The Board of County Commissioners of Indian River County met at the Court House
in Regular Meeting at 9:00 o'clock A. M., Tuesday, October 7, 1952, with the following members
present: W. C. Graves, Jr., Chairman; H. C. Watts, J. J. P. Hamilton and Aubrey L. Waddell.
Also present were S. N. Smith, Jr., Attorney; E. E. Carter, Road and Bridge Superintendent; and
Kathryn Morrison, Deputy Clerk.
Minutes of September 2, 1952, were read and the same were approved upon motion
of Commissioner Waddell, seconded by Commissioner Watts and carried.

made by Commissioner Waddell, seconded by Commissioner Watts and carried.
E. E. Carter, Road and Bridge Superintendent, gave a report as to the work being
done by the Road and Bridge Department.
Homer C. Fletcher, Tax Assessor, appeared -before the Board and requested authority
new
to purchase a/printing calculator for the Assessor's Office stating that the approximate cost of
a new machine was $447.75, less trade-in on adding machine of $82.50, or a net cost of $365.25.
Said request was granted on motion of Commissioner Hamilton, seconded by Commissioner Waddell and
carried.

Mrs. Anne Christensen, County Welfare Case Worker, made a report of her activities
for the month of September, 1952, and the report was filed with the Clerk.
Mr. George W. Simons, Jr. of Jacksonville, Florida, presented his idea of a County
zoning plan.to the Commissioners and requested a meeting be called of the County Planning and
Zoning Commission to meet with this Board at 2:00 o'clock P.M., Thursday, October 16,1952, and
it was so ordered.
Mr. Joseph Walton appeared before the Board to present a plat for filing in which
a 250 foot right-of-way is dedicated to the County for public road rights-of-way, said 250 foot
right-of-way being the -north 250 feet of Government Lot 1, Section 28, Township 33 South, Range
40 Eastland the north 250 feet of Government Lot 1, Section 279 Township 33 South, Range 40 East,
lying west of A -1-A Highway.
On motion of Commissioner Waddell, seconded by Commissioner Hamilton and carried,
the Board agreed to accept said right-of-way and that said proposed plat of the north 250 feet of
Government Lot 11 Section 28, Township 33 South, Range 40 East, and the north 250 feet of Govern-
ment Lot 1, Section 27, Township 33 South, Range 40 East, be placed on record.
Audit Report #3794 dated December 31, 1951 of the Florida Inland Navigation Dis-
trict was presented and ordered filed as part of the public records of Indian River County as
provided in Section 125.09 Florida Statutes.
Mrs. Alice Helleso of the County Health Unit appeared before the Board regarding
dedication ceremony as to the new Health Center Unit. Mrs. Helleso was advised the ceremony
would be under the direction of the V. F. W. and the American Legion to be held November 11, 1952."
Chairman Graves stated that he was ordering the placque for the dedication.
On motion made by Commissioner Watts, seconded by Commissioner Waddell and carried,
the Chairman and Clerk were authorized to sign closing agreement with the Florida East Coast Rail-
road dated July 21, 1952, with the provision that all costs in connection with the Railroad cross-
ing in question including any future costs must be borne by the affected property owners and if
any future costs are unpaid by the affected property owners that the County will abandon the
crossing.
The Board approved applications for admission to the State Tuberculosis Sanatorium
for Arthur Jones (colored) and Augrest Foye (colored) of Gifford, Florida.
The Board approved application for admission to the State Tuberculosis Sanatorium
for E. B. Martin, Vero Beach, Florida.
Notary,,Public bonds for CHARLES C. JEWETT, E. W. JACOCKS, JEANNETTE M. MORRIS,
KATHRYN E. DALRYMPLE and BERNICE MEYER, each in the sum of $500.00 with the following Bonding
Companies respectively, were approved by Douglas Baker, clerk Circuit Court, as provided by law;
Massachusetts Bonding and Insurance Company, American Surety Company of New York,, Hartford Acci-
dent and Indemnity Company, American Fire and Casualty Company, Massachusetts Bonding and Insur-
ance Company.
Upon motion of Commissioner Watts, seconded by Commissioner Waddell and carried,
letters of agreement were authorized relating to obtaining right -of -wap deeds for the widening
of State Road #5 south of the city limits of Vero Beach, and State Road #S -505-A (Lateral's Road)
as follows:

partment Deed No. 221, Section $801(691), State Road No. 5, Indian River County, Florida, the
County agrees as follows:
1. That the County will move off the right of way being conveyed in the above deed
the small fruit stand now situated on this right of way and will set up the fruit stand and re
establish the same in good condition as it existed prior to the moving on the property which you
have remaining there.
2. All of the above will be done prior to taking possession of the right of way con-
veyed in the above deed and you may continue in possession of the property described in the above
deed until the above building has been moved as stated.

Dear Mr. and Mrs. Lux:
In consideration of your conveying the right of way described in State Road Department
Deed No. 218, Section 8801 (691), State Road No. 5, to provide for widening and improving this
road, the County agrees as follows:
1. Your small building used as a sales stand located at the Northeast corner of your
property will be moved back off the new right of way line and reestablished in good condition as
it is now.
2. The County agrees to place drainage tile in the road -side drainage ditch which will
be constructed in connectift-with the new road and to fill over the drainage tile all along your
property line for the full length of your property line on the road right of way. If the road
can be constructed without a drainage ditch in front of your property, then the County agrees to
fill all along your edge of the property on the road so there will be a gradual slope from the
road on to your property without any intervening drainage ditch.
All of this work will be done prior to taking possession of the right of way which you
are conveying.

In consideration of your conveying the right of way described in State Road Department

Deed No. 214, Section 8801 (691), State Road No. 5, required for widening and improving this
road, the County agrees as follows:
1. To cut off your existing office building which will be on the new right of way
line and rebuild the wall.
2. To build on the Northwest corner of the existing office building an additional room,
size 14 feet x 16 feet, to be connected into the existing office building with the same type of
construction as the existing office building and to then reestablish the whole office building
in good condition.
3. To cut off the barn or shed where it encroaches on the additional right of way and
to rebuild the same amount on the West end of the barn and reestablish the same in good condition.
4. To move the citrus trees now planted on the additional right of way and replant
them in whatever location you designate.
5. In consideration of the above and due to the fact that the room being built is
larger than the part of the office being taken, we understand that you will pay the County $500.00.
6. The County will the whatever drainage ditches constructed between your property
and the new road and fill in the ditch so you will have access all the way along your property
from the office building to the South end of the property.
7. All of the above will be done and completed prior to taking possession of the prop-
erty described in the additional right of way.

Deed No. 206, Section $$01 (691), State Road 5, the County agrees to move your building now
partly situated on this right of way being conveyed in an Eastward direction so that the building
will be placed off the right of way and on the remaining property owned by you. The building
will be set up and reestablished in good condition as it existed prior to the moving.
All of the above will be done prior to the time of taking possession of the land de-
scribed in the above deed.

approach and fill now located on the above described property at two different places from their
present East end Eastward to the new right of way line being established by the above conveyance
of the same width as now exists.
The County further agrees that this will be completed prior to November 1, 1952, and if
the work is not so completed, the deed will be returned to you unrecorded.

In consideration of your conveying the right of way described in State Road Department
Deed No. 234, Section $$01 (691), State Road No. 5, the 'County agrees as follows:
1. To pay to you the sum of $1,200.00 for the property described in the above right
of way deed.
2. The County further agrees that should the construction of this road prevent your
driving between the West right of way line and the East side of your packing house located along-
side this road, that the County will either provide by putting in a the and filling over any
ditch so that you can drive on the East side of the packing house or if this is not possible
the County will move your packing house and set it up and reestablish it in good condition as it
existed prior to the moving.
You may remain in possession of and have the use of the additional right of way described
in the above deed until construction of the widening of this road begins and the County agrees to
do and perform all of the above before possession is taken of the additional right of way describ-
ed in the above deed.

In consideration of your conveyance of the right of way described in State Road Depart-
ment Deed No. 211, Section $801(691), State Road No. 5, Indian River County, Florida, the County
does herewith agree as follows:
1. That the County will move off the right of way being conveyed both of the buildings
now partially situated upon the additional right of way conveyed. Each building will be located.,
and reestablished on the remaining property which you own at this location in good condition as
the same existed prior to the moving.
2. In consideration of the above, the County would also receive a subrogation of the'
mortgage interest held by Ralph E. Harris and Bessie Dean Harris, his wife, and a subrogation of
the mortgage interest held by First Federal Savings and Loan Association of Indian River County,
without further cost to the County.
3. All of the above will be done prior to taking possession of the right of way des-
cribed in.the above deed and you may continue in possession of the property described until the
two buildings mentioned are moved as stated.

State Road Department Deed No. 5, Section $855-150, State Road S -505-A, Indian River County,
Florida, the Board of County Commissioners agree to pay to you prior to the beginning of con-
struction on this road the sum of $1,250.00 in cash.
The County also agrees to cut off the existing artesian well at a sufficient depth to

prevent the road construction interfering with the well and piping the well underground to come
up West of the new right of way line. The County also agrees to relocate and reestablish in
good condition thb corrugated culvert and gate with concrete bulkhead and to provide adequate
entrances to your property at the North and South lines.

The Board of County Commissioners of Indian River County have instructed me to advise
you that in connection with obtaining additional right of way for widening and paving State Road
5-505-A, locally known as the Lateral "B" and the King's Highway road, the County agrees as
follows:
1. Upon a conveyance by you of the right of way required for this work, the County
will pay to you the sum of $1,800.00.
2. The County agrees to reconstruct on the new right of way line the drainage structures
consisting of reinforced concrete bulkhead to which is attached screw-type irrigation gate and
18 inch corrugated drain pipe to the canal and reestablish the same in good condition.
3. The County agrees to cut off the existing artesian well on the new right of way at
a sufficient depth to prevent the road construction interferring with the well and piping the
well underground to come to the surface West of the new right of way line and the County further
agrees that if the well is damaged by virtue of it being under the right of way or if the flow
of water is impeded because of the angles in the well, the County will repair the well or recon-
struct the same so that you will receive the flow of water therefrom as the same now exists.
4. You may have possession of the property to be conveyed and you continue to be the
owner of the fruit and may pick the same at any time to the date of removal of trees on the
right of way.

In consideration of your conveyance of the right of way described in State Road De-
partment Deed No. 2, Section 8$55, State Road No. S -505-A, Indian River County, Florida, the
County does herewith agree as follows:
1. The line between your property and that being conveyed in the above deed is a
foot or so to 'the South of the hedge and concrete posts located at the Northwest corner of your
property so that the hedge and posts will be in the right of way which you are conveying. The
County has consulted with the State Road Department and the State Road Department has assured
the County that this road can be constructed without interfering with the hedge and posts men-
tioned. The County does herewith assume the responsibility and does herewith assure you that
the posts and hedge will not be damaged or moved from their present location until after July 1,
1953. After this date, if you desire, the County will move the hedge and posts back on your
property and set them up and reestablish them in good condition as they now exist.
2. The County agrees to reestablish the three road outlets which you have from your
property on to the above described road in good condition as they now exist.
3. The County agrees to reestablish the two drainage outlets which you now have from
your property along this right of way line in good condition as they now exist.
4. You may remain in possession of the right of way described in the above deed until
construction of the road begins. You may remain in possession of that part of the right of way
conveyed until work begins and you may remain in possession of the part where the posts and hedge
are until July 1, 1953.

Motion was made by Commissioner Hamilton, seconded by Commissioner Waddell and
carried, to exchange unused right-of-way on the west side of State Road No. 5 for additional
lands needed on the east side of said State Road No. 5 for the construction of a four -land high-
way from the city limits of Vero Beach to the south County line over property of the Oslo Hammock
Corporation.
The several bills .and accounts against the County, having been audited, were
examined and found correct, were approved and warrants issued in settlement of same. Such bills
and accounts being on file in the office of the Clerk of the Circuit Court, the warrants so
issued from the respective funds being listed in the Supplemental Minute Book, as provided by
the rules of the State Auditor, reference to such record and the list so recorded being made a
part of these minutes.

v'The County Depository filed its monthly statement, showing receipts and disburse-
ments of the various funds, which having been audited, were found to be correct.
.,'There being no further business, on motion made, seconded and carried, the Board
operations incidental to agriculture or other operations in the area. This also includes saw-
then adjourned.

THURSDAY, OCTOBER 23, 1952
The Board of County Commissioners of Indian River County met at the Court House
in a Special Meeting held at 2:00 o'clock F.M., Thursday, October 23, 1952, with the following
members present: W. C. Graves, Jr., Chairman; H. C. Watts, Aubrey L. Waddell; J. J. P.
Hamilton; and Allison Warren. Also present were S. N. Smith, Jr., Attorney; E. E. Carter, Road
and Bridge Superintendent; and Katherine Morrison, Deputy Clerk.
Chairman Graves stated this meeting was called for the purpose of re -activating
the County's Planning and Zoning Board.
Members of the Planning and Zoning Board present were Robert Graves; William E.
Stewart and Dewey Reams. Absent were Everett Vickers and J. J. Holmes. Also present was
George W. Simons, Jr. of Jacksonville, Florida, whose business is Municipal Engineering Research
and Planning.
Chairman Graves then turned the meeting over to Mr. Simons who stated that the
Zoning Commission should decide on some tentative regulations which should be advertised in the
paper and placed on the bulletin Board in the Court House two weeks before a public hearing is
held. He then proceeded to give a resume of the County as now zoned.
He said that the Commission could impose regulation anywhere in the County except
in the Corporate areas. The western part of the County he has placed in an agricultural zone -
this zone permits practically every activity to continue as it now is. He stated here that any
business now being operated that might be objectionable to the Commission could not be done
away with but if these operations should at any time cease that they would have the power not
to let a new operation of the same nature come in.
He further stated that in the event of subdivisions in the agricultural zone
outside the corporate zones, where tracts are subdivided, will have to conform to the size of
lots as stipulated by the Zoning Commission. This agricultural zone also provides for temporary
sales stands along principal highways, permits guest houses, motels, etc., packing houses or any
operations incidental to agriculture or other operations in the area. This also includes saw-
