REGULAR MEETING OF THE BOARD OF COUNTY
COMMISSIONERS
The Board of County Commissioners of Indian River County, Florida, met in Regular
Session at the County Commission Chambers, 1840 25`' Street, Vero Beach, Florida, on
Tuesday, August 4, 1998, at 9:00 a.m. Present were John W. Tippin, Chairman; Kenneth
R. Macht, Vice Chairman; Fran B. Adams; and Caroline D. Ginn. Commissioner Carolyn
K. Eggert was on vacation. Also present were James E. Chandler, County Administrator;
William G. Collins, II, Deputy County Attorney; and Patricia "PJ" Jones, Deputy Clerk.
1. CALL TO ORDER
Chairman Tippin called the meeting to order.
2. INVOCATION
Chairman Tippin delivered the Invocation.
3. PLEDGE OF ALLEGIANCE
Commissioner Adams led the Pledge of Allegiance to the Flag.
4. ADDITIONS TO THE AGENDA
Commissioner Ginn requested the addition of Item 7.G., Permission for Out -of -
County Travel to the August 20, 1998 Orange County Housing Summit.
Commissioner Adams requested the addition of Item 13.C., Association of National

unanimously added the above items to the Agenda.

The Chairman asked if there were any corrections or additions to the Minutes of the
Regular Meeting of July 21, 1998. There were none.
ON MOTION by Commissioner Ginn, SECONDED
by Commissioner Adams, the Board, by a 4-0 vote
(Commissioner Eggert being absent), unanimously
approved the Minutes of the Regular Meeting of July
21, 1998, as written.

DESCRIPTION AND CONDITIONS
At the May 19, Board of County Commissioners regular meeting, the
board authorized staff to begin contract negotiations for
engineering services for the Stormwater Management Improvements.
Attached is an agreement with Carter Associates, Inc. for
engineering services, drainage design, environmental permitting,
land surveying, and related services in connection with the project
RECOMMENDATIONS AND FUNDING
Staff recommends the Chairman execute the attached Engineering
Services Agreement. Funding to be from 315-214-541-068.11.
August 4, 1998
ON MOTION by Commissioner Adams,
SECONDED by Commissioner Ginn, the Board, by
a 4-0 vote (Commissioner Eggert being absent),
unanimously approved the Professional Engineering
Services Agreement - Indian River County
Stormwater Management Improvements with Carter

SUBJECT: Agreement and Release of Utility Easement
Indian River County has a 10 -foot wide utility easement over the southwesterly
portion of Lot 1 in Sea Oaks River Homes IV, P.D. The owner has requested
that the County release the utility easement so that he may put a swimming pool
in that portion of his lot. The Utilities Department has determined that the
easement is not needed. but the easement is occupied by a discontinued 6 -inch
water main.
Presented is an agreement for release of the utility easement in consideration of
the owner agreeing to be responsible for removal of the 6 -inch water main within
the easement and agreeing to hold the County harmless for any continuing
occupation of the easement by the water main until removed.
RECOMMENDATION:
Authorize the Chairman to execute the attached Agreement and Release of
Utility Easement.
ON MOTION by Commissioner Adams,

unanimously approved the Agreement and Release

SUBJECT: Proposed Settlement Sea Turtle Survival League v IRC et al
The Plaintiff has offered a settlement of the subject law suit. A copy is attached.
Attorney Tomasello, who represents the property owners (Defendants along with
IRC) who installed the sea wall, would like the County to settle, but only if DEP and
Sea Turtle Survival League (STPL) agree to allow the sea walls to remain.
The proposed STPL settlement would have us agree that STPL is the prevailing
party" which would open up the County to pay their legal fees. In addition, it would,
like the Tomasello proposal, have the County agree to limit all future action with
regard to issuing permits. Staff feels that the County cannot contract away any of its
statutory rights and obligations. Further, the entire tenor of the STPL proposal is that
the Countv was at fault.

DESCRIPTION AND CONDITIONS
The ±298 acre Oslo Riverfront Conservation Area (ORCA), a resource-based park owned jointly by
the County and the St. Johns River Water Management District, was officially opened to the public
in Mav, 1997. Prior to that time. in 1995, the County was awarded a $90.600 cost -share assistance
grant from the Florida Inland Navigation District (FIND) to construct public access facilities and
education displays on the property. Under that grant, parking facilities, boardwalks, a viewing pier.
and a canoe landing have been constructed. What remains to be constructed under the FIND grant
is an elevated observation platform and educational displays.
The FIND grant is set to expire in September, 1998. Staff has been coordinating with an ORCA
working group, spearheaded by staff of the Florida Medical Entomology Laboratory (FMEL),
regarding installation of educational displays (by the September deadline) and establishment of
regular guided tours of the property using trained volunteers.
Janice Broda of the FMEL has received quotes for educational displays and trail signs from
Wilderness Graphics. Inc., a Tallahassee -based company that specializes in the design of outdoor
educational displays and signs for resource-based parks. The County has previously purchased signs
from Wilderness Graphics for displays at county parks. including Wabasso Causeway Park. and
Round Island Park (riverside).
Staff is requesting that the Board of County Commissioners authorize staff to proceed with
purchasing educational displays and trail signs from Wilderness Graphics for the Oslo Riverfront
property as further described herein.
ALTERNATIVES & ANALYSIS
Description of Signs & Cost
.-attached is a memorandum from Janice Broda of the FVIEL with a description of the proposed signs
and displays. The proposal consists of ten flora and fauna informational signs ($7.075) to be
.uspiaved at various locations on the property, and fifteen 9" x 12" trail signs (52.550). The total cost
estimate for the signs and shipping is S9.850.

The FLND grant allocates $15.000 towards educational signs and displays, $10,000 of which comes
from the FIND grant. The remaining $5,000 relates to County in-kind services for construction and
installation of the signs and displays.
Purchasing Procedures: Justification
County Code Chapter 105. Purchasing, sets forth bidding procedures and requires Board approval
for the purchase of materials or services exceeding $5.000. Code Section 105.03 provides that
bidding is not required except for certain projects specifically requiring bidding under Florida
Statutes (which is not applicable in this case).
It is staffs position that it is appropriate and in the County's interest to select the services of
Wilderness Graphics. Inc. for the signs and displays without need for formal bidding, based on the
following reasons. First, the price quote submitted is within original project cost estimate. Second,
Wilderness Graphics has considerable experience in the specialized field of outdoor educational
displays for resource-based parks. and has ready-made panels that can be obtained in a timely
manner. which is important for meeting the time -frame of the FIND grant that expires in September.
1998. :also. Wilderness Graphics has demonstrated competence in delivering quality products
regarding previous County purchases of similar signs from the company. Finally, the County's in-
kind contribution as reflected in the FIND grant is estimated to be $5,000 for on-site construction.
However. purchasing a pre -fabricated display kit will require assembly only, thereby reducing the
cost of the Countv's in-kind contribution.
RECOMMENDATION
Staff recommends that the Board of County Commissioners authorize staff to purchase from
Wilderness Graphics. Inc. the described educational displays and trail signs, at the quoted price of
59.850.

10. EMERGENCY SERVICES DISTRICT MILLAGE RATE
County Administrator Jim Chandler commented regarding the recent discovery that
the Emergency Services District's millage rate is capped at 3.5 mills rather than 3 mills.
There appeared to be some confusion with respect to the 2.7 million dollars referred to in
the newspaper. That sum would be the value of one-half mill based on the current tax roll
but that does not mean the County has 2.7 million dollars to be allocated. In order to
generate 2.7 million dollars, the County would need to increase the tax rate by one-half mill.
Commissioner Ginn recognized and commended Bob Johnson, a member of the Board
of Directors of the Taxpayers' Association, who had made the discovery.
Bob Johnson, of the Taxpayers' Association, noted that he had verified the millage
by doing some research on behalf of the Taxpayers' Association and he complimented the
taxing district for holding the line on the millage rate on behalf of property owners. He also
noted how valuable the District is to the residents of Indian River County. He complimented
the emergency and medical personnel for doing an outstanding job and noted the fine job all
the volunteers do. The emergency services workers in South County support over 22,000
people and do an excellent job.

Since the intent of the original lease was for the tower to be limited to the use of the County and
Talcom communications systems equipment only, a First Amendment To Lease Agreement was
approved by the Board on December 9, 1997, wherein collocation agreements would be
permitted based on the policy of the County relating to towers and tower construction.
Article 18 (c) of the original Lease Agreement referenced above provides that, as to other
parties, the Agreement may not be sold, assigned, sublet, licensed or transferred, in whole or
in pan, without the prior written consent of the County. Talcom, Inc., is requesting the
County's consent to enter into a Collocation Agreement with Nextel South Corporation pursuant
to all fees being paid and all conditions of the original Lease Agreement with the County being
met.
As prior negotiated with Talcom, Inc., and as in other existing Collocation Agreements, the
County will receive one half $15,000) of the $30,000 reimbursement amount (one time payment)
paid by Nextel to Talcom plus one half $9,000) of the annual rent, which is expecrtd to be
$18.000 for each company collocate on the tower. The revenue from the collocation agreement
will be utilized as recommended by the County Administrator and approved by the Board of
County Commissioners.

On August 9, 1996, the Indian River County Board of County Commissioners approved a
Certificate of Public Convenience and Necessity for Able Ambulance Service to provide ALS/BLS
non -emergency interfacility transport services in Indian River County. The certificate was
necessary in order to comply with rules from the Florida Department of Health and Rehabilitative
Services for Able Ambulance to provide interfacility transport service in Indian River County.
The certificate was issued for a period of two years pursuant to the Indian River County Code of
Laws and Ordinances. The certificate will expire on August 9, 1998, and the renewal process
should be accomplished prior to that date.
The Indian River County Code provides for routine renewal of the Certificate of Public
Convenience and Necessity on application by the certificate holder. This can be accomplished
without a public hearing if the Board has no reason to believe that the public health, safety, and
welfare require it. Staff submits that there is no reason to hold a public hearing and absent that
requirement, requests the Board to issue and renew the certificate routinely.
An application has been completed requesting renewal of the certificate. The EMS Director and
Medical Director have reviewed the application and EMS protocol with the EMS staff and certifies
no reasons are known or perceived that would require a public hearing pursuant to the established
ordinance.
RECOMMENDATION
Staff respectfully recommends that the Board of County Commissioners approve and renew the
Class B Certificate of Public Convenience and Necessity for the Able Ambulance Service to be
effective for a period of two years.

As a result of firefighters and other public safety personnel's efforts in suppressing wild fires
in the State of Florida during the past couple of months, invitations have been extended to
firefighters by Walt Disney Attractions. Vero Beach Dodgers, and additional invitations to
receive a free "Salute To Firefighters Pass" to include spouses and/or dependents. Other
invitations are expected from other theme parks in the State. Staff is also informed that under
a separate effort. the same will be extended to other emergency personnel such as paramedics,
emergency management, military, and law enforcement personnel.
Staff has received the attached letter from Walt Disney Attractions and Vero Beach Dodgers
detailing the offers as well as a request from Local 2201 President An Zyskowski seeking
permission for emergency services staff to participate in the promotions being offered.
In January, 1995, the Board approved revisions to Chapter 104 which allows for Commission
approval of such events on a case by case basis. Section 104.06 (5)(b)(8) states "The
prohibitions enumerated in paragraph (a) and (c) of this section do not apply in the situations
enumerated below: "... Local outings offered to all county employees or with prior approval
of the Board of County Commissioners, units of county employees."
RECOMMENDATION:
Staff respectfully requests the Board favorably consider this matter and authorize emergenc}
services personnel participation in the special offers being extended.

Services is prepared to make final payment to the contractor once the additional 500 ± L.F. of
sod is laid. It is anticipated that this minor item will be completed prior to the Boards approval
of this agenda.
.ANALYSIS
The original awarded contract amount was 5162,665.00. Change Order No. 1 is in the amount of
S7.755.45. which equates to a final contract amount of 5170,420.45. As discussed in the
attachments of Change Order No. 1, 54,900.00 represents emergency work outside of this
contract associated with the Public Works Department for the Kings Highway project. The
amount of the final change order associated with this project equates to 52,855.45 or a 1.8% total
increase. The final construction cost that will be used in the project's assessment is 5165,520.45.
which is approximately 535,000.00 below the original estimate, resulting in substantial savings
to the customers.
Payment for the U.S. Highway No. 1 portion of this project will be from Account No. 473-000-
169-315.00. The emergency funding in the amount of $4,900.00, for the Kings Highway project
will be from Account No. 473-000-169-339.00 (For details of the final pay request and change
order, please reference the attached documents).
RECOMMENDATION
The staff of the Department of Utility Services recommends that the Board of County
Commissioners approve the final pay request and change order as presented and authorize
Chairman to execute same.

On December 3. 1996, the Indian River County Planning Department brought forward a
request for special exception use approval for the South County Wastewater Treatment
Plant Expansion. (Please refer to the attached agenda item and minutes.) The Board's
discussion at that meeting centered around a recommendation by the Planning and
Zoning Commission's request to consider additional buffering of the site. The main
concerns were maintaining the existing oak hammock on site and additional buffering.
The Board tabled the matter for two weeks for staff to investigate options.
On December 17. 1996, staff returned to the Board with several options to preserve the
oak hammock and an assurance that additional buffering would be worked out with the
Indian River Club. (Please refer to the attached agenda item and minutes.) Alternative
No. '_ of the available options was selected by the Board, maintaining the integrity of the
oak hammock at a estimated additional cost of 5306,000.00. The previous instruction to
staff to meet with Indian River Club to add additional buffering was also reiterated.

On June 3. 1997, the plant expansion project was awarded for construction at a cost of
S8.527.000.00, and more discussion took place regarding the need for additional
buffering. Following project award several meetings were held with County staff and
Bob Swift (Indian River Club General Manager). The first agreement that staff felt they
had reached with the Club was the planting of an additional wax myrtle hedge along the
property line of the plant site and also increasing the tree caliper size on the existing
proposed plantings. (See attached letters from CDM to the County, Bob Swift and the
Contractor, along with the accompanying cost quote from the contractor.) The cost
proposed for this was an additional 530,954.00, with Indian River Club providing the
maintenance and irrigation which staff agreed with.
.-additional discussions followed, with the Club ultimately retaining the services of a
landscape architect to design an alternative berm and planting scheme. We are now,
therefore, coming to the Board of County Commissioners for direction in the
implementation of the Club's proposal.
Several considerations must be taken into account in the decision-making process. The
following were considered as a basis for the options as presented:
1. The County is desirous of being good neighbors to Indian River Club and the
community at large. This was exemplified by Board approval in December 1997 to
expend an additional estimated 5306,000.00 to maintain a pristine oak hammock on
the plant site for preservation as well as buffer, and the initial agreement to expend an
additional 530,954.00 through the plant construction contract for more buffer.
'. The site plan as approved meets or exceeds all current regulations for site buffering
that a private entity would be required to provide.
3. The total proposed cost of the Club's landscape plan is 5107,413.08. The cost, if
funded by the Utility customers, predominantly benefits a private sector development.
(Please refer to the attached cost proposal.)
4. Indian River Club is also incurring an expense to accommodate the proposed
landscape plan by the relocation of tee boxes, cart paths and committing to all future
maintenance.
Options proposed are as follows:
A. Cost share the project with Indian River Club with the County contributing the
originally proposed sum of $30,954.00 toward the Club's plan, leaving the Club
to fund the remainder.
B. Remove the following items from the Club's proposal and propose that the Club
pay for the portion outlined below with the County to contribute the remainder of
the funding (i.e., $71,563.08):
a) Required fill $21,700.00
b) Relocate fence 5,650.00
c) Irrigation 8.500.00
Total $35,850.00
C. Propose the County pay for the entire cost of $107,413.08.
Staff is of the opinion that of the three options, option B is the fairest compromise to all
parties, should the Board agree to allocate additional funding.
The staff of the Department of Utility Services recommends that the Board of County
Commissioners approve option B. as outlined above through the issuance of a Purchase
Order to Indian River Club in the amount of 571,563.08 to be paid at the time of project
completion.

As a member of the Indian River Lagoon Basin Advisory Board (the follow-on organization to the
Indian River Lagoon National Estuary Program Policy Committee), Indian River County is being
asked to provide $200 or one-fifth of the total membership fee of $1,000. The Counties of
Brevard. St. Lucie. Volusia and Martin are also being asked to provide a one-fifth portion of this
fee. The St. Johns River Water Management District paid last year's membership fee of $1,500.
The fee was reduced this year to 51.000.
The Association of National Estuary Programs was successful in increasing funding to the
national program by $1 million last year. This resulted in an additional $36,000 in implementation
funding to the Indian River Lagoon. This year the ANEP is working to increase funding by over
S30 million nationwide which would result in an increase in funding to the Indian River Lagoon of
over 5800.000. The Indian River Lagoon National Estuary Program prefers not to use federal
funding for this membership in order to avoid any potential conflicts related to the nature of the
educational and lobbying efforts of the association.

Since November 1996, when the Indian River Lagoon National Estuary Program's
Comprehensive Conservation and Management Plan (CCMP) was approved, the Indian River
Lagoon Basin Advisory Board has worked to build support and secure funding for the
implementation of the Indian River Lagoon CCMP. These efforts have in -tum provided funding to
local municipalities and counties, such as Indian River, to assist in addressing upland stormwater
flooding and water quality problems in the lagoon.
The National Estuary Program has provided over $200,000 in federal funding to Indian River
County during the previous seven years.

PROBLEMS FACING AMERICAS BAYS AND ESTUARIES
Estuaries are nearshore bodies of water where fresh- and saltwater mix. These highly productive
ecosystems are vital to our nation's environmental and economic well-being, but they are
threatened by impacts from a wide range of human activities.
-a Toxic Chemical Contamination
Since 1940, more than 70,000 synthetic chemicals have been introduced to the marine
environment through stormwater runoff, industrial discharges and air pollution. Many of them are
toxic in minute concentrations. Of particular concern are polycyclic aromatic hydrocarbons
(PAHs), toxic metals, polychlorinated biphenyls (PCBs), and pesticides. These chemicals collect
in sediments and bio -accumulate in fish and shellfish, causing health risks to people and marine
life.
=J Excessive Nutrients
Nutrients (such as nitrogen and phosphorus) occur naturally and are necessary to support a
healthy ecosystem. However, excess nutrients create problems, such as stimulating the growth
of algae which die and decompose, robbing the water of oxygen necessary to support aquatic
life. Excess algal growth diminishes water clarity, harming aquatic plants that are sensitive to
light changes. This impairment or loss of critical freshwater and estuarine habitats results in
declines in fish and shellfish populations. Excessive nutrients in some southern estuaries have
also been linked to fish kills caused by toxic microbes. Primary sources of nutrients are fertilizers,
animal wastes, and septic systems.
Health Risks from Pathogens
Pathogens are viruses, bacteria and protozoans that cause disease in plants, humans and other
animal;. Aside from serious health risks to recreational users and consumers, pathogen
contamination causes economic loss due to closed shellfishing beds and beaches, affecting
important industries. Diseases linked to pathogens include gastroenteritis, salmonellosis, and
hepatitis A

The National Estuary Program
In 1987, as part of an amended Clean Water Act, the National Estuary
Program (NEP) was created. This innovative program finds solutions
to environmental problems in at -risk estuaries. These estuaries and
bays are important to the environmental and economic well-being of
this country. Estuaries of national significance around the nation have
been defined and federal funds have been allocated to create Estuary
Programs to develop Comprehensive Conservation and Management
Plans for the estuaries. With 28 programs now in action, this approach
nas provided an important laboratory to test and refine the principles of
watershed management. it is also among a handful of government
programs that successfully involve citizens in decision-making and
problem identification at the local level.
The Estuary Programs conduct scientific assessments in
estuarine watersheds that identify priority problems and issues, bring
ocai stakeholders to the table to craft strategies and solutions, and
:oorainate the wont of many partners to implement those solutions.

Commissioner Adams commented that the County is part of the Estuary Program with
5 other counties. The Program has now become a national program with annual dues. Last
year SJRWMD paid the $1500 membership fee and this year they are billing each of the 5
counties $200 for the membership fee which has been reduced to $1000. The problem is that
the Indian River Lagoon Basin Advisory Board (follow-on organization to Indian River
Lagoon National Estuary Program Policy Committee) has not had a chance to discuss this.
The next meeting will be held in September and Commissioner Adams suggested delaying -
any action until after that meeting.
CONSENSUS was reached to delay any action until after the September meeting of
the Indian River Lagoon Basin Advisory Board.
