HomeMy WebLinkAbout7/12/19470 0 1 Pursuant to the foregoing Notice' the County Assessor of Taxes, Homer Fletcher' submitted the assessment roll for the year 19471 and that no complaints with regard to the same were made, either in person or in writing, and that the roll was considered by the Com- missioners, and that thereupon by motion duly made, seconded and unanimously adopted, the Board adjourned to meet at the. -.hour of 10:00 O'clock A. M., July 12, 1947, in the County Courthouse in Vero Beach for the purpose of further and final considering such roll and acting thereon. M.,'Saturday, Jtay 12, 1947, in r egular"adjourned meeting with the following members of the Board present: `W. C.'Graves, Jr., Chairman; Albert 0. Helseth, and J. L. Helpling. Absent: S. E. Glover and,Frahk C. Vickers, Also present were E. E. Cartel County Engineer, Charles A. Mitchell, .Attorney; and Douglas Baker, Clerk. The minutes of the previous meetings were read and approved. R R S O L U T I© N The following Resolution was introduced by Commissioner Albert 0. Helseth who moved 1 its adoption as follows to -wit: WHEREAS due notice that the County Assessor of Taxes would meet *ith the Board of jl County Commissioners of Indian Rive�Pounty at the office of the Clerk of the Circuit Court of said County at the County Courthouse on Monday, July 7, 1947, for the purpose of hearing com- plaints and•ieeeiving testimony as to the value of any property, real or personal, as fixed by the County Assessor of Taxes, and of perfecting, reviewing and equalizing the assessment, was given by publication thereof in the'Vero Beach Press Journal, a newspaper of general circula-. tion published in such County, in the issues of such newspaper of June 20, 27 & July 4, 19471 ,and as more fully appears by Proof of such publication as shown on page 360 under Minutes of J14y 71 1947: AND WHEREAS, pursuant to such notice, the Board of County Commissioners of Indian I River County did meet at the County Courthouse at 10:00 o'clock A. M., July 7, 1947, and the County Assessor of Taxes did at such time present the assessment roll of said County for the year 1947, and which assessment roll did have the approval of the State Comptroller and as will appear by such approval duly endorsed thereon, and the said Board did consider such asses ment roll and received no amplaints or testimony relative to the same, or to the value of any property fixed thereon; and did thereupon adjourn to meet at the hour of 10:00 o'clock A, M., July 12, 1947, for further and final consideration of said assessment roll; and, WHEREAS, said Board did duly meet in the County Courthouse at 10:00 O'clock A. M., July 12, 19479 pursuant to such adjournment and did further consider said assessment roll for the purpose of perfecting, reviewing and equalizing the same; therefore, BE IT RESOLVED that the tax assessment roll of said County for the year 1947, as submitted to such Board by the County Assessor of Taxes, has been perfected,ieviewed and equal- ized and is hereby determined to be perfected, reviewed and equalized; and the Board not find - Ing it necessary to increase or change any value as fixed upon said assessment roll by the County Assessor of Taxes; therefore, BE IT RESOLVED that said assessment roll as submitted is herewith approved. - - - - - - - - - - - - - - - The motion for the adoption of the Resolution was duly seconded by Commissioner J. L. Helpling and unanimously adopted. Clerk and the Tax .Assessor having given fully consideration to the needs and necessities of the County and the requirements for the different purposes to meet the expenses during the said fiscal year,have determined and do hereby declare the following to be the expenses and all special and extra -ordinary expenses contemplated for the fiscal year next ensuing and for which the revenue for the year 1947 from ad valorem taxation and the estimated receipts from other sources will be available. The name of this organization shall be the State Association of County Commissioners. agICLE 11 ,(PURPOSE AND OBJECTIVE. The general nature of the purpose and objective of this Association . a !shall be the promotion and advancement of the general welfare of the people of the State of ;!Florida, and of the efficient and economical administration of. County government; and to ac- complish such objective as an independent organization and/or by affiliation or cooperation ,with other official state or national organizations having similar purposes and objectives; ,to do all things necessary and proper to accomplish its purposes and objectives. II ARTICLE 111 !i I'ERSHIP. The membership shall be classified into three groups' Active (who must be County 11Commissioners), Honorary and Sustaining. The privileges, duties and responsibilities of such ,!classes of membership shall be as defined by the By -Laws. Only active membersa in good standing; shall be qualified to hold office or vote and voting by proxy is prohibited. �� �T,ICLE IV ;OFFICERS AND BOARD OF DIRECTORS. The officers of this organization shall consist of a President' ;;Vice -President' Secretary, Treasurer and such other officers as the By -Laws shall provide from ;;time to time. The offices of Secretary and Treasurer may be held by the same person. The llBoard of Directors shall consist of at least two members from each Congressional District as "established by laws and a number of members elected from the State at large' the number of !'Directors at Large to be fixed by the By -Laws. No County shall be permitted to have more than e two Directors holding office at the same time. it ARTICLE V jDHEETINGS. There shall be an annual meeting of the Association to be held as provided in the ,By -Laws. Special call meetings may be held from time to time as may be provided in the By - i 'Laws. �I ARTICLE VI METHOD OF ELECTIONS. The Directors from Congressional Districts shall be nominated by members of the Association from such respective Districts and shall be elected by the membership at 'the annual meeting. The Directors at Large shall be nominated and elected at the annual meeting iliaccording to the method of nomination provided in the By -Laws. The President and Vice-President: hshall be nominated and elected at the annual meeting by such method as may be provided in the ,By -Laws,) providing, howevert that the privilege of nominations for President, Vice -President (sand Directors at Large-, from the floor of the Convention, shall always be open. Any active member of the Association' in good standing, shall be eligible for election as President or Vice -President. The Secretary and Treasurer shall be nominated at the annual meeting by the Incoming President and confirmed by the membership. The election of officers and directors Jshall be the last order of business of the second day of the annual meeting. Officials elected ;shall assume their positions on adjournment of the annual meeting. The By -Laws shall provide L i�the times and methods of nominations and elections to fill vacancies. ARTICLE VII li "IDUE<S. Membership dues of this Association shall be determined by the By -Laws, ARTICLE VIII i AMENDMENTS TO CONSTITUTION AND BY-LAWS. Amendments to Constitution and By -Laws of this Asaoc- iation shall be prepared by the Directors and approved by the membership at the annuel meeting: I,Constitution and By -Laws may be altered or amended only at an annual meeting and only after :written notice of such proposed amendment or alteration is promulgated by the Secretary to the Is*embership at least thirty days prior to such annual meeting. Such proposed amendment or changei ,in the Constitution or By -Laws may be proposed/upon written request containing such proposed amendment signed by ten active members of the Association' and filed with the Secretary at ;least forty-five days prior to the annual meeting. The By -Laws, however' may be amended at any 1gsuch annual meeting without such prior notice' by affirmative vote of three-fourths of the Members present. The name of this Organization shall be the State Association of County Commissioners. I' ARTICLE 11 Membership. �A I' Membership in this Association shall be divided into three Classes, Active, Honorary ;and Sustaining. Section. 1. Active members of this Association shall consist only of County C om- j°missioners and any duly qualified and acting County Commissioner shall be eligible for mem- i ": bership. I, Section 2. Honorary members shall consist of distinguished persons selected or in - h �,vited to membership in this Association by its members at the annual meeting, after previous la:approval and recommendation by the Board of Directors. Honorary members shall not be required I to be residents of the State of Florida. Section 3. Sustaining Members. Any former County Commissioner, ar*, County Attorney or other County or State Official who evidences sincere interest in the affairs of this �Ikssociation shall be eligible, upon his request and approval by the Board of Directors, to :'!membership in the Association as a Sustaining member. Sustaining members may participate in the aims and purposes of this Association, may speak from the floor of the Convention and at special meetings, and shall be eligible to serve upon Committees but shall not be entitled to vote. Dues. Section 1. Dues of this Association shall be payable annually on or before the first day of Abril per County, in accordance with the following schedules All Counties of the State, having a population of less than 15,000, according to the last CenstLs, shall pay the sum of $25.00. all Counties of the State, having a papulation of between 15,000 and 35,000, according to the last census$ shall pay the sum of $50.00. All Counties of the State, having a population of between 35,000 and ?5,000, according to the last census, shall pay the sum of $75.00. All Counties of the State, having a population of between ?5,000 and 125,000, accord- 1 and confirmed by the members at any annual or special meeting for any purpose consistent with • ;the aims and purposes eeRele#eat-with-th of the Association. Such assessments shall be pro - '{,rated among the Counties according to the formula or ratio governing annual dues and immediat 'ffiled with the Secretary of the Association who shall promptly notify the several Ccu reties. 'ing to the last census, shall pay the sum of $100.00. All Counties of the State, having a 1population greater than 125,000, according to the last census, shall pay the sum of $200.00, �;providing, however, that this schedule of dues shall not prohibit any County from paying more Jif it so elects. j Section 2. Payment of the above dues shall entitle all Commissioners of such Countie jto active membership in this Association. i Section 3. ARTICLE IV Officers. Section 1. The business of the Association shall be conducted by the Presidentq the oard of Directors and the following standing Committees: Legislative Committee Welfare Committee Convention Committee Auditing and Budget Committee Constitution and By -Laws Committee Entertainment Committee 'Resolutions Committee Section 2. All Committees shall be appointed by the President. h' ARTICLE V i' Affiliations. Section 1. This Association' its officers and members collectively and individually' i• may participate in and affiliate with' individually or as a component part of this Association, i' 'any other organization having similar purposes or ideals, and the officers and Board of Dir- ectors of this Association shall have power to contribute to and aid such other organizations in the furtherance of joint purposes. Section 2. This Association shall actively affiliate with the National Association of County Officials and the officers are authorized and directed to pay such dues, assume such duties' and take such action as may be required to implement such affiliation. Section 3, The Officers and Directors of this Association are authorized and empower-! i1 ed to provide representation and, :membership for this Association and to pay expense incident i! thereto by affiliating or cooperating with other State Associations or a central council of i� I'such State Associations, ARTICLE VI Nominations and Elections. ;! �i Section 1 President - - - » i and Vice -President. Nominations far President and Vice rras w ident shall be made from the floor. The nominee for each such office receiving a majority of votes by secret ballot shall be declared eAected. In the event of a tie vote between the i :nominees receiving the highest vote a second vote shall be taken upon the tying -nominees and succeeding ballots shall be taken if necessary until one nominee.shall receive a majority. Section 2. District Directors. The Congressional Districts of the State of Florida shall be election Districts for this Association for the purpose of electing two District Dir - ii ectors to this Association! respectively. The active members from such Congressional Districts !shall select two nominees for Director from such Districts at the annual meeting and so certify same to the Board of Directors of this Association. Section 3. Directors at Large. Directors at Large shall be nominated and elected by the active membership at the annual meeting at the time provided for elections. Nominations shall be made from the floor. Balloting shall be by secret ballot and the'nine nominees re- iving the highest number of votes on such balloting shall be declared elected. Section 1+. Sections and 3 of this Article shall take effect at the annual meeting of Association to be held in March 1948. ARTICLE VII Vacancies. Section 1. President and Vice -President. In the event of a vacancy in the office of dent the Vice -President shall become the President of the Association. S E i 1 0 1 0 1 1 40 0 1 1 • 1 0 1 In the event of a vacancy in both the office of President and the office of Vice - President, the Secretary shall, within five days, call a special meeting of the Board of Diip­ rectors to be held not less than ten nor more than fifteen days after such call at the time and place therein specified, and at such meeting the Secretary shall preside and a President and Vice -President shall be elected by the Board of Directors. As soon as the President is so elected the office of Secretary shall be vacant and the newly elected President shall fill such vacancy by T pointment. Section 2. District Directors. -In case of a vacancy in the District Directors, the l 'Secretary shall advise the active members of the Association in the particular District, where- fupon such active members shall make nominations to fill such vacancy by mail addressed to the i ,'Secretary. The three persons with the highest number of nominating ballots shall be considered ;nominated. Thereupon the Secretary shall submit in writing to all the active members of the ;i Association the names of the three so nominated, and such active members shall vote by mail for the one to fill such vacancy. The one receiving the highest number of votes shall be elect- ed for the unexpired term. In the event of a tie, the two receiving the highest votes shall determine the outcome by lot in the presence of the Secretary. All such nomination and election ballots shall be in the hands of the Secretary within ten days after mailing of his notice of vacancy and list of nominees, respectively. No nomination or election ballots shall be consid- ered unless received within such times. Section 3. Directors at Large. In case of a vacancy among the Directors at Large the Secretary shall advise the active members of the Association by mail, and they shall make nominations by mail addressed to the Secretary. The five persons receiving the largest !number of nominating ballots shall be considered nominated. Thereupon the Secretary shall sub- mit in writing to all the active members of the Association the names of the five nominees, Iaand such active members shall vote by mail for the one to fill such vacancy. The one receiving �jthe.largest number of votes shall be deemed elected for the unexpired term. In the event of I �a tie, the outcome shall be determined by lot, in the presence of the Secretary. Section 4. Secretary and Treasurer. A vacancy in the office of Secretary or Tre er shall be filled by appointment by the President. ARTICLE VIII Meetings. Section 1.. Annual meetings. The annual meeting shall be held beginning the first Thursday in March. Section 2. Special call meetings of the Association; Special call meetings of the Association may be held from time to time upon call of the President, or upon call of not less i than seven members of the Board of Directors. Any such call shall be filed with the Secretary, ;;who shall call a meeting not less than 10 days nor more than 15 days after the filing thereof. IIThe purpose of such meeting shall be set out in such call. Section 3. Directors' meetings. Meeting of the Board of Directors shall be held as L jjsoon as possible after the close of each annual meeting of the Association and at such regular ;Itimes as the Board may determine ,from time to time. The President or any five members of the Ii _ r_-_37'2- oard of,a-Di:rectoksem&yoeall a special meeting at any time. Such call shall be filed frith the u !Secretary' who shall notify the Board members by mail not less than 10 nor more then 15 days after the filing of the call. The purpose of such call shall be stated therein. Section 4. Seven members of the Board of Directors shall constitute a quorum. ARTICLE IX Secretary and Treasurer. i "y. Section 1. The Secretary shall keep an accurate record of all proceedings of the Association and of the Board of Directors and shall perform such other duties as the Board may II, , ?prescribe. Section 2. The Treasurer shall be bonded in the -sum of $5,000.00, to faithfully perform his duties and to account for all funds of the Association received by him. No dis- �bursements of funds of the Association shall be made unless authorized by the Board of Direct - C° ;fors and paid by check signed by the Treasurer and counter -signed by the President. - &TICLE X The Vice -President. , Section 1. The Vice -President shall have and perform all of the powers and duties of the President in the latter's absence. ARTICLE XI Seal. SeGton 1. The Directors of this Association are authorized and empowered to pre- pare a proper s6al,9 which seal shall be a circular die having the words "State Association of County Commissioz�er,s of Florida" inscribed thereon. There being no further business on motion made, seconded and carried, the Board then adjourned.
