The Board of County Commissioners of Indian River County, Florida,
met in Regular Session at the Court House at Vero Beach, Indian River County,
Florida. at 10:00 o'clock A.M. on July 21, 1925.
The following members of the Board were present: John H. Atkin, Chairman,
G.A. Braddock, 0.0. Helseth nd J.W. LaBruce. Thera way also present Wiles Warren,
Clerk.
Upon motion of Commissioner G.A. Braddock, seconded by Commissioner
C.O. Helseth, the following resolutions were adopted by unanimous vote of all
members of the Board of County Commissioners:
WHEREAS Special Road and Bridge District No. 4 of St. Lucie County,
Florida, was duly and legally created and established by the Board of County
Commissioners of St. Lucie County, Florida, prior to the creation of Indian River
County, Florida, but by the enactment of the law creating Indian River County, Florida,
the territory of the District theretofore known as Special Road and Bridge District
No. 4 of St. Lucie County, Florida, has become a part of Indian River County, Florida;
and whereas the: Dnard of County Commissioners of Indian Aiver County, Florida, does
hereby recognize, declare and adopt the territory of said Spey+al Road_and Bridge
Diatriot as Special Road. and Bridge District No. 4 of Indian hiver County, Florida; and
WHEREAS, in the election held to determine whether or not the territory
embraced in said District should be constituted into a Special Road and Bridge District,
it was also decided that certain roads and bridges be constructed in said District and
paid for by the issue of bonds, and
WHEREAS, in the petition requesting the Board of County Commissioners to
oall an election in the territory which it was then proposed to create into a Special
Road and Bridge Diatrict and which has since been created into a Special Road and Bridge
District, and designate1 as Special Road and Bridge District No. 4, it was stated
that the amount estimated as being meoessary with which to pay for the construction
of said roads and bridges was $490,000; and
SEAS, in the call for the above described election published by order of
the Board of county Commissioners of St. Lucie County, Florida (the territory comprising
said Special load and Brodge District being then located within St. Lucie County, Flori
it was stated that.if said bonds were authorized to be issued by said election then said
bonds would be issued in denomination of $1,000 each, loped July 1,1925, said bonds to
be numbered from '1" to x'490" both inclusixe, and bear interest at the rate of six per
cent; per annum; payable semi -ani i*ily on the first day of July and the first day of
Januar] of each year. The principal of, said bonds being payable as follows:
ORp bonds on July 1, 1926; two bonds on July 1, 1927; four bonds on July
1, of each of the years 1923 Ltd 1930 ino?usive; nine bonds on July 1 of each of the
years 19a# to 1935 inclusive; fourteen bonds on July 1 of each of the years 1936 to
1940 inclusive; nineteen bonds on July 1 of each of the years 1941 to 1945 inclusive;
twenty-four bonds on July 1 of each of bhe years 1946 to 1950 inclusive; and twenty.nine
bonds on July 1 of each of the years 1951 to 1955 inclusive; and
AREAS', at the date of the filing and preeentatio n of the petition
for the calling of an election to determine whether said Special Road and Bridge Diatriot
Should be created, and whether the roads and bridges described in said petition should

Board of County Commissioners of St. Lucie County, Florida, r..nd at the date upon
which orders and resolutions were adopted by the Board of County Commissioners
of St. Lucie County, rlorida, creating said Special Road. and Bridge Distriot,
and desisating the same as Speoial• Road and Bridge District No.4., the territory
embraced within said Speoial Road and Bridge District 746. 4 was located wholly
within St. Lucie ‘'ounty, Florida;
AND WHEREAS, after all of said steps and preoeedinge had been duly and reg-
ularly taken by the Board of County Commissioners of St. Lucie County, Florida, the
County I#H of Indian River was duly created and organized from a portion
of the territory of St. Lucie County, and upon the creation and organization
of said Indian River County, the territory embraced within the boundaries of said,,
Special Road and Bridge Distr±dt No. -.4 became wholly located within the boundaries
of said Intdan River County; and
WHEREAS, under and by virtue of a Special Act of the Legislature of the year
1925, approved June 5, 1925, entitled "AN ACT to Legalize and Validate the Creation
and Bonds of Special Road and Bridge District 1o. 4 of St. Lucie County, Florida,
and all Acts and Proceedings in relation thereto; and Providing for the Performance
of Duties in Connection therewith by the Board of County Commissioners and Proper
Officers of Indian River County #114 in the event said County is Created."
The Board of County Commissioners of Indian River County are authorized
to perform all acts and duties ;.i connection with the creation of said Special
Road and Bridge Distriot and the issuance .id sale of bonds thereof, the assess-
ment and levy of taxes to pay interest and principal of said bonds, and the ex-
penditure of the funds of said Special Road and Bridge District, and any part of
said duties not previously performed by the .oard of County Commies,I.oners of St.
Lucie County,
NOW,THEP.EFORE, BE IT RESOLVED by the Board of County Commissioners of
Indian River County, Florida;
That the territory of the District heretofore ]mown as Special Road and,
Bridge District No.4 of St. Lucie County, Florida, is hereby recognized, declared,
and adopted as a Special Road andr.Bridge District of Indian River 6ounty, Florida,
by the name of Special Road and Bridge District No.4 of Indian River County, Florida.
That the bonds authorized -by said election to be issued and Bold for thL
purpose of raising funds to pay for the construction of said loads and bridges i
said Special Road and Bridge Dirtrict No. 4 shall be dated July 1,1925, and con-
sist of four hundred and nista'', bonds in denomination of $1,000.00 eaoh; with
interest coupons attached and bearing interest at the rate of six per cent. per
annum after date, payable semi-annually on Julia 1 and January 1 of each year;

This bond is one of a series of 490 bonds aggregating $490,000.00 of like tenor
exoept as to number and date of maturity, issued by Special +load and Bridge District
No 4 in Indian River County, Florida, for the purpose of rai sing funds to construct certain
roads and bridges in said Special Road and Brodge District No 4, and is issued pursuant to the
favorable vote of more than a maZority of the qualified voters of said District
voting at an election duly called and legally held for that purpose; and pursuant
to resolutions of the board of :ounty Commissioners of St. Lucie County, r'lorida,
and the Board of County Commissioners of Indian River County, Florida, duly passed
approved and adopted as required by law and pursuant to and in full compliance
with all requirmeuts of the laws of the State of blorida, including the provisions
.of Section 1647 to 1666 inclusive, of the Revised General Statues of the State of
Florida:
It is hereby certified, recited and declared that the issue of bonds of which
this is one os within every debt and other limit prescribed by the Constitution andllaws of the
State of Florida, and is made in strict conformity with the Constitution and Laws
of the State of *lorida, and of resolutions of the Boards of County Commissioners of

RESOLVED FURTHER, that in coc►plianoe with the law a sinking fund is hereby
created which shall be used to meet and off said bonds as they become due, and that
there shall be raised by tax I

annually required to meet and pay off said bonds as they mature during eaoh of said

RESOLVED FURTHER, that a tax also be levied for each and every year for
thirty yearn on all the taxable property in said Special Road and Bridge District
No.4 in Indian River County, Flarida, sufficient to raise such sum of money as will meet
and pay off the interest of said bends as the same beoome due and payableduring each
year of said thirty years.
RESOLVED FURTHEP., that the slid Board of Bounty eommissivners shall at the
proper times as fixed by law in each year levy a tax of a sufficient number of mills
Tier dollar valuation upon all taxable property, both real and personal, including
railroads, telegraph and telephone 'ines owned or situated in said Special Road and
Bridge District No. 4 in Indian lover County, Florida, as will be sufficient to
raise, meet and pay off the principal and interest of said bonds as the same become
due and payable, and said taxes as the same shall be levied shall be placed to the
credit of a fund to be designated !Special Road and Bridge Distriot No.4 Bond Fund"
of said "ounty, to be used abd applied only in the payment of the principal and
interest of said bonds as the same shall become due.
RESOLVED FUR'r ;E, that the proceeds of the sole of said bonds shall be used o
only for the construction of certain roads and brides described in the petition
requesting the call of an election to create said Special Road and Bridge District.
RESOLVED FURTHER; that the Clerk of the Board of county 6ommissioners is
hereby directed to publish in the Vero Beach Press, a newspaper published at Vero
Beach', Indian Aiver County, Florida, that this Board of &aunty Commissioners will
receive sealed bids for the purchase of said bonds at the Clerk's office up to
the hour of two p.m. on the 24th day of August, 1925, at Which time said bide will
be opened. Each bid shall be accompanied by certified check for 35,000.00 payable to the
the order of this Board of County Commissioners, and the right is reserved to reject
any and all bide;
RESOLVED FURTHER, that F.L. Hemmings, Attorney, is authorized and direoted
to have said bonds prepared and certified by United .6tatea Mortgage Ind Trust Company;
to have printed a circular advertising the sale of the bonds; and to have said bonds
validated, and to obtainsthe opinion of John A. Thomson, of 120 Broadway, New York City,
as to the validity of these bonds.

It was ordered that the County pay 50 per day per prisoner for the use of the
City Jail. This to be upon the approval of the City Counb*l of the City of Vero.
Commissioner Braddock offered the following resolution, seconded by Commissioner
LaBruce .
Be it resolved taat the Board of County Commissioners of Indian River County do
rent and lease the entire second floor of the Seminole Building in the City of Vero
Beach for the use of its County officials and for the holding of Court and for saoh
other uses and purposes as the Board may determine for the period of one year from
July 1st 1925 at a monthly rent of +$400 00 per month.
Be it further resolved that the Chairman of this Board be and he is hereby
authorized and empowered to execute on behalf of the Board with the owner of said
Seminole Building a proper lease covering said above described premises, for the time
and upon the terms as this resolution sets forth, said lease to be prepared and
approved by the attorney for this Board.
Whereupon the resolution was unanimously adopted.

At a regular meeting of the Board of County Commissioners in.and for Indian
River County, Florida, held in the Court House in Vero Beach, Florida, on Tuesday
August 4th 1925, the following members of the Board were present: John H Atkin,
Chairman, 0. 0. Helaeth, J. W. I,aBruce, Donald Forbes and G A Braddock. Also present
were Miles Warren, Clerk and J. W. Knight, Sheriff.
The minutes of the previous meetings were read and approved.
The time hatng arrived for the opening of bids for the $50,000. time warrants
issued by the Ccunty for the purpose of paying the ordinary and extraordinary expenses
of the County, the bid of the Farmers Bank of Vero was opened and read as follows:

ordered, by unanimous vote, that the bid be accepted.
A petition signed by J. H. Sutherland and 67 others was presented askeng that a
road be constructed along the present right-of-way paralleling Sub -lateral #20, from
the present East road, Test, to the Park Lateral Bridge on Sub -Lateral #20, and from
a point on said road to construct a road running North to the South boundary of the
Town of Fellsmers to connect with the termination of the Street 'Broadway".
It was ordered that the petition be filed, Commissioner ImBruoe advising the
Board it was his intention to build and repair this road immediately after repairing
the present bard surfaced road within his district.
Itvwas unanimously ordered that the matter of copying plats, maps and eto. from
St Luoie County, be referred to the County Engineer to work in conjunction with the.,
Tax Assessor and they are authorised to have prepared copies of all plats and maps

dook the following resolution was proposed for adoption:

Be it resolved by the Board of County Commissioners of Indian River County, Flo-
rida, sk in regular session assembled on the 4th day of August A D 1925, that
:SAS, An Act of the Legislature of the State of Florida, for the year 1925,
duly signed by the Governor, provides for the creation and incorporation of a Special
taxing district in Brevard Couuty, Florida, and St Lucie County, Florida, to be known
and designated as Fellsmere Cross State Road District, prescribing the boundaries
thereof; Providing for the Government and Administration of said liatrict; Defining
the powers and purposes of bald district, and of the Board of Commissioners thereof; to.
authorize said Board to construct, improve and maintain a road across the St Johns
harsh; to provide for the acquiring of property or condemnation thereof for district
purposes; to Provide for the levy and collection of taxes for district purposes; to
Authorise future levies and assessments; to Authorize said Board to borrow money and
issue and sell bonds; to Procure money to carry out the provisions of this Act; to
Prevent injury to works constructed under this Act, and to provide penalties therefor;
to Provide for the holding of election for issues of borate in an amount not to
exceed $4,000,000.00; to Provide for continuity of District in event of change of
County organization and generally to provide for the construction, maintenance and
improvement of said road in said District.
It is provided among other things that ePid Act shall not take effect until an
election shall be held within certain territory described in said Act, at which electio
only registered votes residing in said District who own real or personal property as
shown by the Assessment Roll for the year 1925 in the office of the County Tax Collectors
of the respective counties, shall be allowed to vote, and providing further for the
election for the offices of three commissioners; the boundaries of said Fellamere
Cross State Road District, formerly in St. Lucie County, Florida, and new Indian River
County, Florida, provided by said Act being as follows:
Begin where the waters edge of Atlantic Ocean intersects the line between Township
30 and 31, thence Westerly along the North boundary of Indian River County, to the

described in said Act as herein above set forth, and known as that part of Fellsmere
Cross State District, lying and being in Indian River County, Florida, for the purpose
of electing three Commissioners of the Fell:mere Cross State Road District; and to
determine wheUher the Board of Commissioners of Fellsmere Cross State Road District
shall be authorized to issue bonds in the sum of $200,000.00 for the purposes provided

placing by law in another County than St Lucie County, or Brevard County, all duties
therein prescribed for offices of St Lucie_or Brevard Counties shall be performed by
officals of such other County or counties, and whereas it is provided among other
things that the Board of County Commissioners of St Lucie County and the Board of County
Commissioners of Brevard County shall call for and provide for a special election for
the purpose of electing three Commissioners as provided for in said act and to determine

The Board of County Commissioners then proceeded to Fort Pierce, Florida, to meet
in joint session with the Board of County Commissioners of St Lucie County, Florida, for
the purpose of effecting a settlement between the two counties in accordance with the
Act of the Legislature of the 1925 session.
On motion duly made seconded and carried the following agreement was accepted.

THIS AGREEMENT made this 4th day of August 1925, by and between the Board of County
Commissioners of Indian River County, State of Florida, party of the first part and the
Board of County Commissioners of St Lucie County, State of Florida, party of the second
part, '
Wf8IRRAS, an Act of the Legislature of the State of Florida, approved May 30, 1925,
entitled "An Act providing for the Creation of Indian River County in the State of Flo-
rida, and for the organization and government thereof" provides among other things that
it shall be the duty of the Board of County Commissioners of Indian River County at as
early a date as may be possible to hold a conference with the County Commissioners of
St Luoie County, and agree with the said Board 'n a plan or plans for the assumption
by Indian River County of its prorates share of the indebtedness of St Lucie County,
in accordance with the provisions of the Constitution of the State of Florida, based en
the assessed valuation of the property both real and personal, subject to taxation
within said counties; and that the Board shall also agree upon equitable division of the
surplus funds and personal or movable property on the day that said Act takes effect,

AND WHEREAS, the County of Okeechobee was organised in the year 1917, taking part
of the territory of St. Lucie County and said Okeechobee County assumed twenty-six per
cent of the then existing indebtedness of St Lucie County, Florida, consisting of Bonds is
and Time warrants, and in reaching tj:is agreement due consideration has been given to that
part of indebtedness of St. Lucie County, which has been previously assumed by Okeechobee
County. 1
AND WHEREAS the Legislature of the State of Florida of the year 1925, has also
provided for the creation and organisation of 15artin County which new County takes a
portion of St Lucie County, and due consideration has been given to the effect of the
creation of tartin County in, reaching this agreement,
AND WEIR A8 it has been a,.:eed by the two Counties to this agreement that the total
assessed valuation of all taxable property both real and personal of the territory of
8t Lucie County, Indian River County and that portion of St. Lucie County to be included
in le►rtin County is $9,076,745.00 and the parties to this agreement have agreed that
Indian River County has taxable property within its boundaries amounting to 43.4 per cent
of the said total assessed valuation.

County, Florida, Indian River County is entitled to and shall receive the following

It is further mutually agreed tat whereas the County Tax Assessor of St Lucie
County, Florida, is charged with the duty of preparing and completing the County tax
assessment roll for the year 1925, covering all taxable property in both St Lucie and
Indian River County, and the law creating Indian River County provides that the County
Tax Assessor for Indian River County shall receive no compensation for the work of
preparing said 1925 tax levy, but that full compensation shall be paid to the County
Tax Assessor of St Lucie County for said duty. Therefore the Board of County Commission-
ers of Indian River County hereby agree to assume and pay 43.4 per cent of the compensation
allowed to the County Tax Assessor of St Lucie County, Florida, for his duties in the
preparation and completion of said 1925 tax roll covering both Counties.
The Board of County Commissioners of Indian River County agrees to pay to each of
the cities of Fort Pierce, Vero and Fellsmere 43.4 per cent of the 50 per cent of General
Road Taxes for the year 1924 collected on property within the boundaries of said cities,
the remainder of aid amounts due said cities to be paid by St Lucie and ilsryin Counties

the Court House in Vero Beach, Tuesday, September let 1925, with the following members

The minutes of previous meetings of August 4th and August 24th were read and approved.
Br N. it. Dale representing the Amerioan Legion appeared before the Board regarding
County wide publicity during the Legion's national meeting October 5th to 10th, nett
at Omaha, Nebraska. Upon motion made, seconded and carried, it was ordered $500.00 be
appropriated out of the Publicity Fund, payable January lst 1928 for the purpose of
advertising this County at said meeting. •
The proposition of The G. B. Sawyers Company to take charge of and manage the adver-
tising and marketing of the $490,000. Special Road & Bridge District No. 4 Bonds was
received, read and filed. After some consideration it was deemed advisable not to enter
into an agreement with such Compauy.
The Vero Beach Press was designated as the newspaper in which the Acts of the Legis-
lature of 1925 will be published.
The Bill of St. Lucie County for its percentage of road and Bridge tax in the cities
of Fort Pierce,ssmt Vero Beach and ?slimmers was ordered rejected for the reasonit has
been taken oars of in settlement between the Counties heretofore made.
It was ordered that the County Bemgineer advertise for bids for patching the hard
surfaced roads in County Commissioners Districts No. 1 and No. 2.
