The Board of County Commissioners of Indian River County met.at the Court house in

Vero Beach, at 10:00 o'block A. M. Tuesday December 2nd, 1941 in regular meeting with the
following members.. of the Board . present: C. S... Michael, - Chairman, Albert . 0. - Hel Seth, W.. C .
Graves, Jr., Frank C. Vickers and S. L. Glover.. Also present were Chas. A. Mitchell, Attorney
for the Board, Wm. W. Frick, Sheriff and -Douglas Baker, Clerk.
E. E. Carter, County Engineer, made a report as to the condition of the roof of the
Jail and Court -House and recommended certain roofing materials be purchased and the same
applied on the roof of the Jail
On motion made by Commissioner Graves, seconded by Commission Vickers and carried,
it was ordered that material for waterproofing the roof of the Jail, which was guaranteed for
three (3) years, be purchased from the firm of Luther and Knight as per statement submitted
by them.
The Board then proceeded to approve the commissions due the assessor of taxes, W.
R. Duncan, from the various and several special taxing districts within the County, for commis-
sions due for assessing the taxes and preparing the tax roll for the year 1941, as indicated on
statement submitted by Mr. Duncan, and the following statements having been audited, on motion
made by Albert 0. Helseth,.seconded..by S. E. Glover and carried, were approved.by the Board wi
the exception.of the .General School Commission and this to be approved upon a favorable opinion
from the Attorney General stating that this item should be paid by the Board of County Commis-
sioners;

(2) That said Tax Sale:.Certifioates or any interest therein, has not been hypothe-
cated, sold, assigned, transferred or delivered by as and I have received no consideration
therefor.
(3) That said Tax Sale Certificates have been lost or destroyed and that I have made
diligent search and em unable to locate said certificates.
(4) That if duplicate Certificates are issued in lieu thereof and the originals
should at any time be located, the same will be surrendered to the Clerk of the Circuit Court)
of Indian River County for cancellation.

RESOLUTION - TRANSFERRING FUNDS FROM FANNER ACT TO INTEREST AND
SIN$ING FUND ST. LUCIE COUNTY REFUNDING BONDS.
Commissioner Braves introduced the following resolution and moved its adoption to -wit:
WHEREAS, St. Lucie County, Florida, has heretofore caused to be issued Road and Brid
Refunding Bonds bearing date of July 1, 1937, to be exchanged for outstanding funded indebted-
ness of said St. Lucid County; and
MMFMAS, of such indebtedness this County is justly indebted to said St. Lucie Count
in the proportionate share which has heretofore been established and fixed on the records of
the State Board of Administration, and for which proportionate share this Board has heretofore
caused to be lodged with the State Treasurer as County Treasurer ex officio, Road and Bridge
Refunding Bonds bearing the same date, interest rates, and terms of payment as the Road and
Bridge Refunding Bonds provided to be issued by St. Lucie County; and said State Treasurer as
County Treasurer ex officio has necessary instructions for the issuance of said bonds from time
to time as the circumstances warrant; and
WHEREAS, semi-annual interest coupons on said Road and Bridge Refunding Bonds of this
County will become due and payable January 1, 1942, and it is the desire of this Board to make
funds available for the payment of coupons maturing as set forth above, from such Refunding
Bonds as are issued by the.State Treasurer as County Treasurer ex officio under instructions
heretofore furnished him;
NOWs THEREFORE, BE IT RESOLVED BY THE BOARD OF, COUNTY COMMISSIONERS OF INDIAN RIVER
COUNTY, FLORIDA, IN SESSION DULY ASSEMBLED:
Section 1. That the State Board of Administration, Tallahassee,.Florida, be, and it

Kanner Bill Account for this County's indebtedness to St. Lucie County to be transferred from
said Kanner Bill Account to the Interest and.Sinking Fund Account of said Refunding Bonds of
this County issued to St. Lucie County, said transfer to be made in an amount which, after mak-
ing due allowance for funds.now.in said Interest and Sinking Fund ,account of said Refunding
Bonds, will be sufficient to provide for the payment of the coupons maturing as set forth, in
the preambles of this resolution from such of the Refunding Bonds of ` this County as have been o

and Sinking Fund Account of the said Refunding Bond issues identified in the preambles hereto
so that the funds in said applicable Interest and Sinking Fund Account, making due allowance
for funds already therein not heretofore earmarked for specific interest payments, will be the
amounts set forth in the following tabulation; and, after said transfer is made, said Board
shall cause the said funds to be applied to the payment of interest coupons on said Refunding
Bonds as follows:

Section 3. That, in addition to the amounts hereinabove provided to be transferred,
the State Board of Administration is hereby authorized to transfer from the applicable Banner
Bill Account for the taxing units identified in the preambles hereof to the applicable Interest
and Sinking Fund Account of the said Refunding Bond issues identified in the preambles hereof,
either now or as funds become available from future collections, a sum of money sufficient to
permit funds to be placed with the Paying Agent for the said. Refunding Bond issues.to replace
any funds heretofore sent to the Paying Agent to be applied in payment of interest on said Re-
funding Bond issues but which have subsequently either been recalled because of peremptory
writs of mandamus or impounded because of the service of alternative writs of mandamus or im-
pounded out of any reserve account by the service of any writs of mandamus, said remittance to j
be made, at the option of the Board of Administration, either at this time or at such time as
any of such coupons are presented to the Paying Agent for payment; provided, however, that in
the event the latter option is elected by the Board of Administration, the said Board is hereby
requested to make arrangements with the Paying Agents to be notified when any hinds are needed
for this purpose.
Section 4. That the intent of this resolution is to make present provision for the

payment, when and if presented, of all interest through the next coupon paying date on all
Refunding Bonds identified in the preambles hereof; and any action by the Board of Administrat.

INVITING BIDS ON NEW 4% REFUNDING BONDS, SERIES 19419 OF INDIAN
RIVER COUNTY, FLORIDA, SPECIAL ROAD AND BRIDGE DISTRICT NO. 4.
VPHEREAS-, in statutory proceedings recently pending in the Circuit Court of Indian
River County, Florida, the said Court, by Final Decree entered March 31, 1941, validated and
confirmed an issue of 4% non -callable serial maturing Road and Bridge Refunding Bonds, Series
19419 of Indian River County, Florida, Special Road and Bridge District No.. 4, hereinafter
more particularly identified, and said Bonds have been duly prepared, executed and deposited
in escrow with The First National Bank of Chicago, Chicago, Illinois; and
WEMAS, said Bonds are provided to be issued for the purpose of refunding and re-
tiring the presently outstanding callable 4/6% Refunding Bonds of said District dated January
1, 1937; and
AREAS, said Series 1941 Refunding Bonds are now in process of being issued in ex-
change for bonds dated January 1, 1937; and
WHEREAS, notice has been given of the intention of this ,Board to call for redemption
and payment on January 1, 19421, such of the 1937 Series Bonds as are then outstanding and it i

Delivery of said bonds shall be made at The First National Bank of Chicago, Chicago,
Illinois, and shall be made December 31, 1941, before 11:00 o'olock A. M. Eastern Standard
Time on said date, attention being directed to the fact that the outstanding optional bonds to
be retired by the proceeds from the sale of these Bonds have been called for redemption and
payment on January 1, 1942.
All coupons maturing January 1, 1942 or prior on said Bonds will be clipped before
delivery of the Bonds. No bids will be considered except for the entire amount offered for
sale, but only such amount thereof shall be delivered as may be delivered in accordance with
law.
The undersigned reserves the right (1) to award the bonds to the bidder submitting
the most advantageous bid, which shall be determined by the undersigned in its absolute and
uncontrolled discretion; and (2) to reject any or all bids.
Bids must be enclosed in a sealed envelope marked on the outside "PROPOSAL FOR RE-
FUNDING BODS", and shall be accompanied by a certified check upon or Cashier's Check of an
incorporated Bank or Trust Company, payable unconditionally to the order of the undersigned
for an amount equivalent to three per cent. (3%) of the par value of the bonds covered by
each bid, which said check will be forfeited to the undersigned as liquidated damages by the
bidder to whom the Bonds may be awarded in the event of non-performance of the terms of his
bid, or returned to the said bidder simultaneously with, or forthwith after full performance
thereof. Checks of unsuccessful bidders will be returned on the day the ®ward is made. If
the undersigned does not make award of the bonds the day the bids are opened, any bidder may
immediately recover his check if he does not desire to allow his bid to remain open for con-
sideration during the period desired for consideration by the undersigned; but, in the event
of any withdrawal of any such check, the bid to which said check was attached will be consid-

RESOLUTION - TO PURCHASE $45,000 ROAD & BRIDGE DISTRICT NO. 4
REFUNDING BONDS DATED JANUARY 1,, 1937
Commissioner Glover introduced the following resolution and moved its adoption, to -
WHEREAS, this Board has caused to be published, Notice of Redemption effective as of
January 1, 1942, of Indian.River County, Florida, Special Road.and Bridge District No. 4 Road
and Bridge Refunding Bonds dated January 1, 1937; and
WHEREAS, it is contemplated that refunding bonds dated January 1, 1941, of said Dist -
riot will be sold in such amounts as with the proceeds thereof, and the Interest and Sinking
fund available or to be made available, will provide funds to meet the terms of the published
Notice of Redemption; and
WHEREAS, it is calculated that such sinking fund surplus will be $45,000 and it is
determined that such surplus should be applied toward meeting the called bonds;
NOW9 THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMSIONERS OF INDIAN RIVER
COUNTY, FLOIMDA, IN SESSION DULY ASSEMBLED:
Seotion'1. That the State Board of Administration at Tallahassee, Florida, be and it
is hereby,authorized and directed to purchase with such surplus sinking funds, available or to
be made available, at the price of par and accrued interest,,$45,000 of Indian River County
Special Road and Bridge District No. 4 Road and Bridge Refunding Bonds dated January 1, 1937,
if such bonds are offered to said Board.
Section 2. That as an alternative to the purchase of the aforesaid amount of bonds
in the event that no such offering is made, the State Board of Administration at Tallahassee,
Florida, is hereby authorized and requested to forward to the Chemical Bank and Trust Company,
New York, New York, the paying agent named in said issue of bonds, the sum of $45,000 for the
purpose of retiring said principal amount of the designated issue on January 1, 1942, this
Board of County Commissioners having made arrangements to supply the remaining principal amount
required to meet the bonds called for payment as of January 1, 1942.
Section 3. That the State Board of Administration is hereby requested and directed
to cause to be remitted to the paying agent designated in the particular issue of bonds, funds
to pay coupon due January 1, 1942, on bonds of the following issues that may be outstanding
on January 1, 1942:
Indian River County, Florida, Special Road and Bridge District
No. 4 Road and Bridge Refunding Bonds dated January 1, 1937.
Indian River County, Florida, Special Road and Bridge District
No. 4 Road and Bridge Refunding Bonds dated January 1, 1941.
Section 4. That the funds necessary to carry out the provisions of Sections 1, 2 and l
3 hereof shall be derived from present Interest and Sinking Fund balances and from transfer
the Kanner Bill account accrued or to accrue, which transfer the State Board of Administration
is hereby authorized and directed to make.
Section 5. That, if calculations made by the State Board of Administration reveal
that after allowing for the amount required to meet the interest payment set forth in Section
3 hereof, funds will not be available to retire and principal amount of Refunding Bonds dated
January. 1, 1937, namely $45,000 as set forth in Sections 1 and 2 hereof, then and in that event
the principal amount of bonds to be so retired will be reduced to the principal amount for
which the records of the Board of Administration indicate funds can be made available.
Section 6. That this Board affirms that when and as provision has been made for the
retirement of the $45,000 of bonds as set forth in Section 1 and 2 hereof, then $44,000 of the
1941 Series of Refunding Bonds will not be subject to issuance and can be cancelled, there hav-
ing been no refunding bond of the 1941 Series provided for bond No. 361 of the January 1, 19379
issue.
Section 7. That the State Board of Administration is respectfully requested to not-
ify the Clerk of this Board not later than December 12, 1941, of the action taken on this re-
solution.
Section 8. That the Clerk of this Boprd shall furnish duplicate certified copies of
this resolution to the State Board of Administration, which certified copies will be the au-
thority of that Board to do and perform the acts necessary to carry out the purpose of this
resolution.
The resolution was duly seconded by Commissioners Graves and upon being put to a
Vote the same was unanimously adopted.
RESOLUTION - REQUESTING STATE ROAD DEPARTMENT TO TARE
OVER WINTER BEACH BRIDGE
Commissioner Glo=ver introduced the following resolution and moved its adoption to -wit;
WHEREAS, the bridge which traverses the Indian River in Indian River County, Florida,
at Winter Beach, Florida, and which bridge is known .as the Quay Bridge is a part of a public
highway which has been heretofore designated as a state road; and
WHEREAS, such bridge serves a considerable amount of traffic passing to and from the

Speninsula and ocean in Indian River County to U. S. Highway No. 3 in said County; and
WHEREAS P said bridge is of great benefit in the transportation of fruit from the
peninsula to U. S. No. land packing houses situated thereon; and
NEEREAS, the State Road Department of Florida maintains other bridges in the same
area in which said Quay Bridge is situated and has equipment available for'the maintenance of
such bridges which is not available to the Board of County Commissioners of Indian River County;
and
1HEREAS9 the Board of County Commissioners of Indian River County has the sum of
$5,000.00 in the maintenance fund of said Quay Bridge'District and which sum it willing to
deliver to the State Road Department of Florida uponsaidState Road Department taking over
said Quay Bridge for maintenance; therefore,
BE IT RESOLVED, that the State Road Department of Florida by and through the Honor-
able Harry H. Hector, member of the State.Road Department from this district be and it is here-
with requested to take over for permanent maintenance the said Quay Bridge also known as the
Winter Beach Bridge in Indian River County, Florida.
BE IT FURTHER RESOLVED That upon the State Road Department taking over such bridge
for maintenance the officers of this Board are herewith authorized to execute and deliver to
the State Road Department of Florida proper warrant whereby the sum of $5,000.00 now in the
maintenance fund of said Quay Bridge District shall be transferred to the State Road Department
of Florida.
BE IT FURTHER RESOLVED That two certified copies of this resolution be forwarded by
the Clerk of this Board to the Hon. Harry H. Hector with the request that the same be presented
to the State Road Department of Florida.
The redolution was duly seconded by Commissioner Graves and upon being put to a Vote
the same was unanimously adopted.

BILL AS TO QUAY BRIDGE DISTRICT
Commissioner Glover introduced the following resolution and moved its adoption to-
BE IT RESOLVED By the Board of County Commissioners of.Indian River County, Florida,
in session duly assembled:
1. That for the specific period beginning with the date hereof and ending September
309 1942, and thereafter until further action of this Board, this Board hereby elects to re -
jest the provisions of Chapter 15891, Laws of Florida, commonly known as the "Kanner Bill" as
re-enaoted and amended with respect to the taxing district described as follows, to -wit:
Quay bridge District, Indian River County, Florida.
' 2. That this Board hereby expressly reserves to itself in respect to rescinding,
limiting, amending or Modifying the terms of this resolution all of the right and privileges
accorded it under the said law.
3. That duplicate certified copies of this resolution be furnished the State Board
of Administration.
The resolution was duly seconded by Commissioner Vickers and upon being put to a vote
the same was unanimously adopted.
The several bills and accounts against the County, having been audited were examined
and found correct, were approved and warrants issued in settlement of same. Such bills and
accounts being on file in the office of the Clerk of the Circuit Court. The warrants so issued
from the respective funds being listed in the Supplemental Minute Book, as provided by the rule
X54
of the State Auditor, reference to such record and the list so recorded being made a part of
these minutes.
The County depository filed its monthly statement, shoving receipts and disbursementsil
of the various funds which having been audited was found to be correct.
There being no further business, on motion made, seconded and carried the Board then
adjourned until 10;00 o'clock A. M. Tuesday, December 23, 1941.
