The County Depository filedcits monthly statement, showing receipts and disbursments of the various funds which having been audited were found to be correct. The Board of County Commissioners met at the hour of 9330 o'eloek A..M., Monday October 4, 1937, for the purpose of receiving the tau assessment roll of Indian River County for the year 1937. There being no quorum present the meeting was thereupon adjourned for lack of quorum to Tuesday morning October 5th., at the hour of 9:30 o'clock A. M. a C a rman. M„ Tuesday, October 5th., 19370 in regular meeting with the following members of the Board present, R. Be Mudge, Chairman; Be P. -Poole, S, Be Glover, .and Frank C. Vickers, absent Edwin A. Relseth. Also present were Charles A. Mitchell, Attorney for the Board, Wmi Frick, Sheriff, and Douglas Baker, Clerk. The minutes of August 17th., and September 6th., were read and approved. It was announced by the Chairman that the time had arrived, namely 9:30 o'cloc4 A. M., for the opening of sealed bids in the office of the Clerk of the Circuit Court of Indian River County, up to 9:30 A. M. Pierce, appeared before the board and requested that a oo�- mmittee be appointed to work with a committee from St. Lucie County, in order to try and get 5 the State Road Department to make a survey of the peninsular road From Riomar to south County line, which was recently brushed out and grubbed by the Cou;ity. E. P. Poole was appointed as a committee to work with Mr. Martin and Committee from St. Lucie County. Mr. H. H. Heald appeared before the board and requested certain information with regard to a road petition which had been formerly filed and made reference to said petition, page 577, book 1, County Commissioners Minutes, Frank A. Knight,Road Superintendent was re- quested to make an investagation and report back to the Board as to merits and costs of the Road„ Mr, F. C. Poppell appeared before the Board and offered to place a."Washington Statue" on the Cturthouse° grounds, 9 feet 6 inches high, which weighed 16311 pounds, at a cost of $1500.00 less 10% and stated that public subscription in the amount of approximately $265.00 had been pledged provided the County would accept his proposal. Mr. Poppell was'advisel by the Board that no provision had been made in the budget for expenditures of this kind. Mr. E. P. Poole was appointed as a committee to make arrangment for the transports - tion of approximately 40 C.C.C. boys to the Armory, Wiest Palm Beach and return on October 19. The County Tax Assessor appeared before the Board and requested an extenalon of time to October 19th, 1937, for the purpose of presenting the tax assessment roll for Indian River County for the year 1937 to the Board of County Commissioners for their final consider,�-G- ation and approval. Thereupon Commissioner Poole introduced the following resoluti= and moved its adoption, to -wit: WHEREAS the County Tax Assessor for Indian River County has filed before this Board of the County,tax assessment roll for the year 1937 and appearing proper so to do. THEREFORE, be it resolved that the time for the presenting to this Board of the County tax assessment roll for the year 1937 by the County Tax Assessor be and it is herewith extended to October 19th# 1937 at the hour of 9:30 Ovolbok A. M. at which time the County Tax Assessor shall present said County Tax assessment roll to this Board. The motion for the adoption of the resolution being duly seconded it was declared adopted by the following vote. LAyes- Mudge, Vickers, Glover and Poole. That, in the consideration of the matters hereinafter referred to, the attention of the State Board of Administration, Tallahassee, Florida, is directed to resole= tion heretofore adopted by this Board authorizing the issuance of the Road and Bridge Refundr ing Bonds hereinafter more particularly described, certified copy of which has been furnished to said State Board by the Clerk of this Board. Section 2. That the said State Board is hereby directed, in view of the refunding of the originally outstanding bonds, to transfer to the Interest and Sinking Fund account of said Refunding Bond issue described in said resolution all interest and sinking fund balances credited to the issue of bonds refunded pursuant to said resolution identified. Section 3, That, after effecting the transfers of funds as provided in Sections 2 and 4 hereof, said State Board is hereby directed to remit to the designated paying agent sufficient money to pay the interest coupons due on said Refunding Bonds in accordance with the certified bond and coupon schedule which has-been or.will be furnished, it being the in- tention and purpose of this Board that said remittances be not forwarded in advance,_ but tha said funds be remitted at the latest possible date allowing only sufficient time for their f receipt by the said paying agent on the date said coupons are due to be paid; said Road and Bridge Refunding Bonds being;,identified as follows, to -wits Amt. of Int. That, although this Board has heretofore adopted, for and on behalf of the taxing unit whose bonds were refunded under the resolution above identified, the provis:*3 ions of Chapter 15,891, Laws of Florida, Acts of 1933, known as the Kanner Bill, and desires to continue operations under said law except where said operations would interfere with the payment of coupons as hereinabove provided to be made, nevertheless this Board has deter- mined and does hereby declare that the best interest of the designated taxing unit, and the taxpayers therein, are served if sufficient funds are transferred from the so-called Kanner Bill account for the issue of bonds hereinabhve identified to make the payment directed to be made as hereinbefore specifically provided, in Section 3 hereof, and the said State Board is hereby directed to make such transfers when necessary, it being the desire of this Board of County Commissioners that all advalorem taxes credited to the interest and sinking fund as hereinabove set forth be first u®ed for the designated payments and only such Kanner Bill funds transferred at the time specified as are necessary to make up the difference between the available interest and sinking funds and the total amount required to be paid hereunder, Section 5. That the State Board of Administration is hereby requested to approve the transaction herein provided for, and to instructits proper officers to do and perform the acts hereinabove authorized, upon receipt of advices from the Clerk of the Board of County Commissioners of this County that the refunding program identified herein is in such shape that the instructions hereinabove given should be consummated. Section 6. That the Clerk of this Board is hereby instructed to prepare in tab- ulated form and certify to said State Board in due course a full description of the Refund- ing Bonds as set forth in the resolution above identified, setting forth the bond and coupon schedules to maturity, and the Clerk shall also forward certified copy of .this resolution to the said State Board which shall be the authority Of said Board to do and perform all acts necewsary to accomplish the purposes set forth herein. 164 1&4 - The motion for the adoption of the resolution being duly seconded by Commissioner Glover, it was declared adopted by the following vote. CERTIFIED COPY OF RESOLUTION ADOPTED BY BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA AT A REGULAR MEETING THEREOF RELD AT THE COURT HOUSE IN VERO BEACH, FLORIDA ON OCTOBER 5, 1957 AND SAID RESOLUTION STATING POLICY OF SAID COUNTY WITH REGARD TO THE "KANNER BILL". Whereas, this Beard has heretofore adopted resolutions providing for the application 11 of gasoline tag money allocated and distributed to Indian River County and the Special Road and Bridge Districts therein -under and by virtue of the provisions of Chapter 158919 lags of Florida, known as the "Kanner Bill" and with reference to all such allocations to road and bridge funds controlled by this Board; therefore, in order that the State Board of Admini- stration may be duly advised with regard to.rthe operations of Indian River County and the road and bridge Districts thereof with regard to the "Kanner Bill'; Be It Resolved that the Board of County Commissioners of Indian River County, Flori does herewith adopt the provisions of Chapter 15891, Laws of Florida, known as the "Danner Bill" with regard to application of gasoline tax money distributed to Indian River County, Florida and the Special Road and Bridge Districts therein situated for the fiscal year be- ginning October 1, 1937, provided that this resolution shall not apply to Atlantic and Gulf Special Road and Bridge District situated in Indian River County and Osceola County, Florida and shall not apply to Fellsmere Cross State Road District situdted in Indian River and Bre- vard Counties, Florida and which said districts are under the control and supervision of trus- tees rustees thereof and are not under the control and supervisionn of this Board; further provided that the provisions of said Chapter 15891, Laws of Florida, known as the "Danner Bill", shall not be applied to Vero Bridge District in said County; Farther provided that the provisions of said Chapter 158919 known as the "Danner Bi shall apply to gasoline tag money distributed to and for the benefit of Special Road and Bridge District No. 4 in Indian River County, Florida only to the extent provided by reso- lution relative thereto as heretofore adopted by this Board and certified to the State Board of Administration, and which said resolution specifically provides that this Boafyd of County Commissioners has heretofore adopted for and on behalf of said Special Road and Bridge-Districi No. 4 the provisions of said "Kanner Bill" and desires to continue operations under said law except where said operations would iahterfere with the payment of interest coupons on refund- ing bond issue of said District dated January 1, 1937 and in the amount of $4450000,00; that nevertheless this Board has determined and does hereby declare that the best interests of the designated taxing unit and the taxpayers therein are served if sufficient funds are transx__' (erred from the so-called "Danner Bill" account for the issue of bonds hereinabove identified to make the payments of interest thereon promptly as such interest payments become due and that said State Board of Administration is directed to make such transfers for the payment of such interest when necessary, it being the desire of this Board of County Commissioners that all advalorem taxes credited to the interest and sinking fund of said Special Road and Bridge District No. 4 in Indian River County be first used for the said interest payments and only atwh "Kanner Bill":' -funds transferred as are necessary to make up the difference between the available interest and sinking funds of said District and the total amount re- quired to be paid for such interest from time to time. Be It Further Resolved that all gasoline allocations for the benefit of Indian River County and of Special Road and Bridge Districts therein be used and administered under 1 and"by virtue of said "Kanner Bill" except said Fero Bridge District and except said Atlantic and Gulf Special Road and Bridge District and except said Fellsmere Cross ;Mate Road District and with the qualification provided as to said Special Road and Bridge District No. 4. The motion, for the adoption of the resolution being duly'seconded it was declared adopted by the following vote: Ayes: Mudge, Poole, Vickers, Glover. Nays: bone. On motion made by E. P. Poole, seconded by S.°E. Glover and carried the Board agreed to rent the County road roller to Manly Kersey at the rate of $10.00 per day and with a county employee on thebbasis of 30¢ per hour. Application for license to sell intoxicating liquors, wines and beer was filed by Harry E. Thompson, Gifford, which was carefully examined and denied because of location being to close to churchs: Notary Public Bond in the amount of $500.00 for Ralph Sedgwick with. the American Surety Company of New Fork as surities was approved. Notary Public Bond in the amount of $500,00 for Troy Be Moody with the U. Si Fidelit and Guarantee Company as surities was approved September 17th., 1937 with the -signatures of ,Commissioners Helseth, Glover and Poole. Hon. Troy E. Moody, Tax Collector, filed his errors, insolvencies and double assess- ments list and an motion made by E, P. Poole, seconded by Frank C. Vickers and carried said list was accepted by the Board. Miss Leila M, Bunkley, County Nurse, appeared before the Board and filed her report for the month of geptember as follows, to -wit: Number .of cases under care during the month, 55 white and 17 colored, Total number of visists to these cases were, 64 white and 23 colored, 21 visits were made in behalf of these cases, 6 clinics were held for Venerehl Diseases with an attendance of 92, 14 cases 01 were feferred for Medical examination: One case hospitalized. Children in 5 white schools were given the opportunity to be immunized against Small. Pox and Diphtheria. 105 conferences were held with interested individuals, doctors, teachers and nurses.1 Dr. C. We Pease District Health Officer and Mrs. Inez Nelson District Supervisor of Nurses were in the county during the month. Four classes were conduc&ed in Home.Hygiene with an attendance of 29, Scheduled for the month of October is the Puppet•Show. This show is to be put on by Bureau of Dental Health under Dr. E. C. Geiger. Constakle, Clark S. Rice, filed his semi-annual report of fees and commissions for the period January 1, 1937 to June 30, 1937 as follows; Receipts. Barnes, Vero Beach, and the former was approved for the sum of $4.00 and the latter was aper ed for the sum of $10.00 p®r month, until the further orders of the Board. .Application was made to the Board of County Commissioners for the issuance of dup- licate tax sale certificate in lieu of certificate alleged by affidavit to be the property of the affiant therein and to have been lost and destroyed and which certificate was numbered #85 of the sale of 1924 for taxes due the State of Florida and what was then St. Lucie and is now Indian River County, Florida for the year.1923, and upon property situated in what is now Indian River County, Florida, described as follows:. Lot 10 in Block 6, Edgewood Addition to the City of Vero (now Vero Beach) Florida. Upon motion duly made, seconded and carried the Board of County Commissioners order ed that upon the filing of affidavits aforesaid by the holder and owner of said lost or dem stroyed tax sale certificate, and which affidavit shall contain a written jStatement that the .said holder and owner shall protect the Clerk of the Circuit Court of Indian River County and his successors in office .from any liability or expense by reason of the issuances of duplicate tax certificate, the Clerk of the Circuit Court of Indian River County, Florida, is authorized to issue such duplicate tax certificate to L. A. Moeller, holder and owner thereof, upon re- ceipt of the statutory fee theref.dr. Mr. Troy E. Moody, Tax Collector, was instructed by the Board to collect County occupational license from each insurance agent or representative -as prescribed by law. Plat of Blythewood Park was Filed by Paul Goodridge and Alice S. Goodridge, and was approved by the Board. Commissioner S. E. That all Road and Bridge Bills approved and all fine and forfeiture bills approved at the time of the making of the budget aforesaid and as designated in said outstanding indebted- ness fund have heretofore been paid in full, either from said outstanding indebtedness fund or from other funds of said County; That the new Court House of Indian River County, Florida has been completely equipped and all of such equipment paid for in full either from said outstanding indebtedness fund or from other funds of said County; That all sums due the Pauly Fail Building Company, including said balance in full as set out in said budget, have been paid from said outstanding indebtedness fund; That Special Road and Bridge Districts loos. 1 and 4 in said County are special taxing Districts and are not ego -extensive with the boundaries of said County and that the obligations of said two Special Road and Bridge Districts are not countywide obligations of Indian River County, nor are they obligations of its outstanding indebtedness fund, which fund is levied upon all property in said County; that payments of the obligations of said Special Road and Bridge District Nos. 1 and 4 are r made either from gasoline allocations by the Stat® of Florida to the �I benefit of such Districts or from levy of advalorem taxes in said Districts or from both, and i that such payments are made by and through the State Board of Administration; that there is no responsibility for the payment of said Special Road and Bridge Districts Not 1 and No. 4 obliga- tions from the outstanding indebtedness fund of said County and that said fund is not liable for said obligations but rather the same are payable from the funds of said respective Districts; That therefore the original debt in said outstanding indebtedness fund for which said fund is legally responsible and liable has been retired and a surplus remains in.said fund of said sum of 05964.52; Therefore, Be.It Resolved, that the sum of $2000.00 be transferred from the outstand indebtedness fund to the general revenue fund and that the sum of $1000.00 be transferred from the outstanding indebtedness fund to the fine and forfeiture fund, upon the approval of the Comptroller, to assist in meeting the current and extraordinary expenses of the County. Upon being duly seconded the same was unanimously adopted. The County Depository filed its monthly statement, showing receipts and disbursments o the various funds which having been dddited were found to be correct. The several bills and accounts against the County, have been audited, were examined and found correct were approved,. and warrants ordered issued in settlement of same. Such bills dnd accounts being on file in the office of the Clerk of the Circuit Court. The warrants issued from the respective funds being listed in the supplemental minute book as required by the rules and practice of the State Auditing Department, reference to said record and the list so recorded being made a part of these minutes.
