The Tax Assessor having presented his books showing the assessed valuation of proper-
ty -for examination by the Board in compliance with the requirements of Section 934 of the com
piled laws of Florida, and the Board of County Commissioners having given notice of fifteen days
by publication in the Vero Beach -Press Journal, -a newspaper -published in Aero Beach, in the
County of Indian River, that the Board would meet on this day as a Board of Equalizers for the
purpose of hearing complaints and receiving testimony as to the value of any property real,
personal or mixed,

The Board of County Commissioners of Indtn River- County met in the office of the Clerk
of The Circuit Court, in the County of Indian River, on this the 5th., day of July, 1938, at
in regular adjourned meeting
9t30 o'clock A. M /and tke following County Commissioners were present:. E. P. Poole, Chairman;
Edwin A. Helseth; Frank C. Vickers, S. E. Glover and C. S. Michael. Also present wer® fit i,.. Frick l
Sheriff, Charles A. Mitchell, Attorney for the Board, and Douglas Baker, Clerk.
Commissioner Helseth stated to the Board that he had sent in his resignation -hs mem-
ber of the Board of County Commissioners to Lion. Fred P. Cone, Governor and presented a wire
from the Governor accepting his'resignation as of July 5th., 1938 and said wire was ordered
filed with the Clerk and made a part of these minutes.
The Board then resolved itself into a Board of Equalizers of Taxes for the purpose of
hearing complaints and receiving testimony. as- to the -_value..of-any property, .real, personal or.
mixed, as fixed by the County Tax Assessorof Taxes, for. assessment- for the taxes of the year
1939, the owners and. agents :of .property, who appeared for that purpose, were allowed to make
full and complete statements as to the valuation of the property owned or represented by them
and the Tax Assessor and -the members of. the Board.'having . fully - discuss.ed :.the: ,. statements and
facts as presented decided not to change the valuations as fixed by the_County.Assessor.6f
taxes for the year 1938, and thereupon on -motion made`by 17'kank C. Vickers, seconded by S. E.
Glover and carried said assessment roll was approved.
The tax books being ready to be returned to the Tax Assessor for the, --purpose of ex-
tending the taxes thereon as provided by law the Board of County Commissioners took up the
matter of making an estimate of the necessary expenses for the fiscal -year from October 1st
1938 to the 30th day of September 1939, and having considered the receipts estimated by the Clerk
and the valuation of the property of the County as shown by the assessment rolls- thetty
prepared by the TaxAssessor and having given full consideration to the needs and necesei ie- of,
and the requirements for the different purposes to meet the expenses during the said fiscal year,
have determined and do hereby declare the following to be the expenses and all. special and extr-
aordinary expenses contemplated for the fiscal year next -ensuing and for which the revenue for
the year 1938 from ad valorem taxation and the estimated receipts from other sources will be
available

It was thereupon resolved that the Clerk of the Circuit_ Court be directed to have the
foregoing estimates as made by the Board published in a newspaper in this County by two inser-
tions and that a copy thereof properly certified .be forwarded to the Comptroller of the State
of Florida..

It was further resolved that at a regular- meeting of, thia Board ,ta,:bye° held. -on the . 2nd.
day of August, 19.389 the foregoing estimates shall. be taken up and considered and acted upon
and at the same time the tax levy for the year 1938,.will be. made.
Mr. F. C. Poppell again appeared before the Board with regard to erecting a monument
on the Court House grounds and after consideration the Board advised, - Ur* Poppell that they had
definitely decided that they would not purchase a monument at this ..time.
,Yr. Forrest C. Graves appeared before the Board. and.requested,the Board modify their
former action regarding the rental of County equipment to the extent that it might be rented in
emergencies when citrus Groves were threatened by high water caused.by excessive rains. No
action was taken.
Kr. W. S. Buckingham again appeared before the Board with regard to a bridge across
Blue Cypress creek. The Board a dvised Mr. Buckingham the.* would give considerable thought to
his request.
It was announced by the Chairman .that the time had arrived, namely on or before 10:00
o'clock A. M., for the opening of sealed bids in the office of the Clerk of the Circuit Court
of Indian River County, for two trucks and one tractor, as invited by public notice published
in the Vero Beach Press -Journal, a newspaper of general circulation, published at Vero Beach,
Indian River County, Florida, and sworn proof of the said publication of said -public notice
being herewith filed and reading as follows:

After careful consideration, on motion made by Frank C. Vickers, seconded by S. E.
Glover and unanimously carried, the Board accepted the bid as submitted by the Clewiston Motor
Company for the net.sum_of $2600.00
The Board agreed that it would consider truck bids with aveight (8) foot brace side
body job with D7 hoist, said body to be manufactured by Gar Wood and bids on two trucks with
bodies as described were submitted as follows;

After careful consideration on motion made by Frank C. Vickers, seconded by C. S.
Michael and unanimously carried the Board accepted the bid submitted by Vero Beach Cadillac
Company for two G. M. C. Trucks with Gar food Hoist and Dump bodies at a price of $2352.00
Harry W. Damerow appeared before the Board with a plat of Vero Gardens Subdivision
and stated the property was owned by the City of Vero Beach and that said Subdivision had never
been openned and that the City desired that the Subdivision be retained or put back in acreage
On motion made by Frank C. Vickers, seconded by S. E. Glover and carried the plat was approved
and ordered filed by the Clerk. Mr. Damerow also presented the Board with a blue print of the
ocean beach road survey, the Blue print was accepted and ordered filed in the Clerk's office.
Miss Leila U. Bunkley, County Nurse, appeared before the board and filed Nurse's
report as to her activities for the month of June 1.438, as follows to -wit:

the paupers fund for the care of M. M. Hat�away until the further ordered of the Board.
it was ordered Daisy Barker, Wabasso, receive the sum of $15.00 per month in lieu of
$8.00 for the remainder of the summer months.

Mrs. J. U. Tillis _appeared before the Board and requested. the- County, to have her
dwelling repaired as it was badly in .need of repaira.. On'motion.made .by.C. S. Michael, Se
by S. E. Glover and carried.it was so ordered and Frank A. might, Road -Superintendent was
instructed to have said.-- repairs made.
Commissioner C. S. Michael delivered a check for $26.08 representing , refund. of
serum.used on employees of the Deer Field Groves and it was ordered that this amount be placed
in the General Rgvenue.Fund.
Mr. George James appeared.b efore the Board and requested the County to accept title
to the Minter Beach Cemetery in order that a W. P. A. project-.might.be-.obtained fnr said cem-
etery. It was moved by S. E. Glover, seconded by Frank C. Vickers.and carried..that_the County
accept title to the Winter Beach'Cemetery and sponser a W. P. A. project in order to improve
the present condition of the cemetery.
It was ordered that transportation be furnished for approximately 7 boys to the C.C.(
Camp at West palm Beach and Frank A. Knight, Road Superintendent was instructed accordingly.
Douglas Baker, Clerk, was instructed to write Hon. Angus Sumner, Assistant State
Attorney, and request his presence at the next regular meeting of this Board.
The Chairman appointed W. R. Duncan, Charles A. Mitchell and Frank C. Vickers as a
committee to investigate the possibility of the County obtaining some land bordering on Blue
Cypress Lake.
Bids on gas & oils were received.from the American -Oil Company, Sinclair refining
Company and the Standard ail Company. On motion made by S. E. Glover, seconded by Frank C.
Vickers and carried it was ordered that Sinclair refining Company be awardered this business
for a six months period ending December 31st 1938.
It was reported t#e bath house at Wabasso was gradually being destroyed and on moti
made by C. S. Michael, seconded by S. E. Glover and carried it was ordered the County post a
$100.00 reward for the conviction of any person or persons defacing, destroying or injuring
said bath house.

RESOLUTION
Commissioner Michael introduced the following resolution and moved its adoption,
Khereas, Johnny Smith was convicted bf murder in the first degree, in the year 1936,
in the fall term of the Circuit Court in and for Indian River County, Florida, and at such
term of said Court was sentenced to death by the Judge of such Court; and
Whereas, the said Johnny Smith did take his writ of error from said judgment to the
Supreme Court of Florida, and said Court has long since affirmed the judgment of the lower
Court; and
Whereas, many months have passed and the said Johnny Smith remains in the County Jail
of Indian River County, Florida, at the expense of the taxpayers of said County, and because it
appears that no death warrant has been signed by the Governor of Florida under which the said
Johnny Smith could be removed from the.County Jail of Indian River County, Florida and placed
in the State Prison at Raikord, Florida; and
Whereas, many citizens and officials of Indian River County have written and other
wise communicated with the office of the Governor of the State of Florida, and with the office
of the Attorney General of Florida, and despite such communibations no action has been taken
whereby the said Johnny Smith can lawfully be placed in the State Prison.at:'Iaiford; and
Whereas, the Attorney General of the State of Florida has advised an official of
Indian River County, Florida that the entire record with regard to the said Johnny Smith has

been in the office of the Governor of Florida since January 3rd, 1938; therefore
Be It Resolved., That the Board of County Commissioners of Indian River County,Florida,
in its own.behalf and at the request of many petitioning citizens, does herewith formally re-
quest the Governor of the State of Florida to.do any and all acts that may be necessary in
order that the said Johnny Smith may be removed from the County Jail of Indian River County,
Florida and placed in the State Prison at Raiford, Florida, and the sentence of said Court be
carried out, and that such action be requested immediately in order that there may be due enfor-
cement of the laws of the state and in order that the taxpayers of Indian River County, Florida
may be relieved of a burden which properly should not be borne by them.
Be It Further Resolved, That a copy of this resolution be transmitted to the Governor
of the State of Florida; a copy be transmitted to the Attorney General of Florida; a copy be.
transmitted to the presiding Judge of Division C of the Circuit Court for the Ninth Judicial Ci3
cuit of Florida; and that a copy hereof be transmitted to-the*State Attorney for the Ninth Jud -w
ictal Circuit of Florida.
The motion for the adoption of the resolution being.duly seconded, it was declared
adopted by the following vote:
Ayes: Glover, Michael, Poole and Vickers.

RESOLUTION.,
Coismissioner Glover introduced the following resolution and moved its adoption, to, wi
Whereas, the Works Progress Administration quota for Indian River County, Florida,
exclusive of the sewing room, is 19; and
Whereas, not less than 75 men, and probably a number of men in excess of 1006 are
badly in need of work in Indian RiVer County at this time, and they and their families are
without means of support, and all of.said men are qualified for WPA work under the rules and
regulations of the said Works Progress Administration; and
Whereas, Indian River County has appropriated a sum -.-of money sufficient to meet.its
share of.a WPA project in connection with planting oyster beds in this county, and said project)
has been approved and all equipment has been placed'in the county, and the persons in charge
of said project have requisitioned the Indian River County Works Progress Administration office
for 75 men, and the said office i -s unable to furnish said men by reason of the low WPA quota ink
said county, although -there are 75 or more men in said county nova oat of work and in extreme

Whereas, by reason of seasonal conditions a much larger WPA quota is needed in said
county in the summer months`than-in the winter months; therefore
Be It Resolved: That this Board requests those having any influence in the matter of
Works Progress Administration quota do everything possible to secure an increased Works Progres
Administration quota for Indian River County, and that a copy of this resolution be forwarded
to Senators Charles 0. Andrews and Claude Pepper, Congressman J. Mark Wilcox and State Works
Progress Administrator R. J. Dill.
The motion for the adoption of the resolution being duly seconded it was declared
adopted by the following vote;
Ayes: Glover, Michael, Poole, Vickers.
Nayes: None.
The County Depository filed its monthly statement, showing receipts and disbursements
of the various funds which having been audited were found to be correct.
The several bills and accounts against the County having been audited, were examir►ed
and found correct.were approved and warrants ordered issued in settlement of same, such bills
and accounts being on file in the office of the -Clerk of the Circuit Court. The warrants iss-
ued from the respective funds being listed in the supplemental minute book as required by the
rules and practice of the State Auditing Department, reference to said record and the list so
recorded being made a part of these minutes.
There being no further business on motion made, seconded and carried, the Board
adjourned.
