Chapter 15,891, Laws of Florida, Acts of 1933, known as the Kanner Bill, and desires to continu
operations under said laws except where said operations would interfere with the payment of cou-
pons as hareinabowe provided to be made, nevertheless this Board has determined -and does hereby
declare that the best interest of the designated taxing unit, and the taxpayers therein, are
served if sufficient funds are transferred from the so-called Kanner Bill account for the issue
of bonds hereinabove identified to make the payments directed to be made as hereinbefore specift
Cally provided, in Section 3 hereof, and the said State Board is hereby directed to make such
transfers when necessary, it being the desire of this Board of County Commissioners that all ad
valorem taxes credited to the interest and sinking fund as hereinabove set forth be first used
for the designated payments and only such Kanner Bill funds transferred at the time specified
as are necessary to make up the difference between the available interest and sinking funds and
the total amount required to be paid hereunder.
Section 5.- That, the State Board of Administration is hereby requested to approve
the transaction herein provided for, and to instruct its proper officers to do and perform the
acts hereinabove authorized, upon receipt of advices -from the Clerk of the Board of County Com-
missioners of this County that the refunding program identified herein is in such shape that
the instructions hereinabove given should be consummated.
Section 6. That the Clerk of this Board is hereby instructed to prepare in tabulated
form and certify to said State Board in due course a full description of the Refunding Bonds as
set forth in the resolutions above identified, setting forth the bond and coupon schedules to
maturity, and the Clerk shall also forward certified copy of this resolution to the said State
Board which shall be the authority of said Board to do and perform all acts necessary to accom-
plish the purposes set forth herein.
The County Depository filed its monthly statement, showing receipts and disburse bAte
of the various funds which having been audited were found to be correct.
The several bills and accounts against the County having been audited, were examined
and found correct were approved and warrants ordered issued in settlement of same, such bills
and accounts being on file in the office of the Clerk of the Circuit .Court. The warrants issued
from the respective funds being listed in the supplemental minute book as required ,by the rules
and practice of the State Auditing Department, reference to said record and the list so recorded
being made a part of these minutes.
Where being no further business on motion made# seconded and carried, the meeting
adjourned until Friday April 8, 1:30 o'clock P. M.

The Board of County Commissioners in and for Indian River County, Florida, met at the
Courthouse in Vero Beach at 1:30 o'clock P. M. Friday, April 8, 1938 in regular adjourned ses
sion with the following members of the board present, E. P. Poole, Chairman; Edwin A. Helseth;
Frank C. Vickers; C. S. Michael and S. E. Glover. Also present were William Frick, Sheriff;
Charles A. Mitchell, Attorney and Douglas Baker, Clerk.
The board proceded to, and did name and select the following persons as Inspectors
and Clerk -of election of the various precincts to hold and conduct the primary election to be
held Tuesday, May 3, 1938 to -wit:

State offices to this Board, it was ordered that the following named persons be placed on the
official Democratise ballot of Indian.River County, for the'.primary election to be held Tuesday,

deliver said ballot boxes so prepared to the Sheriff for distribution to the various precincts
of the County.
The following resolution was introduced by C. S. Michael who moved its adoption:
RESOLUTION
AREAS, this Board, as the governing authority of Special Road and Bridge District
no. 4, of Indian River County, Florida, has heretofore, by resolution duly and legally adopted,
authorized and ordered the issuance of $445,000.00_2oad and Bridge 2efonding Bonds of said Dis-
trict, in the denomination of $1,000.00 each, dated January 1, 1937, for the purpose -of refund-
ing: (a) $3669000.00 outstanding Road and Bridge Bonds dated July 1, 1925, of said District,
as fully described in said authorizing resolution above referred to; and (b) $79,000.00 accrued
-and unpaid interest to January 1, 1937, on said outstanding bonds; and
WHEREAS, pursuant to the provisions.of_said refunding resolution first above referred
to, said $445,000.00 Refunding Bonds of said District have been duly validated and confirmed by
decree of the Circuit Court in and for Indian River County, Florida, made and entered on Sept-
ember 13, 1937,and said bonds have been duly executed and deposited with The First National Bang
in the -City of Chicago, Illinois, designated exchange agent, accompanied by formal'instructions
and authority for exchange of said Refunding Bonds for bonds of original issue and evidences of
interest accruals -thereon; and
WHEREAS, it now appears that, by reason of clerical error, interest coupons due July
1, 1937, in the sum of $10,560.00 were inadvertently included in calculating the interest ac-
cruals on outstanding bonds of original issue provided to be exchanged for bonds of said Refund-
ing Bond issue dated January 1, 1937, and therefore the amount of refunding bonds authorized to
be issued is $10,560.00 in excess of actual requirements for such exchanges, and said excess Re-
funding Bonds are a nullity and should be cancelled and destroyed; and
WHEREAS, it is contemplated that, in the course of this refunding operation, some of
the bonds and matured coupons of original issue may possibly be required to be paid and not be
exchanged for Refunding Bonds, in which event it would become necessary to cancel Refunding Bond
in an amount equivalent to any such original items so paid; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORLDA,
IN SESSION,DULY ASSEMBLED:
Section 1 (a) That the First National Bank, Chicago, Illinois, be and it is hereby

authorized and requested to cancel ten (10) of the said Refunding Bonds held by that institutio
as exchange agent and allocated to be exchanged for Ten Thousand Dollars ($10,000.00) of inter-
est accruals on outstanding Road and Bridge Bonds dated July 1, 1925, of said District, and to
carry forward to a „suspense account" the remainder, $560.00, of the excess amount as set forth
in the Third Preamble hereof, said residual amount to be added to any subsequent amounts of
original coupons hereafter reported as having been paid, as provided in Section 2 hereof, and
when said suspense account reaches a total of $1,000.00, or multiple thereof, anoquivalent
amount of Refunding Bonds allocated for exchange for such evidences of interest accruals shall
be cancelled by said First National Bank of Chicago, as specifically provided in Paragraph (c)
hereof.
(b) That said immediate cancellation of $10,000.00 Refunding Bonds be made by reason
of the circumstances set'forth In the Third Preamble hereof.
(c) That the said First National Bank, Chicago, Illinois, be and it is hereby further
authorized and directed, upon receipt hereafter of certificates from the State Treasurer as pro
vided for in Section 2 hereof, to cancel proper refunding bonds allocated for exchange for any
original bonds or matured coupons appurtenant thereto, described in such State Treasurer's cert
ficates as having been paid and cancelled.
(d) That the said First National Bank, of Chicago, Illinois, shall promptly forward
the State Treasurer, as Treasurer of the State Board of Administration, Tallahassee, Florida,
any and all mutilated refunding -bonds which are cancelled pursuant to the provisions of this
resolution, sending c°�ies of the letter of transmittal to the Clerk of this Board, and tp.•the
Fiscal Agent, R. E. Crummer & Company,.First Narional Bank Building, Orlando,
Florida, and to said Company at 800 First National Bank Building, Chicao, Ill.
Section 2. That the State Treasurer as ex -officio County Treasurer of Indian River
County, Florida, be and he is -hereby authorized and directed to prepare and forward to the said
First National Bank, of Chicago, -Illinois, a certificate listing and describing any bonds of
original issue, included within the scope of the above identified refunding program, which have
been cancelled and retired since the Refunding Bonds were executed and deposited with said bank,
and is further authorized to furnish such other and additional certificates to said bank, from
time to time and whenever the occasion arises, describing any Special Road and Bridge District
No. 4 bonds of original issue or matured coupons appurtenant thereto which may hereafter be paid
and retired, and the said State Treasurer is requested to forward copies of such certificates to
the Clerk of this Board and to the County's Fiscal Agent, R. E. Crummer & Company, First Nat
Bank Buildings, Orlando, Florida, and to said Fiscal Agent at 800 First National Bank Building,
Chicago, Illinois.
Section 3. That the Clerk of this Board be and he is hereby diree ted to forward
certified copies of this resolution to the State Treasurer as County Treasurer ex -officio, Talla
hassee, Florida, and to the First National Bank, Chicago, Illinois, which shall be their author-
ity to do and perform the acts provided for in Sections 1 and 2 hereof, respectively, and that
certified copies be also furnished the Orlando and Chicago offices of R. E. Crummer & Company."
The foregoing resolution was duly seconded•by Commissioner Vickers, and upon being,
put to a vote the same was unanimously adopted.
As provided by law, the State of Board of Pensions, furnished this board with a list
of persons residing in this County who now receiving Confederate Pensions from the State, each
having been checked over by the board was found to be correct. The following is the list of

The Clerk was instructed to write the Planning and Zoning Commission of this City and
request their presence at a meeting of this board to.be held Friday, April 15, 1938 at 1:30
P. M. for the purpose of obtaining advice, suggestions and counsel of the said commission with
further regard to selecting the right of way for the peninsula road from the south City limits
to the south County line.
There being no further business on motion made, seconded and carried the Board ad
ed to meet on Friday, April 15, 1938 at 1:30 P. M.

The Board of County Commissioners -of Indian River County met at the Courthouse in
Vero.Beach at 1:30 P. M., Friday April 15, 1938 in adjourned meeting, with the following members
of the board present, E. P. Poole, Chairman, S. E. Glover, Frank C. Vickers.and Edwin A. Helsett
Absent: C. S. Michael. Also present, Wm. Frick, Sheriff, Chas. A. Mitchell, Attorney, and Leile
Gray, Deputy Clerk.
The Chairman announced that this meeting was for the purpose of discussing a highway
on the ocean front from Beaebland Boulevard to the south lirie..of Indian River County. Discus-
sions were made by.R. R. Martin, W. T. Humiston, H. W. Guthrie, W. R. Duncan, W. H. Damerow and
S. E. Glover.
Motion was made by John Corsa, seconded by F. R. Jewett,that a Preliminary Survey be
made at once, which motion carried unanimously.
Motion was made by Commissioner,. S. E. Glover, seconded by Commissioner Vickers, that
the Preliminary Survey be authorized, not to exceed an expenditure of $150.00 which -amount will
be appropriated by the County Commissioners for that purpose. Such survey to be carried out
under the direction of the Chairman of the Board of County Commissioners, and.that a represent-
ative of the City Planning and Zoning Commission together with the City Engineer and the Secre-
tary of the Vero Beach Chamber of Commerce be requested to.cooperate with the Chairman of this
board in an advisory capacity, which motion was duly carried.
Bond of E. G. Thatcher as Notary Public in the amount of $500.00 with American Surety
Company, as surety was approved.
The application of Margaret Foster to be placed in State Tuberculosis Sanitarium in
Orlando, Florida was filed. Commissioner Frank C. Vickers made motion which was seconded by
Commissioner Glover that this matter be deferred until the next regular meeting to be held in
May.
