The several bills and accounts against the County, having been audited, were ex-

amined and found correct, were approved and warrants isaued in settlement of same. Such
bills ana `accounts being on file in the office of the Clerk of the Circuit Court, the
Warrants so issued from the respective funds being listed in the Supplemental Minute Book,
as provided by the rules of the State Auditor, reference to such record and the list so
recorded being *ade a part of these minutes.
The County Depository filed its monthly statement, showing receipts and disburse-
ments of the various funds, which having been audited were.found to be correct.
There being no further business on motion made seconded and carried the Board
then adjourned.

Pursuant to the foregoing notice, Comissioner Graves introduced the following
Resolution and moved its adoption as follows to wits
R O S O L U T I g N
BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida*
that this Board does herewith find and determine as follows:
1. That Joseph W. Dalton filed a Petition before this Board on the 3rd day of
July, 1951, at a meeting of said Board requesting this Board to adopt a Resolution closing,
vacating, and abandoning the road or street and renouncing and relinquishing the rights of
Indian River County, Florida, or the public in and to any lands delineated on the recorded
map or plat of Ocean Beach Road Survey in Township 33 South, Range 40 East, Indian River
County, Florida, according to plat thereof recorded in Plat Book 2* pages 37 and 38, in the
office of the Clerk of the Circuit Court of Indian River County, Florida, and shown thereon
as a street, road or highway.
2. That this Board has published Notice thereof one time in the Vero Beach Press
Journal, a newspaper of general circulation in Indian River County, Florida, said publica-
tion being published at least two weeks prior to the date stated therein for such ptblic
hearing.
3. That the street, road or highway delineated upon said recorded map or plat
above described is not a State or Federal road maintained by the State of Florida and the
said street* road or highway delineated on said recorded map or plat is not located within
the incorporated limits of any municipality and is located in Indian River County, Florida.
4. That a public hearing thereon has been held by the Board of County Commis-
sioners of Indian River County, Florida, in the office of said Board in the Indian River
County Courthouse, Vero Beach, Florida, on August 7, 1951, at 10:00 o'clock A. til.: and,
BE IT FURTHER RESOLVED by the Board of County Commissioners of Indian River County,
Florida, that this Board does herewith close, vacate and abandon any public or private street,
road, alleyway or other place used for travel and all portions thereof and does herewith
renounce and disclaim any right of Indian River County, Florida, and the public in and to'
all land delineated as a street, road or highway on the recorded map or plat of Ocean Beach
Road Survey in Township 33 South, Range 40 East, Indian River County, Florida, according to
plat thereof recorded in Plat Book 21 pages 37 and 38, in the office of the Clerk of the
Circuit Court of Indian River County, Florida, as a street, road or highway, provided, howevery,
that this Resolution shall in no wise close, vacate or abandon any public or private street,
road, alleyway or other place used for travel or any portion thereof and shall in no wise
renounce or disclaim any right of the County and the public in and to any land, street, road
or highway acquired by or vested in the County or the public by any other means other than
the plat recorded in Plat Book 29 pages 37 and 38, as above set forth.
The foregoing Resolution was duly seconded by Commissioner Waddell and unanimously
adopted.
STATE ROAD DEPARTMENT RIGHT OF WAY RESOLIITION _- ST_ATE ROAD # 5
WHEREAS, Pursuant to due authorization, the State Highway Engineer had a part of
State Road No. 5, in Indian River County, located and surveyed and has designated the same
as Section 8801, and has prepared a map showing location and survey of that portion of said
Section extending from South City Limits of Vero Beach North on Eighth Avenue, Nest on
Twenty -First Street, and Northwesterly on Commerce Avenue and extension to North City Limits
of Vero Beach,

BE IT FURTHER RESOLVED that in the event the County agrees to secure the right of way
for the roadbed, ditches and borrow pits for said portion of said Section, that the Chairman
and the Secretary of the Department are hereby authorized to execute for the Department the
usual Right of Way Contract with the County.

Pursuant to the foregoing State Road Department Resolution the following Resolution
was adopted.
NOW, THEREFORE, BE IT RESOLVED by the State Road Department, that it hereby
approves the location and survey of said portion of said Section and directs that a copy
of said map of such location and survey certified to by the Secretary and the Chairman of the
Department be filed in the office of the Clerk of Circuit Court of said County;
BE IT FURTHER RESOLVED that it is the judgment of the Department that the construc-
tion of said portion of said Section is necessary, practical and to the best interest of the
State, and that it is necessary that the
right of way for the roadbed, ditches and borrow
pits for said portion of said Section be acquired;
BE IT FURTHER RESOLVED by the Department that said County be, and it is hereby
said Department at Tallahassee, and
authorized and requested, at its own expense, in its name, by its Commissioners, to secure by
gift, purchase or condemnation, the lands necessary for the right of way for the road bed for
said portion of said Section, together with any and all easements for drainage ditches and
borrow pits that may hereafter be found and determined necessary in the construction and
maintenance of said portion of said Section, and to convey the same to the State of Florida,
free of encumbrances, and
BE IT FURTHER RESOLVED that in the event the County agrees to secure the right of way
for the roadbed, ditches and borrow pits for said portion of said Section, that the Chairman
and the Secretary of the Department are hereby authorized to execute for the Department the

COUNTY COMMISSIONERS' RESOLUTION -- STATE.ROAD N0, 5
On motion of Commissioner Graves, seconded by Commissioner Waddell, the following
resolution was adopteds
WHEREAS, the State Road Department of Florida has authorized and requested Indian
River County to furnish the necessary rights of way and easements for that portion of Section
8801, State Road No. 5, extending from South City Limits of Vero Beach North on Eighth Avenue,
West on Twenty -First Street, and Northwesterly on Commerce Avenue and extension to North City
Limits, which has been surveyed and located by the State Road Department as shown by map on
file in the office of the Clerk of the Circuit Court of said County, and in the office of the
said Department at Tallahassee, and
WHEREAS, the said Department will not begin construction of said portion of said
in said Counjcy until title to all land necessary for said portion of said Section
Section/has been conveyed to or vested in said State by said County, and said lands physically
cleared of all occupants, tenants, fences, buildings and/or other structures situate upon or
encroaching within the limits of the lands required for said portion of said Section; now, there-
fore, be it
RESOLVED, that said County, through its board of Cou#ty Commissioners,'comply with
the request of said Department and procure, convey or vest in said State the free,,clear and
unencumbered title to all lands necessary for said portion of said Section and !dbliver to the
State Road Department said lands physically clear of all occupants, tenants, fences' buildings
and/or other structures situate upon or encroaching within the limits of lands required for said
portion of said Section, and that the Chairman and the Clerk of this Board be and they are
hereby authorized and directed to execute and deliver, on behalf of said County to said De-
partment, the contract in the form hereto attached; and be it further
RESOLVED, that the Attorney for this Board be, and he is hereby authorized and
directed to proceed to take the necessary steps for the County to acquire in the name of said
County by donation, purchase or condemnation said rights of way and easements for said portion
of said Section, and to prepare in the name of said County by its County Commissioners all
condemnation papers, affidavits and pleadings, and prosecute all condemnation proceedings to
judgment; alid said Attorney is further authorized to have prepared at said County's expenses
and furnish to the Department, the abstract search provided for in said contract.
Pursuant to Resolution #521, adopted by the City of Vero Beach on the 25th day of
July, 1951, in respect to 'release from dedication of certain property in Block 29 Vero Beach
following
Estates, the/Seheel Resolution was adopted.
RESOLUTION: REVOKING CERTAIN LANDS TO CITY OF VERO BEACH -IN VERO BEACH ESTATES

Commissioner Graves introduced the following Resolution and moved its adoption
as follows to wit:
WHEREAS, by Resolution heretofore adopted by the City Council of the City of Vero
Beach, as to all of'the parcels of property hereinafter described, the Board of County -
Commissioners of Indian River County, Florida, pursuant to the provisions of Chapter 22079,
Laws of Florida, did dedicate to public use and purposes by the City of Vero Beach, Florida,
all of the parcels of property hereinafter described; and,
WHEREAS, the City of Vero Beach, Florida, has delivered to this Board of County
Commissioners of Indian River County, Florida, a duly certified copy of Resolution adopted
by the City Council of said City, reciting that said City has no present or prospective use
for public purposes of the parcels of_property hereinafter described, and releasing all claim
of said City thereto and requesting and authorizing that this Board revoke its dedication
of said parcels of property herewith described for public use and purposes, and to thereupon
handle and dispose thereof as provided by said Chapter 22079; therefore,
BE IT RESOLVED, that the Board of County Commissioners of Indian River County,
Florida, does hereby revoke its dedication for public use and purposes of the parcels of pro-
perty hereinafter described, and does herewith instruct the Clerk of this Board and the Clerk
of the Circuit Court of Indian River County, Florida, to cause his records to show accordingly,
and to cause said parcels of property to be made available for sale.as provided by said Chap-
ter 22079 of the Laws of Florida, and to forward a certified copy of this Resolution to the
Tax Assessor of Indian River County, and to the Tax Assessor of the City of Vero Beach, Florida.
BE IT FURTHER RESOLVED, that the Clerk of the Circuit Court, in determining the basis.
and minimum price for which the lands hereinafter described shall be offered for sale, shall
compute the area of each of said parcels, and the total area of the parcel or lot of which it
is a part, obtain the percentage that the area, of which dedication is herewith revoked, bears
the total area of the parcel or lot of which it is a part; said percentage shall thereupon
be applied to the total base or minimum price fixed by law for said entire parcel or lot) and
the result shall be the minimum price for which said parcel, dedication of which is herewith
revoked, shall be offered for sale.
BE IT FURTHER RESOLVED, that the parcels of propertyi the dedication of which is
herewith and hereby revoked, are those parcels of property situated in Vero Beach Estates,
a subdivision in Indian River County, Florida, as per recorded Plat thereof, and as specifi-
cally described as follows, to -wit:
The West one-half of Lot 37, Block 2 Vero Beach Estates, according
to plat filed in the office of ,the Clerk of the Circuit Court of
St. Lucie County, Florida, in Plat Book 51 page 8.

Commissioner Waddell seconded the foregoing Resolution whibhwas unanimously

A letter dated July 284 1951, was received W U. E. Osterberg, President, Indian
River County Ministerial Association, requesting the Board take action prohibiting the
sale of intoxicating beverages and alcoholic liquors from 12:00 Saturday night to Monday
mornipg., 7:009 and was ordered filed.
Mrs. Anne Christenson, County Welfare Case Worker, appeared before the Board and
made a report of her activities for the month of July.
Upon motion of Commissioner Graves, seconded by Commissioner Wadddll and darried,
E. E. Carter, Road and Bridge Superintendent, was instructed to prepare, furnish and equip
an office for Mrs. Anne Christenson to be used jointly with representatives of the State
Welfare Office in the Court House:
RESOLUTT„QN TO CONGRESS --PRICE CONTROLS
The following motion was introduced by Commissioner Waddell and moved its adoption
as follows to wit:
WHEREAS the United States of America is threatened with a run -away inflation that
will impoverish her people and weaken this nation when it most needs it a strength, and
WHEREAS the national congress is considering a bill to prevent such ruinous
inflation by controlling prices and rolling back the most important commodity costs, and
WHEREAS the consumer and the individual in such a situation as this often feel
they have no effective way of making their wishes known to their national lawmakers,
NOW THEREFORE BE IT RESOLVED BY Indian River County, Florida
That the United States senators and congressmen representing the people of Florida
give their support to a strong and vigorous price control bill that will give this Deo-
cf'atic national administration the weapon it needs to fight inflation.
That we urge all loyal Democrats to remember that this is the party of the people
and not of special privilege for the few, and as such, it is our obligation as Democrats to`
side with the people intheir desire for prices to remain stable.

Commissioner Watts seconded the foregoing Resolution which was unanimously adopted.
By action of the Board Commissioner Watts was appointed Chairman of State Beauti-
fication Committee, representing Indian River County.
A letter received from the Red Cross, requesting use of the Court House for shelter
in case of storms was ordered filed.
Superintdndent of Schools J. A. Thompson, appeared before the Board and requested
Aggistance on play grounds at Vero Bdach Schools, however no action was taken int the matter.
Upon motion of Commissioner Graves, seconded by Commissioner Waddell, the Board
approved payment of a request in the sum of $100 for Indian River County Defense Council

Fund toward defame expenses of same.

Upon motion of Commissioner Watts, seconded by Comissioner Kamilton, carried, the
,Board agreed to increase the salary of C. E. Strait, janitor, from $165 per month to $17.5
per month, effective August 1, 1951,
Douglas Baker, Clerk, anounced he had received an additional $2500 Race Track Funds
and it was ordered deposited in the Road and Bridge Fund.

Casualty Company of Orlando, Florida, as surety was approved, by Douglas Baker, Clekk dircutt
Court, July ll, 1951, as provided by law.

nity Company as surety, was approved.by Douglas Baker, Clerk Circuit Court, July 28, 1951
as Provided by law.
Notary Public Bond for Walter E. Loper in the sum of $500 with the American Surety
Company of New York as surety, was approved August 1, 1951 by Douglas Baker, Clerk Circuit

The Board then proceeded with the matter of fixing the rate of taxation for Indian
River County for the year 1951, and, after careful consideration of the estimated receipts
and expenditures, the following Resolution was introduced by Commissioner Graves who moved

taxes upon property situated within Indian River County, Florida, as provided by law, fixed
such tax levies and have certified the same to this Board and this Board having considered

Estimates having been made by the Board. of Commissioners of SEBASTIAN INLET DISTRICT
and a certified copy of Resolution filed with this Board as required by law and as estimated
by said Board of Commissioners, it is determined and hereby declared that a tax rate of
Three (3) mills upon the dollar be levied and is hereby fixed and assessed for the year
1951 on all of the property in the County of Indian River lying and being in the boundaries
of said Sebastian Inlet District, which said boundaries are as follows, to -wit: All that part
of Indian River County which comprised and made up the first Commissioner's District of St.
Lucie County, Florida, as located and established upon the passage of Chapter 7976, Laws
of Florida, Acts of 1919 as amended, which said levy shall be used as a maintenance fund
for the purposes authorized and prescribed in the Act creating said District, namely, Section
15, Chapter 7976, Laws of Florida, as amended by Chapter 12259 of the Laws of Florida.
Estimates having been made by the Board of Commissioners of the CENTRAL AND
SOUTHERN FLORIDA FLOOD CONTROL DISTRICT, and a certified copy of the Resolution filed with
this Board as required by law and as estimated by said Board of Commissioners, it is
determined and hereby declared that a tax rate of Eight -tenths (.8) mill on the dollar be
levied and is hereby fixed and imposed and assessed for the year 1951, on all of the property
in the County of Indian River lying and being within the boundaries of said Central and
Southern Florida Flood Control District the boundaries of said District being described as
including all of the County of Indian River.
Estimates having been made by the Board of Commissioners of the FLORIDA INLAND
NAVIGATION DISTRICT, and a certified copy of the Resolution filed with this Board, as required
by law, and as estimated by the said Board of Commissioners, it is determined and hereby de-
clared that a tax rate of One-tenth (1/10) mill upon the dollar, be levied, and is hereby

fixed and imposed and assessed for the year 1951, on all of the property in the County of
;!Indian River lying and being within the boundaries of said Florida Inland Navigation District,
the boundaries of said District being described as the entire County as a whole.
Estimates having been made by the Board of Public Instruction of Indian River
County, Florida, and a certified copy of the Resolution filed with this Board as required
by law and as estimated by said BOARD OF PUBLIC INSTRUCTION, it is determined and hereby
declared that a tax rate of Four and Five -tenths (4.5) mills upon the dollar be levied, and
is hereby imposed upon all property in the County of Indian River to meet the current
expenses, incidental and necessary, for the operation of the public school of the County.
Estimates having been made by the said BOARD OF PUBLIC INSTRUCTION and a certified

copy of the Resolution filed with this Board as required by law and as estimated by said
Board of Public Instruction, it is determined and hereby declared that the tax rate of 4.5
mills upon the dollar is hereby levied, assessed and imposed upon all homesteads to meet the
interest ppyments and provide a Sinking Fund for the ultimate redemption of bonds out -standing
against said County current school fund and representing indebtedness incurred prior to the
exemption of said homesteads from taxes.

law, it is determined and declared that a tax rate of Three (3) mills upon the dollar be
levied, and is hereby fixed and assessed for the year 1951 on all property in the County
of Indian River lying and being within the boundaries of SPECIAL TAX SCHOOL DISTRICT N0. 1,
boundaries of which said District are described as follows, to -wits Beginning at the North-
east corner of Sec. 3, Tp. 31 S., Range 39 E., then run west along County line to N. W.
corner of Tp. 31 S., Range 38 E.,, thence South along Range line to S. W. Corner of Sec. 18,
Tp. 31 S., Range 38 E., thence East along Section line to Atlantic Ocean, thence North along
Ocean beach to starting point,'meet the interest payment and provide a Sinking Fund for the
ultimate redemption of bonds of said Special Tax School District No. 1.
Estimates having been made by the said Board of Public Instruction for SPECIAL TAT
SCHOOL DISTRICT N0. 119 and a certified copy of the Resolution filed with this Board as re-
quired by law, it is determined and hereby declared that a tax rate of One and one-half
(1 1/2) mills upon the dollar be levied and is hereby fixed and assessed for the year 1951
on all of the property in the County of Indian River lying and being within the boundaries of
said District No. 11 which boundaries are as follows, to -wits Beginning at the Northeast
corner of Sec. 32, Twp. 32 S., Range 40 E., then run west along sec. line to NW corner Sec.
319 Tp. 32 S., Range 38 E., thence South on Range line to S. W. corner Sec. 31, Tp. 33 s.,
Range 39 E., thence west along section line to N. W. corner Sec. 6, Tp. 33 S., Range 36 E.,
thence South along Range line to S. W. Corner Sec. 18, Twp. 33 S., Range 38 E., thence Egst
to Atlantic Ocean, thence North along Ocean beach to starting point. Seventy-five hundredths
(.75) mills to be used in paying of interest and providing a Sinking Fund for retiring bonds
of said District dated the firsjday of December, 19369 designated as 11A and Seventy-five
hundredths (.75) mills for the purpose of paying interest upon and providing a Sinking Fund
for bonds of said District dated December 1, 19409 designated as 11B.
BE IT FURTHER RESOLVED that the Tax Assessor of Indian River County, Florida, be
and he is hereby directed to assess and levy all the foregoing taxes as fixed and levied by
this Board upon the taxable property in Indian River County, Florida, just and due taxation
within the respective boundaries upon which such taxes are levied, and that a certified copy
of this Resolution be furnished to the County Assessor of taxes, and that a certified copy
of this Resolution be furnished to the County Collector of Taxes.
Motion for the adoption of the Resolution was duly seconded by Commissioner
Waddell and unanimously adopted.
R E S O L U T I O N
Commissioner Watts introduced the following Resolution and moved its adoption
as follows, to -wits
BE IT FURTHER RESOLVED that the rate of Taxation necessary to meet the expenditures
of the Board of County Commissioners of Indian River County, Florida, for the fiscal year
1951-1952 pursuant to the budget of said Board as heretofore published, amended and approved,
is as hereinafter levied and that the tax rate as hereinafter shown and set forth, be and it
is hereby levied on all taxable property in Indian River County, Florida, for the year 1951,
with the rate hereinafter set out, to -wits
In order to meet the estimated current expenses of the County of Indian River of
the sum of $139,489.45, it is determined and hereby declared that a tax rate of six and six -
tenths (6.6) mills upon the dollar be levied and is hereby im osad upon all of the

lying and being in the County of Indian River on the first day of January 1951, for the
GENERAL REVEN[JE F,_, to meet the current expenses of the County and to provide for the ex- •
penditures as estimated in the budget hereinbefore set forth.
To cover the amount of the estimated expenses for keeping the County Roads in
good shape and for the construction and repairing of bridges and other necessary expenses to
keep the roads of the County in good condition and provide other roads when necessary of
$859720.209 it is determined and hereby declared that a tax rate of One (1) mill upon the

dollar be levied, assessed and is hereby imposed upon all of the property lying and being
in the County of Indian Riveron the first day of January 1951, to meet the current expenses
of the County as estimated in the budget for:_•ROQ & BRIDGE FUND.
To meet the interest payments and provide a sinking fund for the ultimate redemption
of County Court House bonds, in pursuance of the requirements of the law the sum of
$39888.35, it is determined and hereby declared that a tax rate of Orbe -tenth (1/10) mill upon
the dollar be levied, assessed, and is hereby imposed upon all the property lying and being
in the County of Indian River on the first day of January, 1951, for INS RIVER,_,COUNTTYY
COURT HOUSE BONDS SINKING FUND.
To meet the expenses estimated to be necessary to be paid out of the FINE & FORS
FEITURE FUND the sum of $39,537.40, it is determined and hereby declared that a tax rate of
Four-fifths (4/5) mills upon the dollar be levied, assessed, and is hereby imposed upon all
the property lying and being in the County of Indian diver on the First day of January, 1951,
for the Fine & Forfeiture Fund, to meet the current expenses as estimated in the budget.
To meet the expenses estimated to be necessary to be paid out of the CAPITAL OUTLAY -
JAIL FUND, the sum of $43,173.659 it is determined and declared that a tax rate of One (1)
mills upon the dollar be levied, assessed and is hereby imposed upon all the property lying
and being in the County of Indian Rivery,onLthe first day of January, 1951, for the Capital
Outlayi,Jai1 Fund to meet the current expenses as estimated in the budget.
According to the millage so determined, fixed, assessed the total millage to be
entered in the column provided for the County taxes in the Assessment Roil for the year
1951, is Nine and Five -tenths (9.5) mills upon the dollar to cover a total estimated expendi-
ture of $311, 809.05.
Motion for the adoption of the Resolution was duly seconded by Commissioner Graves
and unanimously adopted.
The Board authorized S. N. Smith, Jr., Attorney, together with Duncan, Stewart &
McVoy, architects, to prepare and advertise Notice for Bids on Jail equipment for the second
floor only in the new Jail Addition.

The committee, appointed in the matter, made a verbal report and recommended that
the order to vacate be executed, effective August 31, 1951.
Upon motion of Commissioner Hamilton, seconded by Commissioner Graves and unanimously
carried the Board ac.cepted the report and recommendation of the committee and it was ordered.
Upon motion of Commissioner Hamilton, seconded by Commissioner Graves and unanimously
carried, the Wabasso Civic Club was named as the operating agency for the Wabasso Beach
property with the understanding that the property shall be self-sustaining and that no County
funds shall be spent°on building or property.
Notary Public Bond for Anna D. Scent in the sum of $500.00, with the 'American Surety
of New York as surety, was approved by Douglas Baker, 81erk Circuit Court, August 2, 1951,
as provided by law.

The Board of County Commissioners of Indian River County met at the Court House
in regular meeting at 10:00 A. M., Tuesday, September 4, 19519 with the following members Pres
Tom.N. Stewart, Chairman; W. C. Graves, Jr., H. C. Watts, Aubrey L. Waddell, and J. J. P.
iton. Also present were L. B. O'Steen, Sheriff; S. N. Smith Jr., Attorney; E. E. Carter,
Road and Bridge Superintendent; and Douglas Baker, Clerk.
The minutes of the previous meetings were read and the same approved upon motion of
Commissioner Graves, seconded by Commissioner Watts and carried as to July 2, and upon motion
of Commissioner Graves, seconded by Commissioner Waddell and carried as to July 3, and upoh
tion of Commissioner Graves, seconded by Commissioner Hamilton and carried as to August
1951.
Mr. Severin H. Hansen of Roseland, Florida appeared before the Board and submitted
following Petition.
