The Board of County Commissioners of Indian River County, Florida, met in Regular
Session at the County Commission Chambers, 1840 25" Street, Vero Beach, Florida, on
Tuesday, December 22, 1998. Present were John W. Tippin, Chairman; Kenneth R. Macht,
Vice Chairman; Fran B. Adams; Caroline D. Ginn; and Ruth Stanbridge. Also present were
James E. Chandler, County Administrator; Charles P. Vitunac, County Attorney; and Patricia
Ridgely, Deputy Clerk.
1. CALL TO ORDER
The Chairman called the meeting to order at 9:00 a.m.
2. INVOCATION
Commissioner Ginn delivered the invocation.
3. PLEDGE OF ALLEGIANCE
Administrator Chandler led the Pledge to the Flag.
4. ADDITIONS TO THE AGENDA
Administrator Chandler requested the addition of 11.B., Consent to Proposed
Sublease Agreement between BellSouth Mobility, Inc. and Nextel South Corporation for
tower space at Winter Beach site.
ON MOTION by Commissioner Adams, SECONDED BY
Commissioner Ginn, the Board unanimously added the above
item to the Agenda.

Minutes of the Regular Meeting of December 8, 1998, as
written and distributed.

Phase III
It is requested that the data herein presented be given formal consideration by the Board of County
Commissioners at its regular meeting of December 22, 1998.

Phase III of the Island Club PD is the last of a three phase project known as Island Club. The Phase
III plat subdivides 12.34 acres into 49 single family lots. The subject site is located on the west side
of SR A -1-A just north of the Town of Indian River Shores and west of the Baytree development
(see attachment #2).
At its regular meeting of February 20, 1996, the Board of County Commissioners approved the
overall Island Club conceptual PD plan which lays out 131 single-family homes, a clubhouse, tennis
court, lake and pool in 3 phases. The clubhouse, stormwater tract, and 82 lots in Phases I and II
have been platted. Phase III is now ready to be platted.
At its regular meeting of April 23, 1998, the Planning and Zoning Commission granted preliminary
PD plat approval for the Phase III subdivision. Subsequently, a land development permit was issued,
and the developer constructed all of the required subdivision improvements (e.g. roads, utilities,
stormwater improvements) except for a landscape buffer and minor miscellaneous improvements
such as sod and erosion repair. The owner, Beazer Homes Florida Inc., through its agent Knight,
McGuire & Associates, Inc., is now requesting final plat approval and has submitted the following:
1. A final plat for Phase III in conformance with the approved preliminary plat for Phase III.
2. A certified engineer's cost estimate for the remaining required improvements.
3. A contract for construction of the remaining required improvements.
4. Security guarantee construction of the remaining required improvements.
ANALYSIS:
At this time, most of the required subdivision improvements have been completed. A contract for
construction of all of the remaining required subdivision improvements and cash to secure the
contract have been submitted by the applicant. Both the county Engineering Division and the
Planning Division have approved the cost estimates and have verified that the letter of credit
amounts are adequate to cover the estimated cost of the remaining required improvements. The
county attorney's office has approved the construction contract for legal form and sufficiency and
has approved the format of the financial security.
Pursuant to the county's LDRs, the applicant will be required to obtain a certificate of completion
after construction of the required improvements. At that time, the applicant will warranty the utility
improvements for Phase III separately, via a Utility Service Department Bill of Sale. No other
warranties are required since all other improvements are privately dedicated. All applicable
requirements regarding final plat approval for Phase III have been satisfied.
Based on the above analysis, staff recommends that the Board of County Commissioners grant final
PD plat approval for Phase III of the Island Club Planned Development, and authorize the Chairman
to sign the contract for construction and cash escrow agreement.

A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA,
CANCELLING CERTAIN DELINQUENT TAXES UPON
PUBLICLY OWNED LANDS, PURSUANT TO SECTION 196.28,
FLORIDA STATUTES.
WHEREAS, Section 196.28, Florida Statutes, allows the Board of County Commissioners
of each County to cancel and discharge any and all liens for taxes, delinquent or current, held or
owned by the county or the state, upon lands heretofore or hereafter conveyed to or acquired by
any agency, governmental subdivision, or municipality of the state, or the United States, for road

County staff has been working on an economic analysis for the Beach
Preservation Plan (BPP). The economic analysis includes
determining the nature and extent of benefits expected to accrue
from the BPP and allocating these benefits to their proper
recipients. This analysis will be used to develop a local funding
program to support and implement the BPP.
ALTERNATIVES AND ANALYSIS
Based on the findings of the economic analysis, an evaluation of
funding alternatives will be completed. These potential funding
sources will be outlined in a final report which will be presented
to the Board of County Commissioners in January, 1999. One of the
potential sources of revenue to be considered is the development of
an assessment program. In anticipation that Indian River County
may consider an assessment program next year, Florida Statutes
Section 197.3632 requires that the County hold a public hearing and
adopt a resolution of intent to use the uniform method to collect
non -ad valorem assessments.
The resolution must be adopted by January 1, 1999 and sent to the
Tax Collector, the Property Appraiser and Florida Department of
Revenue by January loth. In addition, a list of properties which
may be considered under this type of collection method shall be
provided.
The resolution does not obligate the County to use this method, but
reserves the County Commission's ability to impose assessments.
This resolution only assists the County in meeting statutory notice
requirements necessary to preserve this collection approach. To

reiterate, this resolution is non-binding and the County Commission
may decide not to go forward with the assessment method at a later
date. By adopting the attached resolution, the County Commission
is simply reserving the right to use this type of collection
method.
RECOMMENDATIONS AND FUNDING
Staff recommends approval of the resolution whereby the County
reserves the right to utilize the uniform method to collect non -ad
valorem assessments.
ATTACMdENT
Resolution No. 98 -
List of Properties
Coastal Engineer Jeff Tabar advised that only the proposed resolution was being
presented; there would be no presentation regarding the County's financing and funding
program relative to the Beach Preservation Plan. He apologized to the Board and the public
for any confusion. The suggested funding alternatives will be brought to them at a later date,
probably late January. He explained that one of the funding sources which may be used is
an assessment program. Anticipating that the Board may use the assessment method, and
because Florida Statutes requires certain conditions be met, it was recommended the
resolution be adopted. He stressed that adoption of this resolution will not obligate them to
use the assessment method. He added that the properties listed in the attachment to the
resolution were oceanfront properties within proposed beach restoration projects. He used
graphics illuminated on the ELMO to point out the areas which will be affected by the Beach
Preservation Plan as follows: (1) just south of Sebastian Inlet to Ambersand; (2) Wabasso
Beach area south to Marbrisa (to the northern edge of Indian River Shores); (3) the City of
Vero Beach project starts just south of the tracking station and proceeds south to Rio Mar
Golf Course; and (4) Angler's Cove/Surfside area where seawalls have been constructed.
The final findings report will be presented to the County's Beach & Shore Preservation
Advisory Committee in early January and then to the Board of County Commissioners for
potential final adoption. He stated that the resolution proposed for adoption at today's
meeting was only to meet statutory notice requirements to the Property Appraiser and Tax
Collector and Department of Revenue and does not obligate the County to use this type of
assessment, only reserves the County's right to do so.

Mr. Tabar advised that Virginia Delegal, the County's legal consultant, would tell
them of modifications suggested by staff to the proposed resolution.
Virginia Delegal, attorney with Nabors Giblin and Nickerson in Tallahassee,
explained that Mr. Nickerson sent her in his place today as he had another meeting to attend.
She reiterated that the proposed resolution merely preserves the County's right to collect the
assessment for the Beach Preservation Plan if the County chooses to do so; it does not
obligate the County to use the tax bill collection mechanism. She then advised of the
following suggested changes in the proposed resolution: Under Section 1, replace "intends
to use" with "may intend to use". At the beginning of the next sentence, insert "If such
method is used," and change "shall" to "may".
Mr. Tabar then recommended the adoption of the proposed resolution as amended.
Commissioner Ginn asked for assurance on the adequacy of the language of the
resolution as amended to stop the process, and Ms. Delegal advised that it was adequate and
that there will be future public hearings when the Board could stop the process.
Commissioner Ginn also asked for an explanation of FS § 197.3632 for the benefit of
the public and stressed that she would have liked it in the backup so she did not have to
search for it.
Ms. Delegal then explained the section for the benefit of the public pointing out that
there are many deadlines and other requirements the Board must meet in order to have the
right to actually collect the special assessments on the tax bill. She added that this method
was not the only method for collection and enforcement available, but has been found to be
effective and efficient for all parties involved.
As requested by Commissioner Ginn, Ms. Delegal then explained the difference
between the January 1 and March 1 deadlines advising that January 1 is an absolute date by
which the County must adopt a resolution of intent, if the County does not have express
consent from both the Property Appraiser and the Tax Collector. The Board can negotiate
with the constitutional officers to waive that date. If the resolution is adopted at this
meeting, there will be no March I' deadline.
Commissioner Ginn understood that Property Appraiser David Nolte had objected to
the March 1 date, and Ms. Delegal advised that Mr. Nolte did not object to the March 1 date,
but had proposed some conditions and had agreed to waive the January 1 date if those
conditions were acceptable.

Commissioner Adams added that by the time she was able to meet with Mr. Nolte,
the County had already advertised the public hearing twice and it was decided it would be
better to go ahead and have a public hearing so everybody had an opportunity to see it, hear
about it, and do it publicly.
Ms. Delegal added that Indian River County was not unique around the state, many
other Boards of County Commissioners and City Councils are doing the same thing.
The Chairman opened the public hearing and asked if anyone wished to be heard in
this matter.
Property Appraiser David Nolte's understanding of the statute was a little different
from what the Board had heard up to this point. He believed that the purpose of the
advertisement was not to notify the Property Appraiser and Tax Collector of the intent, but
to notify the public that their property could be assessed, alien could be attached, and, if the
assessment is not paid, they could lose their property. Their property title is being pledged
and it is an automatic process. That is why there is alien date of January 1 in the
Constitution and why meetings of this sort must take place before then. He thought the
amendments may render the resolution unclear. He stressed that the lien would be on the
properties, but could be removed through a later action of the Board.
In response to Commissioner Ginn's inquiry about the March 1 date, Mr. Nolte
advised that if the Board wanted this to be on the TRIM notice, he would have to make some
computer programming changes costing about $5,000. He needed time to get that process
going and to test the programs to make sure they are working properly. He recommended
the Board proceed so the TRIM notice process could be used, since the taxpayers have
become accustomed to it. His concern was based upon time and he felt that if the people did
not want the assessment method used, the Board had the ability to stop it.
Frank Coffey, 88 Cache Cay, asked if the County Attorney agreed with the proposed
changes to the resolution.
County Attorney Vitunac responded that his office had written the changes during a
meeting with Commissioner Adams the previous day. The changes were presented to the
consultants and they agreed they were satisfactory.
Mr. Coffey agreed that the County needed an appropriate Beach Preservation Plan

with a well -thought-out program for funding. He understood the resolution and called it a
"tax alert". He also understood that Applied Technology and Management, Inc. (ATM) had
estimated the initial project cost of the plan at about $17 million and the total cost over 30
years to be $47.6 million exclusive of sand source investigation and other tests. If the
County decided to go forward with the program, the issue would become how to obtain the
funds. It seemed to him, before making an assessment against certain properties, they must
consider total costs (including initial and ongoing maintenance) and availability of funds
from various sources. Also to be considered is whether to assess based on front footage or
amount of storm protection provided. It was his understanding that staff received the report
December 18` and that it will be discussed with the Beach and Shore Preservation Advisory
Committee in early January. Finally, he understood that staff hoped to present their
recommendation with the Committee's support to the Board by the end of January. He felt
it was unfortunate that this resolution was being presented to the Board with so little
information for the taxpayers.
George Gross, 1230 39'h Avenue, asked several questions about the resolution and
process of assessment for additional clarification.
Responding to Mr. Gross, Ms. Delegal confirmed that assessments under this
resolution will be limited to those properties listed in the attachment. If other properties are
to be considered, then statutory deadlines would not have been met to collect special
assessments for those properties on the tax bills. They could be taxed as an ad valorem tax
and may be specially assessed if a separate bill is sent to those properties this year. They
could be picked up on subsequent years' tax bills with an additional resolution attaching
those parcels to it. So, there are other billing, collection and enforcement mechanisms
available to the County if other parcels are found to benefit from the program.
Rene Renzi, 340 E. Waverly Place, Vero Beach, spoke on behalf of and as a member
of the Board of the Civic Association. The Civic Association had discussed this matter at
their meeting last week. They did not have details, but discussed generally the concept of
special assessments. The consensus was firmly in support of some wider application of the
assessments. The Civic Association Board members felt strongly that the cost should be
more fairly distributed throughout the whole community.
Commissioner Adams pointed out that the whole payment plan will be discussed in
the future. She felt that a lot of the questions coming up now will be answered in the future

at the appropriate time.
Ms. Renzi thanked Commissioner Adams for her comments, but stated that she was
shocked to hear of the deadline and possible liens on properties; it was pretty scary.
County Attorney Vitunac clarified that this resolution will impose no lien on anyone's
property. If the Board later adopts a special assessment, then there will be liens on property
just as when the County does water, sewer and road assessments. All County liens relate
back to January 1. This resolution will provide a low-cost, efficient method of collecting the
assessment, if there is an assessment.
Glenn Legwen, 5900 5" Street SW, asked Commissioner Adams who had made the
decision to advertise for this public hearing, and Commissioner Adams responded that the
decision was made by County Attorney Vitunac, Coastal Engineer Jeff Tabar, and herself.
Mr. Legwen submitted two handouts (on file with the backup of this meeting in the
office of the Clerk to the Board) and proceeded to begin to read into the record questions
concerning the ATM Beach Preservation Plan. He stated that the ATM plan had not been
subject to public scrutiny and he would question a lot of assumptions made in it.
Commissioner Ginn asked if Mr. Legwen had written out his questions and suggested
that he give a copy to someone if he wanted them answered.
Commissioner Adams and Commissioner Stanbridge then advised Mr. Legwen that
this public hearing was solely on the resolution presented for consideration and suggested
that Mr. Legwen reserve his comments for the appropriate future public hearings on the
ATM plan in January.
Mr. Legwen felt this was his opportunity to comment as it is very difficult for some
people to get to some of the public hearings and say what they want to say. He felt he had
spent quite a bit of time developing his questions, and he thought the Board might want to
know some of the questions that he as a member of the public has before they adopt the
resolution.
Commissioner Adams explained the Board was interested to know his questions on
the resolution, but the resolution has nothing to do with the ATM plan; she deduced that his
questions had everything to do with the plan. Both she and Mr. Tabar would be very willing
to sit down with him and answer his questions about the plan.
In response to Mr. Legwen's inquiry as to the urgency to pass the resolution,
Commissioner Adams reiterated the explanation concerning the statutory requirements.

I am a avid Press Journal reader. Prior to. two referendums on sand pumping a few
Yew ago, never in my recollection- did any subject generate more controversy, more
activity from the good old boy proponents, or received more pro and con coverage. than
the subject of beach erasion. Publicity included the various mesas of attempting, and I
emphatically state- M=MdV . to stop or control erosion -the haunting dream that
communities around the world have grappled with for SO years. Numerous fall pages
and endless PJ articles depicted every conceivable aspect of the major issue which also
represents mega dollars- over and over.
My files contain primacy observations and statistics including opinions. from university
professors to beach life guards to the taxpayers. From this past long drawn out heated
Issue I submit the following opinions & personal observations which can be documented.
L IF a permanent logical solution was ever avallable. (it is not) the need to replenish
our eroded beaches is primarily to benefit or protect the privately owned buildings
which are near the ocean and threatened by Mother Nature, no different than the same
Mother Nature threatens and destroys buildings from marry other natural acts. For
Political reasons there are those who "wishful think° they can control Mother Natures
forces that never stop "shitting the sands of most all coastal beaches".
Z. Minority property owner in the past have attempted thru a good old boy network to
attempt to get nearly l00% of any project cost from our tax dollars Federal State and
local. That local scheme was resoundingly killed by two referendums.
3. No sound proof alsts that beach sand erosion has crested a local meaningful
shortage of public beach for sun bathers who attempt to get a case of skin cancer from
the leaches ONE amenity. namely sun baking. Furthermore It is evident that at least
6 other major beach amenities remain with us.
The soothing sound of the ocean.
The beautiful look of it with the endless wave variety.
One can walk the beach at the edge of the water for miles and miles in our county,
And at the same time take all the dips Into the surf one desires.
One can smell the salt air,
And throw a fishing pole in the surf at most any time or place along the always public
owned land up to the high tide mark.
4. No one has yet produced a convincing study that dearly establishes that any
significant loss of tourist dollars is due to our erosion or the condition of the beaches.
S. It is hypothetical myth to depict a harmful shortage of new residents coming to this
county because we do not have enough beaches. If a valid survey was ever made this
would be evident. First of all we have an Abundance of line Pubic Beaches. Secondly if
we bad no beach at all, as many Florida communities. do not, this county will grow as
fast or faster than the majority of present resident want it to grow.

I am personally acquainted with.resident who live a block or so from the beach and
never go their. The vast scope of other wonderful amenities in this attractive
community is awesome.
6. So lets get to the basics. You need a beach restoration or preservoon almost
exclusively for the private beach front owners buildings who may be in danger, or their
minority desire to have a wider beach for their personal monetary profit,
7. Another gross fallacy is that suddenly all the beachfront buildings will disappear
and the total tax base win be critically harmed. That could only happen with a once In a
century major direct bit hurricane. Prior beach restoration would have nil affect on that.
& The two past referendums just in the City, proved the majority do not want their tax
dollars spent on the futile temporary sand restoration solutions. The homeowners west
of the beach should not get bit with any new tax. In many instances they don't use the
beach, and in most Instances. they know- we cannot really fight Mother Nature..
9. Wim River County has the beach issue in their lap for one primary reason. The
City special Interest group gave up when two referendum but their scheme, and they
wanted the issue to quiet down a while and then resurrect it in the county where, at
least now, a referendum is not provided for. This is one reason many citizen do not
trust the advocates of beach restoration.
It should be established as soon as possible, before any commitment or spending of
millions of dollars from ANY tax source, on web a controversial issue, that the public
be informed - again , and a referendum on the issue be held.
And why should the advocates fear a referendum. Do their homework and sell the
community and they might win support Get those needing and potentially benefitting
beach front owner to pay the vast majority of the cent. This basic element has been
fought- behind the scenes for years- by special Interest politicians who have a
commitment to beach front building owners and cane less about the public tax dollars.
10. The Press Journal on Sunday suggested citizens speak out today to make sure that
homeowners are not given the tax burden IF any program In put into efi'ecL I am a
homeowner, I see no reason wiry I should pay one cent toward beach nourishment.
A few days ago the Hospital District unanimously voted to ask for a binding referendum
on the hospital issue. I feel this commission should assure all homeowners before they
commit that a county wide referendum will be held on such_a major controversial
project if pushed further.
Yes a referendum must include the beachfront owners who may be assessed. and also
all taxpayers that will pay any share whatsoever. Frank L. Zorc
Bea Gardner advised that she was not comfortable with the fact that properties had
been specified in the resolution and thought they should be deleted before adopting the
resolution.
County Attorney Vitunac stated that the statute requires that the legal description of
the properties to be assessed be included in the resolution.
Ralph Sexton, speaking as president of and representing 900 members of Save Our
Shores, urged the Board to adopt the resolution as a very necessary step in getting a funding
formula adopted and as a means for financing beach restoration.
City of Vero Beach Mayor Carl Pease agreed with many of Mr. Zorc's points. He

also wanted the Board to hold a referendum for the people who have to pay the tax.
In response to questions of Commissioner Ginn, Mr. Tabar explained how oceanfront
properties owned by the Federal and State governments will pay, as well as privately owned
properties. Mr. Tabar specified that staff has been working with the State of Florida and they
have earmarked in excess of $10 million (over the next 10 years) to contribute to our beach
preservation plan. Additional information will be forthcoming with the funding
presentations.
Mr. Legwen requested clarification on the remarks of Mr. Tabar above, and Mr.
Tabar clarified for him and Commissioner Adams added that all that information will be
enumerated in the presentation of the financial information at a future meeting.

Mr. Coffey suggested two workshops be held to inform the public and to get their
Mr. Zorc urged that a referendum of the entire county electorate should be held, not
just those oceanfront property owners.
It was determined that no one else wished to be heard and the Chairman closed the
public hearing.
MOTION WAS MADE by Commissioner Adams, SECONDED
BY Commissioner Stanbridge, to adopt the resolution.
Under discussion, Commissioner Ginn believed that it was in the best interest of all
the residents of Indian River County that the beaches be preserved. Because of the beach
erosion, "the property owners are almost begging for help." She was in favor of moving
ahead, and did not want to hold back, but she was concerned that Applied Technologies had
not met their deadlines under the contract terms, therefore the Board was hurried and the
public was not completely informed. She questioned Mr. Tabar about the timetable of the
financials.
W. Tabar responded that staff was presently reviewing the second draft on the
financials and expected the information would go for public hearings in January.

Commissioner Adams wished to clarify that the County was probably responsible for
the delay on ATM's work because of additional reviews and changes we requested in an
attempt to cover everything.
Commissioner Ginn was concerned that perhaps the County was relying on tourist tax
dollars and pointed out that these dollars are already earmarked and cannot be spent twice.
She was also concerned if people would be allowed time to pay off the assessments and
County Attorney Vitunac explained this assessment could be done exactly the way the water
and sewer projects were done with time payments.
Commissioner Ginn then questioned Ms. Delegal on the provisions of the charter of
the City of Vero Beach concerning sand pumping and a required referendum, and Ms.
Delegal stated in the context of that questioning and cross -comments that "this is not tax
money" as specified under the City's charter.
Commissioner Ginn was reluctant to start the process without all the information, but
on the other hand the beaches were eroding and the people are desperate for help. She felt
it was in the best interest of all, but would still prefer the March 1 deadline so the public can
have greater information and do not think the Board is "trying to put something over on
them", which she has heard.
Commissioner Adams reminded everyone that the process was started when the Board
initiated the Beach Preservation Plan and the update and accepted it. That identified the
problem areas and now we are getting into the cost benefit analysis and other matters which
come with all major projects.
Commissioner Ginn recalled that Mr. Tabar had reported to the South Beach Property
Owners Association and the plan has also been well -aired in the public domain.
Vice Chairman Macht pointed out to Commissioner Ginn that she had talked herself
into and out of all the problems.
Commissioner Ginn thought it important that the Board think it through and admitted
she was thinking it through on her feet this morning. She felt that Mr. Nolte had pointed out
valid reasons why he could not meet the March 1 deadline. She was ready to vote.

The Chairman CALLED THE QUESTION and the motion
carried unanimously. (Resolution No. 98-147 adopted, as
amended, electing to use the Uniform Method of Collecting
non -ad valorem special assessments levied against certain
property located along the Atlantic Ocean in Indian River
County; stating the need for such levy; providing for the mailing
of this resolution; and providing for an effective date.
Upon County Attorney Vitunac's inquiry concerning funding Property Appraiser
David Nolte's computer programming modification, the consensus of the Board was that Mr.
Nolte have a more thorough study of the cost and that could be handled in the future.
Commissioner Ginn asked if the Board had obligated itself to a workshop on this
matter and Chairman Tippin replied that he had said "it sounded like a nice idea".

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY,
FLORIDA ELECTING TO USE THE UNIFORM METHOD
OF COLLECTING NON -AD VALOREM SPECIAL
ASSESSMENTS LEVIED AGAINST CERTAIN PROPERTY
LOCATED ALONG THE ATLANTIC OCEAN IN INDIAN
RIVER COUNTY; STATING A NEED FOR SUCH LEVY;
PROVIDING FOR THE MAILING OF THIS RESOLUTION;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners (the "Board") of Indian River
County, Florida (the "County") is contemplating the imposition of non -ad valorem special
assessments in coastal areas of Indian River County (including both incorporated and
unincorporated areas) to fund the storm protection benefits provided by the County's
proposed beach nourishment program; and
WHEREAS, the Board intends to use the uniform method for collecting non -ad
valorem special assessments, as authorized by section 197.3632, Florida Statutes, as
amended, to fund the storm protection benefits provided by the County's proposed beach
nourishment program because the uniform method will allow such special assessments to be
collected annually commencing with the ad valorem tax bill to be mailed in November 1999,
in the same manner as provided for ad valorem taxes; and
WHEREAS, the Board held a duly advertised public hearing prior to the adoption
of this Resolution, proof of publication of such hearing being attached hereto as Appendix
B;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMIVHSSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AS FOLLOWS:

SECTION 1. STATEMENT OF INTENT. Commencing with the Fiscal
Year beginning on October 1, 1999, and with the tax statement mailed for such Fiscal Year,
the County may intend to use the uniform method of collecting non -ad valorem assessments
authorized in section 197.3632, Florida Statutes, as amended, for collecting non -ad valorem
assessments over a term of years to fund the cost of storm protection benefits provided by . .
the County's proposed beach nourishment program. If such method is used, such non -ad
valorem assessments may be levied against certain property located along the Atlantic Ocean
in Indian River County (including both incorporated and unincorporated areas), as more
specifically described in Appendix A.
SECTION 2. STATEMENT OF NECESSITY. The County hereby
determines that the levy of the assessments is needed to fund the cost of storm protection
benefits provided by the County's proposed beach nourishment program.
SECTION 3. DELIVERY OF COPIES. Upon adoption, the Clerk of the
Circuit Court is hereby directed to send a copy of this Resolution by United States mail to
the Florida Department of Revenue, the Indian River County Tax Collector, and the Indian
River County Property Appraiser by January 10, 1999.
SECTION 4. EFFECTIVE DATE. This Resolution shall be effective upon
adoption.

On October W, 1990, the Indian River County Board of County Commissioners entered into a Lease
Agreement with BellSouth Mobility, Inc., for ground space at 3955 651h Street, Vero Beach, Florida,
for BellSouth to construct a communications tower and building to house communications equipment.
Section 17 of the referenced Agreement provides that the lease may not be sold, subleased, assigned,
or transferred without the written consent of the County. BellSouth has submitted a Site Sublease for
the County's review and consent wherein Nextel South Corporation plans to co -locate on the BellSouth
Tower and place associated equipment within the existing BellSouth fenced enclosure ground space
site.
Consistent with past practices, staffhas negotiated a benefit for the County wherein a one time payment
of $10,000 will be paid to the County by Nextel South Corporation and BellSouth will pay $666.67
monthly rental payments ( $8,000.04 annually) to the County for the County's consent to use the ground
space. The monthly rent will be increased on the first day of each renewal term under the above
referenced Site Sublease by an amount equal to twenty (20) percent of the rent for the previous term.

completed within 90 days). Because the bids were over budget, and Southern Petroleum
Systems was already under contract with the County to do the Fleet Management Fueling
Compound, Southern Petroleum has agreed to do the Sheriff's complex work for a price not
to exceed $88,000 and will be able to complete both jobs within the FDEP required deadline.
Commissioner Adams asked how long the County has known about the December 31
deadline, and Director Dean responded that staff had been working on this for five months
and gave assurances that Southern Petroleum could complete the work within the allotted
time requirement.

BACKGROUND AND ANALYSIS
The Indian River County Board of County Commissioners approved within the 1998-
1999 fiscal year budget the appropriation of fimds for the purchase of a biofiltration unit
in the amount of $20,000.00 for the elimination of odor in response to problems and
complaints (see attached budget appropriation).
The Department is presently operating two biofiltration units—one is located at Lift
Station 200 (Bailey Drive, Sebastian) and the other is Lift Station 143 (Vero Shores, Vero
Beach). Both units have been successful in correcting most odor problems and
complaints at these locations.
Presently, it is recommended that the budgeted funds be utilized for a biofiltration unit at
Repump Lift Station No. 166 (State Road 512 and Fleming Street in Sebastian), where
high levels of hydrogen sulfide gas are creating an odor problem. The proposed price of
the unit and all associated costs for delivery are $19,238.00 (purchase price of
$17,438.00, plus $1,800.00 freight). EG&G Biofiltration is the only company producing
this complete filter system. Due to its being a sole -source item, and as it is the
Department's intent to standardize equipment, staff is seeking approval from the Board
for this sole -source purchase. Please see the attached quotation and specification for the
proposed purchase.
RECOMMENDATION
The staff of the Department of Utility Services recommends that the Board of County
Commissioners approve the purchase of the biofiltration unit from EG&G Biofiltration in
the amount of $19,238.00 for Repump Lift Station 166 on State Road 512 and Fleming
Street in Sebastian.
In response to Commissioner Adams inquiry, Director Don Hubbs advised that the
associated costs for delivery and purchase were $19,23 8; Utilities Department Operations
Manager Gene A. Rauth advised that installation will be done in-house.

SUBJECT: UTILITY CHLORINATION SYSTEM HViPROVEMENTS
BACKGROLTNn
As part of Congress's efforts to protect public health and the environment, it enacted legislation
in 1990 that would provide significant protection in the event of an accidental release of a
hazardous substance. When this legislation was signed into law by President Bush on November
15, 1990, as the Clean Air Act Amendments, it included provisions for regulations to be issued
by the Environmental Protection Agency (EPA) to provide this protection. In separate
regulations promulgated on January 31, 1994, and on June 20, 1996, EPA created the Accidental
Release Prevention (ARP) program. These regulations require that all facilities affected by the
ARP program prepare and submit a Risk Management Plan (RMP) no later than June 21, 1999,
which documents the hazard assessment, prevention program, and emergency response program
necessary to protect public health and the environment in the event of a catastrophic release of
some 140 regulated substances including chlorine.
Six (6) County facilities (2 water, 4 wastewater) exceed the 2,500 LB threshold set by EPA for
chlorine, which is used for disinfection purposes and require submittal of risk management plans
for each. To comply with and implement the ARP program the County has assembled a team
composed of utility, risk management and emergency management staff which will meet
biweekly to prepare and file the necessary information prior to the deadline. While the submittal
of the information/plan is required by EPA, the threat of accidental release of chlorine is still
present. The Department of Utility Services has established a goal of eliminating the potential
threat of accidental chlorine release, beginning with the on-site sodium hypochlorite generation
system, being constructed as part of the nearly $12 million Central Region Wastewater
Treatment Facility expansion project.
Alternative disinfection systems and/or potential safety measures, which are available, include
emergency chlorine scrubber systems, on-site sodium hypochlorite generation and bulk
commercial grade (10-12%) sodium hypochlorite. Emergency chlorine scrubbers activate when
a chlorine leak is detected and absorbs or neutralizes the gas. Sodium hypochlorite, not
considered hazardous, is a safer means of disinfection but requires additional electrical power.
Many municipalities are now converting their smaller- sized disinfection systems to sodium
hypochlorite.

The County Utility staff anticipated that regulations were forthcoming during the design of the
Central Region expansion, now under construction. A twenty (20) year present worth analysis
demonstrated that the cost of an onsite sodium hypochlorite generation system was
approximately equal to the scrubbed gas chlorine system. When Central Region is completed,
the onsite system will effectively eliminate the chance of an accidental chlorine release, thus
Providing increased safety to the surrounding residents.
Beginning November 30, 1998, a four-day pilot project was conducted to determine the
suitability of a particular type of on-site generation system, new to the market supplied by E.K.
Phelps. The results were encouraging and the Department of Utility Services' staff is pursuing a
lease/purchase agreement with the supplier to be brought back to the Board for consideration.
The North Beach Reverse Osmosis Plant conversion project will also, likewise, incorporate an
on-site chlorine generation system. Bids for this project were opened on December 10, 1998.
As stated earlier, risk management plans and accidental release prevention programs are required
to be submitted to EPA by June 21, 1999. Since some County facilities are located in or near
residential areas or schools, the County may want to consider further conversion to alternative
systems as part of the plans. Such conversions, if promptly executed, can reduce the RMP scope
significantly. Preliminary Task Team suggestions are as follows:
1. Fast-track the lease/purchase of on-site generation units for up to three wastewater
treatment facilities, utilizing, in part, deduct change order monies made available through
Change Order No. 3, approved by the Board of County Commissioners on August 25,
1998. (Please see attached copy of agenda item and minutes).
2. Develop a work authorization with the County's waxer consultant, Camp Dresser and
McKee, Inc., to provide Consulting Services on an as -needed basis, for analysis of
alternative disinfection systems or potential safety measures, to be brought back to the
Board for consideration.
The County's Emergency Management Services Department has reviewed and concurs with the
Task Team approach. (Please see the copy of memorandum dated December 4, 1998).
The staff of the Department of Utility Services recommends that the Board of County
Commissioners approve the task -team's preliminary recommendations and allow staff to fast-
track the RMP development, returning to the Board with the appropriate work authorizations and
agreements.

In response to Commissioner Adams' inquiry, Utilities Department Director Don
Hubbs explained some of the history behind the EPA requirements, and stressed that they
are custom designed and site specific, so each of the 6 sites will have its own requirements.
He explained that a 6 -member task team had been assembled to study each site and he gave
assurances the June deadline would be met. The goal is to not only meet the EPA
requirements but permanently eliminate the chances of a chlorine leak throughout the
county's facilities by eliminating the gas chlorine.
Commissioner Adams endorsed the plan and liked the task team approach being used
to study the issue. She asked if they had any idea of the cost.
Administrator Chandler believed that each site will be brought to the Board for
approval.
Director Hubbs advised that Camp Dresser and McKee had given a cost of $340,000
for one unit. He hoped that by considering this as a whole package, we should be getting
better unit prices.
ON MOTION by Commissioner Adams, SECONDED BY
Commissioner Ginn, the Board unanimously approved the Task
Team's preliminary recommendations (as set out in the
Memorandum) and authorized staff to fast-track the Risk
Management Plan development and return to the Board with the
appropriate work authorizations and agreements, as
recommended in the Memorandum.

BACKGROUND
In December 1997, the Board of County Commissioners approved the negotiations with the City of
Palm Bay for surplus water plant equipment from the decommmoned North Beach R.O. Plant.
(Please reference the attached agenda item and minurteS). The Utilities Dem has completed
negotiations with Palm Bay. The City Council has approved the enclosed agreement for purchase and
Utility staff is now seeking Commmon approval to complete the sale. To facAftte a smooth
dismantling of the water plant ffip 4mint, staff is also requesting approval of Work Authorization
Amendment No. 1 with Camp Drier and McKee, Inc. (CDM) for additional services not originally
covered in the Am 3, 1997 Work Authorization. Additional services include review of demolition
coordination and documentation oversight, additional plans and specifications preparation
required to direct Contractor of proper salvage of equipment to prepare for pick-up by palm Bay.
(Please reference attached agenda items of May 13" and June 3rd, 1997, minutes and copy of Work
Authorization Amender No. 1).
ANALYSIS
The proposed sale price to the City of Palm Bay is in the amount of $285,000.00 and is detailed on the
attached agreement for review and execution. The original estimated � cost is appro�dmately
$900,000.00. The proposed sale price equates to a recovery of approximately $.32 cents on the
dollar. Typical bid sales of such equipment range from $.05-.20 cents on the dollar, therefore, the staff
of the Utilities Depart is satisfied with the negotiated sales price. The proposed additional
services for CDM Work Authorimion Amendment No. 1 amount to $18,000.00, (see attached
amendment for details) which reduces the net sale amount to $267,000.00, still above the figure used m
the attached financial analysis of $250,000.00. Funding for this project will be from Account No.
475-000-169-31200.
RECOMMENDATION
The staff of the Departmetrt of Utility Services recommends that the Board of County Commissioners
approve and execute the proposed Agreement with the City of Palm Bay and Amendment No. 1 with
CDM as presented.

of the contract in a satisfactory and timely manner. Staff, therefore, in concurrence with CDM,
recommends award of bid (see attached) to TLC Diversified, Inc.

Director Baird noted that this is just a continuation of the public hearing and it is not
necessary for the Commissioners to be present.
Mr. Heady questioned whether these funds are to provide mortgage money for single-
family homes, and Director Baird explained that Escambia County issues the bonds utilizing
the County's tax-exempt status. These funds are primarily for first-time home buyers at an
interest rate which is lower than the taxable rate. These first-time home buyers may not have
owned a home in the last 3 years. Local banks sign up to become participants in the program
and it is unknown which banks will participate for the coming year. Harbor Federal,
SunTrust and other mortgage companies have participated in the past. St. Lucie County has
a large percentage of people who participate. However, the funds are not limited to low-
income families but can also be utilized for middle-income families.
Mr. Heady then questioned whether participants are required to attend educational
programs sponsored by the County, and Director Baird responded that Mr. Heady was
thinking of the SHIP program. The SHIP program can be utilized along with these tax-
exempt bond funds to assist with the ability to raise downpayment funds. A family of 2 or
fewer is limited to an annual income of $42,900 and a family a 3 or more cannot earn more
than $49,335 annually, in order to participate in the program. These families must also
qualify as first-time home buyers and can purchase new homes costing no more than
$106,366 or existing homes costing no more than $92,600.

Mr. Heady then questioned the total. amount of mortgage money which will be
available here in Indian River County, and Director Baird estimated that it would be 3 to 4
million dollars, depending on the interest in the community and the banks.
Mr. Heady then questioned whether applicants would need to meet general
requirements for mortgages to be sold in the secondary market.
Director Baird advised that this program is very similar to the veterans' mortgage
program. Once the bonds are issued, banks are asked if they are interested in participating
and advertisements are run in the newspapers. He assured Mr. Heady that he would be glad
to put him on the County's mailing list and make sure everyone keeps in touch with him.
Mr. Heady noted that, as a general rule, he was not in favor of so-called "affordable
housing". He believed that if the same amount of time and energy were spent providing
high-income jobs, the need for affordable housing would not exist. He felt that whenever
government becomes involved, the cost is passed on to the taxpayer.
Mr. Heady asked what the interest rate would be, and Director Baird responded that
it is usually 75 basis points lower than the general market. This is not a subsidy, just an
allowable use of the County's tax-exempt status.
There being no one else who wished to speak regarding this matter, Director Baird
closed the public hearing at 9:13 a.m.
