At a regular meeting of the Board of County Commissioners inand for Indian
River County, Florida, held in the Court House in Vero Beach, Florida, on Tuesday
August 4th 1925, the follovuing members of the Board were present: John H Atkin,
Chairman, 0. 0. Helseth, J. W. LaBruce, Donald Forbes and G A Braddock. Also present
Were Niles 'Marren, Clerk and J. W. Knight, Sheriff.
The minutes of the previous meetings were read and approved.
The time haing arrived for the opening of bids for the $50,000. time warrants
issued by the County for the purpose of paying the ordinary and extraordinary expenses
of the County, the bid of the Farmers Bank of Vero was opened and read as follows:

Dear Sir:- For your $50,000.00 of time warrants offered for sale this date, we will
pay you the sum of $50,000.00 and accreted interest to date of delivery to us.
As evidence of our good faith, we are enclosing herewith our check for $500.00
being in accordance with your advertisement, a copy of which is attached herewith and
made a part of this bid.

On motion of Commissioner Forbes, seconded by Commissioner Braddock, it was
ordered, by unanimous vote, that the bid be accepted.
A petition signed by J. H. Sutherland and 67 others was presented askeng that a
road be constructed along the present right-of-way paralleling Sub -lateral #20, from
the present East road, West, to the Park Lateral Bridge on Sub -Lateral #20, and from
a point on said road to construct a road running North to the South boundary of the
Town of Fellsmere to connect with the termination of the Street "Broadway".
It was ordered that the petition be filed, Commissioner LaBruce advising the
Board it was his intention to build and repair this road immediately after repairing
the present hard surfaced road within his district.
Itvwas unanimously ordered that the matter of; copying plats, maps and etc. from
St Lucie County, be referred to the County Engineer to work in conjunction with the
Tax Assessor and they are authorized to have prepared copies of all plats and maps
affedting the territory embracing Indian River County. The Tax Assessor and such
assistants as are necessary to be paid not exceeding 05.00 per day.
The Justice of the Peace bond of Alfred 1 Ivory, as Justice in District No. 2
in the suim of $500.00 with Wm E Feazei and H. Shomber was approved.
The Deputy Sheriff bond of C. T. Tompkins in the sum of $1,000.00 with F. Chas.
Gifford and W. B. Davis, as sureties was approved.
The Notary Public bond of Roy L. Kinney, in the sum of $500.00 with R. J. Dunnam
and J H Sutherland, as sureties, was approved:
The Justice of the Peace bond of M. M. Miller-, as Justice in District No. 1, in
the sum of $500.00 with David Rose and Paul Kroegel, as sureties, was approved.
The Notary Public bond of Hugh D Keifer in the sum of 0500.00 with the American
Surety Company of New York, a corporation, was approved.
The Notary Public bond of A. W. Young, in the sum of $500 00 with the American
Surety Company, of New York, a corporation was approved.
It was ordered that the County lease to St Lucie County, Florida, all convicts
at and for the mxim sum of 010 00 per month per prisoner.
It was ordered that the County Engineer be empowered to employ a County Road
Superintendent at a salary not to exceed 0200 00 per month.
On motion duly made, by Commissioner LaBruce, and seconded by Commissioner Brad-
dock the following resolution was proposed for adoption:
RESOLUTION.
Be it resolved by the Board of County Commissioners of Indian River County, Flo-
rida, ack in regular cession assembled on the 4th day of August A D 1925, that
WHEREAS, An Act of the Legislature of the State of Florida, for the year 1925,
duly signed by the Governor, provides for the creation and incorporation of a Special
taxing district in Brevard. County, Florida, and St Lucie County, Florida, to be known
and designated as Felismere Cross State Road District, prescribing the boundaries-
thereof; Providing for the Government and Administration of said Zistriot; Defining
the powers and purposes of said district, and of the Board of Commissioners thereof; to
authorize said Board to construct, improve and maintain a road across the St Johns
i.rsh; to provide for the acquiring of property or condemnation thereof for district
purposes; to Provide for the levy and collection of taxes for district purposes; to
Authorize future levies and assessments; to Authorize said Board to borrow money and
issue and sell bonds; to Procure money to carry out the provisions of this Act; to
Prevent injury to works constructed under this Act, and to provide penalties therefor;
to Provide for the holding of election for issues of bonds in an amount not to
exceed $4,000,000.00; to Provide 'for continuity of District in event of change of
County organization and generally to provide for the construction, maintenance and
improvement of said road in said District.
It is provided among other things that said Act shall not take effect until an
election shall be held within certain territory described in said Act, at which election
only registered votes residing in said District who own real or personal property as
shown by the Assessment Roll for the year 1925 in the office of the County Tax Collectors
of the respective counties, shall be allowed to vote, and providing further for the
election for the offices of three commissioners; the boundaries of said Fellsmere
Cross State Road District, formerly in St. Lucie County, Florida, and new Indian River
County, Florida, provided by said Act being as follows:
Begin where the waters edge of Atlantic Ocean intersects the line between Township,
30 and 31, thence Westerly along the North boundary of Indian River County, to the
North-west corner of Township 31 South Range 35 East, thence South along the Township
line to the South-west corner of Township 31 South Range 35 East, thence Fast six
miles more or less to the North-west corner of Township 32 South Range 36 East, run
South 6 miles more or less to the South-west corner of Township 32 South Range 36 East,
thence run East 18 miles more or less, to the South-east corner of Township 32 South
Range 38 Nast, thence run North 6 miles more or less to the South-west corner of
Township 31 South Range 39 East, run thence Nast to the waters edge of the Atlantic
ocean, thence north meandering said waters edge to place of beginning.
AND SAS, it is further provided that in the event of all or any part of the
said Fellsmere Cross State Road District being placed by law in another County than
St Lucie or Brevard County, all duties therein prescribed for offices of St Lucie
or Brevard Counties shall be performed by the officals of such other County or counties
and whereas it appears that the above described portion of Fellsmere Cross State Road
District was formerly situated in St Lucie County, Florida, but now lies in Indian
River County, Florida.
NOW, THEREFORE, Notice is herby given that on the 22nd day of August'A D 1925,
between he hours of 8 A. M. and sun down an election will be held in the territory
described in said Act as herein above set forth, and known as that part of Fellsmere
Cross State District, lying and being in Indian River County, Florida, for the purpose
of electing three Commissioners of the Fellsmere Cross State Road District; and to
determine whether the Board of Commissioners of Fellsmere Cross State Road District
shall be authorized to issue bonds in the sum of $200,000.00 for the purposes provided
in said Act, sad that said election will be held in said described portion of Fellsmere
Cross State road District lying in Indian River County, Florida, in Presinct No. 2
at Town hall in Sebastian, Florida; in Presinct No. 8 at Carrier Hall in Fellsmere,
Florida, and in Precinct No. 3 at office American Railway Express Co. Wabasso, Florida,
and in precinct No. 1 at Florida East Coast Railway depot, Roseland, Florida.
The officers appointed to hold said election in Precinct No. 2 shall be: S A Park;
A. Foster; S A Braswell, Inspectors, P. P. Lawson, Clerk.
The officers appointed to hold said Election in Precinct No. 8 shall be: George
Hughes; R J Dunnam; George E King, Inspectors; Dorthera Holmden, Clerk.
The officers appointed to hold said election in Precinct No. 3 shall be: T J Cail;
T H Sibley; A R Miller, Inspectors; Mfrs J 0 Morgan, Clerk.
The officers appointed to hold said election in Precinct No. 1 shall be: WW
Holtzclaw; N. D. Hammond; Dempsey Cain, Inspectors; T A Gerring, Clerk.
It is further resolved that tke candidates for Commissioners of Fellsmere Cross
State Road District may be any person qualified for such position under the laws of
the State of Florida, said election to be governed by the laws of the State of Florida,
governing the calling and holding of said Special election and qualification of candi-
dates therein.
Be it further resolved that the Clerk of this Board cause due notice of said
election to be published as required by law.
The question being put on the adoption of the resolution the vote was as follows:
Yeas: Commissioners Atkin; Braddock; Forbes; Helseth and LaBruce. Nays: None.
So the resolution was declared adopted.
NOTICE OF R7NCTION.
WHEREAS, under and by virtue of the terms of the Act of the Legislature of the
State of Florida, enacted at the 1925 session, being an act creating and incorporating
a special Taxing District in Brevard County and St Lucie County, Florida, to be known and
designated as Fellsmere Cross State Road District, prescribing the boundaries thereof;
Providing for the Government and Administration of said District; Defining the powers
and purposes of said District, and of the Board of Commissioners thereof; to Authorize
said Board to construct, improve, and maintain a road across the St Johns Marsh; to
provide for the acquiring of property or condemnation thereof for district purposes; to
Provide for the levy and collection of taxes for district purposes; to Authorize future
levies and assessments; To authorize said Board to borrow money and issue and sell
bonds, to procure money to carry out the provisions of this Act; to prevent injury to
works constructed under this Act, and to Provide penalties therefor; to Provide for the

It is further provided among other things than no act placing all or any part of
said Fellsmere Cross State Roa'listrict in another County shall affect ,or repeal any of
the obligations of said Fellsmere Cross State Road District or affect any of the powers
of the said Fellsmere Cross State Road District heretofore granted.
In the event of all or any part of said Fellsmere Cross State Road District,
placing by law in another County than St Lucie County, or Brevard County, all duties
therein prescribed for offices of St Lucie or Brevard Counties shall be performed by
officals of such other County or counties, and whereas it is provided among other
things that the Board of County Commissioners of St Lucie County and the Board of County
Commissioners of Brevard County shall call for and provide for a special election for
the purpose of electing three Commissioners as provided for in said act and to determi
whether said Board of Commissioners of Fellsmere Lross State Road District shall be
authorized to issue bonds as provided for in said Act, at which election onlu.registered
voters residing within said district who own real or personal property as shown by the
assessment roll for the year 1925 in the office of the County Tax Collectors of the
respective counties shall be qualified to vote; the boundaries of said Fellsmere Cross
State District lying in Indian River County, formerly in St Lucie County, Florida, as
provided by said act mut being as follows:

the said Fellsmere Cross State Road District lying and being in Indian River County,

of electing three commissioners of the said Fellsmere Cross State Road District and to
determine whether the Board of Commiissioners of Fellsmere Cross State Road District
ehall be authorized to issue bonds in the sum of e200,000.00 for the purpose provided
in said Act of Legislature; that said election will be held in said portion of said
Felismere Cross State road District on the said date in Precinct No. 8 at Carrier Hall,
Fellsmere, Florida. In Precinct No. 2 at Town Hall in Sebastian, Florida, in Pre-

The Board of County Commissioners then proceeded to Fort Pierce, Florida, to meet
in joint see$ien with the Board of County Commissioners of St Lucie County, Florida, for
the purpose of effecting a settlement between the two counties in accordance with the
Act of the Legislature of the 1925 session.
On motion duly made seconded and carried the following agreement was accepted,
approved, ratified and confirmed by both Boards of County Commissioners, to -wit: -
THIS AGREEMENT made this 4th day of August 1925, by and between the Board of County
Commissioners of Indian River County, State of Florida, party of the first part and the
Board of County Commissioners of St Lucie County, State of Florida, party of the second
part,
SAS, an Act of the Legislature of the State of Florida, approved May 30, 1925,
entitled An Act providing for the Creation of Indian River County in the State of Flo-
rida, and for the organization and government thereof° provides among other things that
it shall be the duty of the Board of County Commissioners of Indian River County at as
early a date as may be possible to hold a conference with the County Commissioners of
St Lucie County, and agree with the said Board upon a plan or plans for the assumption
by Indian River County of its prorata share of the indebtedness of St Lucie County,
in accordance with the provisions of the Constitution of the State of Florida, based on
the assessed valuation of the property both real and personal, subject to taxation
within said counties; and that the Board shall also agree upon equitable division of the
surplus funds and personal or movable property on the day that said Act takes effect,
AND WAS the said Board of County Commissioners of said Counties have held a
conference provided by said Act and have agreed upon the following plan for the assump-
tion by Indian River County of its prorata share o' theindebtedness of St Lucie
County and also upon the following division of the surplus funds and personal or movable
property situated in said counties on June 30, 1925, being the day said Act took effect.
AND WI4AS, the County of Okeechobee was organized in the year 1917, taking part
of the territory of St. Lucie County and said Okeechobee County assumed twenty-six per
cent of the then existing indebtedness of St Lucie County, Florida, consisting of Bonds a
and Time warrants, and in reaching t4is agreement due consideration has been given to that
part of indebtedness of St. Lucie County, which has been previously assumed by Okeechobee
County.
AND r, 4 the Legislature of the State of Florida of the year 1925, has also
provided for the creation and organization of Martin County which new County takes a
portion of St Lucie County, and due consideration has been given to the effect of the
creation of Partin County in reaching this agreement,
AND WHEREAS it has been agreed by the two Counties to this agreement that the total
assessed valuation of all taxable property both real and personal of the territory of
St Lucie County, Indian River County and that portion of St. Lucie County to be included
in Bartin County is $9,076,745.00 and the parties to this agreement have agreed that
Indian River County has taxable property within its boundaries amounting to 43.4 per ce t
of the said total assessed valuation.
NOW, THIS AGR 1 EIET WITNESSETH: That out of the total surplus funds of St Lucie
County, Florida, Indian River County is entitled to and shall receive the following
amounts out of the following named funds of St Lucie County, Florida, which are under t•e
control of the Board of County Commissioners of St Lucie County, Florida.

on which Indian River County receives. 43.4 per cent.

The said Board of County Commissioners of St Lucie County, Florida, hereby agree
to pay over the above stated amounts out of said funds, to said Board of County Cosa-
missioners of Indian River County, Florida, and said last mentioned Board hereby agrees
to that the payment of said amounts shall be full satisfaction of all claims by the Boa
of County Commissioners of Indian River County for any money out of the above named
funds of St Lucie County.
IT IS FURTHER MUTUALLY A - *10 that the Board of County Commissioners of St Lucie
County, Florida, will pay over to the Board of County Commissioners of Indian River
County, Florida, 43.4 per cent of all moneys received after July kga 1925 by the first named
Board derived from redemption of Tax Sale Certificates, which have been redeemed prior
d.
to June 30, 1925. The moneys herein referred to being such moneys or funds as are
properly under the control of the Board of County Commissioners. Moneys derived from
such Tax Sale Redemptions belonging to Special Road and Bridge Districts, Inlet Dis-
tricts, Special Bridge Districts and other Special Taxing Districts shall be paid over
to the proper officers of such Special Districts.
IT IS FURTHER MUTUALLY AGREED that the. Board of County Commissioners of St Lucie
County, Florida, shall turn over and deliver to the Board of County Commissioners of
Indian River County, Florida, the following described personal or moveable property,
and the receipt thereof by said last named Board shall constitute full satisfaction of
all claims by said Board of County Commissioners of Indian River County to any of the
personal or movable property of St Lucie County, Florida. Said property is described
as follows, to -mit: -

--IT IS FURTHER MUTUALLY AGREED that the following table shows the total outstanding
indebtedness of St Lucie County, Florida, together with the interest to become due.
thereon. Said table amount of principal and interest due and payable each year from
1925 to 1953, both years inclusive, and also showing the share of said indebtedness
assumed by Indian River County under the terms of this agreement. The Board of County
Commissioners of Indian River County hereby covenants and agrees that during each of
the years from 1925 to 1953, both years inclusive, that said Board of County Commission-
ers will cause to be paid over to the Board of County Commissioners of St Lucie County
Florida, the amount of money shown in column 4 of said table, which shall be used by the
Board of County Commissioners of St Lucie County, Florida, for the purpose of paying
principal and interest of the said listed indebtedness of St Lucie County, Florida, as
the same becomes due and payable from year to year. The Board of County Commissioners
of Indian River County, Florida, further agrees that it will pay over said amounts
respectively from year to year as may be required to assist in payment of principal
and interest coming due from time to time, promptly upon the requisition of the Clerk
of the Board of County Commissioners of St Lucie County, Florida. And the said Board
of County Commissioners of Indian River County hereby covenants and agrees that it
will levy each year a sufficient amount of tax so as to raise the full amount required
to wake such payments as the same become due and payable . from year to year.

It is further mutually agreed that whereas the County Tax Assessor of St Lucie
County, Florida, is charged with the duty of preparing and completing the County tax
assessment roll for the year 1925, covering all taxable property in both St. Lucie and
Indian River County,. and the law creating Indian River County provides thattheCounty
Tax Assessor for Indian River County shall. receive no compensation for the work of
preparing said 1925 tax levy, but that full compensation shall.be paid to the County
Tax Assessor of St Lucie County for said duty. Therefore the .Board_of ,County Commissio -
ers of Indian River County hereby agree .to .assume and pay 43.4 per cent of the compensaion

The Board of County Commissioners of Indian River County agrees to pay to each of
the cities of Fort Pierce, Vero and..Fellsmere 43.4 per cent of the,50per cent of Gener 1
Road Taxes for the year 1924 collected -on property within the boundaries of said cities
the remainder of aid amounts due said cities to be paid by St Lucie and Maryin Counties

The Board of County Commissioners of Indian River County, Florida, met at 2:00
o'clock P. M. on August 24th,- 1925 at the Court House at Vero Beach, Florida, pursuant
to adjournment. The following members of the Board were present: John H Atkin,
Chairman, D. Forbes., J W Ia.Bruce and 0. 0. Helseth. Also present was Miles Warren,Clerk.
The meeting was called to order by Chairman John H Atkin, who announced that the
hour of 2100 P M Having arrived it was now in ordet to open sealed bids for the purchase.
of 0490,000.00 Bonds of Special Road. and Bridge+District No. 4 of Indian River County,
Florida.
Thereupon the following sealed bids, each of which were accompanied by a certified
check for 05,000.00 were opened and read, the name of the bidder and the amount bid
being given:

made, seconded and carried by unanimous vote the following resolutions were adopted:
WHEREAS, in the judgment of the Board all of the foregoing bids are unsatisfactory
because of the low price offered, and all of said bids should be rejected, therefore
be it
RESOLVED, that all of the foregoing bids are rejected, and the checks accompanying
each of said bids are ordered to be returned to the respective bidders.
RESOLVED, further, that the Clerk of this Board is hereby directed to cause said
bonds to be re -advertised for sale in The Vero Beach Press upon sealed bids to be opened
at two o'clock P. M. October 6, 1925, each bid to be accompanied by certified check for
05,000.00 as evidence of good faith.
It was ordered that notice be posted of the change in public road, so as to con-
form and run with streets and avenues of the Beachland Development Company's subdi-
vision as follows;
