DOUGLAS BAKER, Clerk Board of County Commissioners August 4. 1950 93 MHEREAS, The Board of County Commissioners has made and completed the estimate of its'necessery and ordinary expenses and of all special and extra -ordinary expenditures contemplated as required by law, and duly advertised the same as required by law, and this being the first meeting of said Board 'of County Commissioners subsequent to the advertising of the same, and said budget being. now before this Board for final consideration and adoption having been duly considered; Therefore, Be it resolved that the said County Coinmissioners' budget and estimate of espenses and expenditures for the year 1950-1951 as heretofore prepared and duly advertised, and it is herewith ratified, confirmed, and finally adopted by this Board subject to the following provisions. (Board of Pablic Instruction) "No part of this appropriation shall be parable unless and until the Board of County Commissioners of Indian River County receives a sum in excess of $56,000.00 from race track funds during the fiscal year 1950-1951; after receipt of $56;900.00 by said County from said source in suc,-fiscal year, an(which sum has been otherwise appropriated, then all sums in excess of $56,000.00 received from such source in such' year shall be paid to the Board of Public Instruction of Indian River County until said Board shall have re- ceived $20000.00 from such source." (Rospital) "No part of this appropriation shall become payable unless and until Indian River County bas received more than $76,000.00 from race track allocations to said County in the fiscal year 1950-1951, and the first $76 000.00 of said_receipts having been otherwise herein appropriated; that upon the receipt of su9 $76,000.00, then any sums received from such source in said fiscal year in excess of 176,000.00 shall be paid to Indian River County Hospita1'Association, Inc., until said Association shall have received said sum of $5,000.00." Motion for the adoption of the Resolution was duly seconded by Commissioner Waddell and unanimously adopted. The Board then proceeded with the matter of fixing the rate of taxation for Indian River County for the year 1950,and, after careful consideration of the estimated re- ceipts and expenditures, the following Resolution was introduced by Commissioner Stewart who moved its adoption, to -wit: WHEREAS, all acts having been performed and all proceedings had as required by lawind preliminary to the levy of taxes in Indian River County, Florida, for the year 1950; and, WHERAS, the respective board and taxing districts being authorized to fix and levy taxes upon property situated within Indian River County, Florida, as provided by law, fixed such tax levies and have certified the same to this Board and this Board having considered the same and having then found them to be properherefore, be it resolved that; Estimates having been made by the Board of Commissioners of XNDIAN 1IVER4 ,MOSQUITO CONTROL DISTRICT, and a certified copy of the resolution filed with this Board, as required by law, and as estimated by the Board of Commissioners, it is determined and hereby declared that a tax rate of Six and five -tenths (6.5) mills upon the dollar be levied, and is hereby fixed and assessed for the year 1950, on all of the property taxable for such purpose as provided by law in the County of Indian River, lying and being within the boundaries of said Indian River Mosquito Control District, the boundaries of said District being described as follows, to -wits ,//Allof that territory in Indian River County, Florida, included with the boundaries described as follows,.to-wits Begin at a point where the South boundary line of Indian River Copinty, Florida, intersects the Atlantic Ocean; thence run West along the South boundary line of Indian River County, Florida, to the Southwest corner of Section 31, Town- ship 33 South, Range 36 East; thence run North along the range line dividing Range 35 East and Range 36 East to the Northwest corner of Section 6 ;. Estimates having been made by the Board of Commissioners of SEBASTIAN INLET p STRECT and a certified copy of Resolution filed with this Board as required by law and as estimated by said Board of -Commissioners, it is determined and hereby declared that a tax rate of three (3) mills upon the dollar be levied and is hereby fixed and assessed for the year 1950 on all of the property in the County of Indian River lying and being in the boundaries of said Sebastian Inlet District, which said boundaries are as follows, to -wits All that part of Indian River County which comprised and made up the first Commissioner's district of St. Lucie County, Florida, as located and established upon the passage of Chapter 7976,1Laws of Florida, Acts of 1919 as amended, which said levy shall be used as a maintenance fund for the purposes authorized and prescribed in the Act creating said District, namely, Section 15, Chapter 7976, Laws of Florida, as amended by Chapter 12259 of the Laws of Florida. AUSEN MBLBOURNI4, FLQRIDA $ 30,789.00 After considerable discussion and consideration in the matter, and the Board realizing they did not or would not have sufficient funds for the completion of the work during this or the next fiscal year, no action was taken on any of the bids which were re- ceived and they were ordered filed with the Clerk. Upon motion made by Commissioner Stewart, seconded by Commissioner Waddell and carried, the Board authorized and directed the Chairman and Clerk to execute an Agreement between the trustees of the property of Florida East Coast Railway Company and Indian River County relating to a railroad crossing at Gifford, Florida, identified as MP 225 plus:. 632'. A copy of the Agreement together with a blueprint of said crossing is filed in the Clerk's office. It is understood that q proximately $75.00 representing costs in connection with the foregoing crossing will be paid by Charles S. Buster. It was moved by Commissioner Stewart, seconded by Commissioner Waddell and carried, and the Attorney and Clerk of this Board was directed to make application for land from the Federal Government to be used for public recreation purposes, said land to be located on the beach and north of the former Coast Guard station. It was moved by Commissioner Stewart, seconded by Commissioner Waddell and carried, and the Clerk was instructed to deposit the sum of $1172.00 from the Road and Bridge Fund to the Registry of Court Fund being double the amount of $86.00 which amount was recommended by the appraisers who were appointed by the Court to appraise five (5) parcels of land for rights-of-way of State Road No. A1A. Carter and Idinspected my property located on lateral A (Tract 16, Sec. 7, Twp. 32, Rge 39) to determine the amount of this property needed for road right of way. Mr. Carter etermined that it would he necessary to take the East 30 Test of this tract. In view of the fact that I will lose my windbreak, irrigation ditch, road and eventually a row of trees I feel that I should be reimbursed for the property. I would be willing to accept $1000.00 for the property (East 30 feet) with the understanding that the County will pay the cost of having my two 4 inch artesian wells cut off and piped inside of my new property line. It is further understood, that,.if at any time in the future it becomes necessary or desirable for me to remove the East row of citrus trees the County will do this work and dispose of the trees at County expense. Mr. B. C. Spitzley,300 Murray Road, West Palm Beach, Fla. holds a mortgage on the above property. I have ried several times to contact Mr. Spitzley by telephoneto see if he would be willing to sign a release but have been unable to reach him. I assume that he is out of the state on vacation. , If the above proposition is acceptable to the Board of County Commissioners and they can obtain a release from Mr. Sptizley it will be satisfactory with me for the County to proceed with the clearing of the right of way whenever they are ready.
