DESIGNATING NOVEMBER 19 - 259 2000, AS CHRISTIAN HERITAGE WEEK IN INDIAN RIVER COUNTY, FLORIDA WHEREAS, during the season and in the spirit of Thanksgiving, it is right and just to recognize the contributions and sacrifices of our Founding Fathers; and WHEREAS, the preamble of the Constitution of the State of Florida provides, 'We, the people of the State of Florida, being grateful to Almighty God for our constitutional liberty, in order to secure its benefits, perfect our government, insure domestic tranquility, maintain public order, and guarantee equal civil and political rights to all . . . ;' and WHEREAS, the Constitution of the State of Florida guarantees the free exercise of religion; and WHEREAS, the Board of County Commissioners opens its meetings with an invocation, NOW, THEREFORE, BE IT PROCLAIMED by the Board of County Commissioners of Indian River County, Florida, that the week of November 19=25, 2000, be known, designated, CHRISTIAN HERITAGE WEEK in Indian River County, in recognition of the American Family Association's contribution to the quality of life in Indian River County. Baird, Assistant County Administrator DATE : November 15 , 2000 SUBJECT : Public Notice for TEFRA Hearing (Tax Equity Fiscal Responsibility Act) Financial Responsibility for The Palms at Vero The Palms at Vero Beach Limited Partnership would like to issue "tax exempt" Industrial Revenue Bonds to construct an affordable 260 unit garden and townhouse rental community on a 24 acre site near the intersection of 12`h Street and Indian River Boulevard. They are requesting S1 ,500,000 from the local Industrial Revenue Bond allocation to be used in conjunction with 59,951 ,977 requested from Florida Housing Financing Corporation. Staff has received the Industrial Revenue Bond Application . November 21 , 2000 12 BK 116 PG 170 In order for The Palms at Vero Beach Limited Partnership to be able to issue Industrial Revenue Bonds, Indian River County must hold a TEFRA (Tax Equity Fiscal Responsibility Act) public hearing. We are requesting permission to hold a TEFRA hearing on Tuesday, December 12 , 2000 . Recommendation Staff recommends the Board of County Commissioners approve holding the TEFRA Public Hearing on Tuesday, December 12 , 2000 Vice Chairman Ginn reminded the Commissioners that in September the Board approved a bond allocation from the State to Escambia County for single family housing . She thought the County should remain in that position and asked Assistant Administrator Baird to provide the Commissioners with more detail . Assistant Administrator Baird recounted that the Board has already allocated the full amount of District 9B Escambia County Housing Finance Authority Single Family Revenue Bonds . Since then this request was received, as well as an additional request to issue more industrial revenue bonds . It appears that Escambia would be first in line in the allocations since they had the first hearing, but staff will forward all requests to the Board . He explained that the Escambia program is a mortgage program for single family homes . The matter before them today is for a 260 -unit multi- family development at 12`h Street and Indian River Boulevard . Their request is to try to leverage Florida Housing money with a local allocation . If Escambia were to take the entire allocation, there would be no funds remaining for this particular request . There is additional request is for 256 -units at Village Grove Apartments for affordable housing at 74`h Street and SR60 . He went on to explain that industrial revenue bonds can be used for two purposes : manufacturing (to create jobs ) and affordable housing financing . He added that it will be difficult to process the Village Grove application because of time constraints and explained that the cycle for new funds begins each January . November 21 , 2000 13 BK 1 16 PG 17 i p Chairman Adams indicated she would support moving this to a public hearing as per the recommendation in the memorandum . Commissioner Stanbridge agreed . Assistant Administrator Baird mentioned that there is a $ 1 , 000 application fee and that will be lost if the entire sum is awarded to the Escambia program . Vice Chairman Ginn thought companies should be discouraged from coming in to apply at the last minute ; it was unfair to push staff to get everything accomplished by the end of the year . She also requested from staff an evaluation of the affordable housing presently available , what is proposed, the locations , and what is needed, so the Board can make informed decisions in this regard . She felt there was quite a lot of affordable housing already in the county . MOTION WAS MADE by Commissioner Stanbridge to approve staff' s recommendation . There was NO SECOND . A master planned force main is scheduled to be constructed east along the South Relief Canal from the FEC Railroad to Old Dixie Highway, then north along Old Dixie Highway to 4' Street on an as-needed basis driven by development (see attached copy of master plan map). COALITION FOR THE HOMELESS OF INDIAN RIVER COUNTY, INC ., has agreed to enter into a cost sharing agreement with the County to construct the master planned force main in conjunction with their site development. Attached is a proposed developer' s agreement with HOMELESS SHELTER AND ASSISTANCE CENTER OF I.R. C . for reimbursement of a portion of the subject force main. The Developer' s Agreement is stipulated to reimburse the Developer for the County ' s share of the force main based on itemized invoices of installed materials on a percentage complete basis4ess 10% retainage, monthly with final payment and release of retainage at the time said facilities are dedicated to the County (Paragraph - 1 .B of attached agreement). Developer will be required to post a 225% payment and performance bond prior to issuance of Utility Construction Permit (Paragraph — 14 of attached agreement). It is requested that the data herein presented be given formal consideration by the Board of County Commissioners at its regular meeting of November 21 , 2000, DESCRIPTION AND CONDITIONS : Annabelle' s Way is a 14 lot single-family subdivision of a 6. 183 acre parcel of land located on the north side of 8" Street and east of 43nd Avenue. The subject property is zoned RS-6. Residential Single- Family ( up to 6 units per acre) . The density of the subdivision is 2 .26 units per acre . On June 10. 1999, the Planning and Zoning Commission granted preliminary plat approval for AnnaBelle ' s Way Subdivision . The developer, Tom Schlitt, subsequently obtained a land development permit and has completed most of the construction of the required subdivision improvements . The developer is now requesting final plat approval, and has submitted the following: 1 . A final plat in substantial conformance with the approved preliminary plat, and 2 . A cost estimate for the remaining required improvements, and 3 . A contract for construction of remaining required improvements , and 4. A cash escrow agreement to secure the contract. November 21 , 2000 25 BK 116 PG 183 r ANALYSIS : The majority of the required subdivision improvements have been constructed, with the exception of some minor improvements . At this time, the applicant is "bonding-out" these remaining required improvements for this development, as provided for in the county ' s land development regulations . Both the Public Works Department and the Utility Services Department are in the process of reviewing the submitted engineer' s cost estimate and corresponding security amount. In addition, the County Attorney' s Office is in the process of reviewing the submitted contract for construction and the cash escrow agreement. The financial security represents 115 % of the estimated cost to construct the remaining required improvements. It should be noted that all improvements within the AnnaBelle' s Way subdivision will be private, except for the utility facilities . The utility facilities will be dedicated to Indian River county as required by the Utility Services Department and will be guaranteed separately through Utility Service' s bill of sale procedures . With the contract and security, all final plat requirements are satisfied. RECOMMENDATION : Based on the above analysis, staff recommends that the Board of County Commissioners, grant final plat approval for the AnnaBelle' s Way subdivision, authorize the chairman to sign the contract for construction of remaining required improvements, and authorize the chairman to sign the cash escrow agreement that guarantees performance of the construction contract. None of the utility providers or reviewing agencies expressed an objection to the requested release of easement, provided that the pool and deck are located at least four feet from a sewerline that exists within the easement. Since the sewerline is in the portion of the easement that the County will retain, and the owners have agreed not to build the pool or deck closer than four feet to the sewerline, staff' s position is that the requested easement portion release would have no adverse impact to utilities being supplied to the subject properties or to other properties . If the release of easement is approved. the requirement of a four-foor setback from the sewerline will be specified in a release of easement approval letter that will be sent by staff to the owners. November 15 , 2000 BACKGROUND AND ANALYSIS During the 1997 legislative session , the state legislature enacted Section 25 .402 , Florida Statutes , which governs the County Article V Trust Fund . The trust fund was created to provide compensation to counties for certain court costs , including court reporting and transcribing costa expert witness fees, and costs incurred for the appointment of special public defenders i criminal cases. As passed , the Article V Trust Fund program runs from FY 1998/1999 to 2001 /2002 . Fifteen percent of all civil penalties collected by county courts in State fiscal year 2000/2001 will be deposited into the Trust Fund for distribution to the counties through grants-in-aid . This percentage will increase to 20 . 6% in FY 2001 /2002 . Indian River Countyhas been awarded a Grant-in-Aid in the amount of $31 ,538 underthe Article V Trust Fund for FY 2000/2001 . In consultation with the Chief Judge of the Nineteenth Judicial Circuit, staff has developed a spending plan for these funds . Under the plan , Indian River Countywill receive funding forspecial public defender costs , court reporting services , and expert witness fees in criminal proceedings. The grant monies are to be distributed in advance through three disbursements prior to July 31 , 2001 . No matching funds or expenditures by the County are required as conditions of the grant. " Attached is the proposed Granton-Aid Agreement between the County and the Office of the State Courts Administrator, who will administer the grant. In order to obtain the funds , the county must return the signed agreement, along with the spending plan approved by the Chief Judge of the circuit. Each of the proposed ordinances is in final form and ready for Board adoption. ANALYSIS : • Civic and Social Membership Clubs At the November 7" meeting, after an opportunity for input, the Board voted 5 -0 to bring back unchanged the proposed LDR amendment ordinance on civic and social membership clubs for final adoption . BACKGROUND : At its meeting of October 24 , 2000, the Board of County Commissioners voted 3-2 to approve with conditions the Gralia Group ' s request for PD rezoning and conceptual PD plan approval for "The Colony", a 297 acre project located between 43rd Avenue and 27" Avenue on the north side of 17" Street -SW. That approval allows 400 single-family units, 150 multi - family units . and a golf course to be developed on the project site (see attachment #2 for minutes and staff s report) . One of the October 24" approval conditions required elimination of a proposed project entrance drive on 43'd Avenue, while another condition required provision of a project entrance drive on 17" Street SW. Access to 27' Avenue was shown and approved . After considering these conditions , the applicant re-designed the project ' s access connections to provide a connection to 17" Street SW and to provide a restricted connection to 43rd Avenue. The newly proposed restricted connection to November 21 , 2000 48 BK 1 16 PG 206 43rd Avenue cannot be allowed unless the Board modifies its October 24" PD approval condition regarding 43rd Avenue access . To that end, the Board of Countv Commissioners , on November 7' . approved the applicant ' s request for the Board to consider modifying the conceptual PD plan and corresponding approval conditions at a public hearing on November 21 , 2000. Since then, the PD project re-hearing has been properly noticed and re-advertized at the applicant ' s expense . Also, provide a southbound to eastbound left-turn lane on 43rd Avenue for the project entrance . • Provide a full-movement project entrance on 17' Street SW, ±3 ,200 feet east of 43rd Avenue , and provide an entrance on 27" Avenue . • Revise (expand a portion of) residential "POD E", the pod through which the project ' s 17" Street SW entrance will traverse . "POD E" will continue to be limited to a maximum of 100 single-family units . • Via a developer' s agreement with the county , provide for a bridge at 17" Street SW and 43rd Avenue and the paving of ±3 ,200 feet of 171h Street SW from 43rd Avenue to the project' s 17" Street SW entrance . Improvements in Phase I of the project be as follows : a. Build (pave) internal project roadway from the project' s 43'd Avenue entrance to the project' s ITh Street SW entrance, and b . Pierce Wood Hospital ( GPWH ) , located in Desoto County , houses some of the most chronic and persistently ill residents and provides services to 18 counties in 5 districts . The hospital is slated to close on June 30 , 2002 . He cited statistics for Indian River County ' s patients from his handout ( copy in the backup for the meeting) and commented that our county historically has not been fully utilizing its allocated beds . There appears to be no reason for alarm in our county because of lack of services . There have been 65 admissions and 56 discharges since the beginning of the year which indicates the need for long-term care in this area is not great, but clients such as these will require care in an alternate facility after GPWH closes . He advised of the aggressive planning taking place to insure that no person is returned to the community without an individual plan for appropriate community services including a place to live and on- going psychiatric care . Those who require hospitalized care will be treated at other state hospitals in other districts . It is anticipated that the number requiring hospitalization will be limited by community care and an effort to keep individuals as close to their families as possible . He advised of a commitment to substantially improve community-based services including 21 statewide assertive community treatment FACT (Florida Assertive Community Training) teams . The FACT teams will consist of a psychiatrist, a psychiatric nurse , social services November 21 , 2000 53 BK 1 16 PG 21 1 workers , counselors , and peer counselors . He gave statistics as to success by these types of FACT teams in other states . In addition, housing will be established . Dr . Woodley ' s purpose was to find out how the community can reintegrate those persons who will be leaving GPWH and reintegrate them into society without adverse consequences to either 4 those individuals or others . He welcomed any discussion, proposals , or suggestions to assist him in dealing with this problem . Chairman Adams believed there would be a major impact on our community with the closing of GPWH and the fact that patients are there because they cannot be cared for within the community in their home situation or within our own medical limitations . She felt it would impact law enforcement, emergency services , and families in instances where the medication becomes imbalanced and violent eruptions result . She was concerned if we don ' t have an acceptable place for treatment while the medications are balanced . Dr. Woodley advised of other hospitals within the state , so our patients will still have somewhere they can be hospitalized, if necessary . The FACT teams he spoke of earlier will aggressively assist the patients to prevent hospital admission . A contract has been given to New Horizons in Ft . Pierce and they are supposed to develop a FACT team which will seek out the persons who need assistance and work with them on a 24 hour basis to make sure they do not require admission to a hospital . They are also contemplating having more CSU (Crisis Stabilization Unit) beds so that persons who are in crisis can be treated without the need for hospitalization . Commissioner Tippin recounted that he had at one time served on the District ' s Mental Health Committee and recalled having toured GPWH , a beautiful campus on an old military base . He was amazed that mentally ill patients of all degrees and ages appeared very happy . He had not heard any reasons why GPWH was going to be closed . Dr. Woodley responded that as a result of 3040 % disproportionate funding from the November 21 , 2000 54 BK 116 PG 212 federal government, the Department of Children & Families decided that they would earmark certain mental health facility beds . GPWH is presently under a court consent decree . He suspected that the department felt that if GPWH were closed certain legal procedures will not necessarily continue . He stated he is not a spokesman for the Department and is not at liberty to give further information . Vice Chairman Ginn was very concerned about the closing of the hospital because she felt that patients who require close monitoring would be discharged . She questioned how this FACT team could take care of 1 , 000 formerly hospitalized patients . Dr. Woodley assured her that no patient would be discharged without a discharge plan and some means by which they can be assimilated into the community or be placed in one of the remaining hospitals in Southwest Florida, North Florida, or Chattahoochee . Chairman Adams understood that because GPWH is closing , the FACT teams are being created to assess and deal with immediate emergencies . If determined necessary , individuals will be hospitalized in one of the remaining hospitals . Dr. Woodley confirmed Chairman Adams ' understanding and added that patients generally do not stay at GPWH for a very long time . In our four- county area, we have never utilized all of our 36 -bed allocation which, he reasoned , means we are much healthier mentally than others in Florida . In one year, we had 65 admissions and 56 discharges . He felt we should not be terribly concerned in our community since persons within our midst are probably mentally healthy . Chairman Adams appreciated the open dialog and understood there is apparently nothing the Board can do to stop the closing of GPWH . Dr. Woodley concurred and pointed out that it is necessary to decide how our community can work together to serve our mentally ill individuals . There was a brief discussion about the location of the remaining hospitals and their November 21 , 2000 55 BK 116 PG 213 operations . Commissioner Stanbridge advised that she had provided the Commissioners with the Florida Association of Counties Health and Human Services _Policy Committee ' s policy statement, which will be worked through the Legislature : to ask for support to invest the savings from the closing of GPWH to fund more community-based care programs in the 15 or 18 counties that were served by GPH . Most of those counti Wes are rural and do not have the funds to operate such a community- based care program . Vice Chairman Ginn wondered if her appointment to a committee to maintain GPWH by Chairman Adams might change because of the FACo policy, and Chairman Adams felt that a "salvage effort" has been brought by Dr. Woodley to make up the difference . He couldn ' t understand why Bill Glynn is continuously appointed to major projects in the County . He then recounted unproven charges by the State Division of Elections against Mr . Glynn . He wondered if Mr . Glynn ' s appointments were connected to political advocacy committees on which Mr . Glynn sat or chaired . He questioned whether Mr . Glynn could give unbiased advice to the Board of County Commissioners on land use and not impose his personal taste on property owners along the north barrier island . He believed past actions indicate otherwise . Mr. Glynn is on the Space Needs Committee which requires members not politically orientated in their thinking . Mr. Turner understood that the Space Needs Committee agreed at their last meeting that renovating the current Administration Building to provide more space is not the way to go . He reproached the Commission for foot dragging for over two years concerning renovation of the Vero Mall which prevented the County from purchasing the Mall when it could have been purchased at a lesser price . He described how the long delay on the formation of the committee to study the County ' s space needs was caused by " a couple of Commissioners haggling over the idea of having the committee chaired by a member of the public" . November 21 , 2000 57 BK 116 PG 215 As Chairman of the Space Needs Committee, Vice Chairman Ginn specified that no decisions have been made by the committee . They will begin their tour of the current Administration Building by touring the first floor at their December meeting . Each meeting of the committee is publicly noticed . She stressed that there are no self- interests on the committee and it is a long way from rendering any decision . The committee will also look at the Vero Mall and give it a fair hearing. She had reluctantly agreed to chair this committee which is composed of 16 strong personalities , bright and talented people . She could now see the wisdom of the committee being chaired by a member of the Commission . She has merely provided the structure so the committee can complete the task and bring their recommendation to the Board . All members were appointed except a builder Mr . Ed Netto , who was agreed upon by the Board . Mr. Turner was aware of what Chairman Ginn had stated, but he did criticize the fact that the process is just beginning . Chairman Adams has heard from some people who think we should do nothing . Others think we are moving too fast and others too slow . She appreciated his comments , and the meeting needed to move on . Bill Glynn , 1802 Barefoot Place, advised that his attorney is handling the PAC (Political Action Committee) issue (Department of Elections ) . He believed he had done if he did , it will be rectified . He is a member of the North Barrier Island nothing wrong, but Task Force with 11 very good members . He recounted accomplishments of the Wabasso Corridor Task Force and the beginnings of the Space Needs Committee . The Press Journal has characterized the Barrier Isle Coalition as "bad boys " , but he felt that it is an advocacy group concerned with things that affect the entire county . The agreement is for work to be billed monthly by submitting invoices against the proposed hourly billing charges contained within the agreement . BACKGROUND INFORMATION : The County Justice Center currently has two air conditioning chillers that work to provide chilled water to cool the facility. The manufacturer of those original chillers is Trane Air Conditioning. The County took the building from the contractor on January 3 °d 1995 . Up until now, the maintenance of the chillers has been through the warranty that had existed on the chillers and then on a time and materials basis after the term of the warranty had expired. As noted by the attached memo from Building and Grounds Superintendent, Lynn Williams, there have been a series of "nuisance trippings" of the safeties. While these trippings cause interruption of service that is only temporary, it also causes staff to make manual resets of the safeties to restore the units to operation. To attempt to acquire contacted maintenance of the units, staff contacted South Florida Trane Service since the air conditioning is a Trane system. South Florida Trane is the direct manufacturer's agent here in Florida. November 21 , 2000 62 BK 1 16 PG 220 In order to get a firm to agree to accept maintenance responsibility, the system should be new or operating properh at the time the company begins maintenance. If not operating properly, the company normaliv would require repairs, and the oxvner would be responsible for the expenses in correcting the problem . Trane has estimated the repair costs to be approximately $6,600 for the repairs . They have quoted a price of $ 11 , 875 for the annual maintenance of the two chillers. As a concession to the County, Trane has agreed to include the repair work (56,600) in the quoted price of S11 ,875 . To compare that quote with a competitive bid, the recent bid awarded to York for the Administration Building chiller was for 58,748 for only a single chiller. ON MOTION by Vice Chairman Ginn, SECONDED BY Commissioner Stanbridge, the Board unanimously waived the normal bid procedures and approved a one-year maintenance agreement with South Florida Trane Service , Inc . , in the amount of $ 11 , 875 which includes $ 6 , 600 for repairs , on the two chillers in the Indian River County Courthouse , as recommended in the memorandum . BEACH EROSION STATUS REPORT Coastal Engineer Jeff Tabar reported on beach erosion over the past two months due to northeast winds . He explained that wave heights of up to 1042 feet created choppy conditions which can cause shoreline erosion effects even more severe than larger hurricane waves . The National Weather Service put out heavy surf and rip current advisories for 5 days in October . His office did a countywide tour of the beaches and he presented photos of the erosion areas on the ELMO . He observed that in certain critical areas there are losses of as much as 5 to 25 feet from the dunes which is certainly a serious situation . On a map of the county ' s shoreline he indicated the most severe erosion areas . He presented photos showing the north to the south beaches of the county . He pointed out debris both in the water and on the shore ; one item he had seen in the surf was a 10 foot long " log " of about 6 feet in diameter which could be very destructive . He had photographs of dune escarpments over 10 feet high . He pointed out that at Wabasso Beach a lifeguard tower had been undermined and was in danger of collapse . Further south , he pointed out how the beach scraping effort had helped to protect from further damage but nevertheless resulted in a critical situation . The photos showed tubes that were placed during the late 1980 ' s to create dunes exposed on the beach indicating certain erosion there . He felt the Vero Beach area faired very well as far as overall losses . A lot of the debris was cleaned up in the city area . The photograph showed a decent amount of beach left in front of the Driftwood Resort and Humiston Park . The south county beaches were subjected to quite a bit of erosion . He spoke of dramatic erosion losses in the Surfside area just since he began working for the County in 1996 . He pointed out how a seawall had been constructed and that it has been undermined and sand scoured out behind it . He advised that he had contacted the Department of Environmental Protection during the second storm event and requested they come down, do site visits , look at the areas , and work with their field staff. They responded and sent a representative down . As a consequence, 4 beach scraping permits have been November 21 , 2000 64 BK 1 16 PG 222 issued to allow areas hardest hit to protect themselves . Also , numerous beach fill permits have been issued . The requests for sea walls continue and permit applications are being processed . Finally, after Hurricane Floyd, the county qualified for approximately $ 900 , 000 in restoration emergency funds (FEMA - Federal Emergency Management Agency) for building some dunes along our shoreline . The permit from Department of Environmental Protection was just received so we can proceed with restoring about two miles of 20 ' dunes in the critical areas during the winter months . He has worked in monitoring and coordinating the beach scraping efforts with homeowners and that has worked out very well . In the future, the beach renourishment program is ongoing for three areas of the county , restore and bypass sand south of Sebastian Inlet . There are also additional coastal regulations which the Commission has touched on in the past . Mr. Tabar was congratulated for an excellent presentation by Chairman Adams and Vice Chairman Ginn , Vice Chairman Ginnproduced three of her photos showing scouring has occurred between the Barton and Gerstner properties and that the Gerstner ' s home has actually been undermined . Chairman Adams noted that the areas where the PEP reef is located seem to have fared better than other areas . She advised that at the previous day ' s Beach and Shore Preservation Advisory Committee meeting it was suggested that perhaps another PEP reef should be done in the Gerstner ' s area because the loss of sand will be continual there . Vice Chairman Ginn thought that would be a very good idea because it is a very serious concern for those homeowners . VICE CHAIRMAN GINN - REPORT ON SUB - STANDARD LIVING CONDITIONS OF ELDERLY IN WABASSO AREA AND GIFFORD NEIGHBORHOOD PLAN Pursuant to Mr. Frank Zorc ' s concerns , Vice Chairman Ginn reported that she, Health Administrator Jean Kline, and Environmental Specialist Don Burgess had gone to see the Wabasso area problems . There are several pockets of poverty in our county about which we are not proud, however, people live there . Anything we do in the area must be done carefully and thoughtfully so as not to impact the homeless situation in our county . Steps the County could take were discussed and the first steps would be to determine the land ownership and the rights - of--way . There is little that can be done until those things gs are known . Guidance from our County Attorney is also necessary regarding the removal of trash from private property which produces unsanitary conditions . She thought the County ' s ordinance regarding minimum housing standards should be researched . These steps should be taken in conjunction with community leaders . She had no desire for the County to go in and displace people . She recounted having attended a national meeting of Habitat for Humanity and she was willing to do whatever she could with them . The national group focuses on cleaning up neighborhoods . She plans to go to Georgia with other members of the committee to visit a neighborhood they cleaned u in Georgia to determine if there P g ere are any applicable situations for us . The Health Department will take the lead and will work with other community agencies on this . The situation has been going on for many years ; it will be turned around but it will not happen overnight. Many of the people who are there are elderly and care has to be taken not to disturb or disrupt them . Commissioner Stanbridge commented that there is an area in Gifford and it has been determined that a small area plan is necessary . Staff has been given permission by the Board to assist in developing a neighborhood plan . Corridors will be studied as well as similar situations that exist in Wabasso and community leaders are involved in a team . Plans are to apply for a " front porch Florida" grant which will give that community its own planning professional to help with ill be made to Station 3 and the potential for obtaining grants needed . Improvements w "brown field funding" is being investigated for some areas . If the Gifford plan proves successful , she thought the same technique could be applied to other parts of the community which need revitalization and improvements . Vice Chairman Ginn thought that would serve as a wonderful model and especially liked the idea of a work force team from the community . In response to her question , Commissioner Stanbridge advised how the Gifford plan had begun and was being accomplished . She explained that when the Comprehensive Plan was developed previously , the smaller communities were not included due to time constraints at the time . The small area plan is imperative to begin the process . Chairman Adams pointed out that in many areas there are no rights- of--way and some homes are actually on other people ' s property . There are a lot of things in the county which are not up to our personal standards but the paramount concern is handling them with the physical and mental health of the citizens in mind . She stated there are families with children living in vacant lots and in the woods , some for years . She has talked with them and seen them . The Wabasso area wells produced good water at one time , but the large wells for the Johns Island golf course basically de-watered the whole area and St . Johns River Water Management District claims there is no evidence to say that is what happened . The recourse of people without a strong spokesman is extremely limited . She explained that our grant requests are often rated low . That is what happened to a CDBG application for drainage , water and sewer, mainly due to the lack of rights- of--ways . She hoped there would be some creative ways to address the utilities problem and the drainage problem needs to be addressed as well . Community Development staff has been working diligently on righting the wrongs November 21 , 2000 67 BK 1 16 PG 225 that have occurred since the early 1920' s . Commissioner Macht maintained that the SHIP program has been very effective by not only providing funding for housing, but also training to help people maintain same . The Homeless Assistance Center and Samaritan Center do likewise . Habitat for Humanity has declared a 10 -year program in our community to eliminate sub - standard housing , which sounds almost impossible , but it was done in Georgia . Chairman Adams added that the Economic Opportunities Council has also provided assistance to fix homes in the areas . Commissioner Stanbridge pointed out that generally a particular funding source cannot be used for any other project than that for which it is specified . The future plans for land acquisition have not yet been established and the sentiment seems to be to determine what we should do and how should we do it . In assigning Dr. Richard Baker, Professor Emeritus , and Grant Coordinator Janice Broda of the Florida Medical Entomology Laboratory to work with the County staff, they have come up with the proposal which would be partially funded by Florida Fish and Wildlife and would require a small amount from the County, which he November 21 , 2000 69 BK ! 16 PG 227 believed could be taken from existing LAAC funds . That will produce a document to increase public awareness concerning the land acquisition program, along with other activities to inform citizens of such things as the uses of the lands already acquired and the type of lands proposed to be acquired with the remaining funds , if it meets with the Board ' s approval . He planned to make a revision in the resolution that created the LAAC along the lines of restructuring it which would include perhaps the chairmanship of the committee . He expected that to come up in January 2001 . Commissioner Stanbridge and Vice Chairman Ginn thought this was an excellent idea . Chairman Adams thought there should also be a mailing to the voters as well as information in Florida Today and the Press Journal . Her point was the circulation of information should not be limited to just what was mentioned in the letter. Commissioner Stanbridge agreed that as much information as possible should be out . Commissioner Macht agreed because of the indication in the Press Journal ' s editorial that these lands_ are acquired but not made available to the public, which is untrue since it is required by our grant partner (Florida Communities Trust) that the lands be made available to some degree to the public . Commissioner Stanbridge recounted that at a recent meeting of the Governor ' s Greenway and Trails Committee, there was a list of counties that passed their first land acquisition legislation . Broward County will issue a bond for $400 million ; it passed by 74 percentile . Volusia County will issue two bonds at $40 million each . Indian River County was early in this and we have benefitted from what we have achieved with the land acquisition program . Commissioner Macht recalled the committee was criticized for moving so slowly , but he felt the thoroughness of the committee was one of its best attributes . He felt that almost November 21 , 2000 70 BK lib PG 2 2 8 f now f zero mistakes have been made in the costs , types , and uses of the acquisitions . Lately, the Board has been seeing and approving a lot of high density projects which involve a lot of new units indicating the county is growing . The proposals have shifted from local to out-of- town developers whose care and concern for the county is second or third to their profit margin and greater density . These factors fuel his desire to buy as much land as possible to preserve it for ecological concerns and keep it out of development . People brag about the quality of life in our county, but that diminishes with population growth . Vice Chairman Ginn hoped that the tabloid that is to be developed could be mailed out to every home in Indian River County and thought the proposal wonderful .
