A called meeting of the Board of County Commissioners was held at 8o'clock P. M. May
25, 1945f at Vero Beach, Florida for the purpose of considering problems connected with access
leading to Blue Cypress Lake.
Present were Commissioner W..C. Graves Jr., R. W. Graves, Albert O. Helseth, Frank
C. Vickers, Douglas Baker, Clerk, County Engineer E. A. Carter and County Attorney Charles A.
Mitchell. Commissioner Glover was absent. Also present were B. L. Holman and Thad H. Carltoni
Discussion was had with regard to injunction suit brought by Mr. Holman against the
Board with regard to a road easement held by the Board] and representing Right -of -May leading
to Blue Cypress Lake. The County Officials expressed themselves as intending to vigorously
contest this suit and to insist upon adequate access for the public to Blue Cypress Lake. in
settlement of the problem, Mr. Holman offered to convey property owned by him to the Board and°
described as the North 500 feet of Lot L and being contiguous to the western shore of the lake
and together with ailed Right -of -Way leading to such property and ;o:. road Right -of -Way would
be a width of 100 feet along the western boundary line of such.Lot L and which offer would be
conditioned upon the Board releasing the present easement which was involved in the suit which
had been instigated recently by Mr. Holman. The Commissioners arranged that a Committee
consisting of Commissioner Graves and Vickers and Engineer Carter would accompany Mr. Holman
to view the site of the property grant and that after viewing the same and considering the
benefit and detrement represented by the proposal the Committee would report to the Board of
County Commissioners for further action. Arrangementwere then made between the Committee and
Mr. Holman,as• td:a specific time for making inspection trip.
There being no further business the Board then adjourned.

The Board of County Commissioners of Indian River County met at the Court House in
Vero Beach, at 10:00 o'clock A. M. Tuesday, Mme 5, 1945, in regular meeting with the following
members of the Board present: W. C. Graves, Jr., Chairman; Frank C. Vickers, Albert 0. Helsel
and R. t,. Graves. Absent S. E. Glover. Also present were L. B. OSteem, Sheriff, E. E. Carte
County Engineer; Charles L. MitcheD. of the Firm of Mitchell, Smith & Mitchell, Attorney; and
Douglas Baker, Clerk.
Minutes of the previous meetings were read find approved.
The Committee consisting of Commissioner Graves and Vickers and Engineer Carter
reported they had viewed the site of the property offered by B. L. Holman and it was their
opinion that the: proposition offered by Mr. Holman world incur expenses ±n'--. excess of the

Honorable A. W. Young, Glen Snodgrass, Charles A. Muster, Frank ITewett and James
together with other citizens and taxpayers Of Indian River County appeared before
and presented their views concerning the proposed Public Park and Bathing Beach for
Also present was Mr. Frank R. Stockton who outlined the proposal in detail from the
up to the present time. After considerable discussion pro and con, the Board decid

to accept the recommendation of the Chamber of Commerce which reads as follows: "Tie director
recommend that a Committee be establishedby the County Commissioners, in which would be re-
presented the Vero Beach City Administration, the American Legion and or the Veterans of
Foreign Wars, the Chamber of Commerce, the Vero Beach Realty Board and the Board of County
Commissioners". it would be the purpose of this Committee to make investigation and hold
conferences, with the objective of assisting the County Commissioners in providing a suitable
Bathing Site, and also a site for Negro Home Developement which would meet needs for Negro
housing which now exists or may arise in the future. Douglas Baker, Clerk, was instructed to
write letters to the foregoing organizations or groups requesting that they appoint a repre-
sentative to serve on this Committee and advise the name of the representative upon the ap-
pointment being made. At such time as all representatives have been named, a meeting of the
Committee will be called. Chairman W. C. Graves, J*1. Jr,was selected to represent the Board of
County Commissions on such a Committee.
Mr. J. B. Miller, Chief Engineer of the State Health Department appeared before. the
Board together with County Nurse Alice Helieso and held a short discussion as to the local
sanitary sewer conditions in this area. The purpose was to try and determine some means and
method of improving the sanitary conditions in Indian River County.
The Board executed Deeds numbers 10, -to%7.24 Inc. on lands acquired by the County
for Delinquent Taxes under Chapter 191 Acts of 1941 Florida Statutes.
Douglas Baker, Clerk, advised the Board that the:keys to the Wabasso Coast Guard
Barracks Building had been delivered to him by le. S. Marine Personnel and that the: keys in turn;
had been transmitted to Commissioner R. W. Graves as per previous instructions of the Boar$.
Alice Hellleso appeared before the Board and made a report of her activities for the
month of May as follows to -wit:

Miss Heileso submitted certain bills concerning the 'aldon Terrell case which were
approved for payment.
Application of Robert V. LeBase(Connecticut'County) Wabasso, Florida for • license
to sell intoxicating �quors, wines and beers was inspected and after carefully considering
the same on motion made, seconded and carried, the same was approved.
Commissioner Helseth introduced the following resolution and moved its adoption,
to -wit:

WHEREAS, Indian River Farms Company by plat filed in Plat Book 2, at page 25, re-
cords of St. Lucie County, Florida on March 23, 1915 dedicated for public use and purposes
and particularly for road right of way a strip or parcel of land having a width of 50 feet in
an easterly and westerly direction and running south from canal A3 of Indian River Farms
Drainage District to the main canal of Indian River Farms Drainage District and which right of
way lies between the East boundary lines of Tracts 1 and 8 in Section 4, Township 33 South,
Range 39 East and the West Boundary lines of Tracts 4 and 5 in Section 3, Township 33 South,
Range 39 East as per plat of Indian River Farms Company and plan of reclamation of Indian
River Farms Drainage District. And,
WH• EREAS, said right of way is not in present use by Indian River County, Florida
and Indian River Farms Drainage District has requested use of said right of way for the con-
struction thereon of a needed drainage ditch or canal; therefore,
BE IT RESOLVED that the Chairman and Clerk'of this Board are authorized and directed
to execute and deliver to Indian,River Farms Drainage District, as the act and deed Of this
Board and of Indian River County, Florida, an Easement upon and over the above described right
of way for the purpose of constructing and maintaining a drainage ditch or canal thereon; that
said Easement shall be for a period of five years with right of cancellation thereafter upon
the giving of six months notice in writing; that said Easement shall recite that it is to the
extent of and not beyond the interest of said County in said right of way and the powers of
this Board to grant such Easement.
The motion for the adoption of the Resolution was duly seconded by Commissioner
Vickers and unanimously adopted.
Mr. S. D. Smith of Wabasso,appeared before the Board co eerning a road petition
which had been presented on Maro8a6th, County Engineer E. B. Carter was instructed to procure
road right-of-way and proceed with instruction as soon as possible or practical.

Mr. Joseph Echoff be restrained from building to or enlarging his present place of business in
any manner whatsoever. The letter from the City stated that Mr. EchoffA:S notified that his
present beer and wine license being used to 'conduct business in Residential Zone of this City
would not be renewed on October 1st., and that the State Beverage Department .and Cotinty
Commissioners be so notified. The letter together with the certified copy of resolution was
ordered filed with the Clerk.
A letter was received from Mr. N. . i. ,EmisirT is the State Road Department advising he
would be glad to meet with the Board at some future time for the purpose of discussion -road
problems, and Douglas Baker, Clerk, was instructed .to write Mr.,, i, , S. 8 er v and ,advise him of
the meeting dates of the Board and extend to him an invitation to -meet with the Board at his
earliest convenience.
Commissioner Helseth intruduced the following resolution and moved its•adoption as
follows, to -wit:
ABSOLUTION
WHEREAS, pursuant to the provisions of Chapter 22079 of the laws of Florida, Indian
River County, Florida has acquired title to the lands hereinafter described, and the City
Council of the City of Vero Beach, Florida, being the governing body of such municipality, and
being a public board of said County, has concurred in and requested, by proper resolution, the
dedication to public use and purpose of the lands hereinafter described by the Board of County
Commissioners of said County; and the same having been duly considered by said Board of County
Commissioners; therefore,
BE IT RESOLVED, that the `'Board of County Commissioners of Indian River County,
Florida, does hereby dedicate to public use and purposes the lands hereinafter described,
situated in Indian River County, Florida,. to -wits
Lots 24 in Block 2, and 38 in Block ll; of Vero Beach Estates; for public streets.
Lot 22 in Block`27„of Royal Park; for public golf course.
BE IT FURTHER RESOLVED, that -said lands shall not hereafter be assessed for taxes so
long as the same remain dedicated or devoted to public use; that a certified copy of this re-
solution -be delivered to the County Assessor of Taxes of said County, in order that he may so
exempt said lands from taxes; that a certified copy hereof be delivered to the City Tax Assessor
of the City of Vero Beach, Florida, in order that he may so exempt said property from taxes.
A motion for the adoption of the resolution -was duly seconded by Commissioner Vickers
and unanimously adopted.

I, Kathryn S. Warr, of the County of Indian River State of Fla, being the owner of
IC Tax sale Certificate No. 18 dated the 4th day of July 1938, in the sum of 4 / a.0'4. covering

hereby make application to your Honorable Body to issue a duplicate Tax Sale Certificate in
lieu of the original described herein.for the following reasons:
(1) That said Tax Sale Certificate was purchased by me at the regular sale of 19�,
for which I paid the sum of $12.06.
(2) That said Tax Sale Certificate, or any interest therein, has not been hypothecat-,
ed, sold, assigned, transferred or delivered by me and I have received no con-

duplicate Tax Sale Certificate in favor of the above named applicant in lieu of the Certifieat
above described which has been lost or destroyed, and that proper record of same be entered in

Aubrey Waddel was granted permission to construct a net rack and dock on the old
Winter Beach road near Ben and Bobbs place on the Indian River East of Winter Beach with the
understanding that it be a temporary proposition and subject to revocation by the Board.
Douglas Baker, Clerk, was instructed to cash or redeem United States Treasury Note
Number 3260404, Tax Series Co in the sum of $10,000 and that the proceeds be deposited in the
General Revenue Fund.

The Board authorized Attorney Mitchell and County Engineer Carter to prepare" otioe
inviting bids on Road and Bridge equipment to be purchased as follows:
One 800 or 1000 gallon asphalt distributor With 20 foot spray bars, heating and
power units mounted on suitable truck equipped with reinforced frame and overdrive.
One 8 to 10 ton three sheel road roller with ample overtaping rolls (alternate bids
will be entertained on tandom road roller of approximately same weight).
One self -powered soil stabilizing mixer of the Pul-vi-mixer type, equipped for both
soil stabilization and bituminous mix pavement with altime width of approximately six feet.
Three 1 ton, long wheel base trucks equipPed with cab, dual wheels and power take-
off units.
•Three Steel frame hydraulic dump bodies for long wheel base lis ton truck.
Douglas Baker, Clerk, was instructed to prepare figures and information on the
proposed 1945-1946 County Budget to submit to the Board at a Special Meeting to be held at
June
2 o'clock P. Saturday/23, 1945.
It was moved by Albert O. Helseth, seconded by Frank C. Vickers and unanimously
carried, that the Vero Beach Press Journal, a newspaper of general circulation, published in
Indian River County, Florida, and which newspaper has been continuously published in said
County for a period of more than.one year prior to this date, be and it is hereby selected and
designated.by the Board of County Commissioners of Indian River County as the newspaper in
which shall be published the list of lands to be advertised and Sold by the Tax Collector of
Indian River County and which selection is required trader the provisions of Section 969 Com-
piled General Laws of Florida; and that said newspaper be designated Epp the publication of
such other legal notices as may be required to be designated by said Board of County Com 1., !..-:�
missioners.
The Vero Beach Press Journal was designated as the newspaper in which. the Laws of
Regular Session, Florida Legislature. 1945 are to be published.
Present at this meeting were G. D. Young as Mayor and Chief Executive Officer of the
City of Fellsmere; J. M.Bssa:ington, as President of the City Council and Head of the Legisla-
tive of the City of Fellsmere, and Mrs. Ida G. Dixon, as Tax Assessor of the City of Fellsmere
The Board of County Commissioners and the above designated and described officials
of said municipality of Fellsmere then entered into a discussion of the price of each parcel
of land to be fixed in connection with the sale thereof under provisions of Chapter 22079,
such land described in Final Decree entered in the Circuit Court of Indian River County,
Florida on the 16 day of April, 1945 and described as follows: Town -of Fellsmere (Plat Book
2, pp. 3 & 4, Records of St. Lucie County) Lots 9 & 10, Block 116, Value set by Board $50.00.
The Board of County Commissioners and said designated officials of the City Of
Fellsmere unanimously and jointly determined and agreed that the price of all such land
situated within the corporate limits of the City of Fellsmere should be 50% of the amount of
the last assessed valuation appearing on the County Tax Roll.
Upon motion duly made, seconded and adopted, the Board adjourned to meet in the next
regular session on July 3, 1945, and to meet in special session as equalization board, as pro
vided by law on July 2, 45.
