adoption as follows, to -wit: WHEREAS, pursuant to the provisions of Chapter 22079 of the laws of Florida, Indian River County, Florida' has acquired title to the lands hereinafter described and the County Board of Public Instruction of Indian River County, Florida, having by proper resolution request -ed the dedication to public use and purposes and for public school use and purposes of the lands hereinafter described, by the Board of County Commissioners of said County; and the City > Council of the city of Fellsmere, Florida, being the governing body of such municipality, and within the corporate limits of said City said lands lie, having concurred in such dedication by proper resolution; and the same having been duly considered by the Board of County Commissio -vers, therefore, BE IT RESOLVED, that the Board of County Commissioners of Indian River County, Florida, does hereby dedicate to public use and purposes, and to be used by the County Board of Public Instruction of Indian River County, Florida, for public school use and purposes, the lands here -inafter described, situated in Indian River County, Florida, to -wit: Lots 3 and 10 in Block 96 of the Town of Fellsmere according to Plat of said town recorded in the office of the Clerk of the Circuit Court of St. Lucie County, Florida in Plat Book 2 at pages 3 and 4. BE IT FURTHER RESOLVED, that said lands shall not hereafter be assessed for taxes so long as the same remain dedicated or devoted to public use; and that a certified copy of this Resolution be'delivered to the County Assessor of Taxes of said County, in order that he may so exempt said lands from taxes; and that a certified copy hereof be delivered to the City Tax ,Assessor of the City of Fellsmere, Florida, in order that he may so exempt said property from taxes. The motion for the adoption of the resolution was seconded by Commissioner R. W. Graves and unanimously adopted. The next regular meeting falling on a Holiday, it was moved, seconded and carried that the next regular meeting of this Board would be held on Wednesday, January 21 1946, in lieu of Tuesday January 1, 1946. The several bills and accounts against the County, having been audited, were examined and found correct, were approved and warrants issued in settlement of same. Such bills and ac- counts being on file in the office of the Clerk of the Circuit Court, the warrants so issued from the respective funds being listed in the Supplemental Minute Book' as provided by the ..rules of the State Auditor, reference to such record and the list so recorded being made a parte of these minutes. The County Depository filed its monthly statement, showing receipt and disbursements of the various funds, which having been audited were found to be correct. There being no further business, on motion made, seconded and carried, the Board then adjourned. JANUARY 2. 1946 The Board of County Commissioners of Indian River County met at the Court House in Vero Beach, at 10:00 o'clock, A. M. Wednesday, January 2, 1946, in regular adjourned meeting with the following members of the Board present: W. C. Graves, Jr., -Chairman, Frank C. Vickersy S. E. Glover, R. W. Graves and Albert 0. Helseth. Also present were Charles A. Mitchell, At- torney, E. E. Carter, County Engineer, L. B. O'Steen, Sheriff and Douglas Baker, Clerk. Graves, and unanimously carried, thAt the Board continue all present officials and employees,salary remaining the samesfor the year 1946 or until.the further orders of the Board. At the request of Sheriff O'Steen and State Patrolman Silsby the following resolution,,, was adopted. The following resolution was introduced by Commissioner S. Be Glover who.moved its adoption as follows, to -wits WHEREAS, reports have been made to the County Commissioners of Indian River Countyly the Sheriff of said County abd state highway patrolmen stationed in said County and by citi- i1 .Aonntgg aens of the County which have caused said/Commissioners to determine that by reason of traffic,', conditions and by reason --of congestion of residential and business construction along the high- way hereinafter mentioned, there exists conditions under which the operation of motor vehicles';! on State Road No. 4, between the north Gifford Road and the south bondary line of the McKee . Jungle Garden property in Indian.River County at a speed in excess of 35 miles per hour is dan-, r gerous and that a reasonable and safe speed limit on State Road No. 4 within said area is not to exceed 35 miles per hour; therefore, BE IT RESOLVED, that the Board of County Commissioners of Indian River County here- with requests State Road Department of Florida, to determine, under the provisions of Section 317.24 of the Florida statutes,whether or not the determination aforesaid of the Board of County Commissioners of Indian River County is sound and proper, and if such fact shall be determined by said State Road Department, then to declare a reasonable and safe speed limit inf,', ii said area and to make the same effective by erecting appropriate signs giving notice thereof as to all operations in said area under the jurisdiction of said State Road Department. We Graves and unanimously adopted. 4 Chairman Graves, speaking for the County on the Indiarr,River Fire Protective Associa-1 tion, reported that the Association agreed to leave the proposition as it is with the under- .1 standing that the County would appropriate a sum not to exceed $1.500.00 for the year 19461 • said sum to be expended in the behalf of the Indian River County Fire Protective Associations �f for purchase of and maintenance of equipment and or for salaries for an additional fireman to be employed and further that representatives at Fellsmera ®end Sebastian would be requested to cooperate with the County, together with Be- Be Carter, County Engineer. Alice Helleso, County Nurse, appeared before the Board and made a verbal and written report of her activities for the month of Decembers said written report being filed in the Clerk's Office. Pursuant to a resolution adopted by the City of Sebastian at a meeting held the 28th :day of December, 19459 regarding certain lands being dedicated to the City of Sebastian, said 1� resolution being on file in the Clerk's Office, the following resolution was adopted. Commissioner Frank C. P E TITI0 N TO THE HONORABLE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY9 FLORIDA: Pursuant to Chapter 22870, Acts of the Florida Legislature session of"19459 the City of Vero Beach9 Florida, represents that it has been the owner in fee simple at all 'times subse- p fluent to January 9, 1942, of property situated in Indian River County,'Florida, described as fol lows, to -wit: Lots 2, 39 4, and 5 in Block 2 of Edgewood Addition, in the City of Vero Beach, as per recorded plat thereof; subject only to such rights as may have been acquired therein by Indian River County, Florida, under and by virtue of the provisions of Chapter 220799 Acts of the Legislature of 1943; that conveyance of said property is represented by Deed from S. N. Smith, Sr., as Special baster in Chancery, as grantor, to the City of Vero Beach as Grantee, dated January 9, 1942, and duly ac- knowledged by the Grantor on said date and on said date delivered to the City of Vero Beach and which Deed is recorded in Deed Book 32, at page 565, public records of Indian River County, Florida. That the name and address of the owner of said property prior to the acquisition of title thereto by said County under said Chapter 22079, is the City of Vero Beach, Vero Beach., Florida. That the date of the Final Decree under which the title to said lands was quieted in Indian River County is April 16, 1945. f The price of said lands as previously fixed by Resolution of the Board of County Com-' missioners of Indian River County, Florida, is $1625.00. The use to which the lands were enjoyed by said City of Vero Beach, Florida, at the time of entry of said Final Decree was municipal uses as to portions thereof and for sale pur- poses or for exchange of other properties needed for municipal purposes as might be determined by the governing body of the City of. Vero Beach, Florida. That said City is using parts of said property for municipal purposes and that such part or all of said properties as shall not be used for municipal purposes are needed for ex- change with private owners in order to obtain privately owned property in other locations need- ed for municipal purposes or for sale to private purchasers and that acquisition of said pro- perty by Indian River County was through oversight of the City of Vero Beach, Florida, and un- less remedied would render a hardship upon the citizens of said City and the general public. That by reason of ownership of said property by the City of Vero Beach, Florida, there are no municipal taxes or tax liens thereon and that said City herewith offers and tenders cer- tified check in the amount of the sum of $523.91 in payment of all taxesuponsaid property which had become delinquent prior to the quieting of title therein in Indian River County to- gether with interest and costs provided by law and subsequently accrued taxes for current and omitted years and which amount is represented by certificate of.the Clerk of the Circuit Court of Indian River County, Florida, attached to and made a part of this Petition. Pursuant to the foregoing Petition, Commissioner Helseth introduced the following Re- solution and moved its adoption to -wit: - - - - - - - - - - - - - - - - WHEREAS, pursuant to Chapter 22870 Acts of Florida Legislature, 19459 the City of Vero Beach, Florida, has filed with the Board of County Commissioners of Indian River County, Flori- da, a verified written Petition stating that lots situated in Indian River County, Florida, ' described as follows, to -wit: Lots 2, 39 4, and 5 in Block 2 of Edgewood Addition, in the City of Vero Beach, as per record- ed plat thereof; have become the property of Indian River County under the provisions of Chapter 220792 Acts of Florida Legislature, 1943 and by virtue of Decree entered in the Circuit Court of Indian River County, Florida on April 16, 1945 and which Petition sets up the name and address of the City of Vero Beach, Florida and recites that said City was the owner of said lots at the time of the. entry of such Decree and sets up the price of the use to which such lots were enjoyed by such former owner at the time of the entry of said final Decree and a statement of the facts and circumstances upon which such former owner basis the request for the restoration of the des- cribed property and an offer to pay an amount equal to all taxes, including municipal taxes and liens, if any which had become delinquent, together with interest and cost provided by law and together with any snubsegftently accrued taxes which had not been assessed and representing cur- rent and omitted years. Emery of the State Road De - apartment requesting he and Mr. Fultz., member of the State Road Department, meet with the City and County officials of Indian River County in the near future regarding State Road and bridge problems within theCounty. It was stated that said officials of Sebastian are interested in getting asphalt on the streetsin Sebastian. Be E. Carter and Charles A. Mitchell were authorized to prepare notice inviting bids for a boiler to heat asphalt in. The several bills and accounts against the County, having been audited, were examined;; and found correct, were approved and warrants issued in settlement of same. Such bills and ac -i' counts being on file in the office of the Clerk of the Circuit Court, the warrants so issued from the respective funds being listed in the Supplemental Minute Book, as provided by the rul-j es of the State Auditor, reference to such record and the list so recorded being made a part of these minutes.
