The Board of County Commissioners in and for Indian River County, Florida,met at the Court House in Vero Beach, at 10:00 o'clock A, M.,Tuesday, December 5th., 19399 in Regular meet Ing with the following members of the Board present: C. S. Michael, Chairman; S. -Z. Glover; W. Graves, Jr. and Albert.O. Helseth. Absent: Frank C. Vickers..Also present were William W. Frick, Sheriff, S. .N. Smith, Jr., Acting Attorney, and Leila Gray, Deputy Clerk. The following letter was reed.to the Board and ordered,.made a part of the minutes, Vero Beach, Florida December 2, 1939 Board of Commissioners Indian River County Gentlemen: A meeting of the.licensed practising physicians of Indian River County was held December 2, 1939 for the purpose of reoommending a county nurse to the Board. Alice Helseth of Oslo, Florida was the choice and I have been authorized to sent this written report to you. Respectfully submitted. David Rose. David Rose,M.D. Chairman.. A delegation headed by Thomas A. Ward and A. W'* Young appeared before the Board in be- half of Leila M. Bunkley, County Nurse, requesting that the Board defer the matter of accepting the Doctorts' recommendation until a future date. The Roard granted this request and assured the delegation that no action would be taken before the first regular meeging in January, 1940. _ The _Clerk was instructed by the, Board. of County. Commissioners -to. notify Frank Vit,. Jewett, of Verc Beach, and J. J. Bustin, of Fellsmere_, the time of this meeting*. Motion was made by W. C. Graves, Jr., seconded by Albert 0. Helseth, and carried that Mrs. Clarence Fertic .be paid $9..00 per month for the 'months- of -December, 1939, January -and lreb ruary, 1940, and that no grocery orders be given her.. It was moved by W. C. Graves, -Jr., seconded by Albert 0. Helseth, and carried that road work for Mr. Charles Harris be approved to..the.extent_of $100.00, provided the monhy be ,paid in advance, and when that.amount has been expended.the work thereon to cease so far as the Countyt s part. Motion by Albert 0. Helseth that the County permit the use of drag line and two truc on Beautification Day and seconded by W. C. Graves, carried. The Board instructed E. F. Carter, Road Superintendent, to patch all roads of the County needing such repairs, The.Board also.authorized Road Superintendent to purchase one car load of rock. After discussift, B. E. Carter, Road Superintendent, was authorized and instructed to purchase Motor for Oil :spreader. Attorney S. N, Smith, Jr, introduced a Resolution on Special Road and Bridge #4 Fund, Jr., and after discussion, W. C. Gravesimade Motion which was seconded by Albert 0, Helseth, that Resolution be adopted,,which Motion carried, said Resolution being in the words and figures, following: adoption: R3S0LUTION. Commissioner W..C. Graves, Jr., introduced the following resolution and moved its 0 WHEREAS, there'Lhave heretofore been issued Refunding Bonds (hereinafter identified as "said Refunding Bonds") for the purpose of refunding outstanding road and bridge bonded indebt- edness of this Counter, said Refunding Honds.being described as follows: Date of Issue January 1, 1937 Tamp& Unit aDesignation SPECIAL ROAD AND BRIDGE DISTRICT NO. 4 ROAD AND BRID,4 REFINDING BONDS 1 1 011 30 January 1, 1938 WABASSO BRIDGE DCCT REFUNDING BONDS WHEREAS, semi=annual interest coupons will become due and payable, on said Refunding Bonds as follows: Uxin, g Unit Coupon -Maturity Date_ Spedial Road and Bridge District No.4 January 1, 1940 #abasso Bridge District January 1, 1940 WHEREAS, it is the desire of this Board to make funds available for the payment of said interest coupons on said Refunding Bonds; and WHEREAS, the State Board of Administration -is authorized to make payments in ac hdwith under the terns of an order entered in the case of "Meredith, et al., Plaintiffs, vs. Fred P. Cone, et al,. Defendant", being Case No. 37 in the Tallahassee Division of the United States District Court for the Northern District of Florida; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMSIONERS'OF INDIAN RIVER COUNTY, FLORIDA, IN SESSION DULY ASSEMBLED: Section 1. That the State Board of Administration, Tallahassee, Florida, be, and it is barbpy, requested, instructed, and directed to cause sufficient funds now, or hereafter, credited to the applicable Kanner Bill Account.for the taxing units iddntified in the, preambles hereto to be transferred from said applicable Kanner Bill Account to the applicable Interest and Sinking Fund Account of the:f-said Refunding Bond issues identified in the preambles hereto so for that the funds in said applicable Interest and Sinking Fund Account, making due allowanoelfunds already therein not heretofore ear -marked for specifid" interest payments, will be the amounts set forth in the following tabulation; and, after. said transfer is made, said Board shall cause.) the said funds to be applied to the payment of interest coupons on said Refunding Bonds as fol- lows: ` Amount.of.Bdlanoe Coupon Taxing Unite after Transfer Naturity Dat, e Special Road and Bridge District No.4 89900.00 January 1, 1940 Wabasso Bridge District 1,540..00 January 1, 1940 Section 2. That the Clerk of this Board be, and he is hereby, instructed and direote (1) to furnish the State Board of Administration with a certificate in duplicate -as to each taxing unit setting forth the Refunding Bonds issued since the date of the last certificate of similar nature executed by him; and t2) to hereafter execute similar certificates covering any exchanges made subsequent to the date hereof. Section 3. That, in addition to the amounts hereinabove provided to bo tranferred, the State Board of Administration is hereby authorized to transfer from the applicable Kinner Bill Account for the taxing units identified in the preambles hereof to the applicable Interest and Sinking Fund Account of the said Refunding Bond -'issues identified -An the preambles hereof, either now or As funds become available from future collections, a sum of money sufficient to permit funds to be placed with the Paying Agent for the said Refunding Bond issues to replace any funds heretofore sent to the Paying Agent to be applied in -payment of interest on said Re- funding Bond -issues but which have subsequently either been recalled because of peremptory wtit of mandamus or impounded because of the service of alternative writs of mandamus, said remit4 Lance to be made, at the option of the Board of Administration, either at this time or at such time-as..any of such coupons are presented to the Paying Agent for payment; provided, howevdr, that in the event the latter option is elected by the Board of Administration, the said Board is hereby requested to make arrangements with the Paying Agents -to be notified when any funds are needed for this purpose. Section 4.. That the intent of this resolution is to make present provision for the payment, when and if presented, of all interest through the neat coupon paying date on all Re- funding Bonds Identified in the.preambles hereof; and any action by the Board of Administratic to accomplish this result, not inconsistent with the Order entered in the Meredith case identi- fied in the preambles hereof, is hereby fully authorized, including the transfer of sufficient funds from the applicable Kanner Bill Account to.the applicable Interest and Sinking Fund Accou of the issues identified in the preambles hereof to permit the payment of interest coupons on the identified issues of Refunding Bonds. Section 5. That the Clerk of this Board be, and he is hereby, instructed and directed to forward duplicate certified copies of this resolution to the State Hoard ,of Administration, Tallahassee, Florida, which certified copies shall constitutethe authority of said Board to do and perform the acts hereinabove directed. The Resolution was duly seconded by Albert 0, Helseth and upon being put to a vote the same was unanimously adopted. * * * * * * * * * * * The letter from.Hon. W. V. Snott, State Treasurer, with off6t of Bonds from State Board of Administration for Special Road & Bridge District #1 was read and after discussion it was decided by the Board that the price on these Bonds was too high, sbma,vhaving been recently purchased for $95.,00 with coupons attached, and the Clerk was instructed to so notify the State Treasurer. The Clerk was instructed to ascertain the company next in line for gasoline and oil businers and so advise their Agent. Jr., Motion was made by.Albert 0, Helseth, seconded by W. C.. Graves dthat L. E. Carter, Road Superintendent, be allowed to purchase any and all necessary needs to an amount not exceed - Ing $25.00. It was decided by the Board that the work on the road across the marsh be postponed temporarily inasmuch as the County is without suffi9tent funds at the present time to carry on the work. Leila M. Bunkley, County Ngrse, appeared before the Board with reference to bills Past due. It was decided by the Board that in some instances the charges made were too high, a limit of $25..00 having,been previously adopted by the Board and upon Notion of Albert 0. HelsetY�, seconded by W. C. Graves, Jr., that the County pay $25.00 only on operation performed by Dr. E. B. Hardee for Henry Owens, for major surgery, which Motion carried. Miss Bunkley also called to the Board's attention.,the fact that Preacher Bains, Colored, at Sebastian, is bed -ridden in need of certain supplies. It was ordered by the Board that Miss Bunkley see Bommissioner Frank C. Vickers, and what ever amount Commissioner Vickers thought sufficlout for his needs, be paid to William Daniels therefor, same would be approved by the Board. Motion was made by W. C. Graves, Jr., seconded by Albert 0. Helseth that County pay $30.00 on the expense of Hospitalization for the operation of Nellie Eason, which amount L9 to be reimbursed in an amount of not. less than., $2#00 per week by Dr. M. D. Councile Said Motion carried. Miss Leila M. Bunkley, County Nurse, appeared before the Board and filed "reports as to her activities for the months of October and November, as follows to -wit: County Nurse's Monthly Report October - 1939 Total number of cases for the month 82 Number of visits to cases 104 Number of visits in behalf of cases 40 Number of office interviews 46 Number of cases to private physician 12 Number of oases to E.E.N.T. Motion was made W. C.,Graves, Jr., seconded by _Albert 0, Helseth, that the County pay for one page of advertising in the Special.Rdition of the 'Pero Beach Press Journal at $40s which motion carried. Motion was made by Albert 0. Helseth, seconded by W..C. Graves, Jr.,,that Mays. Shell 0 Kersey be paid $5.00 per month_until..the further orders of the Board. e It, was- ordered.. that. J.,. V. -Johnson. be removed from the Pauper* s hist as he is now re- ceiving State Aid for the bli,hd. After discussion Be E..Carter,.Road Superintendent, was instructed to write Okeechobei County Commisssioners with reference to road.on-or across marsh, with the understanding , and offer of Indian River Cbunty to pay half of the expense on the road in question. Upon.motion of.W. C. Graves, Jr.,'seoonded by Albert O..Helseth, all bills heretofore] i rendered for work which._.had.. been performed by. the.. Smith of Fellsmere, appeared before the Board asking for aid. It was or - dared by the Board that Leila M. Bunkley, County.Nurse, be instructed to investigate and make report to the Board. Hon. 'Troy Be Moody presented his List of Errors & Insolvencies for the year 1938, which was duly approved by the Board. approved. adoption: TUe application of Floyd Be Boyer, for Liquor License to sell package goods was R E S O L U T I O N Commissioner Albert 0. Helseth introduced the following resolution and moved its WHEREAS there is a balance in the General Revenue Fund of $6814.36 and a balance of $307.94 in the Road &.Bridge Fund, funds under the control of this Board, and, WHEREAS, due to the heavy demand that has.been made upon the 'Road & Bridge Fund of this County to meet the current and extraordinary expenditures; , BE IT RESOLVED, that the sum of $1000.00 be transferred from the General Revenue Fund to the Road & Bridge Fund, upon the approval of the State Comptroller, to assist in meeting the current and extraordinary expenses of the County. Uoen being put to a vote the same was unanimously adopted. The several bills.and accounts against the County.,.having been audited were examined and found correct, were approved and warrants ordered issued in the settlement of same. Such bills and accounts being on file in the office of the Clerk of the Circuit Court. The warrants so issued from the respective funds being listed in the supplemental minute book as provided by the rules of the State Auditor, reference to such record and the list so recorded being made a part of these minutes. The County Depository Piled its monthly statement, showing receipts and disbursements of the various funds which having baba audited were found to be correct. There being no further business on motion made, seconded and carried the Board then adjourned. Tuesday, January 2nd., 1940' in Regular meet- ing with the following members of the Board present: C. S. Michael, Chairman; S. E. Glover; W. C. Graves, Jr. and Albwrt 0. Helseth. Absent: Frank C. Vickers. Also present were William W. Frick, Sheriff, Xitdhell; Smith.8y Mitchell, Attorneys for the Board and Douglas Baker, Clerk* On motion made by S. E. Glovar, seconded by ---W. C Graves, Jr., and unanimously carries the law firm of Kitchell, Smith & Mitchell --was-.elect-ed- County_ Attorney for -the ensuing year# designated to -act when in town, at a salary Chas. A. Mitchell../of $75...00 .per. month -for any and all legal service whatsoever, with the under -standing no expense charge will_be incurred against.the County unless it is necessary to go beyond the limit of this Judicial Circuit on business for the County. The following personswere named for the positions indicated for the ensuing year, and at the salary stipulated: E. E. Carter, Road Superintendant, $125.00 per month County Engineer, $50.00 per month. Miss Leila M. Bunkley, County Nurse, $133.00 per month. Frank Behler, Janitor, $75.00 per month. W.. E. Walker, Winter Beach Bridge Tender, $60.00 per month. It was ordered the salary of the Judge of the Juvenile Court be set at $25.00 per month and that the salary of the County Judge be set at 75.00 per month.. It was ordered the salary of Supervisor of Registration be set at $50.00 per month. Application for the pasition of Winter Beach Bridge Tender was received from Mr. J. Blanton and he was advised that Bir. W. E. Walker, Winter Beach, Florida, had been given the position. Mr. W. T. Knight, Gifford, Florida, requested that a Fruit Stand be moved off the Dixie Highway and he was referred to Mr. Hdath of the State Highway Department and to the Patrolman of said Highway. It was ordered Mrs. Emma Lewis be removed from the Pauper's List=�as she is now em- ployed in the Housekeeping Aid Project. It was ordered George W. Washington be placed on the Pauperts list to receive the sum of $5.00 per month, with the understan4ing that no grocery or medicine orders be given until the further orders of the Board.. Mother's Pension application for Freda Marie Keffer was approved for the sum of per month until the further orders of the Board. 1
