BARTON, CLERK A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, IN OPPOSITION TO CHANGES MADE TO COUNTY VALUE ADJUSTMENT BOARDS BY SENATE BILL/HOUSE BILL 909 WHEREAS, the Florida House and Senate recently voted to make changes to Value Adjustment Boards by amending Chapter 193 and 194, Florida Statutes (2007); and WHEREAS, the Bill requires the Value Adjustment Board to be advised by an outside attorney who must be present at every meeting of the Board; and WHEREAS, the Bill requires the Department of Revenue to create uniform policies and procedures to be used by special magistrates and Boards; and WHEREAS, the Bill permits either the taxpayer or the Property Appraiser to file a motion alleging a "material violation of the law or rules governing the hearing of a petition" i.e. an appeal; and WHEREAS, the Bill requires the Value Adjustment Board to hear these appeals with its attorney in attendance charging a fee for his or her services; and WHEREAS, if the taxpayer or the Property Appraiser disagrees with the outcome of the appeal before the Value Adjustment Board, that decision can now be appealed to the Board of County Commissioners; and WHEREAS, the Bill requires training for special magistrates; and WHEREAS, the Bill also provides for two citizens of the County to sit on the Value Adjustment Board; and WHEREAS, the Bill does not provide any funding to the counties to provide for the changes in the law; and WHEREAS, the amendments to the existing law put a disproportionately greater burden on counties with smaller populations than larger urban counties, NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: 1. The Board states its opposition to House Bill/Senate Bill 909; and 2. The Board asks the Honorable Governor Charlie Crist, to veto this bill. This resolution was moved for adoption by Commissioner Wheeler, and the motion was seconded by Commissioner Bowden, and upon being put to a vote, the vote was as follows: 1 RESOLUTION NO. 2008-053 Chairman Sandra L.
