HomeMy WebLinkAbout1997-059 • • Public Hearing(Third Reso.) 5/97(reso\129th)Vk/DC IN THE RECORDS OF CLERK EFFCIRCJIIT COUR1 RESOLUTION NO. 97- sq INDIAN RIVER CO..FLA. � o A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, CONFIRMING THE SPECIAL ASSESSMENTS IN CONNECTION WITH A WATER MAIN kn EXTENSION TO 129th STREET (BETWEEN OLD DIXIE HIGHWAY AND rn RIVERSIDE DRIVE); PROVIDING FOR SPECIAL ASSESSMENT LIENS TO 'J BE MADE OF RECORD. v1 WHEREAS, the Board of County Commissioners of Indian River County has, by Resolution No. 97-06, adopted May 6, 1997, determined to make special assessments against certain properties to be serviced by a water main extension to 129th Street(between Old Dixie Highway and Riverside Drive);and WHEREAS, said resolution described the manner in which said special assessments = shall be made and how said special assessments are to be paid; and X3. —c w WHEREAS, the resolution was published in the Vero Beach Press Journal, as required by Section 206.04, Indian River County Code;and w WHEREAS, the Board of County Commissioners of Indian River County passed Resolution No. 97-47 on May 6, 1997, and set a time and place for a public hearing at which w the owners of the properties to be assessed and other interested persons would have the chance to be heard as to any and all complaints as to said project and said special assessments, and for the Board to act as required by Section 206.07, Indian River County Code; and WHEREAS, notice of the time and place of the public hearing was published in the Press Journal Newspaper on Friday, May 9, 1997, and once again on Friday, May 16, 1997 (twice one week apart; the last being at least one week prior to the hearing), as required by Section 206.06, Indian River County Code;and WHEREAS,the land owners of record were mailed notices at least ten days prior to the hearing,as required by Section 206.06, Indian River County Code; and WHEREAS, the Board of County Commissioners of Indian River County on Tuesday, � May 27, 1997, at 9:05 a.m. conducted the public hearing with regard to the special -0 assessments; aj N o U .a NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY W :0 � COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: Co Ow t� 1. The special assessments shown on the attached assessment roll are hereby confirmed and approved, and shall remain legal, valid, and binding first liens against the properties 0 0 assessed until paid in full. YV b I � • RESOLUTION NO. 97-59 3. The Board finds that the properties assessed by this resolution will receive special benefits equal to or greater than the cost of the assessment. 4. The County will record the special assessments and this resolution, which describes the properties assessed and the amounts of the special assessments, on the public records, which shall constitute prima facie evidence of the validity of the special assessments. The resolution was moved for adoption by Commissioner T i p p i n , and the motion was seconded by Commissioner Ginn and, upon being put to a vote, the vote was as follows: Chairman Carolyn K. C. cil N v w �9 T� a Providing(First Reso.) 4/97(reso/129street)Vk/DC RESOLUTION NO. 97- 46 A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR WATER SERVICE TO 129th STREET (between Old Dixie Highway and Riverside Drive); PROVIDING THE TOTAL ESTIMATED COST, METHOD OF PAYMENT OF - ASSESSMENTS, NUMBER OF ANNUAL INSTALLMENTS, AND LEGAL DESCRIPTION OF THE AREA SPECIFICALLY SERVED. WHEREAS, the Board of County Commissioners of Indian River County has determined that the improvements herein described are necessary to promote the public welfare of the county and has deter-mined to defray the cost thereof by special assessments against certain properties to be serviced by a water main extension to 129th Street (between Old Dixie Highway and Riverside Drive), hereinafter referred to as Project No. UW-96-05-DS; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: 1. The County does hereby determine that a water line shall be installed to benefit 13 properties on 129th Street (between Old Dixie Highway and Riverside Drive),.and that the cost thereof shall be specially assessed in accordance with the provisions of Sections 206.01 through 206.09 of the Code of Indian River County. 2. The total estimated cost to be assessed is $23,850 or$0.201741 per square foot to be paid by the property specially benefited as shown on the assessment plat on file with the Department of Utility Services. Assessments are to be levied against all lots and lands adjoining and contiguous or bounding and abutting upor, the improvements or specially benefited thereby and further designated by the assessment plat with respect to the special assessments. 3. A special assessment in the amount of $0.201741 per square foot shall be assessed against each of the properties designated on the assessment plat. This assessment may be raised or lowered by action of the Board of County Commissioners after the public hearing, at the same meeting, as required by the referenced County Code. 4. The special assessments shall be due and payable and may be paid in full within 90 days after the date of the resolution of the Board with respect to credits against the special assessments after completion of the improvements (the "Credit Date") without interest. If not paid in full, the special assessments may be paid in ten equal yearly installments of principal plus interest. If not paid when due, there shall be added a penalty of 1-1/2%of the + principal not paid when due. The unpaid balance of the special assessments shall bear interest until paid at s rate to be determined by the Board of County Commissioners when the project is completed. 5. There is presently on file with the Department of Utility Services a plat showing the area to be assessed, plans and specifications, and an estimate of the cost of the proposed improvements. All of these are open to inspection by the public at the Department of Utility Services. • 6. An assessment roil with respect to the special assessments shall promptly be prepared in connection with the special assessments. 7. Upon the adoption of this resolution, the Indian River County Utility Services Department shall cause this resolution (along with a map showing the areas to be served) to be published at least one time in the Vero Beach Press Journal before the public hearing required by Section 206.04.
