D. 1948' by and be- tween the STATE ROAD DEPARTMENT OF FLORIDA, a bogie corporate under the laws of the State of °'' Florida, hereinafter called the "Department", and the COUNTY OF INDIAN RIVER, FLORIDA, a political subdivision of the State of Florida, hereinafter called they "County". witnesses that WHEREAS, The Legislature of Florida has designated and established State Road No. i 512, and the Department has located and surveyed a part of said road designated as Sections of Section 3302 extending from State Road No.6O north and north- !� 8802 and 8804' and has prepared a map of survey and location covering that portion/easterly to ��Stato toad No: 507 in Fellsmeref and that portion of Section 8804 extending through the Town of Fellsmere, in said County,, as shown on said map, duly certified as provided by laws on fil®. The County shall forthwith furnish the Department with a title search made by a ,reliable Abstractor or Abstract Companyp or by the County Attorney, showing the present owner• j ship and record description of each parcel of land over which said right of way aniVdr ease - menta extend, together with all unsatisfied or outstanding recorded liens or encumbrances, leases and tax deeds, tax liens and tax certificates held by parties- ether than the State. Thereupon the Department shall prepare and furnish to the County the descriptions of s aid right of way and/or easements to be aacquired from each of the several parcels of land, or interests thereing and as shown. by said title search. The furnishing of said descriptions shall be solely 14 for the assistance of the County and nothing in this paragraph shall be taken or construed as the Department's acceptance of the title, or quality of the title* to the land or easements jshown, and shall not release or relieve the County of its agreement herein to furnish the De- partment free, clear and unencumbered title to the land.required for said right of way and ;,easements, or from any of its covenants hereunder. 2. After the Department has furnished the County said descriptions the County shall proceed forthwith, solely at its own expense , to acquire by donation, purchase AUT condemnations,' j free, clear and unencumbered title to the land so required as aforesaid for said portion.of m said Section by the Department for said right of way and easements, and convey or vest the same;; to or in the State of Florida for the use of said State Road, by good and sufficient . deed or deedsq and deliver to the State Road Departmant said lands physically clear of all occupants, tenants, buildings and/ser anther structures situate upon or encroaching within the limits of the'! lands required for said portion of said Section. If the County within a reasonable time, to be determined by the �a Department taking into consideration all the circumstances and conditions involved' should fait to comply here*ith, then and in such event the Department may' . at its election- abandon the construction of said portion of said Section, or proceed after giving the County due 'i li notice thereof to acquire said right of way and easements, at the expense of the County, and all sums so advanced by the Department shall be repaid to it by the County upon demand. 3. Commencing with the date when the Department shall begin construction operationns on said portion of said Sections and at all times -thereafter for so long as said portion of said Section shall continue to be a part of the State System of Roads,.the County shall save' I defend and keep the State of Florida, and the State Road Department, its officers, employees - I �j and contractors harmless from any and all damages, claims or injuries, actions at law or V ysuits in. equity arising from or growing out of any defect or allebod defect affecting the ti t14 '� or because of the lack of title or right or possession of the State of Florida for the use of V said road, to any portions of those lands and easement required by the Department for said f� portion of said Section as aforesaid, and the County agrees to pay and discharge all lawful claims, damages+ judgments, decrees and any other expenses arising from or growing out'of j' such claims, injuries, actions or suits. 4. After the acquisition of said right of way and easements by said County and i f the acceptance of same as satisfactory by the Department, the Department agrees to construct the aforesaid portion.of said Section at the earliest date it determines practicable, and appropriate or cause to be appropriated the funds for said construction. "units installed and one unit installed in the Indian River Fire Protxctivd Association truck. The City advised the maintenance expense for the past year was approximately $350.00 and re= quested the County to agree to a fifty-fifty handling of the expenses. It was moved by Commissioner Helseth seconded by Commissioner Glover aBd carried, to -pay not to exceed the sum of $175-00 for the year beginning October 1, 1948, and ending September 30, 1949, for the purpose as stated above• M. Mr. Boudet, County agent, also submitted a report of his activities for -the month of October. Said report was ordered filed with the Clerk. Cobb appeared before the Board with a petition -dated November 2, I {1948, signed by Albert C. Haag and approximately forty-seven additional residents and citizens ii !!of Roseland with regard to the unfavorable condition of roads in and around the community of 'Roseland. E. E.,Carter, Road, and Bridge Superintendent, then reported that practically all %I h, request which were made.in the petition for the improvement and betterment of roads and rosa >ffl had been complied with, and that because of such prompt and efficient service he had i .i - jlbeen accepted as a member of the Roseland Women's Club. P II A letter was received from Mrs. Ruth Ponder, President of the Roseland Women'sClub p e d r n Bred i thanking the Board of County Commissioners together with fir. Carter for the sereices„ !nand requested additional help and co-operation from the County in connection with a: cleanup day jot Roseland. The Board instructed Mr. Carter to keep in touch with Mos.
