That if any portion of this contract shall be legally declared inopera- II tive, or void, said contract, shall, at the option of First Party, be considered as fully oper- ative without such inoperative or void portion; and, in any event, Second Party sha11 not be entitled to receive any benefit from this contract without compensating First Party for the reasonable value of services actually received. Such bills and accounts being on file in the office of the Clerk of the Circuit Court. The warrants so issued from the respecive funds being listed in the supplemental minute book as provided by the rules of the State Auditor, reference to such record and the list so recorded being made a part of these minutes. The County Depository filed its monthly statement, showing receipts and disbursements of the various funds which having been audited was found to be correct. M. Wednesday, October 16th, 1940 in regular adjourned meeting with the following members of the Board present: C. S. Michael,, Chairman, Albert 0. Helseth, W. C. Graves, Jr. and Frank C. Vickers. Absent: S. E. Glover. Also present were Chas. A. Mit Attorney for the Board and Douglas Baker, Clerk. The County Assessor of Taxes, W. R. Duncan, appeared before the Board and presented the tax rolls for the year 1940 on real and personal property and also intangible tax roll,. I' i which were carefully.examined and found correct and on motion made by W. C. Graves, Xr., second I� ed by Albert 0. Helseth and earried were approved, and the warrant to each of said rolls were annexed thereto and is in words and figures following: THE STATE OF FLORIDA. To Troy E. RESOLUTION -CANCELLING QUAY BRIDGE DISTRICT BONDS. Commissioner W. C. Graves, Jr., introduced the following resolution and moved its WHEREAS, The State Board of Administration is holding uncanoelled the following bonds purchased under Chapter 15891 known as the Kanner Bill, more particularly described as follows: Quay Bridge District Bonds Dated December 1, 1922 Bond No. 12 due 12-1-34 With�no coupons attached $19000.00 Bonds Nosh 14 & 15 due 12-1-35 With coupons due 12-1-33 , 6-1-35 and 12=1-35 attached $2,000.00 Bond No. 17 due 12-1-36 With no coupons attached S1,000.00 $49000.00 WHEREAS, After careful consideration the Board of County Commissioners of Indian River County, Florida, deems it to the best interest of the County and said Bridge District to cancel the bonds described above, and so declares, THEREFORE BE IT RESOLVED, By the Board of County Commissioners of Indian River County Florida, that the State Board of Administration instruct W. V. Knott, Treasurer of said Board ti .cancel and.'retire said bonds and furnish to this Board an accurate list and description of the bonds and coupons so cancelled that the same may be duly entered.upon the bond record of Indian River County. BE IT FURTHER RESOLVED$ That a certified copy of this resolution be furnished the State Board of Administration by the Clerk of this Board. The resolution was -duly seconded by Commissioner Vickers and upon being put to a vote the same was unanimously adopted. Hon. Geo. -T. Tippin, Supervisor of Registration, requested advance of $50.00 to use in connection with Fair in Tampa, same to be refunded after Fair is over. Motion that -advance be made from General Revenue Fund.by_Commissioner Vickers, seconded by Albert 0. Helseth and carried. E. E. Carter appeared before the Board with regard to moving trees on State Road 30. It was,ordered.the County remove trees and care for all expense in connection with moving trees and fences, the owners granting Right -of -;day. Chairman Michael appointed W. C. Graves, Jr� and Albert 0. Helseth to serve as a committee to work this out with E. E. Carter, Road Superin- tendent. Douglas'Baker, Clerk was instructed to write the County Commissioners of Brevard County requesting them to authorize Indian River County to proceed,: at some oonvenient.time, with the repairing of the Sebastian Inlet Road.south of the Sebastian Inlet in Brevard County at the -same time the repairing is done on the same Road in Indian River County with the under- standing that Brevard County would pay their proportionate part of the cost. It was ordered the list of purged voters be published, as provided bylaw in the Vero Beach Press -Journal, a newspaper in Vero Beach, Indian River County, Florida. Douglas Baker, Clerk presented the annual statement from October 1, 1939 to Septemb 30th.9 1940 of all receipts, disbursements, assets, funds and unpaid warrants of Indian River County which was approved and ordered filed in the Clerk's office and a copy of the some mailed to Hon.
