D 0 0 1 11 I� any testimony offered as aforesaid and has not deemed it necessary to make any increase in any values fixed by the County Assessor of Taxes as to any property on said tax roll and has given full consideration to all matters pertaining to the same and has equalized the same; therefore,' BE IT RESOLVED that the Board of County Commissioners of Indian River County, Florida, does herewith determine that said tax roll as presented by the County Assessor of taxes is per- fected, reviewed and equalized and that the same is herewith approved and confirmed. ';,The motion for the adoption of the Resolution was duly seconded by Commissioner Graves and unanimously adopted. M. Tuesday, July 29 19469 in regular meeting with the followi i,members of the Board present:, W. C.. Graves, Jr., Chairman, S. E. Glover and R. W. Graves. iAbsent. Albert 0. Helseth and Frank C. Vickers. Also present, L. B. O'Steen, Sheriff, E. E. ;tarter, County Engineer, S. N. Smith, Jr., of the firm of Mitchell, Smith and Mitchell; and V I, l Douglas Baker, Clerk. The minutes of the previous meetinep were read and approved. Notary Public Bond in the sum of $500'.00 for J. A. Harms with Massachusetts Bonding ,and Insurance Company of Boston, Massachusetts, as surety was approved June 21, 1946 by Douglas ,Baker, Clerk Circuit Court as provided by Law. Robert Gramling of the Florida Parole Commission appeared before the Board requesting i, ;'office space for their new district office in the Court House in Vero Beach. Mr. Gramling stat ed that Mr. 'victor Butler of Cocoa would be the new supervisor. The Board agreed to provide s; i:space for this office and instructed Douglas Baker, Clerk, to so:., advise the Florida Parole ;o Commission. i !j At the request of J. Pasco Woods, representing the American Legion in behalf of 'dill% �jRimes,the Huard approved grocery orders not to exceed the sum of $40.00 for the month of July Ifor the welfare of Willie Rimes and family. Said orders to be renewed for the month of August iprovided necessary. Verdict of Coronor's Jury in the matter of the inquest on the body of Effie Mae Bell,. !Fellsmere, Florida, was received and ordered filed with the Clerk. J. R. Middleton, A. -W. Foster, Mrs. Freda Schumann, A. 4. Rose , F. G. 'Hunter and !`Mr. Emery, all citizens of Sebastian residing on or near Louisiana Avenue in Sebastian, appearedi ,!before the Board and -requested immediate repairs be made on Louisiana Avenue stating that the road was in terrible and almost impassible condition. The Board stated they were very much in ',s7mpathy with said request; however, they preferred not to take action until the Commissioner.--- Honorable .omm.issioner. Honorable Frank C. Vickers of that district returned home from his vacation. a County Deeds Nos. 225 to 235 inclusive were signed by the Board as provided by iChapter 194, Florida Statutes of 1941. The Board authorized groceries not to exceed the sum of $40.00 for Mrs. M. W. Yates, pFellbmere, Florida, until the further orders of the Board. The following were, -appointed Deputy Sheriff by L. B. O'Steen, Sheriff, and 'Douglas �Baker, Clerk, announced that said appointments had been filed with him: Nave Precint No. Address J. S. Culpepper 2 Sebastian, Florida j J. A. Cobb, County Service Officer, appeared before the Board and made a report of M,his aetivieies which was well received, and Mr. Cobb was commended for the splendid work which sly the is doing. i' Honorable Troy E. On motion madeby R. W. Graves, seconded by S. E.alummi, Douglas Baker, Clerk, was instructed to prepare notice inviting bids adding and or caculating machines for the Office of ;,the Tax Collector and Tax Assessor. Said machines to cost approximately $445.00 each. Also ifor photo -recording equipment including recording machine and accessories for the Clerk's offie. 'Said machine to cost -approximately $3500.00. Funds for the purchase of this equipment would be provided for from the -County Officers Excess Fee Fund together with approximately $1500.00 excess Race Track Funds. D. 19469.by ad between 'NI • 1 0 1 0 the STATE ROAD DEPARTMENT OF FLORIDA, a body corporate under the laws of the State of Florida, hereinafter called the "Department", and the COUNTY OF INDIAN RIVER, FLORIDA, a policitcal ' subdivision of the State of Florida, hereinafter called the "County, witnesses, that WHEREAS, The Legislature of Florida has designated and established State Road No.4, !' and the Department has located and surveyed a part of said road designated as that portion of Section 8801 from St. Lucie County Line to Overpass Project NES 1409 add has prepared a map of i' survey and location showing said portion of said Section, in said County, as shown on sail map, duly certified as provided by law, on file in the office of the Department at Tallahassee, Florida, ad on file in the 6ffice of the Clerk of the Circuit Court of said County, and in the judgment of the Department said location and survey have been found to be practicable and to i the best interest of the State, and WHEREAS, The Department has requested and authorized said County, solely at ils expensei to secure by donation, purchase or condemnation the lands and property necessary for such right of way, easements for outfall ditches and borrow pits for said portion of said ', Section and such as may hereafter be found necessary by the Department for said portion of Section, and WHEREAS, The Board of County Commissioners of said County, at a meeting duly card ° and held on the 2nd day of duly, A. D. 19", adopted a resolution (copy being hereto attached as.a part hereof, marked Exhibit "A") signifying its agreement to comply with the Department's said requests, and authorizing its Chairman and its Clerk, on its behalf, to executedthis con- tract; NOW, THEREFORE, in consideration of the premises and of the mutual undertakings hereinafter set forth, the parties mutually covenant and agree as follows': 1. The County shall forthwith furnish the Department with a title search made by a reliable Abstractor or Abstract Company, or by the County Attorney, showing the present ownership and record description of each parcel©f land over which said right of way and/or easements extend, together with all unsatisfied or outstanding recorded liens or encumbraanceq,j leases and tax deeds, tax liens and tax certificates held by parties other than'the State. Thereupon the Department shall prepare and furnish to the County the descriptions of said rIg of way and/or easements to be acquired from each of the several parcels of land, or interests therein, as shown by said title search. The furnishing of said description shall be solely for the assistance of the County and nothing in this paragraph shall be taken or construed as " the Department's acceptance of the title, or quality of the title, to the land or easements shown, and shall not release or relieve the County of its agreement herein to furnish the De- partment free, clear and unencumbered title to the land required for said right of way and easements, or from any of its covenants hereunder. 2. After the Department has furnished the County said descriptions the County shall proceed forthwith, solely at its own expense, to acquire by donation, purchase or condemnation, free, clear and unencumbered title to the land so required as aforesaid for said portion df la said Section by the Department for said right of way and easements, and convey or vest the same'j 'l to or in the State of Florida for the use of said State Road, by good and sufficient deed or deeds, and deliver to the State Road Department said lands physically clear of all occupants, j tenants, buildings and/or other structures situate upon or encroaching within the limits of • the lands required for said portion of said Section. Any land to which the Countylas heretofore acquired free, clear and unencumbered title, whi& may be necessary for said right of way and/or easements, shall be conveyed by the County to the State for the said use under the provisions of this section. If the County within a rea- sonable time, to be determined by the Department taking into consideration all the circumstanc t 7Y i and conditions involved, should fail to comply herewith, then and in such event the Department may, at its election abandon the construction of said portion of said Section, or proceed after; giving the County due notice thereof to acquire said right of way and easements,'at the expense of the County, and all sums so advanced by the Department shall be repaid to it by the County upon demand. 3. Commencing with the date when the Department shall begin construction operations �! on said portion of said Section, and at all times thereafter for so long as said portion of said Section shall continue to be a part of ,the State System of Roads, the County shall save,defend, and keep the State of Florida, and the State Road Department, its officers, employees and con- tractors harmless from any and all damages, claims, or injuries, actions at law or suits In equity arising from or growing out of`any defect or alleged defect affecting the title, or be - fl cause of the lack of title or right of possession of the State of Florida for the use of said ;road, to any portions of those lands and easements required by the Department for said portion of said Section as aforesaid, and the County agrees to pay and discharge all lawful claims, C r damages, judgments, decrees and>anny other expenses arising from or growing out of such claims, ,injuries, actions or suits. 4. After the acquisition of said right of way and easements by said County and the acceptance,,of same as satisfactory by the Department, the Department agrees to construct the aforesaid portion of said Section at the earliest date it determines practicable, and appro- priate or cause to be appropriated the funds for said construction. AUGUST 146 The Board of aounty Commissioners of Indian River County met at the Court House in Vero Beach, at 10.400 O'clock, A. M. Tuesday, July 2, 1946, in regular meeting with all members ; present except Frank C. Vickers. Also present were Charles A. Mitchell, Attorney;.E..E. Carter County Engineer; L. B. O'Steen, Sheriff; and Douglas Baker, Clerk. I,I The minutes of the previous meeting were read and approved. Mr. E. W. Knight and Mr. W. B. Crosby appeared before the Board with regard to the road from Blue Cyprus Lake to the Fellsmere grade. They stated this road had been closed just prior to entering land owned by Mr. Fondren Mitchell and that in their opinion, this is and i has been for many years a public road. A letter was also.,received from Dr. W. F. Eubanks re- garding the same problem. The Board advised they would investigate the matter and see what p I I' could be done regarding same, if anything. f Mayor L. M. Shafor of the City of Sebastian, and Charlie Sembler appeared before �I the Board as a committee and requested that some immediate action be taken with regard to the repairing of Louisiana Avenue. Mayor Shafpr stated the City of Sebastian would furnish the rock provided the County would build the road and furnish asphalt for same. It was agreed to build the road on this basis; work to begin as soon as possible. County Deeds Nos. 235, 236, 237 were executed by the Board.under Chapter 22079, a. Acts of 1943, Surety Bond of Marren T. Zeuch in the sum of $109000, as MEMBER OF STATE WELFARE BOARD with U. S. Fidelity and Guaranty Company as surety was approved. Mr. WarrentT.
