1-1 TUESDAY. AUGUST.4, 1942 I• The Board of County Commissioners of Indian River County met at the Court House in ;I Vero Beach, at 10:00 o'clock A. M. Tuesday, August 4 -i 1942, in regular meeting with the fol- lowing members of the Board present; C. S. Michael, Chairman; S. E, Glover, Alberto. Helseth,i' W. C. Graves Jr., and Frank C. Vickers. Also present were Tim. W. Frick, Sheriff, Charles A. Mitchell, Attorney for the Bca rd, and Douglas Baker, Clerk. Douglas Baker, Clerk, announced the following sums of money had been received by i him and placed in the Road and Bridge fund, as follows; Holmes & Raulison, $289.10, for a Bridge at Lateral U and #1, Fellsmere, Leo Cahill, $50.00, partial' cost of constructing a Bridge; M. D. Kersey, $20.00, rental on road machinery. Verdict of Coroner's Jury in the matter of the inquest on the body of Gintle Spear was received and ordered filed. Auditor's report #2483, dated June 4, 1942, mad# by W. 0. Gentry, Auditor, on the Board of County Commissioners, Assessor of Taxes, and the Board of public Insutrction, was presented to the Board in connection with provision of section 21969 Compiled General Laws of 1927, and on motion made by W. C. Graves Jr, seconded by Albert 0. Hel Seth and carried, the same was ordered filed as a part of the public records of Indian River County. Mr. C. A. Routh, representing residents of Gifford and vicinity, appeared before ed the Board and request/the County's cooperation, by furnishing trucks to assist in moving aj the residents of Gifford, who are now residing on property taken by the Navy Project, to their l! new location. Mr. Routh was assured of the County's cooperation in this respect. I' Honorable Geo. T. Tippin, Supervisor of Registration and Manager of the Indian River, County Fair Exhibits, reports the County pictures, which were used at the fair in Orlando have been returned and the same placed in the Community Building, which action was approved by the Board. It was ordered J. H. McClain be removed from the Paupers list, until the further orders of the Board. e On motion made by Frank C. Ni.ckers, seconded by S. E. Glover, and carried, Douglas !, Baker, Clerk, was authorized to make a distribution of funds from bonds and coupons acoppted y. in payment of delinquent taxes, to the General Revenue Fund of the County and to the follow- 1 Ing taxing districts; Florida Inland Navigation; Sebastian Inlet; Mosquito Control; Vero �1 Bridge District; Quay Bridge District; Wabasso Bridge District; Atlantic and uulf special Road and Bridge Maintenance; and Fellsmsre Cross State Road. On motion made by Frank 0. Vickers, seconded by S. E. Glover and carried', it was ordered the County interest and singking fund be authorized to invest its surplus funds in Ii Wabasso Bridge District Bonds, and Douglas Baker, Clerk and Charles A. Mitchell Attorney, were authorized to work out the exchange from the Interest and Sinking Fund on refunding bonds of said district. See minutes on page 574 and 575 regarding this transaction}. C P g On motion made by W. C. Graves Jr. seconded by S. E. Glover, and carried, the Board 11 { authorized Attorney Mitchell to write the Board of Administration, Tallahassee, and offer to exchange St. Lucie County obligations held in the tax redemption account of Indian River County in exchange of a like amount of St. Lucie County refunding bonds. Mr. Johnson of 'White Swan Bedding Company, 'West Palm Beach,, appeared before the rs and mattresses Board and submitted'a proposition to furnish mattresaccoversl plus additional cotton that may be required in renovating the mattresses and pillows for the Jail, in the sum of approximately';` ;i $150.00, which on motion made by W. C. Graves Jr. seconded by Albert 0. Helseth and carried was approved. i� Miss Leila M. Bunkley, County burse, outlined the case of Willie Rimes to the Board and expenditures, not to exceed an amount to be approved by Commissioner Graves, was approved by the Board. City Councilmen C. E. Cox and H. B. Connley, appeared before the Bc®rd and asked w for an appropriation to be used for the purpose of constructing Negro rest rooms in the City and on motion made by W. C. Graves Jr., seconded by Frank C. Vickers and carried it was order- ed the sum of $300.00 be paid the City of Vero Beach for said purpose, from the General Reven-! ue Fund. Mr. C. E. Cox, of the Cox Funeral Home, requested the Board pay $35.00 for County funerals in lieu of $25.00 which sum had been paid in the past. On motion made by W. C. Graves Jr., seconded by Frank C. Vickers and carried, the request was granted. A GREENU"BN T- S U R R E N C Y THIS AGREWENT Executed this 10th day of July, 1942, between W. H. Surreny and Rosa L. Surrency, his wife, hereinafter called the Owners, and Indian River County, Florida, a body corporate, hereinafter called the County, WITNESSETH: That the Owners have this day conveyed to the County a right-of-way for road pur- poses situated in Indian River County, Florida, and described as follows, to -wit: A strip or parcel of land 50 feet in width being 25 feet on each side of a Center line described as follows: Beginning at a point on the center line of the present Blue Cypress County road, said point being 3128 feet due east of the south-west corner of Section 14, Twp. 32 South, Range 35 East, run North-easterly on a tangent line across Sections 14, 13 and 12 of Twp. 32 South, Range 35 Bast to a point on the Range line between Range 35 and Range 36, said point being 6959.51 feet East and 2094.5 feet North of the S. W. corner of the Southeast quarter of Section 11, Trip. 32 South, Range 35 East (note of explanation:- the I above described point on the Range line is 33.2 feet north of Similar Center line described in D. B. 32, page 193, for the purpose of making the Southerly line of the above described right-of-way correspond to the South Rtw. line a strip or parcel of land described in said D. B. 32.9 page 193) ; and subject to the provisions and conditions contained in such deed. In consideration of such conveyance and of the mutual covenants of the parties here- in contained and of other good and valuable considerations received by each party hereto from the other party hereto, the parties to this instrument do agree as follows: i' That so long as said right-of-way is used by the County the said County shall, at I , the point where said right-of-way crosses the easterly boundary of the property of the Owners and enters property now owned by B. L. Holman, provide and maintain at County's expense a good:, and sufficient cattle guard of the general type customarily used in this area fob the purpose of preventing the crossing of cattle. COMMISSIONERS SEAL) The Chairman announced that this regular meeting was held, among other things for the purpose. of considering and acting upon and adopting the estimates of the expense for the fiscal year commencing October 1, 1942 and ending September 30th, 19439 which was prepared and entered upon the minutes of the meeting of the Board of County Commissioners held on the 7th day of July, 1942, and to fix the rate of taxation for the year 1942. A copy of the advertisement containing the estimates of budget made by the Board of County Commissioners at a meeting held at the CourtyHouse on the 7th day of July, 1942, with the publisher's affidavit annexed and presented to the Board and ordered spread upon the minutes and is in words and figures as follows: o �I with such property owners and upon agreement of such property owners will authorize the �I placing of a gate across said road at a point just past and in a northerly direction from • the present residence of the Owners and as provided by Section 2467 of the Compiled General Laws , of Florida. It being understood that new right-of-way conveyed this date by the Owner td the County will eliminate the necessity of general public use of the portion of road des- cribed in this paragraph. The County and the Owners will cooperate in the construction and maintenance of a fence on each side of the right-of-way above described and for the full length thereof or a total of approximately two miles on each side and four miles in the aggregate -and with the County and the Owner each to bear one-half of the expense of said fence. Said fence shall be built at such time 'ban be time as sufficient satisfactory materials obtained and at such as is the total cost of said fence, including materials, and labor, shall not exceed $500. or $250 h for the Owners and v250 for the County. It is agreed that posts for said fence may be purchas ed at once and the same set and further work may be delayed until the necessary and proper • materials can be obtained within the above costs allowed. Whereupon Commissioner Graves introduced the following resolution and moved its adoption towit: Be it resolved that the budget and estimates of the necessary and ordinary ex- penses and extraordinary expenses contemplated by the Board of County Commissioners of In- dian River County for the fiscal year 1942-1943 as fixed in the minutes of this Board and as advertised in the issues of the Vero Beach Press -Journal of #'uly 10 and 17, 1942, be and the same is hereby approved and adopted. The motion for the adoption of the resolution being duly seconded by Commissioner. Helseth, it was declared adopted by the following vote: Ayes: Helseth, Graves, Michael, Glover and Vickers. Hayes: None. The Board then proceeded with the matter of fixing the rate of taxation for In- dian River County for the year 1942 and after careful consideration of the estimated re- ceipts and expenditures the following resolution was introduced by Commissioner Vickers, who moved its adoption to -wit: BE IT RESOLVED that the rate of Taxation necessary to meet the expenditures of the Board of County Commissioners of Indian River County, Florida, for the fiscal year 1942-1943 pursuant to the budget of said Board as heretofore published and approved, is as hereinafter levied and that the tax rate as hereinafter shown and set forth, be and it is hereby levied on all taxable property in Indian River County, Florida, for the year 1942, with the rate hereinafter set out, to -wit: In order to meet the estimated current expenses of the County of Indian River of the sum of $29,591.55, it is determined and hereby declared that a tax rate of one and three fifths (1 3/5) mills upon the dollar be levied and is hereby imposed upon all of the proper- ty lying and being in the County of Indian River on the f fret day of January, 1942, for the GENBR&L REVENUE FUND, to meet the current expenses of the County and to provide for the ex- penditure� as estimated in the budget hereinbefore set forth.
