The Board of County Commissioners in and for Indian River County, Florida met at the
Courthouse in Vero Beach, at 10:00 o'clock A. M. Thursday, January 5th,, 1939 with the follow-
ing members of the Board, who had been elected at the election of. November 8th.; 1938, present:
Albert 0. Helseth; Frank C. Viokers; S. E. Glover and W. C. Graves,,Jr. Absent, Co' S. Michael
Also present were William Frick, Sheriff;. Charles A. Mitchell, Attorney for the Board and
Douglas Baker, Clerk.
On motion made by Frank C. Vibkers seconded by S. T.,Glover and unanimously carried
G. S. Michael was elected Chairman of the Board until its further'irders.
On motion made by Frank C. Vickers seconded by S. E. Glover and unanimously carried
Albert 0. Helseth was elected Chairman Protem until such time that Commissioner Michael's
physical condition would permit him to attend the Board meetings.
On ipotion made by S. E. Glover seconded by W. C. Graves, Jr. and unanimously carried
Charles A. Mitchell, of the firm of Vocelle and Mitchell was elected as County Attorney at a
salary of $75.00 per month for any and all legal service whatsoever, with the understanding no
expense charge will be incurred against the County unless it is necessary to go beyond the limit
of this Judicial Circuit on business for the County.
The following persons were named -for the position indicated, for the ensuing year,
and at the salary stipulated:

After careful consideration and discussion it was moved by W. C. Graves, dr. seconded
by Frank C. Viokers and unanimously carried that the Board accept the bid of Chas. S. Kuster
subject -to the fallowing requirements of this Board, to -wit:
1. That survey be made by surveyor approved by this Board but at the expense of
purchaser in order to define definitely the boundary of the property.
2. That such survey shall show the property to.be the property pointed out by the
purchaser to members Of the Board and that the actual property so shown by such survey.be the
property the members of the Board have in mind as the property herewith provided to be sold.

3. That the sale be subject to the purchaser building ten (104 residences upon the
property within twelve (14) months from this time and each of said residences to be of an
actual value of not less than $2500.00 and that the purchaser shall procure an Abstract on
property to date at purchaser's expense and such Abstract shall not disclose any restrictions
upon the right of the County to sell the property as herewith provided.
L. Knight representing Standard Oil -Company appeared before the Board and request-
ed the County Gasoline and Oil business fcr the next six months. On motion made by W. C. Graves
Jr. seconded by Frank C. Vickers and unanimously carried it was ordered that all Petroleum
Products be purchased from the Standard Oil Company for the next six months ending June 30th.,
1939 unless otherwise provided, this action is.taken with the understanding and requirements
that the Texas Company shall receive the County Gasoline and Oil business for the six months .
period beginning July lst. and ending December 31st., 19399 that the American Oil Company shall
receive the County Gasoline and Oil business for the six months period beginning January 1st.,
ending June 34th., 1940 and that the Sinclair Refining Company shall have the County Gasoline
and Oil business beginning July 1st., and ending December 31st., 1940.
W. C. Graves, Jr. was appointed from this Board, with power to act, as a member of
State Road No. 30'right-of-way Committee.
Oscar L. DuBose, Charles D. Toole, J. W. Crowley, C. M. Williams and E. G. Thatcher
appeared before the Board and requested a donation of $300.00 for the purpose of assisting the
Vero Beach Band Association in purchasing new uniforms for the Band. On motion made by W. C.
Graves, Jr. seconded by S. E. Glover and unanimously carried -this request Was granted and it
ordered a Warrant be issued to the 'Pero Beach Band_As.sociation.for'the sum of $300.00 on the
publicity account of the General: Revenue Fund.
Secretary E. G. Thatcher also requested the Board.appropriate $100.00 from the publi-
city fund for the.Chamber of:Commerce. This request was granted and it was ordered a Warrant
be issued to the Vero Beach Chamber of Commerce for the sum of ;100.00 on the publicity account
of the General Revenue Fund.
W. C. Graves, Jr. was appointed ex -officio member in place of E. P. Poole of Indian
River County Planning Council which is a part of the State Planning Board.
It was ordered Mrs. Gus. Samuelson be placed on the paupers list to receive the sum
of $10.00 per month until the further orders of the Board.
It was ordered a Warrant be issued on the General Revenue Fund to Mrs. Jessie Yates
for the sum of $10.00.
It.was ordered Mrs. Dora Tucker of Sebastian be removed from the paupers list.
It was ordered transportation be furnished for four COC boys from Vero Beach to West
Palm Beach and that the cost of tr�ansportatidn be furnished for two COO boys from West Palm
Beach to 'Pero Beach which will be approximately $2.00.
As provided by law a list of Confederate Pensioners of this County was received from

the Pension Department and carefully checked over and found to be correct, same were approved
and ordered transmitted back to the Pension Department, as-f6llows, to -wit;

ODMMUsioner S.S.Glover introdueed the following resolution and moved its, adeptivn, to -wit:
WE REAS, it is the duty of the County Commissioners of the several counties.in
Florida to hold a meeting of the Boards thereof in the first week.of January of each year, or
as soon thereafter as practicable, for the purpose of selecting and making out a list of per-
sons properly qualified to serve as jurors in such respective counties, and thereupon to sign,
verify and certify such list and to deliver the same to the Clerk of the Circuit Court; and
WEEREAS, the Board of County Commissioners of Yndiani ffii.ver County, Florida, are this
day meeting in regular session of said Board on January 5, 1939, being in the first week of
January of said year, and at such time ado have before them their duty with regard to such jury
list and do find at such meeting that one member of said Board, namely, Hon. C. S. MiehaeVs is
ill and confined to his home and Is unable to be present at this meeting of said Board, or at
any special meeting thereof prior to the next regular meeting of this Board -to be held February
79 1939, and that the said C. S. Michael is representative of a Commissioner's district having
a large population and from which should be selected persons to serve as jurors in Indian River
County and that by reason of such illness of C. S. Michael it is not practicable to select such
list of jurors at this meeting of this Board or at any time hereafter until the meeting of this
Board to be held February 7, 1939; therefore,
BE IT RESOLVED that this Board does herewith.determine that the regular meeting of
said Board to be held February 7, 19399 is as soon after the first week of January of 1939 as
is practicable for the%.seleotion of such list of jurors as is provided by law, and that,
therefore, this Board shall at its regular meeting to be held February 7, 1939, select said
list of jurors and sign, verify and certify the same as required by law.
The Resolution was duly seoonded by Commissioner Frank C. Vickers and upon being put
to a vote the same was unanimously adopted.
Bliss Leila M. Bunkley, County Nurse, appeared before the Board':and made a report of

The report`_'from Dr. Kirby Smith in regard to Mr. Perry Padgetts eye was cancer seems
to be arrested and condition very good.
Drs. Hardee and Clements gave services for five tonsil cases at the Indian River
Hospital.

A transient was found.ill by the Highway at Winter Beach and taken to the Hospital.
The Red Cross paid for care of same.
The nurse also assisted with the Christmas celebration.
On motion made by S. E. Glover seconded by Frank C. Vickers and unanimously carried
it was ordered the County Nurse be instructed that authorization be made by her on behalf of the
County Commissioners for the expenditure of.County Funds other than at a regular meeting Of the
Board only in the event of emergencies and in such emergencies the County Nurse be authorized
to incur a tdtal expenditure of not to exceed $10.00 and in the event of an emergency regarding
the expenditure of more than,$10.00 the same be not authorized unless with the approval of the
member of'the Hoard from the District in which the emergency arises.
Also that when patients or -applicants who are employed or own their homes or other
property apply for County Assistance that same be not authorized.

The County Depository filed its monthly statement, showing receipts and disbursements
of various funds which having been audited were found to be correct.
The several bills and accounts against the County having been audited, were examined
and found correct were approved and warrants ordered issued in settlement -of same, such bills
and accounts botag on file in the .Office of the Clerk of the Circuit Court. The warrants issued
from the respective funds being listed in the supplemental minute book as required by the rules
and practice of the State Auditing Department, reference to said record and the list ,so record-
ed being made a part of these minutes.

The Board of County Commissioners of Indian River County�met at the Court house in
Vero Beach, at 10:00 o'clock A. M., Tuesday, February 7th., 1939 in regular meeting with the
following members of the Board present; Albert 0. Helseth, Chairman Protem; S. E. Glover; W. C.
Graves, Jr.; C. S.. Michael and Frank C. Vickers. Also present was Charles A. Mitchell, Attorney
for the Board; Wm. W. Frick, Sheriff and Douglas Baker, Clerk.
The minutes of January 5th., 1939 were read and approved.
