Fidelity and Guaranty Company as surety was approved. Surety Bond for J. R. Graves as Member Indian River County Mosquito Control Board in the sum of $59000.00 with U. S. Fidelity and Guaranty Company as surety was approved and filed with Douglas.Baker, Clerk Circuit Court. The several bills and accounts against the Countyq having been audited, were examined and found correct, were approved and warrants issued in settlement of same. Such bills and accounts being on fildlin the office of the Clerk of the Circuit Court, the Warrants so issued from the respective funds being listed in the Supplemental Minute Book, as provided by the rules of the State Auditor, reference to such record and the list so recorded being made a part of these minutes. The County Depository filed its monthly statement, showing receipts and disburse- ments of the various funds, which having been audited were found to be correct. There being no further business on motion made' seconded and carried' the Board then adjourned. M., Tuesday, January 2. 1951, with the following members presents W. C. Graves, Jr., H. C. Watts, Tom N. Stewart, Aubrey L. Waddelll and J. J. P. Hamilton. Also present were E. E. Carter, Road and Bridge Superintendent; L. B. O'Steen, Sheriff; Douglas Baker' Clerk, and Sherman N. Smith, Jr., Attorney from the firm of Mitchell, Smith & Mitchell. S. N. Smith' Jr. called the meeting to order. There being no old business to be considered at this time, the Board then proceeded in the order of new business. On motion of Commissioner Stewart$ seconded by Commissioner Waddell and carriedg the Board elected to select the Chairman for the ensuing year by secret ballot with the understanding that a majority of votes would elect, and in the event any one member did not receive a majority on the first ballot that it would be necessary to vote again, and also with the understanding that S. N. Smith, Jr., Attorneyq would check the ballots. n On the first ballot no one member received a majority; however,`on the second ball6t CommissionerGraves received two votes and Commissioner Stewart received three votes and was thereby elected Chairman to serve for the ensuing year. Chairman Stewart then took over the chair. The next order of business was to elect a Chairman pro -tem, and Commissioner Graves was nominated by Commissioner Waddeilq and Commission- er Waddell was nominated by Commissioner Graves who stated that he did not think it necessary for a secret ballot to be taken for the election of a Chairman pro -tem. Chairman Tom N. Stewart then called for a vote on the two nominees. Commissioner Waddell receivedoone vote, and Commissioner Graves received three votes and was thereby elected to serve as Chairman pro -tem for the ensuing year. Application for the position of Road and Bridge Superintendent was presented by Mr. Frank A. Knight; however, no action was taken -in the matter. SIIpon motion of Commissioner Gravest seconded by Commissioner -Waddell and carried, • 1 1 0 123 It was ordefed that Honorable Thad Carleton, Assistant State Attorney, Fort Pierce, Florida, receive the sum of $36.55 per month as pfovided by law. Commissioner Hamilton inquired as to the County Employees and officers together with the salaries being paid and stated the same met with his approval. Minutes of the previous meeting were read by Chairman Stewart, and upon motion of Commissioner Waddell seconded by Commissioner Watts and carried, the same were approved. Commissioner Graves made a motion and requested that Chaltman Stewart serve as Chairman of the Road Committee in his place and said request was granted. The Board requested Douglas Baker, Clerk to contact the County Health Department and request an investigation as tb the present T. B. status of Irones Campbell who was seek- ing re-employment with the Road and Bridge Department. E. E. Carter, Road and Bridge Superintendent stated he had contacted Mr. Kjorsvik regarding a suitable location for wayside park near the Sebastian river bridge and stated that Er. Kjorsvik seemed willing to cooperate but wished to obtain information as to the new proposed =right-of-way for U. S. No. 1 in that area. Id 03 S PATIENT RESOLUTION Commissioner Hamilton Introduced the following Resolution and moved its adoption, tb+wits WHEREAS, The Board of County Commissioners, in and for Indian River County, Florida, _ in the preservation of human lives, desiring to cooperate in the treatment and cure, if possible, of tuberculosis- patients living within this County, and in order to preserve the public health for its citizens, not infected with tuberculosis, have assisted all tuberculo- sis patients making application to thb% in a financial way, by providing the necessary cost for hospitalizat oon and treatment in the several Tuberculosis Sanatoriums located within the Statef for such period of time, as was prescribed by the attending physician; and 4 S. N. Smith, Jr. of the law firm of Mitchell, Smith & Mitchell) was employed as County Attorney for the ensuing year fbr a sum of $150.00 per month. Id 03 S PATIENT RESOLUTION Commissioner Hamilton Introduced the following Resolution and moved its adoption, tb+wits WHEREAS, The Board of County Commissioners, in and for Indian River County, Florida, _ in the preservation of human lives, desiring to cooperate in the treatment and cure, if possible, of tuberculosis- patients living within this County, and in order to preserve the public health for its citizens, not infected with tuberculosis, have assisted all tuberculo- sis patients making application to thb% in a financial way, by providing the necessary cost for hospitalizat oon and treatment in the several Tuberculosis Sanatoriums located within the Statef for such period of time, as was prescribed by the attending physician; and 124 WHEREAS, there are several Tubercular Hospitals within the State classed as liberty free institutions, allowing the patients all the liberty necessary for their recovery and happiness; while there is one such Institution classed as compulsory or restricted Institut- ion, where the patients are kept under strict rules and guards if necessary to preserve the safety of such patients and to prevent them becoming a menace to their health and recovery, and to their -families -and the public; and WHERFA§4 certain patieftts, during treatments have heretofore imposed upon their liberty privilegeq,,and in some instances left the hospital before being released or dis- charged and returned to their homes, thereby becoming a menace to their families and the community; and, when -it becomes necessary to return them to the hospital all treatment and expenses theretofore incurred is wasted and treatment has to be started over, makthg it expensive on the County; and WHEREAS' it has become necessary that certain rules be prescribed by this Board to prevent such conduct on the part of the patients in the future; Now, therefore., PE IT RESOLVED, that in the future, all tuberculosis patients sent from this County to a tuberculosis sanatorium,be and they are required to remain at said Institution until fully and regularly released by the attending physician, and in the event any patient leaves without this permission that they be immediately arrested and placed in the Institution maintaining compulsory attendance and treatment, under the direction of such guards as may be necessary to insure their remaining there until safe for themselves and their families and the public -for them to leave; and BE IT FURTHER RESOLVED' that a copy of this Resolution be furnished to all tuber- culosis patients, whose treatment is being financed by the County and to -the hospital where they are sent. adopted. The foregoing Resolution was duly seconded by Commissloner.Waddell and unanimously - - - - - - - - - - - §EBASTIAN INEPT RESOLUTION Commissioner Hamilton introduced the following Resolution and moved its adoption as followsyto-wit: WHEREAS, the Sebastian Inlet, as the same is now located and constructed' exists in Brevard County' Florida, at a point approximately one and one-half miles North of the North line of Indian River County, Florida; and, WHEREAS, the said Inlet has been constructed at said location subsequent to the establishing on the line between Brevard and St. Lucie Counties' now Brevard and Indian River Counties; and, WHEREAS, there exists a narrow strip of land, all unimproved, between the Indian River and zzk Ocean to, the South of said Sebastian Inlet which is now a part of Brevard County; and, WHEREAS, Brevard County has no access to this narrow strip of land; and, WHEREAS, the road to said Sebastian Inlet through the narrow strip of land above described is unimproved and practically impassible; and, WHEREAS, the Board of County Commissioners of Indian River County, Florida, desires to improve said road in order to make the South side of said Sebastian Inlet accessible to the general public; and, WHEREAS, the Sebastian Inlet District which exists for the construction and main- tenance of this Inlet covers a part of both Indian River and Brevard Counties; Now, there- fore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida,, 125 that this Board does respectfully request the Board of County Commissioners of Brevard County, Florida to adopt a Resolution directed to the members of the Legislature of the State of Florida from Brevard County requesting said Legis]ot m -c :I to secure the passage of an act redefining the boundary -line between Brevard and Indian River Counties, Florida, between the Indian River and the Atlantic Ocean in order that said boundary line shall be center of the Sebastian Inlet. BE IT FURTHER RESOLVED, that the Board of County Commissioners of Indian River Countyt Florida, does herewith request the Honorable Alex MacWilliam, Representative, and the Honorable Evans Crary, Rentor, in the Legislature of the State of Florida, to cause an act to be passed by said Legislature redefining the boundary line between Brevard and Indian Aiver Counties, Florida, as above set forth. The foregoing Resolution was duly seconded by Commissioner Waddell and unanimously adopted. - - - - - - - - - - • Upon motion of Commissioner Waddell, seconded by Commissioner Hamilton and carried, Mrs. Anne Christensen was employed am County welfare case worker at a salary of $150.00 per month effective January, 1, 1951.
