HomeMy WebLinkAbout9/13/1999• SPECIAL EMERGENCY MEETING BOARD OF COUNTY COMIVIISSIONERS INDIAN RIVER COUNTY, FLORIDA SEPTEMBER 13, 1999 TO DECLARE A STATE OF LOCAL EMERGENCY IN PREPARATION FOR HURRICANE FLOYD September 13, 1999 The Board of County Commissioners of Indian River County, Florida, met in Special Emergency Session at the County Commission Chambers, 1840 251 Street, Vero Beach, Florida, on Tuesday, September 13, 1999. The meeting was called by the Chairman to declare a state of local emergency in preparation for Hurricane Floyd. Present were Kenneth R Macht, Chairman; Caroline D. Ginn; Ruth Stanbridge; and John W. Tippin. Vice Chairman Adams was not present. Also present were James E. Chandler, County Administrator; Charles P. Vitunac, County Attorney; and Patricia Ridgely, Deputy Clerk. The Chairman called the meeting to order at 1:52 p.m. and announced that this was an emergency meeting to declare a state of local emergency. Many others were present as a 2 o'clock meeting had been called earlier in the day for the Emergency Services Department to brief all department heads, municipality and agency representatives, constitutional officers, and others about the approaching hurricane. The Chairman read the proposed resolution into the record. ON MOTION by Commissioner Tippin, SECONDED BY Commissioner Stanbridge, the Board unanimously (4-0, Commissioner Adams absent) adopted Resolution No. 99-91 declaring state of local emergency. September 13, 1999 RESOLUTION 99 - 91 INDIAN RIVER COUNTY RESOLUTION DECLARING STATE OF LOCAL EMERGENCY WEMWAS, the National Hurricane Center recognizes the danger to coastal residents of Florida from Hurricane Floyd, by posting a hurricane watch from Hallandale to Flagler Beach; and WaiEREAS, Indian River County has high evacuation times to evacuate residents from the hazards of a hurricane; and WHEREAS, the current forecast error of the National Hurricane Center does not allow for a confident prediction of the track of Hurricane Floyd at that point in time, coinciding with Indian River County's high evacuation times; and WHEREAS, Hurricane Floyd has the potential for causing extensive damage to public utilities, public buildings, public communication systems, public streets and roads, public drainage systems, commercial and residential buildings and areas; and 1 , WHEREAS, Chapter 252.38, Florida Statutes, provides authority for a political subdivision such as Indian River County to declare a State of Local Emergency and to waive the procedures and formalities otherwise required of political subdivisions by law pertaining to: 1..' Performance of public work and taking whatever action is necessary to ensure the health, safety, and welfare of the community. _ 2. Entering into contracts. 3. Incurring obligations. 4. Employment of permanent and temporary workers. 5. Utilization of volunteer workers. 6. Rental of equipment. 7. Acquisition and distribution, with or without compensation of supplies, materials and facilities. 8. Appropriation and expenditure of public funds. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, this 13th day of September 1999, that 1. Hurricane Floyd poses a serious threat to the lives and property of residents of Indian River County and that a State of Local Emergency shall be declared, effective immediately, for all of Indian River County, including, all unincorporated and incorporated areas. 2. The Board of County Commissioners hereby exercises its authority and waives the procedures and formalities required by law of a political subdivision, as provided in Chapter 252.38(6)(e), Florida Statutes. Macht, Chairman Chairman Macht advised he needed the Board's permission to sign a letter to the Honorable Governor Jeb Bush and read the proposed letter into the record. Indian River County y Board of County Commissioners Department of Emergency Services CY 1840 15th Streel, Veno Reach, Florida 119hU September 13, 1999 The Honorable Governor Jeb Bush c/o Department of Community Affairs Division of Emergency Management VIA FAX 850-488-1016 Dear Governor Bush: Hurricane Floyd continues to move toward Indian River County and poses a threat to life and property. If Hurricane Floyd makes landfall over Indian River County as a Category 4, it could be the worst disaster this county has ever experienced. Because of this threat, Indian River County has declared a Local State Of Emergency to allow for adequate protective actions. All county agencies and public safety agencies such as law enforcement, EMS, fire, health, etc., are activating emergency preparations according to the county's Comprehensive Emergency Management Plan. Expenses for budget items such as overtime, supplies, and other operating accounts may exceed estimates for FY 98/99. Therefore, I am rg§ectfully requesting that Indian River County be included in any Declaration of Emergency request submitted by the State of Florida to the Federal Emergency Management Agency. Since substantial damage is expected should Hurricane Floyd make landfall over or in proximity to Indian River County, I am respectfully requesting that Indian River County be considered for any Declaration of Disaster request to the Federal Emergency Management Agency. I have appointed Mr. Douglas Wright, Director of Emergency Services, to be my representative for any contact from the Florida Division of Emergency Management reference this request. Chairman Macht announced the following notice of canceled meetings: Council of Public Officials and Board of County Commissioners regular and budget meetings scheduled for Tuesday, September 14, 1999. Also, Commissioner Carolyn Eggert's Memorial Service scheduled for September 14, 1999 has been postponed until further notice. Emergency Services Director Doug Wright advised that Chairman Macht and the Commissioners have taken the necessary actions he had requested for which he expressed his thanks. He stated that at 12:30 p.m. the National Hurricane Center had upgraded some of the information on Hurricane Floyd and reduced the amount of time for preparedness, thus it was necessary to move forward with emergency plans. He advised that he would start the other meeting with the local representatives from the municipalities and other agencies upon adjournment of this meeting. Administrator Chandler invited the Commissioners to remain for the next meeting so they would be updated on all available information.
