REGULAR MEETING OF THE BOARD OF COUNTY
COMMISSIONERS
The Board of County Commissioners of Indian River County, Florida, met in Regular
Session at the County Commission Chambers, 1840 25' Street, Vero Beach, Florida, on
Tuesday, June 15, 1999, at 9:00 a.m. Present were Kenneth R. Macht, Chairman; Fran B.
Adams, Vice Chairman; John W. Tippin; Caroline D. Grin; and Ruth Stanbridge. Also
present were James E. Chandler, County Administrator; Charles P. Vitunac, County
Attorney; and Patricia "PT' Jones, Deputy Clerk.
1. CALL TO ORDER
Chairman Macht called the meeting to order.
2. INVOCATION
Commissioner Tippin delivered the Invocation.
3. PLEDGE OF ALLEGIANCE
Commissioner Adams led the Pledge of Allegiance to the Flag.
4. ADDITIONS TO THE AGENDA
County Administrator Chandler requested the deletion of Item 9.B., Lewis Barton
request for Emergency Permit :for Seawall.
Vice Chairman Adams requested the addition of Item 13.B.1., an update on the
Aquaculture Use Zone.
Vice Chairman Adams requested the addition of Item 13.B.2., an update on the
Scenic Highways Program.

SUBJECT: M/W LTD's Request for Final PD Plat/Plan Approval for a Commercial
Planned Development to be Known as Magi Mini Storage
It is requested that the information provided herein be given formal consideration by the Board of
County Commissioners at its meeting of June 1.5, 1999.
Magi Mini Storage is a plat of a 4.76 acre parcel located on the south side of SR 60. The plat will
establish a commercial development tract, a stormwater management tract, and utility easements.
Construction of the commercial buildings (mini -storage, accessory office, accessory manager's
residence) was approved through the preliminary PD process. As a PD, the site must be platted prior
to the issuance of a Certificate of Occupancy (C.O.) for any portion of the project.

On May 14, 1998, the Planning and Zoning Commission granted preliminary PD plat/plan approval
to construct the mini -storage facility. The applicant subsequently obtained site plan release and
commenced construction of the improvements. The owner WW LTD, through its agent, Kimley
Hom & Associates, Inc., is now requesting final plat/plan approval and has submitted the following:
A PD final plat/plan in conformance with the approved preliminary PD plat/plan.
All required improvements necessary to serve the buildings have been approved and are controlled
through the preliminary PD plat/plan process. All required improvements will be provided by the
developer prior to the issuance of a Certificate of Occupancy for any building . All applicable
requirements regarding final PD plat/plan approval have been met. There are no publically dedicated
improvements to be constricted as part of this plat. Therefore, no guarantees of publically dedicated
improvements are required at this time.
Based on the analysis, staff recommends that the Board of County Commissioners grant final
approval for the Magi Mini Storage final PD phWplan.

On December 1, 1998, the Board of County Commissioners authorized community development
staff to apply for a Neighborhood Revitalization Community Development Block Grant (CDBG)
and to initiate the process to select a consultant to prepare the CDBG application and administer the
grant, if the grant is awarded.
On February 23, 1999, the Board of County Commissioners approved the county's CDBG consultant
selection committee's consultant selection prioritization list and authorized staff to begin contract
negotiations with the number one ranked firm, CRA Consulting, Inc..
Since then, staff has successfully negotiated a contract for planning application and administration
services with the top-ranked firm, CRA Consulting, Inc.. The proposed contracts are attached to this
staff report (Attachment 1 and Attachment 2). If the grant is awarded to the county, CRA
Consulting, Inc. will receive 8.0% of the grant funds for administration services. The grant
application will be prepared by CRA Consulting, Inc. for $10.00.
Due to the complexity of the CDBG program, obtaining a consultant to prepare the grant application
and administer the grant has become the norm for many local governments. As a result of that norm
and the requirements of the Department of Community Affairs, the contracts between CDBG
consultants and local governments have become standard documents. In fact, the contracts attached
to this staff report are similar to the approved consultant contracts for the county's previous CDBG
project that was undertaken in Wabasso.
Both contracts, one for preparation of a Neighborhood Revitalization CDBG application and one for
administration of the grant, have been reviewed by the county's attorneys. Based on the attorneys'
review, revisions were made to the contract. One such revision was to add a nominal dollar amount
to the cost of preparation of the CDBG application. Adding a nominal dollar amount of $10.00
indicates that the consultant has an interest in the successful execution of the planning services
contract. Normally, no fee is charged by CDBG consultants for preparation of a CDBG application,
provided that the same firm is retained to administer the grant, if the grant is awarded.
Administration costs will be paid with grant funds.
Staff recommends that the Board of County Commissioners:
approve the proposed contract between the Board of County Commissioners and CRA
Consulting, Inc. for the preparation of a Neighborhood Revitalization CDBG application and
for administration of that grant if the grant is awarded; and
authorize the Chairman to execute the contract upon approval.

DESCRIPTION AND CONDMONS
It is required, as part of the Transportation Disadvantaged (TD) Planning Grant contract between the
Indian River County Board of County Commissioners (BCC) as the Designated Official Planning
Agency (DOPA) and the State of Florida Commission for the Transportation Disadvantaged (CTD),
that periodic progress reports and reimbursement invoices be submitted To comply with the CTD's
requirements, staff has prepared a progress report and invoice for the period from January 1, 1999
to March 31, 1999.
JUNE 159 1999
For the 1999 planning grant period, the invoice and progress report represent the first submittal. This
progress report and applicable finished products, such as the Local Coordinating Board (LCB)
meeting agenda items, CTC reports, etc., are required to accompany all reimbursement invoices.
On May 27, 1999, the Transportation Disadvantaged Local Coordinating Board (TDLCB) reviewed
and approved the attached progress report and invoice. At that time, the TDLCB recommended that
the Board of County Commissioners, in its capacity as the Transportation Disadvantaged Program
Designated Official Planning Agency (DOPA), approve the attached progress report and invoice and
forward these to the CTD.
ALTERNATIVES AND ANALYSIS
Attached is a copy of the progress report and invoice for the January 1, 1999 to March 31, 1999
period
Finished products such as TDLCB meeting agenda items, CTC reports, and other pertinent reports
are required to accompany all reimbursement invoices. These materials will be submitted to the state
along with the reimbursement invoice and the progress report.
The BCC/DOPA's alternatives are either to approve the transmittal of the Progress Report and
reimbursement invoice as submitted, to approve transmittal of the Progress Report and invoice with
revisions, or to deny the transmittal of the Progress Report and reimbursement invoice to the state.
Choosing the last alternative could affect the county's reimbursement of staff time expended for
transportation disadvantaged planning related services.
RECOMMENDATION
The TDLCB and the staff recommend that the Board of County Commissioners/DOPA approve
Progress Report and reimbursement invoice #1, and direct staff to transmit the report and the invoice
to the State of Florida Commission for the Transportation Disadvantaged (CTD).

DESCRIPTION AND CONDITIONS
As mandated by the U.S. Constitution, the United States Census Bureau is required to take a census
every ten years. The Year 2000 census count is scheduled for April 1, 2000. Since the total count
will affect the amount of federal and state funds that local governments may receive over the next
ten years, and also affect future redistricting and representation at the state and federal government
levels, it is important for each local government to ensure that every resident of its community is
counted.
To encourage all residents to participate in the Census 2000 count and return their completed
applications, the Bureau of the Census recommends that each local government establish a complete
count committee.
Complete Count Committee
A Complete Count Committee is a major vehicle for planning and implementing local, targeted
efforts that will uniquely address the special characteristics of a community.
The role of the Complete Count Committee will be to plan and implement a locally -based promotion
to publicize the importance of Census 2000. The ultimate goal of the committee is to achieve
widespread participation in the census for the betterment of the county and its residents. The
committee can also provide community benefits beyond the census. According to Census Bureau
recommendations, a local Complete Count Committee should:
• Actively involve leaders from a cross-section of the community, including those segments
of the population which are most difficult to enumerate, in order to stimulate response to the
census.
• Make government employees aware of the census through an internal promotion campaign.
• Localize and augment the various national outreach and publicity projects, activities and
events conducted by the Census Bureau.
• Coordinate local promotional activities with the timing of various Census Bureau field
operations and keep local promotion and participation alive through all phases of the census.
Established by the local elected body, the Complete Count Committee should be comprised of key
influential community leaders, including representatives from government, education, media,
community and religious organizations, and businesses. The Complete Count Committee should
reflect the importance of cooperative efforts between state and local governments, and the Census
Bureau.

o Role of the Local Complete Count Committee
1. Goal of the Complete Count Committee
• Make everyone in the community aware of Census 2000
• Motivate the community to participate by filling out the census form and returning
it immediately.
2. Objectives of the Complete Count Committee
• Develop a local targeted plan of action to support Census 2000 operations, recruiting,
and promotion.
• Use highly visible and well-respected local figures to increase community support
for and response to the census.
• Promote the census to community residents through government departments,
particularly those agencies with extensive public contacts.
• Implement activities that will improve census participation by all residents, especially
undercounted segments of the population.
• Emphasize the Census Bureau's commitment to confidentiality to further increase
participation in the census.
• Augment media programs, publicity, and promotions conducted by the Census
Bureau. -
• Provide local knowledge and intelligence that will assist Census Bureau's operational
activities and programs.
• Support Census Bureau's programs and activities that promote and improve the
census.
• Support Census Bureau's recruitment of employees needed to conduct the census.
o Appointing a Chairperson and Committee Members
The chairperson and members of the committee should be well-respected and influential leaders and
"gatekeepers" from all segments of the community. For example, members should represent
business: labor, local government; homeless, religious and educational organizations; neighborhood
associations; and ethnic and minority organizations. All of the people appointed to the committee
should be willing to invest time, resources, and energy in this project.
o Period of Service
The Complete Count Committee shall serve through June 2000, with the peak impact of the
committee targeted toward April 1, 2000.
ANALYSIS
It is important for the county to ensure that everyone is counted as part of Census 2000. The Bureau
of the Census has scheduled many activities to publicize the importance of the census and to
encourage participation. These activities include advertisements on TV and radio and in
newspapers, as well as awareness programs at schools and others. A local committee can also
enhance the Bureau of the Census' promotional and awareness activities.
As proposed, the activities of this committee will not require any local funding. The Board,
however, could provide funds for local advertisements on TV, radio, or newspapers. In fact, some
local governments choose to spend money promoting participation in the census count, viewing this
money as an investment with the benefit of receiving additional state and federal funds. The
principal purpose of the committee, however, is to encourage local residents to participate in the
census 2000 count through grass roots organizations such as local churches, local businesses and
other similar local organizations.

RECOMMENDATION
Staff recommends that the Board of County Commissioners establish a Complete Count Committee
with the following specifications:
• The local committee should be called "Indian River County Census 2000 Community Action
Committee".
• The committee shall serve until June 2000.
• Committee shall have at least have eleven members, and members should consist of-
- One representative from the Board of County Commissioners
— Five leaders from areas of the county with a high percentage of minorities
*2 from Gifford area
*I from Oslo area
*1 from Wabasso area
* 1 from Fellsmere area
— One -representative from the school board
— One representative from the City of -Vero Beach
— One representative from the City of Sebastian
— One representing local business
— One representing local religious communities
Community Development Director Bob Keating noted that this will be a state-wide
committee and Florida Association of Counties has recommended it be established. He
asked that Kay Clem, Supervisor of Elections, be added as a committee member.
Chairman Macht suggested that representatives of Indian River Shores and the South
Barrier Island be added as representatives for the County's semi-permanent residents.
Commissioner Adams felt that a representative from each municipal government
should be named, as well as a representative from each of the areas considered to be
undercounted.
ON MOTION by Commissioner Adams,
SECONDED by Commissioner Stanbridge, the
Board unanimously established the Indian River
County Census 2000 CommunityAction Committee
to serve until June 2000 as recommended by staff;
with the addition of Kay Clem, Supervisor of

The Agreement states that the Dian River County Department of Utility Services prior to the
expansion of the water system shall provide temporary water service to the Society of St. Pius X by
assessment. They agree to pay all fees required to make this connection. They fi ther agree to
participate in the assessment and to reconnect to this water line as required by the Indian River County
Department ofUtrli'ty Services.
The Dem of Utib y Services recommends that the Board of County Commissioners approve the
attached Agreement with the Society of St. Pius X on the Consent Agenda.

On May 26, 1998, the Board of County Commissioners approved Resolution III, No. 98-59, for the
preliminary assessment roll on the above -referenced project. Construction of the project has been
completed Letters were mailed to property owners notifying them that they could connect to the
system. Customer connections have now begun. We are now requesting the Board's approval of
the final assessment roll. (See attached minutes and Resolution IV).
ANALYSIS
The preliminary assessment was for an estimated cost of $981,641.46, which equated to $0.191713
(rounded) per square foot of property assessed. The final assessment (see attached Resolution IV
and the accompanying assessment roll), is in the amount of $834,107.07, which equates to a cost of
$0.162900 (rounded) per square foot. The final assessment is $.0288 per square foot (15.03%) less
than the preliminary assessment. -
RECOMMENDATION
The staff of the Department of Utility Services recommends that the Board of County
Commissioners approve adoption of Resolution IV, which is attached, and authorize the chairman
to execute same.

(LOCATED WEST OF ROSELAND ROAD AND NORTH OF CR
#512) AND SUCH OTHER CONSTRUCTION NECESSITATED
BY SUCH PROJECT; PROVIDING FOR FORMAL COMPLE-
TION DATE, AND DATE FOR PAYMENT WITHOUT PENALTY
AND INTEREST.
WHEREAS, the Board of County Commissioners of Indian River County determined that
water improvements for properties located within the area of Sebastian Phase INA Water
Expansion are necessary to promote the public welfare of the county; and
WHEREAS, on Tuesday, May 26, 1998, the Board held a public hearing at which time
and place the owners of property to be assessed appeared before the Board to be heard as to
the propriety and advisability of making such improvements; and
WHEREAS, after such public hearing was held the County Commission adopted
Resolution No. 98-59, which confirmed the special assessment cost of the project to the
property specially benefited by the project in the amounts listed in the attachment to that
resolution; and
WHEREAS, the Director of Utility Services has certified the actual "as -built" cost now
that the project has been completed is less than in confirming Resolution No. 98-59,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows:
1. Resolution No. 98-59 is modified as follows: The due date for the referenced project and
the last day that payment may be made avoiding interest and penalty charges is ninety days
after passage of this resolution.
2. Payments bearing interest at the rate of 7.75% per annum may be made in ten annual
installments, the first to be made twelve months from the due date. The due date is the date
of passage of this resolution.
3. The final assessment roll for the project listed in Resolution No. 98-59 shall be as shown on
the attached Exhibit "A."
4. The assessments, as shown on the attached Exhibit "A," shall stand confirmed, and will
remain legal, valid, and binding first liens against the property against which such
assessments are made until paid.
5. The assessments shown on Exhibit "A," attached to Resolution No. 98-59, were recorded
by the County on the public records of Indian River County, and the lien shall remain prima
facie evidence of its validity.

Dear Mr. Evans,
Thank you for your time today to discuss the -Fair Snare- legislation —
Conservation and Reinvestment Act (CARA). As l indicated, this Federal bill could be
one of the most significant pieces of legislation for our nation's coastal areas. It will
provide approximately S 1 billion in new Federal money annually to coastal states and
local governments.
1 encourage the Indian River County Commission to support this important
bipartisan legislation. Attached are informational fact sheets for your review and
discussion with Commission members. Included in the materials is a sample Resolution
that we hope you will adopt, and forward to your Congressional delegation encouraging
cosponsorship of the bills.
As I said. CARA distributes 50% of the annual Federal receipts (600,6 in the
House Bill) from onshore oil dl: gas development to states and local governments, which
is equivalent to the treatment of revenues from onshore federal oil and gas development.
This "Fair Share" of offshore revenues. about S2 billion a year. will be distributed
through three programs.

Title I of the bill, provides 270% of the annual revenues to ALL coastal states and
tcmtorics, not just those states that "host' federal Outer Continental Shelf (OCS) oil and
gas development. Florida stands to gain approximately 585.500,000 (based on MMS
estimated revenues) in Title I Coastal Impact Assistance.
Title Il is the Land and Water Conservation Fund of which Florida would receive
over Sl 1.000.000 approximately, and Title III is for wildlife initiatives of which Florida
Council for Conservation and Reinvestment of Outer Continental Shelf Revenues

Commissioner Ginn made a MOTION TO DENY the request. She had read the
resolution and supporting documents and could not support this. She wanted to make crystal
clear her opposition to H.R. 701 which she felt is not about providing just compensation.
She noted that the backup materials said this would make some people whole who had been
injured. She believed those who feel they have been injured should seek satisfaction from
our court system. She emphasized that the United States Constitution, Article I, Paragraph
17, limits the government's ability to own land as our founding fathers knew too much power
in federal government and agencies could lead to a loss of freedoms. She stated that
enormous tracts of land would be taken off the tax rolls while the monies would be made
available to the Secretary of Agriculture. She believed that 40% of all lands are controlled
by the government, with more being added year after year and public access being
increasingly diminished. She felt that this would become a new "entitlement", establishing
a fund to meet the outdoor needs of the American people "and for other purposes" which are
not listed. States would be required to match funds and local level governments would have
to submit a plan to be approved by the Governor. If the Governor does not approve the plan,
the funds would be held in escrow until an approval is received. This plan reeks of special
interests and is an additional level of bureaucracy and a tax on private property ownership.
Chairman Macht ruled that Commissioner Ginn's MOTION DIES FOR LACK OF
A SECOND.
Commissioner Adams commented that she felt there was a lot of benefit to putting
lands aside. She believed that ifwe don't take measures to protect our resources, particularly
water, in 50 years it will be too late. She understood Commissioner Ginn's concerns but did
not share them and she did support the request.
Commissioner Stanbridge believed that the monies are not just for the purpose of
buying lands, but also to protect our air and water quality, as well as our fish and wildlife.
She saw this project as a funding source to implement projects to protect the lands we
already have. She noted that there are 92 supporters in the Senate.

MOTION WAS MADE by Commissioner Adams,
SECONDED by Commissioner Stanbridge, that the
Board adopt a resolution expressing its support of
proposed Federal Legislation - Conservation and
Reinvestment Act of 1999 (HIL 701) and
Reinvestment and Environmental Resolution Act of
1999 (S. 25).
Commissioner Tippin had very mixed emotions and noted that federal environmental
agencies have done some wonderful and some horrible things. There is so much going on
to protect our habitat but not enough to protect our grandchildren. He could not support the
request.
Commissioner Ginn felt we are giving up our basic freedoms, not through invasion,
but an inch at a time, and we are taking part in that loss now.
Chairman Macht noted that this is not a public hearing but he would allow brief
comments from the public.
Guy Barber, 503 7'h Place, believed this is another bureaucratic power. This proposal
does not incorporate just monies from offshore drilling but from every type of conservation
program. He felt this represents combined monies for a land grab, with no allowance to use
the funds for maintenance or upkeep which puts the maintenance and upkeep back on local
government. He believed that people will be given incentive payments -and was opposed to
the request. They want to include Florida because of our coastline of over 1300 miles which
will be available for Louisiana to use. These lands will be controlled by international
regulations and will belong to a "global" community. He believed that this proposal is
backed by irresponsible conservationists and is about land ownership and control of fresh
water in the State of Florida.
Rosemary Wilson, 1490 5' Avenue, commented that it is obvious which of the
Commissioners are in favor of big government. She felt this is pure Marxism, taking away
the rights of citizens. She warned that the source of economic well-being is private property
ownership and stated she did not feel the Board is truly representing our freedoms.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA,
EXPRESSING ITS SUPPORT OF PROPOSED FEDERAL
LEGISLATION - CONSERVATION AND REINVESTMENT
ACT OF 1999 (H.R. 701) AND REINVESTMENT AND
ENVIRONMENTAL RESOLUTION ACT OF 1999 (S.25).
WHEREAS, the development of federal oil and gas resources on the Outer
Continental Shelf (OCS) liquidates a capital asset of the nation; and
WHEREAS, a significant portion of the liquidated capital assets of the nation
should be reinvested in the conservation and enhancement of other precious capital
assets of our nation, including the coastal zone, inland habitat and wildlife resources;
and
WHEREAS, coastal states that host federal offshore oil and gas development
are suffering adverse impacts on their environment and increased pressure on their
public services for which mitigation and compensation should be made by the federal
government; and
WHEREAS, under the Mineral Lands Leasing Act, when federal mineral
resources are developed on shore, the federal government shares 50% of its revenues
from the development with the host state,
NOW, THEREFORE, BE IT RESOLVED, that the federal government should
share with the states, annually, as an entitlement, 50% of the revenues derived from
federal oil and gas development on the Outer Continental Shelf, with 27% being
distributed to all coastal states pursuant to the formula recommended by the OCS Policy
Committee to the Department of Interior in October, 1997, and 23% being distributed to
all states through the Land and Water Conservation Fund and a program of wildlife
conservation initiatives; and
BE IT RESOLVED FURTHER, that the Board of County Commissioners of
Indian River County, Florida endorses the Conservation and Reinvestment Act of 1999
that has been introduced in the United States House of Representatives (H.R. 701) and
the Reinvestment and Environmental Restoration Act of 1999 that has been introduced
in the United States Senate (S.25) and recommends its enactment to the Governor of
Florida, the legislature of Florida, the Congressional delegates of the State, and the
entire United States Congress and the Administration.

13.B.1. VICE CHAI UY AN FRAN B. ADAMS - UPDATE ON
AQUACULTURE USE ZONE

Vice Chairman Adams gave a brief update on the Aquaculture Use Zone which
former Commissioner Carolyn Eggert had supported after the net ban in an effort to provide
some economic relief to the fishermen. This is an intergovernmental effort between the
State, US Fish & Wildlife and the County to set up a zone within the boundaries of the
Pelican Island Refuge. The Governor and Cabinet did finally pass this and the leases now
will go through the Department of Environmental Protection and be approved in an effort to
provide some useful economic gain from the Refuge. The Committee will host a workshop
in the near future and then will sunset in about 1 year.

13.B.2. VICE CHAIRMAN FRAN B. ADAMS - UPDATE ON THE
SCENIC HIGHWAYS PROGRAM
Vice Chairman Adams then gave a brief update on the Scenic Highway Program. She
attended a workshop last week and the next step may be a presentation to the Commission
and the public, probably to be held in the City of Sebastian. She also noted that she would
like to see the City of Orchid join the program.
NO BOARD ACTION REQUIRED OR TAKEN.
14.A. EMERGENCY SERVICES DISTRICT
The Chairman announced that, immediately upon adjournment, the Board would
reconvene as the Board of Commissioners of the Emergency Services District. Those
Minutes are being prepared separately.

The Chairman announced that immediately upon adjournment of the Emergency
Services District Meeting, the Board would reconvene as the Board of Commissioners of the
