That if any clause, section, paragraph, or provision of this resolution or of the Refunding Bondshereby authorizedbe d.ec lared unenforceable by any court of final jurisdiction, it shall not affect or invalidate any remainder thereof,_and, if any of the Re- funding Bonds hereby authorized be adjudged illegal or unenforceable, the holders thereof shall be subrogated to the rights,of theholdersof the indebtedness hereby provided to be refunded thereby and as such enforce their.claim for payment. Section 7. That Charles A. Kitchell, Attorney -at -Law, be andhe is hereby authorized and directed to institute appropriate proceedings in the Circuit Court of the Ninth Judicial Circuit of Florida, in and for Indian River County, for the validation of said Refunding Bonds, and the Chairman and Clerk of this Board are hereby authorized to verify any pleadings in such proceedings, and to impress thereon the corporate seal of this Board. (SEAL) Y The County Depository filed its monthly statement, showing receipts and disbursments of the various funds which having been audited were found to be correct. The several bills and accounts against the County, having been audited, were examin- ed and found correct were approved, and warrants ordered issued in settlement of same. Such bills and accounts being on file in the office of the Clerk of the Circuit Court. The warrants issued from the respective funds being listed in the supplemental minute book as required by the rules and practice of the State Auditing Department, reference to said record and the list so recorded being made a part of these minutes. The Board of County Commissioners in and for Indian River County met at the Court- house in Vero Beach, at 9s30 411clock A. No, Tuesday, January 4th., 1938, in r egular meeting with the following members of the Board present, E. P. Poole; S. E. Glover; Edwin A. Helseth, and Franke C. Vickers, absents R. E. Mudge. Also present were Charles A. Mitchell, Attorney for the Board, atm. Frick, Sheriff, and Douglas Baker, Clerk. In the absence of the Chairman R. E. Mudge, who was not present because of illness, Douglas Baker, Clerk called the meeting to order and on motion made by Edwin A. Helseth, s6- conded by S. E. Glover and unanimously carried E. P. Poole was elected Chairman until the further orders of the board. Mrs. Lawrence (Iduma) Smith submitted an application for Bothers Pension which was approved by the Board for the sum:of 10.00 per month. Diss Leila M. Bunkley County Nurse appeared before the Board and submitted the fol- lowing report for the month of December 1937, to -wits The total case load for the month of December was white- 78 colored -32. The total number of visits to homes were 56. The total number of visit& to.cases were 114. Where were 66 conferences with commissioners, doctors, ?purses, social workers and ' interest individuals. 1 1 0 1 RESOLUTION. The following resolution was introduced by Commissioner Badger; who moved its adoption¢. Number of hookworm, treatments given were.R5. Your venera&l diaease c linins were held with -an_.attendance of 70. One pre-school child..and three school children had their tonsils and adenoids removed at a clinic at the Indian River Hospital. Eight patients were referred to d=octors for examinations and seven cases were hospit- alized. A cripple girl was taken to Coral Gables Clinic for the adjustment of Traces. The nurse assisted with the distribution of the Christmas Boxes. It was ordered that ae warrant for the sum of $12.00 be drawn on the General Revenue Fund to Mrs. Julia E. Fields for the care of John Council. It was ordered that Mrs. U ly Bond be stricken from the bothers Pension Fund list by. reason of the fact that her husband had been pardoned as of December 19th., 1937. It was ordered that Mrs. Daisy Barker, Wabasso, be reinstated on the Mothers Pension Fund List to receive the sum of $8.00 per month until the further orders of the board. It pas -ordered that W. R. Duncan Tax Assessor be paid the.sum of $100.00 each month for the remainder of the year, from the General Revenue Fund, to apply on Assessors Commission for the year 1938. Mr. F. G. Fletcher appeared before the Board and offered for sale approximately 35 or 40 creosoge pilingac-however the board decided that they would not purchase said piling. On motion made by S. E. Glover, seconded by Frank C. Vickers and carried it was order- ed that Frank A. Knight, Road Superintendent purchase a Bush and Bob Harrow at a cost of approximately $150.00 to be used for County road purposes. Mr. Chas. D. Toole, President of the Nero Beach Volunteer Fire Department and Secretary of the. Indian River County Fruit Festival Association,appeared before the Board and invited the Commissioners up to inspect the new building being constructed by the Indian River County Fruit Festival Association and -this having been done Mr. Toole requested the Board to donate $500.00 toward the construction and completion of said building pointing outthe-many advantages that a building of this kind and type would give to Indian River County. After careful ddn.sideration on motion made by S. E. Glover, seconded by Edwin A. Helseth_and carried it was ordered that.. $500.00 be appropriated from the General Revenue Fund, which said amount had been heretofore earmarked for advertising purposes and it was further ordered that a warrant be drawn on the General Revenue Fund for the sum of $500.00 payable to Indian River County Fruit Festival Assoc- iation for the purpose of advertising-epromoting Indian River County. At the request of the Board of County Commissioner Mr. C. F.. Simpson and Mr. Fischer representing the Florida Portland Cement Company, and Mr. H. 0. Bishop and lir. Hall representing the Barrett Roofing Company and Mr. William H. Hensick and Mr. W. H. Garns, Contractor and Arch- itect respectfully, appeared before the Board for the purpose of making a further inspection with regard to the leaks in the Courthouse and later the same day Mr. Garns speaking.for the heretofore named committee reported that in making various tests for leaks that a water hose had been turned on first below the belt course and then a bove the belt course and very soon afterwards the water made its appearance on the inside of the building and further stated that in their opinion it seems to be quite evident that the leaks are a result of defective motar and of the belt course around the building. The Board then expressed their appreciation to all of these gentlement for their services rendered. A coroners report in the matter of the death of Louis Benson was filed by Hon. Geo. W. Walters Coroner. The Board of Commissioners of Indian River Mosquito Control. District submitted the following resolution, to -wits RESOLUTION. The following resolution was introduced by Commissioner Badger; who moved its adoption¢. F -p4,"- 194 Whereas, it has been indicated to the Board of Commissioners of. Indian River Mosquito Control District that the Board of County Commissioners of Indian- .River County is desirous of working the convicts of said county upon the public works of said county, therefore Be It Resolved by the Board of Commissioners of Indian River Mosquito Control Distric that this District does hereby give its consent to having county convicts of Indian River County work upon the grogram of mosquito control and eradication of Indian River County as outlined by this Board, and that this Board does agree to pay and will pay the salary of a_warden and guard, and will furnish transportation to and from said work, and clothing on said work for said con- victs. The foregoing resolution was duly seconded by Commissioner Corsa, and upon being put to a vote was adopted as followat Ayes Commissioners Badger, Corsa and Cox Mayst None Douglas Baker, Clerk was linstructed to acknowledge receipt of said resolution and to advise Mr. W. B. Shaffer that this Board stands ready and willing to co-dperate in any way possible and awaiting the further advise of the Mosquito Control District Commissioners.
