TUESDAY, JANUARY 4. 1952
The Board of County Commissioners of Indian River County met at the Court House
in regular adjourned meeting at 10:00 o'clock A. M., Tuesday, January 4, 1952, with the follow-
ing members present: Commissioners W. C. Graves, Jr., Aubrey L. Waddell, H. C. Watts, and J. J.,
P. Hamilton. Also present were Allison Warren, newly appointed Commissioner from District #5 in
place of Tom N. Stewart, who stated that he had not as yet received his Commission; L. B. O'Steen,
Sheriff; E. E. Carter, Road and Bridge Superintendent; S. N. Smith, Jr., Attorney; and Douglas
Baker, Clerk.
Sherman N. Smith, Jr. called the meeting to order and, there being no old business
to be considered at this time, the Board then proceded in the order of new business. On motion
of Commissioner Hamilton, seconded by Commissioner Waddell and unanimously carried, the Board
elected W. C. Graves, Jr. as Chairman for the ensuing year.
Chairman Graves then took over the Chair. The next order of business was to elect
a Chairman pro tem, and on motion of Commissioner Hamilton, seconded by Commissioner Watts and •
unanimously carried, Commissioner Waddell was elected to serve as Chairman pro tem for the ensu-
ing year.
On motion of Commissioner Waddell, seconded by Commissioner Hamilton and unani-
mously carried, all County employees and officers were re-employed, salaries remaining the same
as follows:

At the meeting
of December 4, 1951, a Committee consisting of Commissioner Waddell,
E. E. Carter, Road and Bridge
Superintendent, and S. N. Smith, Jr.,
Attorney, was instructed to
investigate the Surrency - Whittier Road problem and bring in a recommendation
to be acted upon
at the next regular meeting of this Board. Sherman N. Smith, Jr.,
speaking for the Committee,

stated the Committee had met with Mr. Whittier and Mr. Surrency and that no agreement could be
reached and that it was his opinion the requested right of way for Mr. and Mrs. Whittier, through
the lands.of Mr. Surrency was a matter which should be left to the parties involved and that the,
County would not be justified in the expenditure of public funds in providing a right of way for,

Mr. and Mrs. Whittier.
Mr. Frank A. Knight appeared before the Board and made a verbal application for
the position of Road and Bridge Superintendent. Chairman Graves advised Mr. Knight the Board
had already employed E. E. Carter as Road and Bridge Superintendent.
Mrs. Anna Christensen, County Welfare Case Worker, appeared before the Board and
made a report of her activities for the month of December, 1951, and said report was filed with
the Clerk.
The following Confederate pensioner of Indian River County was approved:

Bond of E. W. Vickers, as Member of Board of Commissioners, Indian River Mosquito
Control District, in the sum of $5,000.00 with Continental Casualty Company as surety, was ap-
proved by, and filed with, Douglas Baker, Clerk, as required by law.
Verdict of Coroner's Jury in the matter of the inquest of the body.of Robert
Eugene Fortenberry was received and filed with the Clerk.
Certain work was authorized to be done relating to the obtaining of rights of way
on Florida State Road #5 and copies of letters on file in the Clerk's Office directed to the
following: Mr. and Mrs. W. R. Rye, 755 18th Place, Vero Beach, Florida; and Mr. A. L. Pond,
Vero Beach, Florida.
Sherman N. Smith, Jr. was authorized to go to the Florida East Coast Railway
Attorney's office in Jacksonville, Florida, to try and get approval on the various ramifications,
etc. relating to State Road #5 (U. S. #1) right of way problems.
Upon motion of Commissioner Waddell, seconded by Commissioner Watts and unanimous-
ly carried, the salary of G. E. Strait, Janitor, was increased from $185.00 to $200.00 per month,
and the salary of Douglas Baker, as Clerk to the Board, was increased from $200.00 to $250.00
per month.
The Board authorized traveling expenses for the County Commissioners and Attorney
to attend a budget meeting of the State Road Department in Tallahassee on January 14., 1952, re-
lating to secondary roads and other matters. 1
It was ordered the sum of $150.00 be paid from the.<General Revenue Fund to L. G.
Burger, Chairman Florida Free Highways Association.
A certified copy of Resolution duly adopted by the County Democratic Executive
Committee, setting out the Party assessments levie'd,'against t he.earious candidates who partici-
pate in the Democratic Primary election to beheld Tuesday, May 6, 1952, was received and care-
fully noted as follows:

Upon motion of Commissioner Hamilton, seconded by Commissioner Watts and carried',
the Board then instructed Douglas Baker, Clerk, to collect from each candidate who seeks nomin
ation for any office a filing fee of three percent (31) of the annual salary of the office as
provided in Section 99.031 of the 1951 Florida Statutes.
Commissioner Watts presented a petition signed by Donald MacDonald and numerous ,
other property owners of the Roseland - Sebastian area urging the construction of a new highway.
in order to eliminate a bottle -neck now existing on U. S. Highway #1 running south from the
bridge across the Sebastian River and follows the shore line of the Indian River.
RESOLUTION -- Changing of Right of Way, Florida State Road #5, (U.S. #1) at North County Line, South
Pursuant to the foregoing petition, Commissioner Watts introduced the following
Resolution and moved its adoption as follows, to -wit:
WHEREAS, the Board of County Commissioners of Indian River County, Florida, has

heretofore petitioned the State Road Department of Florida, by Resolution, to widen, extend and;
improve Florida State Road No. 5 on its present right of way into a modern and adequate four a
lane highway through Indian River County; and, —
WHEREAS, there has been filed before this Board of County Commissioners a peti-
tion of residents and property owners in the Northern part of Indian River County, requesting
that the right of way of Florida State Road No. 5 be changed as the same comes South from the
Sebastian River bridge; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County, Flor-
ida, that this Board does herewith concur in the expressions made in said petition and said
Board does herewith recommend that the State Road Department consider the changing of the right
of way of Florida State Road No. 5 at the North County line in order that said right of way
shall run in a more direct Southerly line from the Sebastian River bridge South in order that
the curves and winding section of said road along the shore of the Indian River immediately to
the South of the Sebastian River bridge may be eliminated and so that said new right of way may,
come back to the present right of way at a point South of said curves.
BE IT FURTHER RESOLVED that a certified copy of this Resolution be furnished to
the Honorable Alfred A. McKethan, Chairman, State Road Department, and to the Honorable Merrill
P. Barber, member of the State Road Department from this District. j.
Upon being duly seconded by Commissioner Waddell, the same was unanimously adopted.
RESOLUTION -- Requesting Game and Fresh Water Commission to Fix Dividing
Line Between Fresh Water and Salt Water in the Sebastian River
Commissioner Hamilton introduced the following Resolution and moved its adoption,
as follows, to -wit:
WHEREAS, the Board of County Commissioners of Indian River County, Florida, is
interested in the preservation of fish and game in Indian River County, Florida; and,
WHEREAS, it is the opinion of the Board of County Commissioners that it would be
to the best interest of the citizens of Indian River County,` Florida, that a definite line be
established defining and determining the part of the Sebastian River which lies in Indian River
County, Florida, as to that which constitutes fresh water under the laws of the State of Florida
and as to that which constitutes salt water under the laws of the State of Florida; Now, there-
fore,
BE IT RESOLVED by the Board of County Commissioners of Indian River County, Flor-
ida, that this Board does herewith respectfully request the Game and Fresh Water Fish Commission

of the State of Florida to fix`the dividing line between fresh water and salt water in the Sebas-
tian River in that part of said Sebastian River lying in Indian River County, Florida, as the
center line of the Sebastian River Bridge on Florida State Highway No. 5 and declare that all of
the waters of said river in said County to: the West of said center line as fresh water and all of
the waters to the East of said center line as salt water; and,
BE IT FURTHER RESOLVED that a certified copy of this Resolution be furnished to
the Game and Fresh Water Fish Commission of the State of Florida, with the request'that said Com-
mission fix said line as authorized under Section 371.01 (11), Florida Statutes, and with the re-
quest that a certified copy of said order be filed with the Clerk of this Board.
Upon being duly seconded by Commissioner Watts, the same was unanimously adopted.

by law, the Board then proceded to review the Registration Books of
Indian, River County, Florida, and after such review and examination, it was moved by Commission-
er Watts, seconded by Commissioner Hamilton and unanimously carried, that the Board found no
names to be.erased from the
Registration Books of the County.

bills and accounts against the County,
having been audited, were ex-.
'amined, and found correct, were approved and warrants issued in _settlement of same. Such bills
And acpounts being on file
in the office of the Clerk of the Circuit
Court, the warrants so
is:sued,from their espective
funds being listed in the Supplemental
Minute Book, as provided by
the rules of the.State Auditor, reference to such record and the
list so recorded being made a
Pert of these minutes.
The.County Depository
filed its monthly statement,
showing receipts and disburse-
ments.of the various .funds,
which having been audited, were found
to be correct.
There being
no further business, on motion made, seconded
and carried, the Board
then adjourned. o
