REGULAR MEETING OF THE BOARD OF COUNTY
COMMISSIONERS
The Board of County Commissioners of Indian River County, Florida, met in Regular
Session at the County Commission Chambers, 1840 25'b Street, Vero Beach, Florida, on
Tuesday, January 5, 1999, at 9:00 a.m. Present were John W. Tippin, Chairman; Kenneth
R. Macht, Vice Chairman; Fran B. Adams; Caroline D. Ginn; and Ruth Stanbridge. Also
present were James E. Chandler, County Administrator; Charles P. Vitunac, County
Attorney; and Patricia "PT' Jones, Deputy Clerk.
1. CALL TO ORDER
Chairman Tippin called the meeting to order.
2.A. INVOCATION
Mrs. June C. Parsons, First Church of Christ Scientist, delivered the Invocation.
2.11. PLEDGE OF ALLEGIANCE
Commissioner Stanbridge led the Pledge of Allegiance to the Flag.
3.A. ELECTION OF CHAIRMAN
The Chairman opened the floor to nominations for Chairman of the Board of County
Commissioners for 1999.

Macht, SECONDED by Commissioner Stanbridge.
There were no other nominations.

The Chairman directed the Clerk to cast a
UNANIMOUS BALLOT for Commissioner Kenneth
R. Macht for Chairman of the Board of County
Commissioners for 1999.
Commissioner Tippin passed the gavel to Chairman Macht, who assumed the chair.
3.B. ELECTION OF VICE CHAIRMAN
The Chairman opened the floor to nominations for Vice Chairman of the Board of
County Commissioners for 1999.
Commissioner Stanbridge NOMINATED
Commissioner Adams, SECONDED by
Commissioner Tippin.
There were no other nominations.
Commissioner Ginn asked whether it were the intent of the Board to bypass District
5 in the rotation as it was her understanding that the Chair moves through rotation.
County Attorney Charles Vitunac noted that there is no official policy. The Chair and
Vice Chair are elected strictly by motion of the Board.
Commissioner Ginn just wanted to be certain that District 5 was not being ignored.
The Chairman directed the Clerk to cast a
UNANIMOUS BALLOT for Commissioner Adams
as Vice Chairman of the Board of County
Commissioners for 1999.
4. ADDITIONS TO THE AGENDA
Chairman Macht requested the following additions and changes to today's Agenda:
1. Add Item 13.B., motion of appreciation to Chairman John Tippin.
2. Add Item 13.C., Department of Environmental Protection Park Patrol high-
speed chases in Indian River County.

The Chairman asked if there were any corrections or additions to the Minutes of the
Regular Meeting of December 15, 1998. There were none.

unanimously approved the Minutes of the Regular
Meeting of December 15, 1998, as written.

Chairman Macht commented on the hefty payments to psychologists for evaluations.
He understood that these payments are approved by circuit judges and there is no appeal.
He suggested that perhaps this should be brought to the attention of the legislature in an
attempt to gain more control.
Commissioner Adams felt that the matter should be uiscussed with the judiciary prior
to going to the legislature.
Assistant County Attorney Terry O'Brien noted that these are evaluations done in
criminal cases to determine whether or not the defendant is competent to stand trial. At the
rate of $200 per hour, the fees add up quickly. They run a whole series of tests on each
individual.

Commissioner Tippin believed it would be worth looking into and stated that he
would feel more comfortable with a little more "say-so".
Chairman Macht felt that it was dead wrong that there was no appeal procedure.

Sand Mine
Indian River County approved a sand mine operation for Atlantic Coast
Enterprises, Inc. in the unincorporated area of Sebastian. The mine is being
developed in phases. The developer has transferred a $32,700.00 performance
bond to guarantee compliance with the site plan and restoration of the site from
Phase I to Phase III as permitted by the Code. (A separate cash bond secures
Phase II compliance and restoration.)
Because the mine area of Phase III is 2.3 acres larger than Phase 1, additional
security for compliance and restoration in the amount of $2,300.00 is required by
Code.
Attached is a Cash Deposit and Escrow Agreement with respect to the sand
mine as supplemental security for Phase III.
RECOMMENDATION:
Authorize the Chairman to execute the Cash Deposit and Escrow Agreement
SP -MA -95-04-17 for Phase III supplemental security.

in Criminal Cases
The Board of County Commissioners at its April 21, 1998 meeting authorized
staff to look into the subject matter and issue an RFP. Meetings were held with
the County Judges and an RFP was prepared and circulated for comment.
During this process Chief Judge Kanarek brought to my attention the existence of
a "Municipal Services Bureau" (MSB) which provides this service to local
governments.
I have been in contact with MSB and have received information and a proposed
contract from them. A list of Florida entities served by MSB is attached for your
information.
A contract for these services with MSB is also attached. Contracting with MSB
does not require any out of poukct expenses by rine Counq. MS£'s compensation
comes from the statutorily allowed added fee to the amount owed.
In view of the extensive use of MSB by Florida entities it appears that MSB
should be selected without an RFP procedure. In addition, the contract is easily
terminated if the County is not satisfied with the results obtained by MSB.
Accordingly, it is recommended that the Board of County Commissioners
authorize the Chairman to execute the contract on behalf of the Board of County
Commissioners.

Commissioner Adams noted that the contract calls for a corporate seal and questioned
whether the County is actually planting the small material. She wanted to know whether
enough staff were available.
Project Engineer Sean McGuire stated that the Parks Department staff will plant the
small material and they have personnel available.
Commissioner Tippin commented that planting is more involved thanjust digging a

This price per acre is based on the price paid by the church for the property, and is in line
with other similar A-1 right-of-way parcels the County has purchased within the market
area.
The contrail price is $5,781.00 based upon a total area of .37 acre as determined by the
legal description. There are no appraisal or attorney fees.

Contract

As previously approved by the Board on September 22, 1998, staff has negotiated the attached
design/build contract with the first ranked firm, Barth Construction, Inc. of Vero Beach, Florida.
Design/Build Contracts are structured in phases, with the first phase being the development of a
preliminary designpackage and development of a guaranteedmaximumprice (GMP) for final design
services and construction. After Phase I is complete at a proposed cost to the county of $ 30,000,
an amendment to the contract will be prepared to authorize final design and construction, establish
the GMP, and designate a completion date.
ALTERNATIVES AND ANALYSIS
The DesigwBuilder has prepared a tentative budget for the 20,000 square feet building of $652,540.
This price does not include air conditioning (an additional $233,000 for a chiller A/C system or
$151,000 for a DX type system), restrooms ($65,530), hardened structure for Emergency
Management use ($182,820), nor interior office/storage ($84,448). The rough plumbing will be
installed for future restrooms and rough electrical will be added for future A/C and heating. The
County Road and Bridge Division will construct all sitework and drainage. The cost of an air-
conditioned, hardened structure usable by Emergency Management with complete rooms and
office would cost $1,218,388.
The County has received two grants from the State of Florida totaling $359,000. To find the basic
$652,540 building, additional county or state finding of $293,540 is required. Prior to issuing the
request for proposals, staff contacted a local building contractor that routinely constructs
prefabricated metal buildings. At that time, a budget of $450,000 was established.

The following alternatives are proposed:
Alternative No. 1
Approve the attached Design/Build Contract with Barth Construction to initiate preliminary design
of a basic exhibit building without A/C, restrooms, hardening for EMS Shelter and offices. The
preliminary budget would be $652,540.
Alternative No. 2
Revise the attached DesignBuild Contract with Barth Construction to include A/C, complete
restrooms, hardening for EMS, and offices at a total budget of $1,218,338, or add some of the above
components for the prices previously mentioned.

Reject the attached contract and cease negotiations with Barth Construction, Inc. Begin contract
negotiations with the only other fum that submitted a proposal, Mach III Design -Build of
Melbourne, Florida This alternative may or may not result in a lesser cost.

Commissioner Adams questioned the alternatives and wanted to make certain that we
do not ask the Legislature for more money as they have been very gracious to us. She noted
that the costs are now 50% above what we had hoped. We just need an enclosed exhibit
space. She supported the move forward with Barth but felt the cost could be reduced by
getting down to a very simple exhibit building.
Public Works Director Jim Davis responded that basically the building as proposed
is a bare -bones building which is expandable. It does include masonry walls 8 feet in height
but offices and restrooms have been eliminated. It will just be a shell building and $600,000
is the best they can do.
Commissioner Stanbridge questioned whether the plans call for additional buildings
to be connected to this one, and Director Davis explained that this building can be expanded.
There is a master plan for the fairgrounds which includes other buildings but this one will
stand alone.
Chairman Macht noted that the cost is offset by a $390,000 grant.

Construction of the project has been completed. Customer connections have begun, and we
request the Board of County Commissioners' approval of the final assessment roll. (See attached
minutes and Resolution III).
The preliminary assessment was for a total estimated cost to be assessed of $62,975.00 which
equated to $0.095311 per square foot of property owned. The final assessment (see attached
Resolution IV and the accompanying assessment roll) is in the amount of $59,869.20, which
equates to a cost of $0.090610 (rounded) per square foot of property. This is a project cost and
assessment reduction of .0493%.

time and place the owners of property to be assessed appeared before the Board to be heard
as to the propriety and advisability of making such improvements; and
WHEREAS, after such public hearing was held the County Commission adopted
Resolution No. 97-137, which confirmed the special assessment cost of the project to the
property specially benefited by the project in the amounts listed in the attachment to that
resolution; and
WHEREAS, the Director of Utility Services has certified the actual "as -built" cost now
that the project has been completed is less than in confirming Resolution No. 97-137,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows:
1. Resolution No. 97-137 is modified as follows: The completion date for the referenced
project and the last day that payment may be made avoiding interest and penalty charges is
ninety days after passage of this resolution.
2. Payments bearing interest at the rate of 7.75% per annum may be made in ten annual
installments, the first to be made twelve months from the due date. The due date is ninety
days after the passage of this resolution.

3. The final assessment roll for the project listed In Resolution No. 97-137 shall be as shown
on the attached Exhibit "A."
4. The assessments, as shown on the attached Exhibit "A," shall stand confirmed, and will

5. The assessments shown on Exhibit "A," attached to Resolution No. 97-137, were recorded
by the County on the public records of Indian River County, and the lien shall remain prima
facie evidence of its validity.

This past week our County (Indian River) experienced not one but two high-speed
chases through our streets by the DEP Park Patrol. The first chase was initiated six
miles from the park boundaries by a deputy who observed a truck run a stop sign.
The chase proceeded at 100 m.p.h. speeds and terminated in a crash. Fortunately,
no innocents were injured or killed.
Our County has experienced tragic high-speed chases, and currently has very strict
policies and oversight on such pursuits. Should your Park Patrol have so little to do
that they can cruise our County roads looking for traffic violations, then we suggest
that the State would be best served to grant capital monies and personnel to train
and assist the local law enforcement agencies.

The fact that this Patrol is unable to communicate by radio with any of our local law
enforcement or emergency services agencies is reason enough to restrict the
authority of these poorly equipped and under -trained personnel. Our Sheriff's
Department is more than capable of handling minor traffic infractions. The only role
your Deputy should play, without the request of our local law enforcement agency,
is to report the infractions to the proper local authority.
When the Park Police were added to the budget a few years ago, we were assured
that their mission was to provide security in the State Parks. If their mission is now
expanding beyond the State Parks, perhaps they need to be under the Highway
Patrol where they can truly make a difference and be properly trained and controlled.
We call attention to your Strategic Plan, which focuses on stewardship, citizen
involvement and cooperative partnerships. Let's do.
Enclosed are two newspaper articles regarding the incidents. Any pursuit in our
County must be coordinated with the local law enforcement agency. We will not
stand by idly and see another innocent life lost in our County, due to some Deputy's
ill-timed and unnecessary pursuit. PLEASE DO NOT PUT OUR CITIZENS IN
JEOPARDY.

cer from Brevard County 16 miles .

County Jail with $500 bail.
Piorkowski was trailed into
Vero Beach after the state park of-
ficer allegedly clocked him at 9:41
p m.driving past Sebastian Inlet
State Park at 69 mph, 24 mph over
the speed limit. The officer tried to
stop the Winter Park man repeat-
edly, first with his emergency,

during which Piorkowski remained

at 9:58 p.m. near East Causeway

Commissioner Adams noted that the officers involved had no coordination with local
authorities and she believed the chases were very callous, especially considering the minor
infractions that occurred. She asked for authorization for the Chairman to execute the letter.

Commissioner Ginn asked that Connie Gates be appointed to the Board of Zoning
Adjustments for District 5.
Commissioner Adams questioned whether the vacancies on the MPO Technical
Advisory Committee and the MPO Bike Path Committee were City appointments, and
Executive Aide Alice White stated those are handled by the Planning Department. She will
research the appointments and advise.
Commissioner Adams asked that the Chair of the Historic Resources Advisory
Committee and the Indian River Lagoon Estuary Committee be transferred to Commissioner
Stanbridge as she felt her experience would bring a lot to those committees.
Commissioner Adams then asked that Tom Lowther and George Bunnell be appointed
to the Beach a& Shore Preservation Advisory Committee to replace Art Neuberger and Julie
Lier.
Commissioner Adams also asked for nominations to the Code Enforcement business
vacancy.
