permit wholesaling or processing operations; 4. The business must be located in an area designated either as AG or R on the comprehensive land use map. The Archie Carr NWR, overall, is currently ranked 1st on the LAAC site acquisition list. Individually, the Spallone Tract is ranked 4th on the LAAC acquisition list. However, the 2nd and 3`d ranked projects, Carson Platt Estate and the Irwin Tract, have either been purchased or are approved for purchase. Therefore, the Spallone Tract is the top ranked project not yet approved for purchase. The property is located on the barrier island oceanfront, north of and contiguous to the County's Golden Sands Beach Park property. Procedures adopted by the Board of County Commissioners for environmental land acquisition include confidentiality of appraisals. In accordance with the County's Land Acquisition Guide, and Section 125.355 of the Florida Statutes, appraisals can be released for public information once an option agreement is executed between a seller and the County. Regarding the Spallone property, an option agreement was executed (binding the seller to a negotiated purchase price), and subsequently the appraisals were released from confidentiality. When a county exercises its confidentiality right in purchasing real property, Section 125.355, F.S. requires that the county approve the purchase at a public meeting not less than 30 days after appraisals are released and public notice of the meeting is given. Since the Chairman of the Board of County Commissioners, pursuant to authority delegated by the Board, executed a purchase option for the Spallone property, and since appraisals of the property were made public at that time, the Board must now consider whether to exercise its purchase option (contingent on the State exercising its option). Consistent with Chapter 125, F.S. requirements, this decision will be made at the July 14, 1998 public meeting of the Board of County Commissioners (unless the Board agrees to continue the hearing at that time to another meeting). By having given 30 days public notice of this proposed action, the County will have complied with Chapter 125 requirements as well as LAAC Guide requirements to hold a public hearing before purchasing property with land acquisition bond funds. Site Characteristics The subject 1.43 acre Spallone Tract contains maritime hammock/ coastal strand native plant communities. The property is currently zoned RM -3, Multi -family Residential, up to 3 units per acre. Its Future Land Use Designation is L-1, Low Density Residential, up to 3 units per acre. The property has approximately 110 linear feet of ocean frontage, and would add to the 1,028 linear feet of ocean frontage (Golden Sands Park) acquired by the County in the 1980s under a "Save Our Coast" recreational lands State funding initiative. In addition to protecting rare plant communities, the project would contribute to endangered sea turtle habitat protection in an area with one of the highest sea turtle nesting densities in this hemisphere. The property is located in an area with a high probability of having archaeological sites (shell middens). Therefore, archaeological sites may exist on the property. *Ownership Characteristics Currently, Dr. & Mrs. Spallone and Mr. & Mrs. Kovnot are co-owners of the property. Public records indicate that the current tax assessed value for the tract is $267,410. •Acquisition Cost -Share & Property Management Two issues which are important to staff with respect to all proposed purchases are obtaining cost share assistance in property acquisition and addressing management costs. July 14, 1998 36 • • Cost -Share Approximately three years ago, the County executed a Multi -Party Acquisition Agreement with the Department of State Lands (DSL) for 50% cost -share of properties in the Archie Carr State CARL project, including the Spallone property. In contrast to the Florida Communities Trust (FCT) program, the CARL program is structured such that the State receives full title to the property. However, in light of recent title interest issues raised by the County concerning the Carson Platt Estate purchase, the State Land Acquisition and Management Advisory Council (LAMAC) is considering a change in its policies to allow the County to hold an undivided title interest on properties acquired with county cost -share funds. • Management If acquired, the Spallone Tract will be incorporated with the Golden Sands Park property and managed by the County. It is anticipated that purchase of the Spallone Tract will not significantly increase management costs that the County already incurs in managing Golden Sands Beach Park. That is because public access improvements on the Spallone Tract are not necessary, since the property is contiguous to Golden Sands which has public access. The Spallone property does partially contain an unofficial beach/vehicle access that was created over past years by trespassers. If the property is purchased, county management tasks will include blocking the illegal access and policing regularly for litter clean-up. Moreover, there is an opportunity for the County to restore areas disturbed by illegal access by planting native hammock and coastal strand species in those areas. Funding grants and volunteers could be sought over time for the restoration, at minimal cost to the County. *Appraisals In accordance with County Land Acquisition Guide and State procedures, two independent appraisals were obtained to determine an approved appraised value. The two appraisal firms selected were Real Property Analysts, Inc., and S.E. Baker Group, Inc. The appraised values .are summarized as follows. July 14, 1998 37 • b0"K _10b" FnE 206 boor 100-fAGc 2; ANALYSIS •Multiple Benefits • Comprehensive Plan Acquisition Commitment Conservation Policy 6.3 of the County 2020 Comprehensive Plan commits the County to acquire a minimum of 100 acres of coastal tropical hammock on northern Orchid Island, and Conservation Objective 6 calls for acquisition of at least an overall total of 1,000 acres of native upland plant community. Although the County has already acquired more than 100 acres of coastal hammock on northern Orchid Island (the Cairns Tract, Irwin Tract, and Korangy Tract), the Spallone Tract will contribute 1.43 acres toward the overall total native uplands acquisition commitment, and will further general County policies supporting the Archie Carr refuge project. The project also furthers objectives in the County comprehensive plan relating to open space, historic resources, and endangered species habitat protection. RECONMENDATION: Staff recommends that the Board of County Commissioners approve the Spallone property purchase contract by agreeing to exercise its purchase option, contingent on the State's approval to exercise the option under a 50% cost -share. Staff also recommends that the Board authorize staff to proceed with property closing tasks in coordination with the State, and authorize the Board Chairman to execute any documents associated with the closing. They did not, however, want the title to impede the purchase. He further advised that during negotiations for this purchase, the sellers wanted a closing before the end of August, so it appears the County will have to advance the full purchase price and seek reimbursement for the State's share. The Chairman opened the public hearing and asked if anyone wished to be heard in this matter. Frank Coffey, 88 Cache Cay, questioned whether this property actually fell under the guidelines for purchasing with the County's bond funds as environmentally significant lands. He felt the cost was very high and, because it was classified residential, it ought not be taken off the tax roll and the County should spend the funds more wisely. Toni Robinson, 1100 Indian Mound Trail, believed the County needed to take advantage of the State's funding, which will come to an end in the year 2000. She also favored preserving oceanfront properties and pointed out the importance of this parcel being added to the Archie Carr Preserve. It was determined that no one else wished to be heard and the Chairman closed the public hearing. MOTION WAS MADE by Commissioner Macht, SECONDED BY Commissioner Adams, to approve the Spallone property purchase contract by agreeing to exercise its purchase option, contingent on the State's approval to exercise the option under a 50% cost -share and authorized staff to proceed with property closing tasks in coordination with the State and authorized the Chairman to execute any documents associated with the closing. Under discussion, Vice Chairman Macht thought there was great value in acquiring this land. To respond to Mr. Coffey's concern, he believed the guidelines also included the word "recreation". He felt it very important to preserve beach access for our grandchildren. July 14, 1998 40 Chairman Tippin asked about the population of the beach mice, and Mr. DeBlois believed that the numbers were diminishing. DESCRIPTION AND CONDITIONS Background Pursuant to the requirements of Section 420.907, F.S., the State Housing Initiatives Partnership Program (SHIP), and Rule 9I-37.005, Florida Administrative Code (FAC), the Board of County Commissioners approved the Indian River County Local Housing Assistance Plan (Ordinance #93-13) on April 6, 1993. In June, 1993, the Florida Housing Finance Corporation approved the county's plan and authorized the disbursement of SHIP funds. July 14, 1998 42 • According to a 1993 amendment to Rule 9I-37.005(2), Florida Administrative Code, the county must periodically submit a new Local Housing Assistance Plan to the Florida Housing Finance Corporation. Accordingly, the county's plan was revised in 1994 and 1997. On March 11, 1997, the Board of County Commissioners adopted resolution #97-16, which approved the county's revised 3 year plan for FY 97-98, FY 98-99, and FY 99-2000. The Florida Housing Finance Corporation then approved the county's revised plan on April 21, 1997, and authorized the disbursement of SHIP funds until June, 2000. The plan, however, can be amended as needed. One purpose of the county's local housing assistance program is to rehabilitate existing units owned by very low and low income persons to bring those units up to code and make them safe for occupancy. The proposed changes to the plan discussed in the next section of this report will strengthen the rehabilitation portion of the program. Revisions In the revised plan, additions to the plan are shown as underlined, and deletions are shown as strike- dffu. The revisions are as follows: o Change the maximum assistance amount for rehabilitation loans to $20,000 per unit instead of existing $10,000 per unit. For multiple -family units (3 or more), increase the maximum rehabilitation assistance amount to up to $60,000 instead of existing $45,000. o Remove the existing $15,000 cap for combination loans such as downpaymentJclosing cost and rehabilitation loan assistance. The rehabilitation loan amount maximum shall not exceed the combined maximums allowed by appropriate strategies for appropriate income category. o Change the interest rate charged for the low income group from 3% to 0%, similar to very low income group. o Some other minor changes to the existing plan. Changes are included on pages 13, 20, 25, 27, 28, 29, 30, 31, 35, 38, and 52 of the local housing assistance plan. A copy of the revised Indian River County Local Housing Assistance Plan is available for review at the Board of County Commissioners office. ANALYSIS The revised plan meets all state and local requirements. As revised, the Local Housing Assistance Plan still provides the basic framework and operating procedures for the SHIP program. As such, the Local Housing Assistance Plan includes SHIP program strategy qualification requirements and other provisions. The revised plan also increases the maximum rehabilitation loan amount, making it feasible to rehabilitate houses needing extensive repairs. On June 11, 1998, the county's affordable housing partnership group reviewed and approved the above referenced recommended changes to the local housing assistance plan. By revising the plan, the Board of County Commissioners can enhance maintenance of the existing affordable housing stock, reduce deterioration of existing units, upgrade existing substandard units to code, and make deteriorated housing safe for habitation. At that time, staff referenced a "LAAC Projects Costs/Revenues Report" (see attached) that was presented to the County Commission on May 12, 1998. The Costs/Revenues Report divides LAAC acquisition projects into 3 categories: "LAAO Project Commitments;" "Anticipated Activity;" and "Other Projects." It is estimated in the Costs/Revenues Report that, after accounting for costs of "LAAC Project Commitments" and "Anticipated Activity," approximately $1,567,409 remains (out of the $15 million first bond issuance) to expend on "Other Projects." At the LAAC meeting, the Committee voted 9 to 5 to recommend that the Board of County Commissioners instruct staff to proceed to negotiate properties listed under "Anticipated Activity" and thereafter projects listed under "Other Projects," but not to commitment funds exceeding $1,567,409 for "Other Projects." (the estimated balance of the first $15 million bond issuance). For reference, attached is an excerpt of the draft LAAC meeting minutes relating to the discussion and vote. As such, this matter is presented for the Board to consider LAAC's recommendation regarding expenditure of environmental land bond funds. LAAC member Talmage Rogers, who made the motion to limit bond funds expenditure, clarified that his recommendation was to allow for negotiations of various projects to continue, including possibly those listed as "other projects," so long as the overall commitment of county funds at this time does not exceed funds available under the first bond issuance. LAAC Discussion Issues A number of issues were discussed by LAAC relating to expenditure of bond funds. Those issues included: status of the Lost Tree Islands purchase; fulfillment of County Comprehensive Plan land acquisition minimum acreage commitments; and whether or not the County should continue to purchase lands beyond the minimum acreage commitments. Lost Tree Islands It was explained to LAAC that there are currently no negotiations occurring to purchase the Lost Tree Islands. However, settlements of law suits affecting the islands are being considered, which could affect property value and result in re -appraisals. Moreover, it was reported to the Committee that a channel between the "inner" islands and the barrier island may result in State prohibited bridging and utilities access to those islands, even though Lost Tree Village Corporation (LTVC) claims ownership of the submerged bottom - lands. That issue, because of its complexity, could take years to resolve. One train of thought in the LAAC discussion was for the County to hold off on issuing the second bond series (§+10.5 million, after bond issuance costs) in the event that negotiations to purchase the Lost Tree Islands resume, whereby funds would then be available for purchase of the islands. The opposing view on reserving funds for the islands was that the County and LTVC may never come to terms, and in the meantime opportunities to purchase other environmental lands under the program would be lost. Comprehensive Plan Commitments It was discussed at the LAAC meeting that, once the Carson Platt Estate property is purchased, the minimum requirements of the 2020 County Comprehensive Plan concerning acquisition of conservation lands will be fulfilled, and therefore there is no need to issue the second bond series and unnecessarily expend more taxpayers' dollars. The other viewpoint expressed at the LAAC meeting was that the County should go beyond the minimum purchase commitments, spend the full $26 million as approved by county voters, and continue to buy conservation land to preserve "quality of life" and dwindling natural resources for present and future generations. The motion approved by LAAC relates to the County holding off on committing second series bond funds at this time. If an opportunity arises to purchase the Lost Tree Islands or other properties that would entail expending funds beyond the first bond series, then LAAC and the Board could reconsider the matter at that time. She thought people believed the matter could be readdressed in January. Vice Chairman Macht did not recall any discussion at that meeting about reserving funds for purchasing Lost Tree Islands. He had never heard that as a specific reason for holding off on issuing the balance of the bonds. His impression was they perhaps wanted to shut down the acquisition program and save the $10 million, but he did not know what was in the mind of the maker of the motion. Commissioner Eggert thought the discussion was wider than that and that all the other options had been discussed during the LAAC meeting. Commissioner Ginn pointed out that the vote was 9-5, far from unanimous. She still felt that the Board really ought not get into purchasing more properties until they know what will happen with Lost Tree Islands. She thought the negotiations should be brought back in-house. She asked for a status report from Assistant County Attorney Terrence P. O'Brien. Assistant County Attorney Terrence P. O'Brien reported that he had not heard from the FCT. Mr. DeBlois advised that FCT had contacted him about getting the signatures completed on the grant extension. The documents are presently with the Town of Indian River Shores. As soon as fully executed locally, it will be sent back to Tallahassee. Based on that, he assumed FCT staff is moving ahead with an extension to December. He had not heard from the FCT concerning negotiations. Attorney O'Brien added that the County has requested reinstatement of the funds. Commissioner Ginn felt that the Round Island South purchase should be moved forward, that the others could wait until we have some kind of resolution of the Lost Tree Islands issue. She felt that issue was not dead, that everyone wanted to see the Islands protected. Vice Chairman Macht agreed that everyone wants to see the islands protected, but there was an interesting dichotomy occurring. He spoke of guidelines for one issue being demanded, yet in the Lost Tree Island issue there had been a deviation from the land acquisition guidelines. July 14, 1998 W Chairman Tippin felt this subject need not be rehashed at this time and restated staff's recommendation. Both Vice Chairman Macht and Commissioner Ginn wanted to know what was in the mind of the LAAC member making the motion. Mr. DeBlois pointed out that the LAAC minutes were in the backup and that Mr. Rogers (the member who made the motion) was present. Talmadge Rogers, 5445 Rosewood Road, a charter member of the LAAC and the maker of the motion, felt there was nothing devious in the motion. $1.5 million of the bond funds were not committed, depending on the purchases of the 4-5 parcels not yet finalized. The sense of the motion was intended to give the committee direction and thus to instruct the advisor to the committee as to a procedural order. There was also recognition that there is a split in the community about Lost Tree Islands. Rather than getting into a box down the road, it seemed prudent to put a stop to appropriating additional funds but continue with the purchases to which they had already firmly committed. It would also allow time for the negotiations between the various municipalities and parties on Lost Tree Islands. Toni Robinson, 1111 Indian Mound Trail, a member of LAAC who voted against the motion, thought it necessary to recognize that since 1992 there has been a group actively at work advocating not spending the $26 million which was approved by the voters who trusted that the County would buy the 10 properties on the list which was given to the Press Journal. She pointed out that Lost Tree Islands were #6 on that list. She thought the County should not restrict itself by tying up the funds and felt they needed to move forward because prices on properties are just going up as time is passing. She felt it necessary to move more quickly to purchase the Lost Tree Islands and the property south of the 17'h Street bridge and cited her reasons. MOTION WAS MADE by Commissioner Eggert, SECONDED BY Commissioner Adams, to approve staff's recommendation (direct staff to proceed with negotiations to acquire LAAC sites, with the condition that no bond funds be committed beyond what is available under the first bond series issue) as stated in the Memorandum. To begin the process of developing a successful local mitigation strategy, a Working Group was formed which includes staff from the County, local municipalities, members of locally -based private non-profit organizations, and citizens. The Working Group is at the heart of the entire local mitigation strategy and will be actively involved in its periodic evaluation and enhancement during development. Mr. Mike Busha, Executive Director of the Treasure Coast Regional Planning Council (TCRPC), was invited to make a presentation to the Working Group which was held on June 9, 1998. Mr. Busha gave a presentation regarding providing contractual services to develop a single unified Local Mitigation Strategy adhering to the terms of the deliverables schedule as noted in the contract between IRC and the DCA for a total cost of $83,087. Upon hearing Mr. Busha's presentation, the Working Group agreed by unanimous vote to hire the TCRPC to develop Indian River County's Local Mitigation Strategy. The total awarded by DCA is $105,000 and it was further agreed by the Working Group that use of the balance of funds ($21,913) would be decided by the Group collectively. July 14, 1998 52 0 0 • The Purchasing Manager informed staff, and subsequently the Working Group, that utilizing TCRPC for this work precludes using the Competitive Consultant Negotiations Act (CCNA) rules, which would present a problem with the time frame involved for completion of the project as required by the County with the Department of Community Affairs. RECOAEWENDATION: The advantage of using TCRPC is predicated on the experience they have in preparing other mitigation strategies as well as their knowledge base of Indian River County due to previous projects. Additionally, TCRPC currently has inter -local agreements with Palm Beach and Martin Counties and is negotiating with St. Lucie County at this time to complete their Local Mitigation Strategies as well. Staff recommends Board approval of the Inter -Local Agreement between the Board of County Commissioners, Indian River County, Florida, and Treasure Coast Regional Planning Council. Staff also recommends the approval of the five Municipal Sub -Contracts as Local Mitigation Strategy Plan Development Participants. The funding source for the Inter -Local Agreement with TCRPC in the amount of $83,087 is provided by DCA through the Contract approved prior by the Board on May 11, 1998 as referenced above. O'Brien reviewed a Memorandum of June 25, 1998: TO: Board of County Commissioners FROM: Terrence P. O'Brien, Assistant County Attorney"`!p© DATE: June 25, 1998 SUBJECT: Blake & Torres v. Indian River County The County is a defendant in an inverse condemnation lawsuit brought by the owners of property located on the northwest comer of Oslo Road and Old Dixie Highway. During the course of construction of improvements to the intersection at Oslo and Old Dixie, a storm sewer manhole and a force main were installed several feet into the Blake and Torres property. This established the basis for an inverse condemnation law suit which also includes a plea for damages for the loss of access to Oslo Road. The County made an offer of judgment for $20,000 to settle the lawsuit. This was rejected. Blake & Torres have made an offer to settle for $45,000. In addition, they are seeking attorney fees of $30,000. Attorney fees will be the subject of a separate court action. The subject of this settlement is limited to the claim of $45,000 by Blake & Torres and costs to date. Staff feels that the $20,000 original offer is more in keeping with actual damages. However, inverse condemnation, like condemnation, results in the County paying for experts, costs and the like for the Plaintiff if they prevail. For example, the cost we have received from our appraiser to 1) determine the value of the property taken and 2) the value of the tract before and after the taking is $10,000. There is a question as to loss of access to Oslo Road and if this were decided in favor of the County it could reduce our exposure substantially, but it would not remove the fact that inverse condemnation has occurred and all the attendant expenses would still exist. Staff is reluctant to recommend that we pay the $45,000 but at the same time we are mindful that costs can become prohibitive and this tail can wag the dog. The course of action that we do recommend is that we test, by summary judgment, the issue of "loss of access." If we prevail, then we should defend the lawsuit. If we lose the summary judgment, then we will return to the Board with a recommendation as how to proceed including possible settlement. July 14, 1998 0 ON MOTION by Commissioner Eggert, SECONDED BY Commissioner Ginn, the Board unanimously approved that staff test, by summary judgment, the issue of "loss of access." If the County prevails, staff is authorized to defend the lawsuit. If the County loses the summary judgment, then staff will return to the Board of County Commissioners with a recommendation as to how to proceed including possible settlement. Commissioner Adams asked if procedures were in place to avoid this problem in the future, and Public Works Director James Davis explained in detail how this was an unusual situation which went back to 1990 when the County first began negotiating with the property owners, the Helseth family, to acquire land for the Oslo Road intersection improvements. A subsequent sale of the property to Blake & Torres coupled with lack of communication resulted in this problem 13.A.1. Make no mistake, FAC's members are the key to our victory in Novemberl The purpose of this memo, is to enlist your help in organizing the Revision 7 campaign in your county. Teams are being created to assist our campaign staff in a strategy in 37 counties. In the small counties, a key contact will be identified. He wished to appoint Vice Chairman Macht as the County's lead Commissioner and County Attorney Vitunac as the County's key staff contact. There was no opposition to the above appointments. -Commissioner Eggert asked if this campaign stayed "pure" or if the FAC had put other issues in it, and Commissioner Adams assured her that it is "pure". Commissioner Adams predicted conflict would come with some of the other more controversial amendments that are proposed, including the gun purchase delay. A lot of money will be put into some of those campaigns. In fact, there is talk that those campaigns will be for a total negative vote for all the amendments, in order to get the ones they are opposing defeated. Commissioner Adams called the amendments very boring but very, very important and will affect us greatly. She offered to try to get some information about all the amendments so that the Board will have the ability to know and advise what is being asked for in each amendment and be able to point out what a "yes" vote or a "no" vote would do. Commissioner Ginn believed the problem has been that some 30 Constitutional amendments are being "lumped together" into fewer questions for the ballot. Commissioner Adams commented there was even one ballot question that was being called "miscellaneous", which was very scary. She stated it was a combination of unrelated matters, and compared it to someone's "junk drawer". Commissioner Ginn felt it important to know all of what is included on Revision 7, and County Attorney Vitunac advised he would furnish all of the Commissioners with the details. Vice Chairman Macht hoped the local newspaper would follow through with a public education campaign so the public would understand what the revisions are. 13.A.2. TAX COLLECTOR KARL ZIMMERMANN'S REQUEST TO RESCHEDULE PUBLIC HEARINGS TO CONSIDER EXPANDING THE COUNTY SEAT TO INCLUDE LURIA PLAZA Tax Collector Karl Zimmermann requested that the Board consider rescheduling the public hearings which are one of the prerequisites to extending the boundaries of the County July 14, 1998 71 GOOK 106, Ftlu I ' r.8 600K '� 0 PAGE 3.3 Seat and which will allow him to make his soon -to -open branch office at Luria Plaza (14' Street off US# 1) his main office. By satisfying these requirements, he would be able to turn over his entire square footage in the County Administration Building to the Board of County Commissioners. He suggested there might bean advantage in structuring the advertising and public hearings to also include the Vero Mall (US#1 at 12' Street) since the Board is considering purchasing and utilizing that building for the County's new administration building. County Attorney Vitunac counseled the Commissioners on advertising requirements and time parameters and the Commissioners discussed their preferences on a date for the first hearing. CONSENSUS was reached to hold the first hearing on August 18, 1998. The second hearing would be held on September 1, 1998.
