The following Resolution was introduced by Commissioner Hamilton who moved its a- doption as follows, to -wit: WHEREAS' the County Assessor of taxes has completed his Tax Assessment Roll for the year 1951 and has presented the same to this Board on this day as provided by law; ands WHEREAS9 due notice has been given by publication in the hero Beach Press Journals a newspaper of general circulation published in Indian River County, Florida, at least 15 days before this date that this Board will be in session for the purpose of hearing complaints and receiving testimony as to the value of any property as fixed and assessed by the County Assessor of Taxes and as will more fully appear by proof of publication of such notice filed with the minutes of this meeting; and' WHEREAS, this Board has met this day and has heard any complaints and has received any testimony offered and has not deemed it necessary to make any increase in any values fixed by the County Assessor of Taxes as to any property on said•tax roll and has given fall consideration to all matters pertaining to the same and has equalized the same; therefore' BE IT RESOLVED that the Board of County Commissioners of Indian River County, Florida' does herewith determine that said tax roll as presented by the County Assessor of taxes is perfected' reviewed and equalized and that the same is herewith approved and con- firmed* The motion for the adoption of the Resolution was seconddd by Commissioner Watts ald unanimously carried. Walton • - To: The Board of County Commissioners of Indian River County,Florida Gentlemen: There is recorded in Plat Book 2, pages 37 and 38s in the office of the Clerk of the Circuit Court of Indian River County, Florida, a plat of Ocean Beach Road Survey in Township 33 South, Range 40 East, Indian River County, Florida, which said survey as shown upon said plat began at the SoUth unite of the City of Fero Beach, Florida, and ran South to the South line of Indian River County through property now owned by the undersigned and other citizens of this County. As you know, there was recently completed Florida State Road AlA from Beachland Boulevard in the City of Vero Beach, Florida, South to the South line of Indian River County, Florida, and that the right of way for said State Road AlA was obtained by the Board of County Commissioners of Indian River -County, Florida, from the property owners'affected by the plat above referred to and that said State Road AIA parlIallels and follows in a general way the plat of Ocean Beach Road Survey except that said Ocean Beach Road Surtsey is located closer to the Atlantic Ocean than said Florida State Road AlA. I wish to call your attention to the fact that this plat of Ocean Beach Road Survey was placed of record as above recited and that the same constitutes a cloud upon the title of your Petitioner and others similarly affected.. That said Ocean Beach Road as set fpnth in said plat above referred to was not approved by any of the property owners affected, that the right of way as shown upon said plat was not conveyed by the affected property owners and that the road shown upon said plat has never been laid out, used or established and that neither the Board of County Commissioners of.Indian River County, Florida, nor has any other public body acquired icy condemnation or otherwise any right, title or interest in and to the right of way shown upon said plat. ZONING RESOLUTION --RE: SALE OF ALCOHOLIC BEVERAGES NEAR SCHOOLS, Commissioner Graves introduced the following Resolution and moved its adoption, as follows to wit: R E S O L DTI O N WEEftEAS, the Board of Public Instruction of Indian River County, Florida, is now erecting a public school on the North Gifford Road in Indian River County, Florida; and, WHEREAS, in the opinion of the Board of County Commissioners of Indian River County, Florida, it would be to the best interests of the citizens of Indian River County that the area surrounding said public school be zoned with respect to the sale of alcoholic beverages and limiting the area wherein the location of a vendor's place of business licensed under the State Beverage Laws of Florida may be permitted to be operated; Now, -therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that this Board does herewith establish a zone or area in Indian River County, Floridan in a territory lying without the limits of any incorporated city or town wherein the location of a vendor's place of business licensed under the Beverage Laws of the State of Florida is prohibited from being operated and that such prohibited territory wherein such vendor's shall not operate and wherein no license shall be granted to any such licensee to conduct such a place of business is described as follows, to frit: All that area or territory lying within onv-half mile North and lying` within one-half mile South of a line described as follows: Beginning at the Intersection of Florida State.Road No. 5 or U. S. The foregoing Resolution was duly seconded by Commissioner Hamilton and unamiously adopted. Upon the recommendation of Chairman Stewart the Board agreed to pay for 200 feet of water hose for the Grower's fire truck to cost approximately $200. Mrs. .Anne Christenson appeared before the Board and made a report of her activities for the month of June. The Board authorized Mrs. Christenson to make such changes and arrangements as she deemed advisable and proper, for the care of Ole Evans and John Atkins. ordered • Upon the recommendation of Mrs.. Christenson, the Board li payments to Lizzie Watkins in the sum of $25.00 a month for the care of Arthur Harvin, to be discontinued August 1, 195'1. The Board authorized hospitalization for Seibert Jenkins not to exceed the sum of $50.00. Councilman J. F. Barrett, representing the City of Vero Beach appeared before the service Board stating that it was very essential and neccessary, that a twenty-four hour ask be maintained in the Radio room at the City Hall,in other words that three men working aright ed hours each should be employed and request the Board to increase thela-ppropiation from $1400 to $2800 to be applied as salary, in order to maintain twenty-four hour service. Upon motion of Commissioner Graves, seconded by Commissioner Hamilton and carried' the Board agreed to and granted the foregoing request and ordered said amount be appropiated for this purpose in the 1951-1952 Budget, effective October 1, 1951* Pursuant to Resolution #516, adopted by the City of Vero Beach on the 13th day of June, 19511 in respect to release from dedication of certain property in Block 3, Vero Beach Estates, the following Resolution was adopted: ESLIITI EVO A Commissioner Graves introduced the following Resolution and moved its adoption as follows to wit: aASO&II1IOA WHEREAS, by Resolution heretofore adopted by the City Council of the City of Vero Beach, as to all of the parcels of property hereinafter described? the Board of County Commissioners of Indian River County, Florida, pursuant to the provisions of Chapter 220799 Laws of Florida, did dedicate to public use and purposes by the City of Vero Beach, Florida, all of the parcels of property hereinafter described; and, WHEREAS, the City of Vero Beach, Florida, has delivered to this Board of County Commissioners of Indian River County' Florida, a duly certified copy of Resolution adopted by the City Council of said City, reciting that said City has no present or prospective use for public purposes of the parcels of property hereinafter described$ and releasing all claim of said City thereto and requesting and authorizing that this Board revoke its dedication of 0 1 40 said parcels of property herewith described for public use and purposes, and to thereupon handle and dispose thereof as.provided by said Chapter 22079; therefore, BE IT RESOLVED$ that the Board of County Commissioners of Indian River County, Florida, does hereby revoke its dedication for public use and purposes of the.parcels of property hereinafter deseribsed, and does herewith instruct the Clerk of this Board and the Clerk of the Circuit Court of Indian River County$ Florida, to cause his records to show aco, cordingly, and to cause said parcels of property to be made available for sale as.provided by said Chapter 22079 of the Laws of norida, and to forward a certified copy of this Re- solution to the Tax Assessor of Indian River County, and to the Tax Assessor of the City of Vero Beach, Florida. Such bills ana `accounts being on file in the office of the Clerk of the Circuit Court, the Warrants so issued from the respective funds being listed in the Supplemental Minute Book, as provided by the rules of the State Auditor, reference to such record and the list so recorded being *ade a part of these minutes. The County Depository filed its monthly statement, showing receipts and disburse- ments of the various funds, which having been audited were.found to be correct.
