WHEREAS , Gail has announced her retirement from the Public Works Department, Traffic
Engineering Division, and Indian River County Board of County Commissioners effective January 18 , 200 1 ;
and

WHEREAS , Gail has been employed with Indian River County since May 4 , 1987 . During her tenure
with the County, Gail began as a Secretary in the Probation Office. Then in 1988 , she was promoted to
Secretary III and transferred to the Public Works Department, Engineering Division. In 1997 , Gail was
promoted once again and became a Traffic Technician with the Traffic Engineering Division, which is the
position she holds today ; and
WHEREAS , Gail has always received excellent or above average evaluations ; and
WHEREAS , Gail has played a lead role in organizing the records of the Traffic Engineering Division;
in particular, the traffic accident reports and computerized summaries . Gail prepared annual accident
summaries, cross-referenced by accident location, frequency and rate. These summaries were of immense
value to the County and assisted in the installation of traffic signals and other traffic safety measures . Gail
often worked long hours to ensure that reports were completed quickly and accurately; and
WHEREAS , Gail has been both a citizen and a public servant striving for the betterment of both the
community and its environment through her long years of unselfish service to the public ;
NOW, THEREFORE, BE IT PROCLAIMED BY THE BOARD OF COUNTY COMMISSIONERS

Description And Conditions
The attached budget amendment is to appropriate funding for the following :
1 . The Indian River County Libraries have received a total of $ 12 , 256 in donations . The
attached entry appropriates these funds .
2 . Digital aerial photography is needed to improve the County' s GIS database . County
staff has reached an agreement with the Property Appraiser' s office to split the cost of
this project , since this will benefit both agencies . The total cost should be about
$ 30 , 000 , and the County' s portion is 50 % or $ 15 , 000 . This will provide better digital
images for the entire County east of the St . John ' s Marsh . Funding will come from
General Fund contingencies .
3 . On January 9 , 2001 the Board of Commissioners approved various expenditures under
the Emergency Management Performance Grant ( EMPG ) , which was formerly called
the State and Local Agreement . The attached entry appropriates funding in the amount
of $ 33 , 775 , as approved by the Board .
4 . Computer Services needs to purchase additional equipment and servers for the
County ' s network system . The attached entry approves funding from General Fund
contingencies for $ 16 , 600 .
5 . On October 3 , 2000 , the Board of Commissioners approved a grant agreement with the
Florida Fish and Wildlife Commission . This grant provides $ 20 , 000 for evaluating fish
populations on four artificial reefs built in 2000 . The attached entry appropriates the
use of these funds .
6 . On January 9 , 2001 , the Board of Commissioners approved a public official bond for
incoming Sheriff Roy Raymond . The attached entry appropriates funding from General
Fund contingencies for $ 1 , 700 .

Chase Phase II
It is requested that the data herein presented be given formal consideration by the Board of
County Commissioners at its regular meeting of January 16 , 2001 .
DESCRIPTION AND ONDITIONS :
Oak Chase Phase II is a 36 lot 23 . 48 acre portion of a three phase project located on the north
side of 33rd Street and on the east side of 66 " Avenue . The property is zoned RS - 3 ( residential

single- family, up to 3 unit/acre) . The density of the subdivision is 2 . 47 units per acre . Phase I has
been constructed. Phase II is encompassed in this final plat, is located immediately north of
Phase I , and provides for an extension of the roadway and storm water tracts from Phase I . The
remaining portion of the overall project is to be constructed in a subsequent phase .
At its regular meeting of April 8 , 1999, the Planning and Zoning Commission granted
preliminary plat approval for the overall subdivision. The applicant is requesting final plat
approval for Phase II and is bonding out all required improvements as part of the final plat
approval process . The owner, Oak Chase Development L . L . C . , through its agent Carter
Associates Inc , is now requesting final approval and has submitted the following :
1 . A final plat in substantial conformance with the approved preliminary plat .
2 . Certified Engineer ' s Cost estimate for remaining improvements .
3 . A Contract for Construction for the remaining required subdivision improvements .
4 . Security arrangement guaranteeing the contract for construction.
ANALYSIS :
A majority of the required subdivision improvements have been constructed, with the exception
of some infrastructure items and landscaping improvements Staff anticipates that all cost
estimates and security amounts will be finalized and approved prior to the Board ' s January 16 `'
meeting . The developer has made arrangements with Public Works to submit a final engineers
cost estimate and financial security after the Board of County Commissioners grants final plat
approval . The format of the financial security has been approved by the County Attorney ' s
Office, and unit cost estimates for construction items have been approved by Public Works . The
developer also has submitted a copy of the Contract for Construction of Required Improvements .
The contract, which is on a standard form approved by the County Attorney ' s Office, will be
executed by the developer after the January 16 , 2001 Board meeting date . Once the final cost
estimate is approved by staff and the appropriate financial security is submitted, the plat will be
recorded . All subdivision improvements are privately dedicated with the exception of the utility
system, which is separately warranted through the Department of Utility Services . Therefore, no
subdivision warranty and maintenance agreement is require .

Based on the above analysis, staff recommends that the Board of County Commissioners grant
final plat approval for the Oak Chase Phase II , authorize the Chairman to execute the Contract
for Construction and any security documents, and accept the security .

It is requested that the data herein presented be given formal consideration by the Board of County
Commissioners at its regular meeting of January 16 , 2001 .
Atlas Development Corp . has filed an appeal of a decision by the Planning and Zoning Commission
to deny site plan approval for a seven unit development . At its December 147 2000 meeting , the
Planning and Zoning Commission voted 3 to 4 on a motion to approve the project , an action which
effectively resulted in a denial . For reference, please refer to the staff report and draft minutes from
the December 14, 2000 Planning and Zoning Commission meeting ( see attachment #2 ) .
According to the county ' s land development regulations (LDRs) , appeals of decisions of the
Planning and Zoning Commission are considered by the Board of County Commissioners . The
Board is authorized to review the Commission ' s decision and approve, approve with conditions , or
deny the subject site plan application .
The site plan application now under appeal was submitted by Knight , McGuire & Associates , Inc .
on behalf of Atlas Development Corp . This application reflects the applicant ' s proposal to develop
a 7 unit site planned residential development . The 1 . S3 acre subject property is located between SR
A - 1 .A and the Atlantic Ocean , just north of the Summer Place subdivision, and is zoned multi -
family (RM-4 ) . The homes located south of the subject site in Summer Place were built in the
1970's and are located seaward of the 1987 Coastal Construction Control Line (CCCL ) and in some
cases up to and partially seaward of the 1981 CCCL . North of the subject site , there is a more
recently constructed home that is located just landward of the 1987 CCCL . Atlas Development is
Proposing a single three story building containing 7 units a with separate pool and cabana area. The
east end of the proposed 3 story building is located seaward of the 1987 CCCL , roughly alono an
imaginary line drawn between the nearest Summer Place home and the newer home to the north of
the subject site. As proposed, the Atlas Development project will have a single driveway connection
to SR A - 1 -A to provide access to the 7 units . Through the development review process , there is
required landscaping which provides for a Type "D"double frontage buffer along the south property
line (Sandalwood Lane) .
This site is the same site as the Boston Homes/Orchid Dunes proposed project that was considered
and ultimately approved by the Board on March 21 , 2000 - That project proposed two units and two
guest cottages . That project 's site plan is still valid and is the subject of a lawsuit .
The Board is now to consider the site plan application and the Planning and Zoning Commission ' s
denial . The Board may uphold or overturn the Planning and Zoning Commissions ' s decision . In
doing so , the Board may approve, approve with conditions, or deny the subject site plan application .
• Planning and Zoning Commission Action Being Appealed
Procedurally, the Atlas Development Corp . application was reviewed through the county ' s standard
project review process . After extensive review, staff recommended that the Pl
Commission approve the site plan application subject to conditions, including a condit on hat ung and the
applicant obtain a DEP coastal construction control line permit for the proposed 7 unit building and
revise the site plan, if necessary, to correspond to DEP 's requirements . After considering comments
from the public and the applicant, the Commission chose not to approve the site plan, an action
resulting in denial of the site plan application. During discussion, the Commission indicated that its
denial was based on the fact that the subject site is in an area of significant coastal erosion and that
the proposed structure should be located landward of the 1987 CCCL .

* Coastal Construction Regulations
Through the currently proposed site plan, the applicant is proposing to locate a portion of the
proposed building seaward of the 1987 CCCL and landward of the 1981 CCCL . The proposed
location will be seaward of the existing home to the north ( residence built in 1990's ) , but landward
of the existing homes to the south (Summerplace residences built in the 1970s) .
The Department of Environmental Protection (DEP) regulates construction seaward of the 1987
CCCL . County regulations prohibit construction of residences ( but do allow beach accesses )
seaward of the 1981 CCCL, and the site plan complies with these county regulations . The applicant
will be required to obtain a construction permit from the DEP , and that permit will determine how
far east ( seaward ) the proposed building will be allowed to project beyond (seaward of) the 198 ;
CCCL . Prior to site plan release , the applicant will be required to obtain the DEP permit for all
construction seaward of the 1987 CCCL .
Since the early eighties , the State of Florida has regulated coastal construction in Indian River
County. In 1981 , the State Department of Natural Resources (DNR) established the county ' s first
coastal construction control line . That line was revised, and in many cases moved significantly
landward, in 1987 . Both the 1981 and 1987 lines were established as lines of regulation . Seaward
of those lines , the Department of Environmental Protection (DEP ) , successor agency to DNR.
regulates all construction activity . While DEP does not pre-empt local regulation seaward of the
CCCL , construction in that zone is not allowed unless permitted by DEP .
The county ' s land development regulations (LDRs) address coastal construction, dune vegetation ,
sea turtle protection, and similar environmental regulations on oceanfront parcels. For instance, the
county has designated the 1981 CCCL as the county ' s Dune Stabilization Setback Line (DSSL ) and
has prohibited construction seaward of that line except for certain structures such as dune crossovers .
County staff has verified that the proposed project meets the county ' s DSSL requirements . In
addition to the DSSL regulation, county ordinances address the 1987 CCCL , which is located
landward of the 1981 CCCL (DSSL) . LDR section 932 . 06 (3 ) states that, in regard to development
seaward of the 1987 Coastal Construction Control Line (CCCL) , ". . . the FDNR [staff note : now
D . E . P . ] and Indian River County may permit construction activity" (see attachment #3 ) .
Because LDR section 932 . 06(3 ) states that the county may permit construction activity seaward of
the 1987 CCCL , the county appears to have the discretion to not approve such construction .
Consequently, both DEP and the county have regulatory authority and discretion regarding
construction activities seaward of the 1987 CCCL . In the past, it has been county policy to let the
DEP determine the extent to which a proposed structure may project seaward of the 1987 CCCL and
the type of construction and conditions it must meet in order to be so located. This policy of deferral
to the DEP has been applied to single-family structures as well as construction proposed as part of
site plan, PD, and subdivision projects . The policy is predicated on the DEP ' s expertise in the
review and permitting of coastal structures and the county ' s comparative lack of expertise in such
matters . In terms of county project reviews, the policy requires DEP approval prior to site plan
release for site plan projects, and prior to county building permit issuance for single- family homes .
At a meeting subsequent to its initial review of the Boston Homes/Orchid Dunes appeal, the Board
of County Commissioners discussed the CCCL regulations in general . At that meeting, the Board
heard from citizens and experts and acknowledged the technical basis for state CCCL regulations .
The Board then directed staff to continue to implement the county ' s policy of deferring to DEP
regarding applications for construction seaward of the 1987 CCCL . Furthermore, the Board directed
staff to coordinate with DEP on analyzing and possibly re-defining the CCCL in critically eroding
areas of the county . Since that time, the county ' s coastal engineer has been coordinating with the
DEP .

ANALYSIS •
The county ' s land development regulations (LDRs) provide criteria for the Board to use in its revie
of the appeal of the Planning and Zoning Commission ' s decision on the site plan application . These
criteria , based on LDR section 902 . 07 ( see attachment #5 ) , are as follows :
( 1 ) Did the Planning and Zoning Commission fail to follow the appropriate review
procedures ?
(2 ) Did the Planning and Zoning Commission act in an arbitrary or capricious manner?
( 3 ) Did the Planning and Zoning Commission fail to consider adequately the effects of
the proposed development upon surrounding properties, traffic circulation or public
health, safety and welfare?
(4) Did the Planning and Zoning Commission fail to evaluate the application with
respect to the comprehensive plan and land development regulations of Indian River
County?
The Board is to consider each of these criteria and make findings in all 4 areas addressed by the
criteria. Staffs analysis of the Planning and Zoning Commission ' s decision in regard to the 4
criteria is as follows :
( 1 ) Did the Planning and Zoning Commission fail to follow the appropriate review
procedures?
The Planning and Zoning Commission considered the application at a
regularly scheduled meeting, heard continents from staff and all interested
parties, and had lengthy discussion before making a decision . The motion
was properly made, and a vote was taken as reflected in the meeting minutes
( see attachment #2 ) . In addition, proper timeframes and procedures have
been followed regarding the appeal . Procedurally, the Commission appears
to have conducted an appropriate review of the applications .
(2) Did the Planning and Zoning Commission act in an arbitrary or capricious manner?
- During consideration of the site plan application , the Planning and Zoning
Commission questioned the staff attorney as to matters of law and questioned
the applicant ' s engineer as to matters of fact . In response to questions , the
staff attorney indicated that the Planning and Zoning Commission could look
at specific coastal properties on a case by case basis , but also indicated that
the county did not have the data and analysis or expertise to determine a new
line of prohibition . In questioning the applicant ' s engineer and the county ' s
coastal engineer, the Commission inquired as to coastal erosion in the area,
including the DEP ' s method for determining how far seaward of the 1987
CCCL . a structure is generally allowed to extend, setbacks used for
development within the Town of Orchid and Windsor, and methods of
construction used in such coastal locations . Some Planning and Zoning
Commissioners stated at the end of the discussion that no one could present
evidence that the project failed to meet the LDRs, while other commissioners

stated that the county did not have the knowledge or policies in place to
approve the project . -
After reviewing the referenced information and discussing the applications ,
the Planning and Zoning Commission denied the application, by failing to
approve it . The commissioners who voted against the motion to approve the
project did not give specific reasons for their vote . However, discussion
during the meeting indicated that commissioners had concerns that the
project area is an erosion "hot spot", that the county has the discretion under
the LDRs to not approve construction seaward of the 1987 CCCL , and that
the county does not have the knowledge and expertise to evaluate the
construction proposed seaward of the 1987 CCCL . These concerns appear
to be the basis of the denial . In staffs opinion, the decision to deny was
arbitrary because :
* The 1987 CCCL was never established as a line of prohibition and no
evidence was presented that the 1987 CCCL is the appropriate line seaward
of which construction should be prohibited for this property .
* The prohibition of construction seaward of the 1987 CCCL on the subject
property will not be consistently applied to other oceanfront parcels, because
construction of single- family homes on oceanfront lots are reviewed and
approved by staff, and current LDRs do not allow staff to restrict construction
of single- family homes seaward of the 1987 CCCL .
• There was no evidence presented to challenge the fact the DEP ' s 1987
CCCL permitting process ensures that structures built seaward of the 1987
CCCL will be adequately engineered for oceanfront conditions , thereby
obviating the need for more of a setback from the ocean .
The decision to deny the application raises two policy questions . What is the
objective of location restrictions along the coastline? What is the purpose of
the 1987 CCCL and how does DEP apply its regulations seaward of that line ?
If the objective of the denial is to move the proposed units landward to
protect them from coastal erosion, then the issue of construction standards
must be considered . Because stringent DEP construction standards do not
apply to structures that are located entirely landward of the 1987 CCCL ,
structures may be better protected by being built seaward of the 1987 CCCL
and built to a higher construction standard, than structures built to the lower
standard and located immediately landward of the 1987 CCCL . Requiring
the higher construction standards for structures partially or wholly seaward
of the 1-987 CCCL puts the DEP in a much better position to deny future
seawall permits for such structures, since the structures are designed and built
to stand-up under storm events .
If the objective of the denial is to convert the 1987 CCCL from a line of
regulation to a line of prohibition in areas that appear to be significantly
eroding , then the gathering of substantial competent evidence is necessary .
If the 1987 CCCL becomes a line of prohibition rather than a line of
regulation without some competent substantial data to support it as a line of
prohibition, such use of the line becomes arbitrary . In establishing the 198 ,
CCCL , the DEP used the best science available at the time to predict coastdi
erosion and arrive at a line of regulation . Through the permitting process , the
DEP can apply its criteria on a site- by-site basis to establish the conditions

for any given site, especially sites where significant erosion is occurring . 1 he
DEP has adopted the line as a line of regulation to review construction
proposals on a site-bv-site basis . Thus, there is a process in place for experts
to review proposed construction on a site -bv- site basis . The Planning and
Zoning Commission ' s decision would eliminate such a review without
underlying expert evidence .
The staff is continuing to coordinate with the DEP on a revision to the 1987
CCCL line in critically eroded areas . Any revision to the 1987 CCCL will
need to be based on substantial competent data. Until anv new line is
established, it would be premature to start denying applications based on
improvements located east of the 1987 CCCL .
( 3 ) Did the Planning and Zoning Commission fail to consider adequately the effects of
the proposed development upon surrounding properties , traffic circulation or public
health, safety and welfare?
- The Planning and Zoning Commission heard from representatives of the
adjacent property owners regarding the effects that the proposed development
would have on surrounding properties . Most of the comments from the
property owner representatives centered on the erosion issue and the possible
public health, safety, and welfare concerns that the erosion may cause . There
was also discussion regarding the impact of locations of existing and
proposed residences on ocean views . Thus , the record indicates that the
Planning and Zoning Commission did consider the effects of the proposed
development upon surrounding properties , traffic circulation, and health ,
safety, and welfare .
( 4 ) Did the Planning and Zoning Commission fail to evaluate the application with
respect to the comprehensive plan and land development regulations of Indian River
County?
The Planning and Zoning Commission decision was based on the same code
section (932 . 06 [3 ] ) as its previous decision regarding the Boston
Homes/Orchid Dunes application ( see attachment #3 ) . The Planning and
Zoning Commission did discuss the applicable LDRs related to the proposed
project and how the LDRs applied to the application . Therefore, the Planning
and Zoning Commission did not fail to review the project with respect to the
applicable county LDRs .
SUMMARY -
The Commission ' s denial "sent a message" that Commission members continue to be concerned
about the county ' s DEP deferral policy in areas where coastal erosion appears to be significant . In
so doing , commissioners expressed concerns that DEP requirements may not be stringent enough
in areas of significant coastal erosion and that it may be best to make these decisions locally . After
two applications on this site, discussion at the Planning and Zoning Commission meeting and review
of the subject appeal , staff s conclusion is that a great deal of study and on-going expertise would
be needed if the county decides to regulate coastal construction above and beyond DEP permitting
requirements . It is also staffs opinion that technically justified, specific criteria would need to be
established by the county to fairly and uniformly apply the "discretion " given in LDR section
932 . 06(3 ) . Staff also notes that there are numerous structures and entire lots that are located seaward
of the 1987 CCCL that would need to be carefully considered if the county "goes beyond" DEP
regulation of such structures and properties .

Based on the absence of substantial competent evidence and objective and specific county criteria
to apply to construction proposed seaward of the 1987 CCCL , the decision to deny the Atlas
Development Corp . application, despite required compliance with DEP and county DSSL
requirements , is arbitrary and cannot be uniformly applied to other similarly situated properties .
Therefore, the Planning and Zoning Commission ' s decision does not meet all four review criteria
and should be reversed, as ultimately the Boston Homes/Orchid Dunes Planning and Zoning
Commission decision was reversed by the Board .
RECOMMENDATION :
Based on the above analysis, staff recommends that the Board of County Commissioners find that
the Planning and Zoning Commission acted arbitrarily in its Atlas Development Corp . decision,
overturn the Planning and Zoning Commissions decision, and grant major site plan approval for the
Atlas Development Corp . proposal with the following conditions :
1 . Prior to site plan release, the applicant shall :
a. Submit and obtain planning staff approval of details of the landscaping and
irrigation improvements required on the south side of the wall that is
proposed to run parallel to Sandalwood Road, and
b . Obtain, and submit to county staff, a DEP permit for construction seaward of
the 1987 CCCL and revise the site plan, if necessary, to comply with anv
DEP permit requirements , and
2 • Prior to the issuance of a certificate of occupancy, the applicant shall construct the
buffer required along the site ' s Sandalwood Road frontage, and construct or bond-out
the 5 ' sidewalk along the site ' s SR A- 1 -A frontage.
Director Boling gave a brief history of this property , including Boston Homes , Inc . ' s
site plan of Orchid Dunes for 2 units which was submitted to the Planning & Zoning
Commission on 1 /27/00 and denied ; the subsequent appeal to the Board on March 7 , 2000 ,
where the denial was upheld , and the further review of the matter by the Board on March 21 ,
2000 , at which time the site plan was approved with the conditions submitted . He then
displayed a drawing of the old site plan and pointed out the 1987 and 1981 Coastal
Construction Control Lines ( CCCL ) .

A drawing of the new site plan , which is now being appealed after its denial by the
Planning and Zoning Commission , was then reviewed . Director Boling commented on the
zoning of the neighboring areas , including the Disney and Sea Oaks developments to the
south , and noted that multi - family zoning in most of the areas has been developed as single -
family residential .
The County Comprehensive Plan treats the 1981 CCCL as a line of prohibition , with
an exception for dune crossover structures which are allowed seaward of that line . The
Department of Environmental Protection ( DEP) regulates structures located between the
1981 and 1987 CCCLs . The 7 units proposed are the maximum number allowed and the
developer proposes to save as much of the hammock as possible .
Chairman Ginn questioned the erosion rate in that area. and County Coastal Engineer
Jeff Tabar reviewed his Memorandum of January 15 , 2001 , with attachments , and noted that
this particular area has been designated a critical erosion site with erosion occurring at a rate
of 2 to 3 feet per year :

development regulations that are more stringent than the State of
Florida rules in Chapter 161 , Florida Statutes and 62B - 33 FAC . This
memo provides a summary of the responses received , and supporting
documents are attached .
In general , most Counties defer to the state rules , or have
language in their Comprehensive Plans that matches the State rule
language . Several Counties do have additional regulations . These

process of producing a Beach Dune Management Program , which may
contain other dune protection measures . There is also an item in
the Comprehensive Plan prohibiting the repair or rebuilding of any
coastal armoring structure that has been more than 75 % destroyed .

Volusia County
Volusia County has no additional setback requirements or
armoring restrictions , but does have additional construction
standards for the entire barrier island . While state rules
require a 110mph windload design seaward of the Control Line ,
Volusia County also mandates a 110 mph windload design for the
entire barrier island landward of the CCCL . ( Mike Nelson , ( 904 )

Brevard County
Brevard County includes , under its Comprehensive Plan , an
additional 25 foot setback from the 1981 CCCL . This line is
termed the Brevard County Coastal Setback Line . The Comprehensive
Plan also includes prohibitions on new armoring structures ,
particularly in the north county . A copy of the Coastal
Management Element of the Brevard County Comprehensive Plan is
attached . ( Virginia Barker , ( 321 ) 633 - 2016 ) .
St , Lucie County
St Lucie County has no coastal development regulations over
and above the state CCCL rules ( Julia Shewchuck , ( 561 ) 462 - 2822 ) .

Martin County requires an additional setback of 50 feet for
coastal construction beyond what is required by state CCCL rules .
Martin County Ordinance Number 462 provides for the establishment
of a Dune Preservation Zone extending 50 feet landward of the
1981 CCCL . No Development is permitted within the Dune
Preservation Zone . A copy of the Ordinance is attached . ( J . Ross

Palm Beach County
Palm Beach County has no coastal development regulations other
than state CCCL rules . ( Dan Bates ( 561 ) 233 - 2414 ) .
Broward Countv
Broward County used to have coastal development rules that
were identical to the state rules , but they have been eliminated
as duplicative . ( Ken Banks , ( 954 ) 519 - 1230 )
Dade County
No rule other than state CCCL regulations . ( Brian Flynn , ( 305 )
372 - 6850 ) .
Monroe County -
Monroe County has almost no sand beach shoreline , and thus
CCCL lines have not been established there . Monroe County
development regulations were developed under a Memorandum of
Understanding with the Department of Community Affairs and
include setbacks measured from the mean high water line . No
habitable structure may be closer than 50 feet from and unaltered
shoreline ( mangroves ) , 20 feet from an altered shoreline ( canal
etc . ) , or 30 feet from an open water shoreline ( rocky shore ) . A

Development Corporation , noted that the prior owner was Boston Homes , Inc . Atlas
Development purchased the property just prior to submitting the new plan to the Planning
and Zoning Commission .
Chairman Ginn noted that this is not a public hearing but the Board will hear anyone

Chester Clem , Attorney , 3333 201h Street, representing Mr . and Mrs . Steven Brown ,
noted that the prior plan was for 2 units while the current plan is now dealing with 7 units .
He then introduced Mr . Walther and asked him to review his handout .
Michael Walther , President, Coastal Tech , 3625 20 `h Street, reviewed a handout
( COPY ON FILE WITH THE BACKUP FOR TODAY ' S MEETING IN THE CLERK ' S
OFFICE ) . He noted that this is a critically eroded area and is eroding at a rate
of
approximately 2 to 3 feet per year . The erosion has drastically increased since 1986 and .
even at 1 - foot per winter, the bluff line will soon be within 10 feet of the proposed building .
At that time , the owners will be asking for a seawall . This structure would be 53 feet
seaward of Mr . and Mrs . Brown ' s home . He strongly suggested that. in -light of this critical
erosion , this structure should be located landward of the 1987 CCCL to avoid an adverse
impact by erosion .

Attorney Clem believed the question is whether the Board has the power and authority
to act within the 1987 and 1981 CCCLs . If this plan is sent to the State , there will be public
hearings , but local citizens have a right to deal with local government . If this structure is
allowed , within 30 years the owners will be back for assistance . The 1987 CCCL makes
sense and everyone to the north of the subject property , including Mr . and Mrs . Brown , have
built behind this line . Mr . and Mrs . Brown would certainly rather have single- family
residential development, but at least the Board can ask that the construction be moved back
behind the 1987 CCCL .
Bill Glynn , 1802 Barefoot Place , President of North Beach Civic Association and
Summerplace Improvement Association , commented that this property keeps coming back
before the Board . First the plan was for 6 3 , 000 - square - foot homes , then for 2 very nice
homes on the edge of the dunes , and now a 7 - unit residential development is proposed .
FEMA has already allocated monies to replace the dunes east of this property . The property
does not actually exist . He and his neighbors are getting water against their seawalls in
Summerplace and it is only getting worse . A building that large is not the right thing to do
in that area . This building will be 55 - feet high in an area of single - family homes where the
dune is only 8 to 10 feet high and is the only line of defense . If the Board allows 45 feet on
top of that, it will tower over everything else and affect the real estate values . This Board
has been very helpful to the north beach area by developing the North Beach Task Force ,
building the fire station , obtaining open lands for the citizens , and getting AIA and CR - 510
named as Scenic Highways . All of this hard work could be for naught . He believed the
Planning and Zoning Commission did not make an arbitrary decision but a well - thought - out
one . The citizens in this area need the Board ' s help to forestall this rape of the area .

Pat Carpenter, 9425 Doubloon Drive , stated that a few years ago they came to Vero
Beach to build their dream home . The island is a community of beachside homes and
riverfront homes and is a delightful place to live . The residents feel as though they are a part
of the wonderful island environment . She did not believe the County is looking for a
condominium jungle and hoped the Board would deny the project .
Maud Geng , 1830 East Cayman Road , stated that she had previously lived in a more
metropolitan area in a gated community and moved to Vero Beach to live in an area where
there are no gates , but beach roads which are more private and individual . She asked the
Board to oppose the project and preserve the special quality of Vero Beach .
Bob Bruce , Vice President of North Beach Civic Association , wanted to discuss the
predominant zoning , and Chairman Ginn felt it would be more appropriate for him to first
discuss the matter with Planning Staff and place the discussion on the agenda .
Mr . Bruce noted that the entire north barrier island is developed as single - family
residential areas . He realized that the underlying zoning allows for multi - family
development but felt the Board should really look at the character of the area .
Ruth Myers , 1981 West Sandpiper Road , asked that the Board please ensure that all
the trees are not removed .
Dr . John Meyer, 1851 Cayman Road East, commented that he had walked past this
property 2 weeks ago and land clearing has already begun . There is a 20 to 30 - foot swath
already cut on the property . The discussion is about saving a hammock that no longer exists .

Commissioner Stanbridge wanted to know whether land clearing has already begun .
and Attorney Evans stated that the prior owner had been given a " hand type " land clearing
permit .
After further discussion , Commissioner Stanbridge noted that we probably need to
video these sites before any clearing permits are issued so there is a record of what has been
removed .
Ann Hunter, 1990 Cayman Road West, stated that building so close to the ocean
endangers the environment . Already there is nothing left like Summerplace . There are sewer
systems and building on every available inch of property . She also noted the lack of bridges
for getting everyone off the island in the event of a hurricane or other disaster .
Jeff Morton , 9429 Sea Grape Drive , noted that everyone in the area has made an
effort to build westward of the 1987 CCCL , while this project wants to violate the average
heights in the neighborhood and does not care about being in harmony with the people
already living there . He asked the Board to please make the plan conform to the existing
uses .
Bill Hunter , 1990 Cayman Road West, noted that when he built his home , he was
told that this sort of development would never happen and he hoped it won ' t .
Sarah Cawley , Sandalwood Road , has lived in the area for about 30 years and all the
remarks about the erosion are absolutely true . This project is also too high for the area .

Mary Berkshaw , Barefoot Place , moved here 2 years ago from Key Biscayne . This
is a lovely place and she would hate to see development happen here as it did in South
Florida .
Director Keating reported on his investigation into the land clearing permit and noted
that a limited land clearing permit has been given which only allows clearing underbrush in
specific areas .
Commissioner Stanbridge asked whether code violations are being checked out , and
Director Keating stated that it will be checked .
Commissioner Macht felt the wording of the permit should be checked in an effort to
make certain that it cannot be too widely interpreted and the clearing go too far before the
plans are approved .
Attorney Evans stated that this property is zoned multi - family and the height of the
building meets the requirements of the LDRs . His client has made an application for this
project and all regulations of the LDRs have been met . If this were a single- family
residence , there would never have been a site plan and no discussion about erosion at the
County level . The zoning permits what the applicant has applied for . The basic issue is
whether the Board can deny the project because it is seaward of the 1987 CCCL . Chapter
161 , F . S . , states that the County may regulate construction in the area between the 1987 and
the 1981 CCCL if the county develops rules and regulations and submits a request to the
DEP to undertake this regulation . That has not happened in this county . The County does
not, therefore ,. have the authority to grant or deny permits without statutory DEP approval .
This County has the practice of sending these requests to DEP and the CCCL is regulated
by DEP . This footprint and site plan is the same and if we were a single- family residence .

we would not be in this bind . When you apply for a permit, part of the requirement is
construction to withstand water and you give up the right to come back later for armoring .
The public is upset -about using this land in accordance with the regulations . It is not fair to
work with staff for months on the regulations , have staff approve the plan and say we meet
all LDR requirements , and then we go to P &Z with no representation , expecting to get their
approval and instead get their denial . The same thing is true when the appeal to the Board
is filed and the Chairman opens the floor to public comment . We have no idea what they are
going to present and no way to prepare for their objections . He had never seen their
handouts or examined their challenges . He was told there are no conflicts with the
Comprehensive Plan . County staff represents Mr . Brown and every other person in this
County . They are supposed to be the watchdogs for the County .
Mr . Evans objected to the Chairman ' s opening the discussion to the public and asked

move in and realize that the neighbors were all worried about the erosion and might take
some action against the developer for putting them in harm ' s way .

Commissioner Macht noted that all the " quasi -judicial " requirement imposes on the
Board is that nothing can be said out of the hearing of the public . There is no requirement
for examining pre- trial evidence .
County Attorney Bangel agreed that Commissioner Macht ' s comment was correct and
noted that the County ' s ordinance governing procedure does give the presiding officer the
discretion to open the meeting to public comment .
Commissioner Stanbridge questioned the Board ' s responsibilities in this matter , and
Deputy County Attorney Will Collins stated that the language in the County ' s code implies
that the Board may or may not approve the new plan . The rules , however , must be applied
consistently unless and until the County adopts codes approved by DEP . The Board is
making rules when it acts " legislatively " and in taking an application and applying the rules
acts " quasi judicially " , saying that the plan either does or does not meet the requirements set
forth . If the plan meets the rules , it should be approved .
Commissioner Stanbridge then questioned whether the Board has the discretion to add
the common - sense factors of health , safety and the welfare of the citizens .
Attorney Collins stated that, where the rules are inadequate , the Board can act to
protect health , safety and welfare . They cannot, however, change the rules on a case - by - case
basis .
Commissioner Stanbridge continued that the County has critically eroded areas and
should not put people in harm ' s way .
Attorney Collins noted that the Board is not permitting homes to go in harm ' s way ,
they are simply allowing them to apply to DEP .

Commissioner Macht emphasized that the Board is still responsible for taking care
of what is put before it . The people in North Beach have built single - family construction all
the way down to CR- 510 . Another consideration should be the simple courtesy awarded
from neighbor to neighbor . Blocking the view of a neighbor could not be considered
courteous . He felt that P &Z did not consider a number of facts including the visual evidence
of erosion and the health , safety and welfare of the people who will live in that development .
He saw no reason to permit a dangerous situation even though it may meet the letter of the
law . Martin and Broward Counties have seen fit to extend the CCCL one way or the other
and the state has set requirements to build elevated buildings , more than a tacit admission
that the building will be in harm ' s way . When the City of Vero Beach was asked to be the
determining authority in 1986 or 1987 , the City Manager commented that DEP simply
wanted to get out of the stream of lawsuits which they could see coming .

uphold the Planning & Zoning Commission ' s
decision .
Chairman Ginn questioned how much FEMA money has been dedicated to restoration
of this area , and County Coastal Engineer Jeff Tabar stated that the County has received
$ 900 , 000 from FEMA to replace 2 miles of dunes directly to the south of this site , including
the adjacent property .
Chairman Ginn felt the State has done a very poor job in protecting the area between
the CCCLs . She felt that revisions to the regulations should be on the front burner before
any more of these projects are presented .

Scott McGuire of Knight and McGuire stated that they have had a lot of meetings
with the adjacent property owner and have tried to come up with a plan to satisfy them to no
avail . The developer would be willing to accept a condition that the building be located
behind the 1987 CCCL .
Chairman Ginn reminded the Board that there is a motion on the floor to uphold the
P &Z decision .
Commissioner Adams commented that if another condition is added , it would start the
process all over again . Any further conditions should have been brought to staff before this
time .
Commissioner Tippin wished he did not have to vote and commented that he would
not build over there even if he could afford it . He supported the motion because the building
should be behind the 1987 CCCL and he felt there should be a common- sense approach to
the erosion problem .

SUBJECT : Humane Societv
The Humane Society operates on a ten ( 10) acre site they acquired from Indian River
County , located at 4701 415` Street. Five acres of the property was purchased from Indian River
County for S 10 ,000 on May 3 , 1984 . On July 27 , 1999 Indian River County deeded an
additional ( 5 ) five acres . In 1991 the Humane Society was required to hook-up to county sewer
at which time the County appropriated 549 ,490 in the General Fund to pay the sewer impact
fees . The Humane Society property was originally the old South Gifford Road landfill , and
unfortunately , ground water contamination has been found. Indian River County has been
monitoring the contamination , and has hired a consultant to develop and begin remediation or
cleanup of the site . The consultant Geo Syntec has assured the Humane Society that the
contamination is of no immediate concern for the welfare of Humane Society ' s animals . staff,
volunteers , or clients , and that with proper engineering controls , the site can be safely developed .
Humane Society of Vero Beach and Indian River County provides the community with
a vital service . They had begun expansion plans to build their proposed Adoption and Education
Center. The site permits were issued , land was cleared , the site was fenced , and the culvert for
a new roadway was added to the current location in preparation for the building construction .
After consultation with County Administration and engineers specializing in landfill
remediation, the Humane Society ' s Board of Directors has made a decision to seek a new
location for their building . Humane Society has found a new location that is thought to be
suitable and has entered into a real estate contract for the purchase of 38 acres located on Hobart
Road ( 77' St. ) between 58 `h Avenue and 66" Avenue ( adjacent to the fairground property) at a
cost of $ 275 ,000 . The move will cost more than had been anticipated since they will have to
replace their existing facility, and also have incurred costs on the existing site for the expansion .
The Humane Society has estimated the relocation costs . A summary follows :

Humane Society is requesting Indian River County provide compensation and assistance
with the relocation of the existing facility .
Analvsis
Humane Society performs an important function for the community , and because of this
Indian River County has cooperated with them in the past by assisting with obtaining land and
funding. Humane Society has also been very cooperative . Relocation costs of $ 1 , 158 ,013 would
be very hard for the County to pay. However, staff feels that the County could be of assistance
by purchasing the present 10 acre site at 4701 41 " Street and assist with the paving cost at the
new location . The costs would be as follows :

Humane Society has 13 ERU ' s of sewer capacity reserved and 3 ERU ' s of water capacity
reserved on the 4701 4151 Street site for the current building . Based on the unusual and
extenuating circumstances , staff is requesting the Board of County Commissioners make an
exception and transfer the existing water and sewer impact fee credits to the new location .
Assistant County Administrator Joe Baird stated that the Humane Society has a
contract for a new piece of property at 77t ' Street between 56 " and 58 " Avenues , adjacent
to the Fairgrounds . He asked the Board to amend the recommendation to consider having
the Utility Department refund the ERU deposit funds and having the County pay for the new
capacity required by the Humane Society at their new location . There should be
approximately a 59 . 000 additional cost at the new rates .

Commissioner Adams noted that everyone was aware that the present site was an old
landfill but no one ever expected any contamination as grave as was discovered . This new
purchase will allow them to expand their program .
Commissioner Macht questioned whether the existing building could be put to some
public purpose , and Mr . Baird responded that the only use the county might have for the
building would be as a storage facility , but substantial renovations would be required .
Commissioner Adams said she would be "nervous as a house cat " about sending
county employees in there until the contamination problem is fixed .
Commissioner Stanbridge noted that the whole area needs to be investigated but that
is another subject for another day .
Chairman Ginn questioned whether the Humane Society owns the property in fee
simple .
Wayne McDonough , Attorney , 190125 ' Street, stated that the Humane Society does
own the property in fee simple but he did not know who in their right mind would buNf such
a property .
Commissioner Macht questioned whether there is substantial agreement between
staff' s recommendation and what the Humane Societv wants .
Don Wright, President, Humane Society Board of Directors , 1775 44 "' Avenue , stated
that they respect the county ' s position and have a great working relationship with county
staff. They have been providing a service to the county since the early 1950s and plan to
continue that relationship . The Humane Society spent a lot of effort on long- range planning
about 7 years ago and in 1997 began a capital campaign to build a new adoption center,
continuing to use the present facility to house unwanted animals . The new facility was

planned at 25 , 000 square feet which would have given them a total of 3-3 , 000 square feet .
They have had overwhelming support from their contributors and began clearing the land in
the spring of 2000 when the contamination problems were discovered . The Society could
not risk spending any more money on this property and unanimously decided to look
elsewhere . The Executive Committee has raised $ 275 , 000 to purchase the new 38 acres
which are in a location that will possibly be the center of the county in 20 years . This
facility will be something our grandchildren can be proud of and enjoy . The Society is
extremely grateful for the county ' s assistance but what is being recommended will not cover
their replacement costs for the existing facility which will be approximately $ 670 , 000 . They
have been quoted $ 84 per square foot as a replacement cost . The American Humane
Association says the national average is about $ 125 per square foot . This is a unique
construction because it is dedicated to the care of animals and must be solid in the event of
hurricane or national disaster . They are requesting that staff reconsider the recommendation
to include costs to replace their existing facility .
Shelley Ferger, 25 5t ' Avenue, Canine Community Center , stated she has been a
member of the Humane Society for 15 years and is their Program Coordinator . The existing
shelter building needs to be abandoned and the number of animals requiring care will
continue to grow . She suggested that perhaps the existing facility , after cleanup , could
remain as a shelter for the County ' s Animal Control Department . As a taxpayer and as a
member of the Humane Society , her dollar is contributing to the County ' s Animal Control
costs . She asked that the County reconsider the recommendation and consider its impact on
the Humane Society .

Mr . Wright emphasized that the Board of the Humane Society is committed to
continuing their partnership with the County but noted that the County ' s Animal Control
Department represents 26 % of the costs expended by the Society .
Mr . Baird then confirmed that the Utilities Department will refund the ERU deposit
monies and the County will then buy , in the name of the Humane Society , 13 sewer ERUs
and 3 water ERUs for their new site , or give them the cash instead . The refund amount will
be $ 31 , 857 and the cost of the new ERUs at the new site will be $ 40 , 248 , approximately
$ 8 , 391 more .
Joan Carlson , Executive Director of the Humane Society , hoped the Board would
consider sending the item back to staff regarding the issue of reimbursement for the existing
facility . She believed that this is a critical issue for the Society to continue to maintain their
level of service .
Bill Barrows of The Moorings , is a donor to the Humane Society and has committed
$ 500 , 000 , of which $ 200 , 000 has already been donated . When he received the news about
the contamination at the existing facility , he began to have second thoughts about how that
would affect the dollars involved in the expansion . He attended a meeting last week where
a representative from the American Humane Society paid the local Society some very nice
compliments and commented that it was one of the best in the country . He felt that the
Society may lose some donors over this issue and that the move will cost more than $ 1
million dollars .
Chairman _ Ginn noted that the Society is well - funded but she felt the County does
have some responsibility to help them replace their building .

Commissioner Adams stated that the building is probably worth -$ 670 , 000 and she
would be comfortable , if the property could be marketed , to dedicating the proceeds to the
Society .
Chairman Ginn commented that the property is not marketable at this time and she

and (2 ) refund of the existing 13 ERUs of sewer
capacity and 3 ERUs of water capacity from the
4701 4151 Street location ; and payment of the costs

capacity at the Humane Society ' s new location .

in service since June of 1981 , approximately twenty years . When the plant was built,
t the design for the motorized overhead crane was for the lifting of motors and pumps
throughout the RO bay.

t ANALYSIS

t The Indian River County Commissioners authorized the firm of Camp Dresser &
McKee Inc . to perform engineering services for membrane process optimization and
system improvements on December 7, 1999 . Among the improvement/enhancement
€ suggestions was the modification of the overhead crane. (Please see attached . ) Item #8
S
of the letter sent to the County on August 11 , 2000, states that the current overhead
monorail crane system would be modified with a switch and additional length of track
t to the mezzanine above the offices . The additional track would allow the crane to lift
loads up to the mezzanine area for storage. Currently the Operators have to carry items
F. up a stairway to store them. This is a safety hazard and can be taken care of with the
modification of the current crane . When the cost estimate was proffered in August
k 20009 it was with an estimated cost of $ 6, 000. However when the actual bids came in,
the low bidder was $ 16 , 000.
RECOMMENDATION :
The staff of the Department of Utility Services recommends that the Board of County
i Commtsstoners approves and accepts the apparent low bid submitted by J. Herber
' Corporation, of $ 16 , 000 for the modification of the overhead crane monorail . The
$ 6 , 000 . 00 budgeted will come out of 471 -000- 169-476 . 00 and the additional
a $ 10, 000. 00 will come out of R&R fund 471 -219- 536-066 . 49 .

' No . 2000 -088 , for the preliminary assessment roll on the above -referenced project . Construction of the
project has been completed . Owners have been notified and connections have begun . Staff is requesting
the Board ' s approval of the final assessment roll . ( See attached minutes -ATTACHMENT 1 ) of the above
referenced meeting .

The preliminary assessment was for an estimated cost of $ 18 , 795 . 00, which equated to $0 256861 (rounded )
k per square foot of property assessed. The final project cost and assessment ( see attached Resolution IV and
the accompanying assessment roll-ATTACHMENT 2 ) , is in the amount of $ 14, 800 . 10 which equates to a
cost of $0 .202265 ( rounded) per square foot . The final assessment is $ 0 . 0546 per square foot or 21 . 26%
r less than the preliminary assessment.

RECOMMENDATION
The staff of the Department of Utility Services recommends that the Board of County Commissioners
E approve adoption of Resolution IV, which is attached, and authorize the Chairman to execute same .

` WHEREAS , the Board of County Commissioners of Indian River County determined that

time and place the owners of property to be assessed appeared before the Board to be heard
as to the propriety and advisability of making such improvements ; and
WHEREAS , after such public hearing was held the County Commission adopted

1 . Resolution No. 2000-088 is modified as follows : The due date for the referenced project
and the last day that payment may be made avoiding interest and penalty charges is ninety
days after passage of this resolution .
2 . Payments bearing interest at the rate of 8. 5% per annum may
made in ten
installments , the first to be made twelve months from the due date . The due date asnual the

Commissioner Caroline Ginn , County Health Administrator Jean Kline , and City
Councilman Craig Fletcher traveled to Arcadia to tour GPW,
* Staff welcomed us , and were very professional in their approach . From the
outset it was apparent that their main concern is for the welfare of their patients .
* Number of beds : 380
* Number of beds currently filled : 308 (Extremely disabled patients )
* Safety incidents at the hospital have been reduced . (Evidently this has
been a problem in the past .
* GPW serves two ( 2 ) populations : 1 ) 13ack up to local services , and 2 ) long
term care .
* Approximately one third of patients return to families .
* The buildings are old barracks dating from the 1940 ' s. Because of their age
and distance from one another , all efficiency is lost . The State has " tortured "
buildings into providing a mental hospital . There is no electronic surveillance
equipment for monitoring and/or ingress/egress .
* GPW staff has done their absolute best with what they have . While old and
in need of sprucing - up , the interior of the buildings are clean , pleasant and without
odors .
* Grounds are in need
� of maintenance and landscaping . There is a staff of 50
persons responsible for maintenance . Seems excessive .

* GPW patients appeared to be well cared for .
* Staff seems genuinely interested in the welfare of their patients . They also
appear to be very caring professionals .
* It is obvious that staff would like to see the facility remain open . HoweverIlk

we came away with the impression that they know closing is inevitable .
BECAUSE OF THE AGE , PHYSICAL CONDITION , AND LOCATION OF THE
BUILDINGS AND THE LACK OF MODERN SURVEILLANCE EQUIPMENT
RESULTING IN AN INEFFICIENT OPERATION , EACH MEMBER OF OUR
REVIEWING PARTY (Ginn , Kline , Fletcher) CAME TO THE CONCLUSION ,
INDEPENDENTLY , THAT WE SHOULD NOT OPPOSE THE CLOSING OF THE

2 . Because of the fragile infrastructure local ) for mental

` opinion that closing should be delayed until local governments can accommodate
those patients who will be served in our county/district .
* We currently have no group home in our community .
` *There is no guarantee of apartment accommodations .
*The County's SRT would not be in place or staffed .
*Training is essential .

*Local "drop - in" centers need to be expanded .
*What of the elderly mentally ill ? Nursing homes will not take them .
* We have been promised 5 additional beds in our local crisis
stabilization unit in Ft . Pierce . Funding? When operational?
*Indian River County will be receiving money for a 15 bed SRT unit .
This will need to be in place with trained staff prior to closing GPW .
* We need a clear understanding of who will be responsible for the
patients' medical costs . Many , if not most , mentally ill patents have
chronic health problems requiring a great deal of medical attention .
For example , heart disease , diabetes , osteoarthritis , obesity . What

impact will this have on our local health care providers/Health
Department?
* A health professional will be needed with knowledge of the
interaction between psychiatric medications and medications for other
illnesses .
*Dollars have been promised for a second FACT team , but IRC has
had difficulty organizing one FACT team .

*Indian River County needs an implementing plan to accommodate
those we will have to serve . Without a well thought out plan ,
Patients will suffer and the community will suffer .
M 3 . The County Health Unit has indicated that at the present time there are
i
people in our community who are in stages of de - compensation who will end up in
crisis and be back under Baker Act care . Without a clear indication of where
they will be treated , they will end up in our jails and/or homeless shelter .

4 , Funding from the State is imperative .

5 , The remaining mental hospitals (South Florida/Jacksonville ) need to gear up for
additional patients .
Jean Kline , Administrator of the Indian River County Health Department, stated that
they spent the whole day at the facility which originally was a British military base , taken
over by the state in 1947 . She had been there while she was in nursing school and it has not
k
changed much in the interim . The facility is very dilapidated and in poor repair . They are
i
down to 308 patients from over 800 . The staff was very warm and receiving, compassionate
and very open with a high level of concern about the readiness of the communities served
to take over the care of their patients . They have discharged over 50 % of their patients in

the last 6 months . Some of these had been there 20 to 30 years . They expressed concern
about visits from family members to the patients and felt the move will seriously affect those
visits . There is a tremendously high cost for health care for these patients and our
community certainly is not prepared to receive these individuals . G . Pierce Wood Hospital
serves our 4 - county area and the Department of Children and Families ( DCF ) is just
beginning to organize FACT ( Florida Assertive Community Treatment) teams . These teams
need to be up and running before any patients are received . Our community has no housing ,
educational support , occupational support, and no medication plan in place . She felt the
closing should not be opposed , but must be delayed until support services are available
locally .
City Councilman Craig Fletcher, 2345 Avalon Avenue noted that this was
very
traumatic experience for him to see the conditions in which these patients exist . However

t bad those conditions may be , it would be even more horr - A ing to turn them out without a
system of care in place to take care of them . These people are the least capable of taking
care of themselves -of anyone . We need at least a 2 year delay in the closing to prepare
locally for their care . He will bring this matter before the City Council and asked that
everyone contact their congressman to ask for assistance in these preparations before moving
` these patients .
Chairman Ginn wanted to take this matter to the Legislative Delegation on Friday .

She did not want to oppose the closing of the hospital . The patients are well - cared - for but
the building is old and lacks modern conveniences .
Mr . Fletcher emphasized that they have a great staff at G . Pierce Wood , they just
don ' t have enough money or the proper facilities .

Commissioner Tippin commented that he had visited G . Pierce Wood 5 or 6 years ago
and was amazed at the smiles on the faces of the patients . They all appeared to be happy
t there and they absolutely cannot take care of themselves .
Chairman Ginn recommended that a delay in closing be requested from the Legislative
Delegation and a demand made to insure funds for local communities to deal with this
situation .
ON MOTION by Commissioner Tippin ,
SECONDED by Commissioner Stanbridge .. the
Board unanimously approved presenting the matter
to the Legislative Delegation , not opposing the
closure of G . Pierce Wood Hospital but requesting
that such closure not take place until local
infrastructure is funded and in place .

Proposal to close transfer stations
RAISES A STINK
A county consultant has suggested shutting landfill -
1 transfer stations and replacing them with mandatory
curbside garbage collection . But many officials and
homeowners are dumping on the idea . .
Commissioner Macht wanted it known that he is a municipal taxpayer and has
mandatory garbage pickup . He is also a County taxpayer and has to maintain the transfer
stations . He hoped that this discussion could continue and expressed his opinion in favor of
mandatory trash pickups .
Chairman Ginn noted that will be one of the recommendations when the master plan
is considered . The Utilities Advisory Committee expects to bring something before the
Board in another month or so .
