! The several bills and accounts against the County, having been audited, were ex-
amined and found correct, were approved and warrants issued in settlement of same. Such
bills and accounts being on file in the office of the Clerk of the Circuit Court, the
Warrants so issued from the respective funds being listed in the Supplemental Minute Book,
as provided by the rules of the State Auditor, reference to such record and the list so
recorded being made a part of these minutes.
The County Depository filed its monthly statement, showing receipts and disburse -
meets of the various funds, which having been audited were found to be correct.
There being no further business on motion made, seconded and carried, the Board
then adjourned.

The Board of County Commissioners of Indian River County met at the Court House
in regular meeting at 10:00 A. M., Tuesday, September 4, 19519 with the following members Pres
Tom.N. Stewart, Chairman; W. C. Graves, Jr., H. C. Watts, Aubrey L. Waddell, and J. J. P.
iton. Also present were L. B. O'Steen, Sheriff; S. N. Smith Jr., Attorney; E. E. Carter,
Road and Bridge Superintendent; and Douglas Baker, Clerk.
The minutes of the previous meetings were read and the same approved upon motion of
Commissioner Graves, seconded by Commissioner Watts and carried as to July 2, and upon motion
of Commissioner Graves, seconded by Commissioner Waddell and carried as to July 3, and upoh
tion of Commissioner Graves, seconded by Commissioner Hamilton and carried as to August
1951.
Mr. Severin H. Hansen of Roseland, Florida appeared before the Board and submitted
following Petition.
Whereupon, Mr. Hansen agreed to execute a deed to Indian River County as to that
I of property lying within 40 feet of each side of a line (see description in recorded
) for County right-of-way.
The foregoing was agreeable to the Board and the same approved upon motion of
ommissioner Watts, seconded by Commissioner Graves and unanimously carried.

ntlemen:
The Plat of the Town of Wauregan is recorded in Plat Book 1, pages 178 and 179 in
:h� office of the Clerk of the Circuit Court of St. Lucie County, Florida,'which said property
.s now located in Indian River County, Florida. The plat of this Town shows a street running i
�n East and West direction known as Cherokee Street. After 'the `recording of this plat, the
ounty.built a road known as the Roseland Road, which extends from Florida State No. 5 West to

the Town of Roseland. The Roseland Road parallels Cherokee Street' according to the plat of
Wauregan, and includes a part of Cherokee Street, but not all of the same. Most of the
Roseland Road extends through Blocks 17, 18 and 19 of the Plat of Wauregan instead of being
in Cherokee Street.
In order to correct this situation, I am willing to convey to the County a strip of
land 70 feet wide lying 35 feet on either side of the center line of the Roseland Road as the
same now exists where it runs through my property, in exchange for which I request that the
Board of County Commissioners adopt a Resolution closing, vacating and abandoning that part of
Cherokee Street not within 35 feet of the center line of Roseland Road and renouncing and dis-
claiming any right in any of the land delineated on said recorded plat as Cherokee Street in-
sofar as the same pertains to that part of Cherokee Street shown on said plat and described
as follows, to -wit:
All that part of Cherokee Street lying more that 40 feet on each side of a line
described as.follows:
Beginning at a point 37 3/10 feet from the northwest corner of Block 19, according
Ito the Town Plat of Wauregan, which point is on the West line of.said Block, thence running
(East on an interior angle with the West line of said Block 90 degrees 12 minutes for a dis-
tance of 280.8 feet to a point, thence on a tangent line to a point on the West line of Lot
11, said point being 122 feet South of the Northwest corner of Lot ll, except, however,

R E S 0-L U T I 0 N--- REQUEST RESURFACING STATE ROAD N0. 5.
WHEREAS, the Board of County Commissioners of Indian River County, Florida, has
noted that State Road No. 605 in Indian River County' Florida, from State Road 60 South to
the South County Line is widely used by the travelling public and relieves the congested
condition of Florida State Road No. 5 to a considerable extent and'that said road is badly in
need of resurfacing; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida,
that this Board does herewith respectfully request the State Road Department of Florida to
immediately resurfacr this road as a part of its Inaintenance program in Indian River County,
Flokida; and ,
BE IT FURTHER RESOLVED that a certified copy of this Resolution be furnished to the
ionorable Merrill P. Barber, Member of the State, Road Department from this District.
Motion for the adoption of the Resolution was duly made by Commissioner Hamilton and
inanimously carried.
R E S O L U T I O N--- REQUESTING THE FLORIDA INLAND NAVIGATION DISTRICT
AND THE CORPS OF ENGINEERS OF THE UNITED STATES ARMY TO DF'P_0_SIT ,ANY SPOIL
REMOVED FROM IK2IJZ RIVER UPON THE SHORES OF THE INDIAN RIVER
Commissioner Graves introduced the following Resolution and moved its adoption to merit
The foregoing Resolution was seconded by Commissioner Waddell and unanimously carried

WHEREAS, the Board of County Commissioners of Indian River County, Florida, is vital

interested in the control of mosquitoes, sand flies and other insects in Indian River County
Florida, and the protection of property in this County
i�rom flood and storm damage; "

WHEREAS, this Board has noted that most of Indian River County along the Indian River
is located along that part of the Indian River known as the "Narrows", that is, that the Indian
River through this County.is much narrower than it is both to the North and to the South of
this County and that said river cont4ins many islands, shoals and bars impeding the flow of
water; and,
WHEREAS, this Board has noted that in the time of hurricanes, storm winds or
high tides caused primarily by winds that the waters of the Indian River buildup to a flood
heighth in the narrows thereby flooding the property adjoining the Indian River in this County;
Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County that
this Board does herewith respectfully request the Florida Inland Navigation Distkict and the
Corps of Engineers of the United States Army to make note of the unusual situation prevailing
along the Indian River in this County and to immediately stop its practice of dredging,
cleaning or clearing the Inter -Coastal Waterway in the Indian River through this County by
dumping the spoil into the Indian River, thereby further impeding the flow of water throggh
the narrows and this Board does further request that in the future, any contradts for dredging
of the Inter -Coastal Waterway provide that any spoil removed from the Indian River will be de-
posited upon the -shores of the Indian River where the same will not only prevent the impeding
of water through the narrows but will also be of great benefit to the citizens of this County
in filling the marsh areas on the shore, thereby assisting in eliminating mosquitoes, sand
flies and other insects in this area.
BE IT FURTHER RESOLVED$ that a certified copy hereof be furnished to the
Honorable Spessard L. Holland and the Honarable George Smathers, United States Senators from
Florida, and the Honorable Dwight L. Rogers, Member of Congress from this District, the
Honorable Axel Peterson, Member of the Florida Inland Navigation District from this District,
and to the Florida Inikdd Navigation District and the District Office of the Corps of
Engineers, United States Army, at Jacksonville, Florida, with the request that all these
parties use their best efforts and good offices toward accomplishing the purposes set forth
in this Resolution.

Upon the suggestion of Tom N. Stewart, chairman, the Petition requesting the Board
of County Commissioners to establish a Small Claims Court was referred back to the .Chamber
of Commerce fD± further study in the matter and suggested that a public meeting be called and
the local Attorneys and Merchants be extended an invitation to attend such a meeting for the
purpose of discussing and being informed as to the operation of the Small Claims Courts in
order to determine whether or not they desire such a Court to be established. The Commissioners
previously appointed from the Board were Commissioners Waddell, Graves and Hamilton.
S. N. Smith, Jr., Attorney, reported that Mr. Cates had not vacated the Wabasso
Beach as requested by the Board and suggested a suit be filed in behalf of the County to obtain
possession of the property. Upon motion of Commissioner Hamilton, seconded by Commissioner
Watts and carried the Board authorized S. N. Smith Jr., Attorney, to proceed with the file df
the suit.

Dear Mr. and Mrs. Harding:
The Board of County Commissioners of Indian River County, Florida! at a meeting on
September 4, 19519 adopted a motion agreeing that the County would move your residence building
situated on the North 40 feet of the South 121 feet of Lot 24 of Palm Addition in Vero Beach,
and set the residence back from the new property line that would be established by your
conveyance of additional right of way to the State Road Department for widening Florida State
Road No. 5 ( U. S. Highway No. 1). In other words, the County will move the building back ons,-

the lot at the place you designate and will reestablish the same as it now is on its new
location, all without cost or expense to you, provided you will not execute the deed of con-
veyance to the State Road Department.
This work will be done by the County prior to the completion of the widening of the
road.

At the request of Mr. E. G. Thatcher, Secretary -Treasurer Civilian Defense
Council of Indian River County, and upon motion of Commissioner Graves, seconded by Commissioner
Waddell, and unanimously carried, the Board granted permission for such Council to place office;
files and cabinets, together with other necessary supplies and equipment in the County Commis-
sionerst room of the Court House in order that it may be designated as headquarters for the De
fense Council. (Note: Jack Jennings is Chairman and Allison Warren is Vice -Chairman of the
Council.-)
It was ordered that the sum of $100.00 be paid to Marcel A. Boudet,.Secretary,
Indian River County Water Conservation Committee, from the General Revenue Fund.
Application for admission to State Tuberculosis Sanatorium for Viola Stephens
(white), Vero Beach, Florida, was approved.

The several bills and accounts against the County, having been audited, were ex-
`amined and found correct, were approved and warrants issued in settlement of same. Such bills
sand accounts being on file in the office of the Clerk of the Circuit Court, the warrants so
issued from the respective funds being listed in the Supplemental Minute Book, as provided by
,the rules of the State Auditor, reference to such record and the list so recorded being made =a

Chairman Stewart announced this meeting was called for the purpose of adopting
:resolutions relating to certain State Roads and such other business as might be properly brought i

4 STATE ROAD #60 -- RIGHT-OF.WAY RESOLUTION, -- "MIRACLE MILE E%TENSION"
On motion of Commissioner Hamilton, seconded by Commissioner Graves, the follow -
ling resolution was adopted:
WHEREAS, the State Road Department of Florida has authorized and requested Indian
:River County to furnish the necessary rights of way and easements for that portion of Section
:8808, State Road No. 60, extending from State Road No. 5 in Vero Beach Easterly along Twenty -
!,first Street, thence Northerly along Indian River Boulevard to State Road No. 502, which has
been surveyed and located by the State Road Department as shown by map on file in the office of
:the Clerk of the Circuit Court of said County, and in the office of the said Department at Tal-
lahassee, and
WHEREAS, the said Department will not begin construction of said portion of said
Section in said County until title to all land necessary for said portion of said Section has
been conveyed to or vested in said State by said County, and said lands physically cleared of
all occupants, tenants, fences, buildings and/or other structures situate upon or encroaching
within the limits of the lands required for said portion of said Section; now, therefore, be
