Indian River County, 19[" Circuit Case No . 00-0343-CA- 19 Following a three hour bench trial , Judge Kenney entered Final Judgment in the above matter ordering that the northern 25 feet of the 50 foot strip immediately adjacent on the south of the Driver property is declared to be owned in fee simple by the Drivers and the County has no right , title , interest, or claim to it. Although the statutory platting scheme first adopted in 1971 states that all streets shown on a plat are deemed dedicated to the public, Judge Kenney's decision accepted the Drivers' contention that the only way an implied dedication (a dedication without any dedicatory language on the plat) could be perfected under the common law was some formal acceptance or use by the public . With respect to the 50 foot right-of-way, the Judge did recognize the Resolution designating the strip of land as a limited use right-of-way on August 23 , 2000 as a formal acceptance , so that a 25 foot strip is still available for pedestrian access to the river, drainage and utilities as necessary. During discovery for the trial a survey disclosed that the Drivers ' house not only fails to meet setbacks from the "right-of-way" but partially encroached into it. The Final Judgment should resolve all setback-related issues for any future construction by the Drivers of a new residence or any addition to the existing residence. Reed felt that the Court had set a dangerous precedent in releasing this property and noted that the County has always had possession of that property . Chairman Adams stated that the recommendation of the County Attorney was that an investigation be done to see what other properties might be involved in an effort to preclude any other such actions . Deputy County Attorney Will Collins stated that in 1971 the laws changed to read that any roads shown on a plat are deemed dedicated to the public . Before that time , common law required an express acceptance of the dedication of the property indicated on the plat as a road . His office is examining early plats to ensure that this does not happen again . The Court has ruled that the Drivers own the fee simple to the 25 foot right- of=way . County Attorney Paul Bangel commented that another factor against filing an appeal is that a risk would be taken that a negative result would set a binding precedent at the appellant level . Attorney Collins attempted to explain that the filing of the plat showing the road implies an offer to dedicate , but to perfect the dedication, a body has to take formal acceptance . The claim is , therefore , valid under common law . The law was changed in 1971 to indicate that these rights -of--way can be accepted by resolution or by use . Commissioner Stanbridge suggested that the ladies meet with the attorneys after this meeting in an effort to clear up their misunderstandings and the attorneys indicated their willingness to assist . As with most such applications, both requests were processed concurrently. State law, however, provides some special requirements for county initiated rezoning requests, such as the subject request, that involve more than 10 acres . Among those special requirements are the following: • The Board must hold 2 advertised public hearings; and • The second hearing must be held at least 10 days after the first hearing and must be advertised at least 5 days prior to the hearing. The first rezoning public hearing was held at the November 14, 2000 Board of County Commissioners meeting. At that meeting, the Board voted 4 to 0 to hold the second rezoning public hearing at the December 5 , 2000 Board of County Commissioners meeting. Because the December 5 , 2000 meeting satisfies the requirements for the second hearing, the rezoning ordinance can be adopted following that public hearing. On May 11 , 2000, the Planning and Zoning Commission voted 6 to 0 to recommend that the Board of County Commissioners approve this request to rezone the subject properties. DECEMBER 59 2000 BK I I PG 274 - 32 - i � Existing Land Use Pattern Subject Property 1 Subject Property 1 is part of the ±22,000 acre St. Sebastian Buffer Preserve. That preserve includes land adjacent to Subject Property 1 on the north, in Brevard County, and on the east (The Coraci Tract in Indian River County) . Containing pine flatwoods, wetlands, and scrub habitat, the St. Sebastian Buffer Preserve, including Subject Property 1 , is nearly completely undeveloped. The portion of the preserve located in Brevard County is zoned either AU, Agricultural Use, or GU , General Use. To the South of Subject Property 1 , land at the northwest corner of I-95 and CR 512 is vacant and is zoned CG, General Commercial District. Recently annexed into the City of Fellsmere, land on the south side of CR 512, west of I-95 , is also vacant. Prior to the annexation, that land was in the unincorporated county and was zoned A- 1 . Further west along the north side of CR 512 is the I, Industrial, zoned MESA Park entertainment complex, also in the City of Fellsmere. West of Subject Property 1 , land is zoned either A- 1 or A-2, and uses include citrus groves, vacant land, and residences on large lots . Subject Property 2 Subject Property 2 consists of two parts- the western portion between 130'" Avenue and 122nd Avenue, and the eastern portion between 122d Avenue and I-95 . The western portion consists of inactive citrus groves which the St. Johns River Water Management District plans to restore to a natural use. Abutting those inactive groves on the south are wetlands associated with the St. Johns Marsh. Those wetlands are zoned Con- 1 . More citrus groves, apparently also inactive, abut Subject Property 2 on the west. Those groves are zoned A-2 . West of 122"d Avenue, land north of Subject Property 2 is zoned A4 and contains single-family residences on large lots. East of 122d Avenue, land is undeveloped and consists of wetlands and heavily wooded uplands. The property bordering the northern boundary of the eastern part of Subject Property 2 was recently annexed into the City of Fellsmere. Prior to the annexation, that land was zoned A-2. The property bordering the southern boundary of the eastern part of Subject Property 2 is also zoned A-2 . Land east of Subject Property 2, across I-95, is zoned A- 1 . Subject Property 3 Bordered by the Con- 1 zoned estuarine wetlands of the Pelican Island National Wildlife Refuge on the west, Subject Property 3 is zoned A- I and consists of inactive citrus groves and jurisdictional wetlands. The United States Fish and Wildlife Service intends to use Subject Property 3 for wetland restoration or to buffer existing wetlands. The lands to the east of the site consist of citrus groves and are zoned A- 1 . Subject Property 4 Subject Property 4 contains heavily wooded uplands . To the south of Subject Property 4, land is zoned RS=3 and contains citrus groves or single-family residences on large lots. Abutting Subject Property 4 on the west is the RS-3 zoned Lindsey Pines Subdivision of single-family residences. Abutting Subject Property 4 on the north is an ±20 acre tract that is zoned A- I and contains one single-family residence. To the east of Subject Property 4, across 58`h Avenue, land is zoned RS-6, Single-Family Residential District (up to 6 units/acre), and contains single- family residences . DECEMBER 5 , 2000 BK 1 16 PG 275 - 33 - Futnre i .and Use Pattern On November 14, 2000, the Board of County Commissioners adopted an ordinance redesignating the subject properties to C- 1 , Publicly Owned or Controlled Conservation Land (zero density). Consistent with state law, however, the effective date of that ordinance is when the land use designation amendment is found "in compliance" by the State Department of Community Affairs (DCA) . According to state law, DCA must determine that the amendment is either "in compliance" or "not in compliance" within 45 days from receipt of the amendment. DCA has not yet formally made that determination. Therefore, at this time, the future land use patterns in the areas of the subject properties are as follows : Subject Property 1 Subject Property 1 and lands to the west are designated either AG4 , Agricultural4 , or AG-2, Agricultural-2, on the county' s future land use map. The AG- 1 designation permits agricultural uses and residential uses with densities up to 1 unit/5 acres. The AG-2 designation permits agricultural uses and residential uses with densities up to 1 unid10 acres. The southwest portion of Subject Property 1 abuts the MESA Park entertainment complex in the City of Fellsmere. The MESA Park property is currently designated I, Industrial, on the City of Fellsmere' s future land use map . South of Subject Property 1 , across CR 512, is the land that was recently annexed into the City of Fellsmere. Prior to the annexation, the county' s land use designation for most of that land was AG- 1 . The exception is at the southwest comer I-95 and CR 512. Prior to the annexation, the county ' s land use designation for land at the southwest corner I-95 and CR 512 was C/I, Commercial/Industrial. The C/I designation permits various commercial and industrial zoning districts. Land at the northwest comer of I-95 and CR 512 is designated C/I, Commercial/Industrial, on the county's future land use map. Most lands abutting Subject Property 1 on the east are designated C- 1 , Publicly Owned or Controlled Conservation- 1 (zero density). The C- 1 designation permits conservation and passive recreational uses. Land to the north of Subject Property 1 , in Brevard County, is designated AG, Agricultural, on Brevard County's future land use map. The AG designation permits agricultural uses and residential uses with densities up to 1 unit/acre. Subject Property 2 Subject Property 2 and adjacent properties to the east and west are designated AG-2 on the county ' s future land use map. The exception is land east of 1-95 which is designated AG4 . Lands north of the western portion of Subject Property 2 are also designated AG- l . Lands north of the eastern portion of Subject Property 2 were recently annexed into the City of Fellsmere. Prior to the annexation, the county ' s land use designation for that land was AG-2 . Lands south of the western portion of Subject Property 2 are designated C- l . Lands south of the eastern portion of Subject Property 2 are designated AG-2 . Subject Property 3 Subject Property 3 and lands to the east, across Jungle Trail, are designated L- 1 , Low-Density Residential- 1 , on the county ' s future land use map . The L4 designation permits residential uses with densities up to 3 units/acre. Other lands surrounding Subject Property 3 are designated C- l . DECEMBER 5 , 2000 3K I ► 6 PG 276 - 34 - Subject Property 4 Subject Property 4 and lands to the north, south, and west, are designated L-2 , Low-Density Residential-2, on the county ' s future land use map . The L-2 designation permits residential uses with densities up to 6 units/acre. To the east of Subject Property 4, across 58w Avenue, land is designated M-2, Medium-Density Residential-2, on the county ' s future land use map . The M-2 designation permits residential uses with densities up to 10 units/acre. Environment Subject Property 1 Subject Property 1 contains ± 1 ,072 acres of freshwater wetlands and ±4,289 acres of native upland plant communities (pine flatwoods and scrub). The site contains habitat for several federally threatened and endangered species, including bald eagles, re&cockaded woodpeckers, Florida scrub jays, and sand hill cranes. Much of Subject Property 1 is within an "A" 100 year floodplain, with an undetermined minimum base flood elevation requirement. Subject Property 2 Containing both freshwater wetlands and native upland plant communities, Subject Property 2 is managed by the St. Johns River Water Management District to reduce phosphorus loading into the Blue Cypress Water Management Area, and to protect and manage endangered species ' habitat. Large portions of Subject Property 2 are within an "A" 100 year floodplain, with an undetermined minimum base flood elevation requirement . i Subject Property 3 Located adjacent to the Indian River Lagoon and its estuarine wetlands, Subject Property 3 consists of inactive citrus groves and jurisdictional wetlands. The property is within an "AE" 100 year floodplain, with a minimum base flood elevation requirement of eight feet NGVD . Subject Property 4 Subject Property 4 consists of dense pine flatwoods, a native upland habitat. According to Flood Insurance Rating Maps, the site is located outside of a flood hazard area. I tilities and Services Subject Property 1 Located outside of the county' s urban service area, neither water nor wastewater lines extend to the site. Subject Property 2 Located outside of the county' s urban service area, neither water nor wastewater lines extend to the site. Subject Property 3 Currently, neither water nor sewer lines extend to the site. County plans, however, call for both water and wastewater lines to extend along Jungle Trail to the site by May 2001 . The water lines will connect to the North County Water Plant, while wastewater lines will connect to the North County Wastewater Treatment Plant. DECEMBER 59 2000 BK 1 16 PG 277 - 35 = Subject Property 4 Water lines extend along 58`h Avenue to Subject Property 4 from the North County Water Plant, while wastewater lines extend to the site from the Central County Wastewater Treatment Plant. Transportation system Subject Property 1 Subject Property 1 can be accessed from CR 512, a twalane road with approximately 80 feet of public road right-of--way. The segment of CR 512 adjacent to Subject Property 1 is classified as a rural major collector road on the future roadway thoroughfare plan map. No improvements to this section of CR 512 are currently programmed. Subject Property 2 Subject Property 2 can be accessed from 130`h Avenue which is a twalane unpaved road with approximately 40 feet of public road right-of-way. Currently, there are no plans to expand this portion of 130d' Avenue, Subject Property 3 Jungle Trail borders Subject Property 3 on the east and provides the only automobile access to the site. A two-lane unpaved local road, Jungle Trail has been designated by the county as an historic and scenic road with special building setbacks and vegetation protection areas along its entire length. The public road right-of--way for the segment of Jungle Trail abutting Subject Property 3 ranges from 15 feet to 20 feet. Subject Property 4 Subject Property 4 abuts 58`h Avenue, a two-lane paved road with approximately 80 feet of public road right-of--way. This segment of 58`h Avenue is classified as an urban principal arterial road on the future roadway thoroughfare plan map and is programmed to expand to 130 feet of public road right-o &way by 2020 . ANAs MS In this section, an analysis of the reasonableness of the application will be presented. Specifically, this section will include the following: • an analysis of the request ' s impact on public facilities ; • an analysis of the request' s compatibility with surrounding areas ; • an analysis of the request' s consistency with the comprehensive plan; and • an analysis of the request' s potential impact on environmental quality. Concurrency of Public Facilities Only Subject Properties 3 and 4 are located within the County Urban Service Area, an area deemed suited for urban scale development. The comprehensive plan establishes standards for: Transportation, Potable Water, Wastewater, Solid Waste, Stormwater Management, and Recreation (Future Land Use Policy 3 . 1 ) . The adequate provision of these services is necessary to ensure the continued quality of life enjoyed by the community. To ensure that the minimum acceptable standards for these services and facilities are maintained, the comprehensive plan requires that new development be reviewed. For rezoning requests, this review is undertaken as part of the conditional concurrency determination application process . DECEMBER 59 2000 BK 1 16 PG 2 7 8 - 36 - i 1 As per section 910. 07(2) of the Concurrency Management Chapter of the County' s Land Development Regulations, projects which do not increase land use density or intensity are exempt from concurrency requirements. For the subject request, ± 1 , 799 .4 acres of A- 1 zoned land, ±6,909 acres of A-2 zoned land, and ±20 acres of RS-3 zoned land, with a total development potential of ± 1 , 1 l l units will be replaced with ±8 ,713 .4 acres of Con4 zoned land. Since Con- 1 zoned property has zero density, the proposed rezoning will result in a decrease of ± 1 , 111 units in the overall development potential of the subject properties. Because of that overall decrease in land use intensity of ± 1 , 1 l l units, this rezoning request is exempt from concurrency review . It is important to note that adoption of the proposed rezoning will not impact any public facilities or services. romp2tibility with the Surrounding Area Under the requested Con4 zoning district, there will be no development on the subject properties except for minor facilities associated with passive recreation activities . For that reason, the subject request will enhance compatibility between the sites and surrounding land uses. In contrast to the ± 1 , 1 l l units allowed under the sites ' existing zoning districts, development under the requested zoning district will be limited to conservation uses and passive recreational uses. In terms of traffic, noise, and aesthetics, the impacts associated with uses allowed under the proposed Con- 1 zoning district will be significantly less than those that would occur with development under the existing zoning districts. In fact, the passive recreational uses allowed under the requested zoning district will serve as an amenity for nearby residential uses. Additionally, because Subject Properties 1 , 2, and 3 are located adjacent to existing conservation areas, the request works to enhance the environmental quality of those areas . For these reasons, staff has determined that the proposed rezoning is compatible with the surrounding area. Consistency with the Comprehensive Plan Rezoning requests are reviewed for consistency with all policies of the comprehensive plan. Rezonings must also be consistent with the overall designation of land uses as depicted on the Future Land Use Map, which include agriculture, residential, recreation, conservation, and commercial and industrial land uses and their densities. Commercial and industrial land uses are located in nodes throughout the unincorporated areas of Indian River County. The goals, objectives and policies are the most important parts of the comprehensive plan. Policies are statements in the plan which identify actions which the county will take in order to direct the community's development. As courses of action committed to by the county, policies provide the basis for all county land development related decisions--including rezoning decisions. While all comprehensive plan objectives and policies are important, some have more applicability than others in reviewing rezoning requests. Of particular applicability for this request are the following policies. DECEMBER 59 2000 6K 1 16 PG 279 - 37 - i I Future Land Use Element Policies 1 .6 and 1 .41 Future Land Use Element Policy 1 .6 limits the C- 1 land use designation to publicly owned land with conservation and/or limited passive recreational uses. Since the Con- 1 zoning district is also limited to publicly owned land with conservation and/or limited passive recreational uses, the Con- 1 zoning district is consistent with, and allowed on, C4 designated land. In fact, Future Land Use Element Policy 1 .41 specifically establishes that G1 designated land can only be zoned Con- 1 . To ensure that the subject properties are not rezoned to Con4 until the land use amendment redesignating the subject properties to C4 is in effect, the rezoning ordinance contains a special provision. That provision establishes that the rezoning ordinance cannot become effective until the sites have been redesignated to C- 1 . For these reasons, the request is consistent with Future Land Use Element Policies 1 .6 and 1 .41 . As part of the staff analysis, all policies in the comprehensive plan were considered. Based upon that analysis, staff determined that the proposed rezoning is consistent with the comprehensive plan. Potential Impact on FnAronmental Quality The sites ' existing zoning districts offer only limited environmental protections. Development of residentially zoned land would be required to preserve only 10 or 15 percent of the upland habitat of the sites. Being exempt from the upland preservation requirement, agricultural development of agriculturally zoned land could result in the removal of all upland habitat on site. In contrast, under the proposed zoning district, the entire area of each site will be preserved, and development will be limited to conservation and compatible passive recreational uses. Although the sites are publicly owned and could be developed as public parks under the existing zoning districts, the proposed zoning district provides the sites with additional protection from development. By prohibiting most types of development on the sites, the proposed request will ensure that the environmental quality of the sites will be preserved. For these reasons, the proposed rezoning is anticipated to positively impact the environmental quality of the subject properties . CONCLUSION Based on the analysis, staff has determined that the proposed rezoning is consistent with the comprehensive plan, compatible with all surrounding land uses, and will cause no adverse impacts on the provision of public services. The proposed changes will ensure the preservation of environmentally sensitive and important habitat. For these reasons, staff supports the request. 12F. COMMFNDATTON Based on the analysis, staff and the Planning and Zoning Commission recommend that the Board of County Commissioners rezone the subject properties to Con4 by adopting the attached rezoning ordinance. PUBLIC DISCUSSION ITEM - KEVIN DOTY - DISCUSSION OF CORPS OF ENGINEERS PROJECT AT BLUE CYPRESS LAKE (MIDDLETON) The Board reviewed a Memorandum of November 22 , 2000 : To . Adams Date : November 22 , 2000 Subject: Public Discussion Item by Kevin Doty Mr. Doty will discuss the Corps of Engineers Project at Blue Cypress Lake . Kevin Doty , Attorney, 1701 Highway AIA, representing Mr . and Mrs . Middleton , stated that he is here to ask for the County ' s help with a letter to the Corps of Engineers expressing concern over the delays in the project which are negatively affecting his clients ' business . The project will be wonderful in the end but construction was supposed to start during the summer and we are now into the Middletons ' busy season and the delay is seriously affecting their business at the lake . The contractor has already received at least one 30-day extension and he believed a letter from the County expressing concern and requesting that no more extensions be granted would be helpful . None of his comments and no comments by his clients are directed at the County . County staff has been a delight to work with . DECEMBER 5 , 2000 BK 1 16 PG 2 9 9 - 57 - Chairman Adams noted that Commissioner Tippin had originally met with the Corps of Engineers and the Middletons and the Corps explained that bids did not go out until June . They had promised that the ramp would be opened by Thanksgiving . Public Works Director Jim Davis went out there with a representative from St. Johns Water Management District to help them get the project moving . The County did the early part of the project for them and the contractor and the Corps have failed in getting the project done in a timely manner . They are insensitive to our area and hired a contractor from Miami . They have almost put the Middletons out of business and they have been there almost longer than the lake . We feel helpless and would love to finish the project for them . They are now bringing gravel all the way from Miami . Mr . Doty inquired whether it would be all right for the County to ask Jim Davis to take over the project . Commissioner Tippin commented that it took an Act of Congress to get the project started and dealing with this bureaucracy is worse than dealing with the FEC . He strongly suggested that the Chairman write a missive to all involved in the project . Chairman Adams felt that we need to involve our Congressman at this point . She did not know what else we can do, especially in light of the fact that they replaced a boat ramp that the County had just built . After general discussion , CONSENSUS was reached to write a letter and arrange a meeting with all involved to attempt to get some progress on the project . Public Works Director Jim Davis stated that he had visited the project and spoken with the contractors and with Mr . Middleton . They are scheduled to pour the concrete for the boat ramp and the materials have arrived . They are advising that this phase will be finished and opened and then they will go to the area around the bait store . Smith, Telecommunications Manager Department of General Services Subject: Replacement of ESSX contract with CENTREX contract BACKGROUND : On February 13 , 1996 Indian River County Board of County Commissioners agreed to a 60 month extension contract with BellSouth for the provision of ESSX service. ESSX, which was BellSouth' s Brand Name for CENTREX, was being replaced by a new product named MULTI-SERV ; the 1996 contract was Indian River County' s last opportunity to extend the more favorable ESSX service. In March of 2000, BellSouth tariffed a new CENTREX offering as a replacement for the grandfathered ESSX contracts and the MULTI-SERV contracts enacted since 19% . The new CENTREX offering is basically the same product with basically the same features as our existing ESSX service, but the way it is bundled and priced is different. DECEMBER 5 , 2000 BK 1 16 PG 305 -63 - ANALYSIS : Indian River County now has a little over 500 ESSX stations. ESSX is usually the service of choice when voice circuits are added because an ESSX station costs the County an average of less than $20 per station for a typical voice application as compared to $34.30 for a normal business line. In those locations where there is a large concentration of telephone usage (e.g. the County Administration Building, the Courthouse, the Sheriffs Office) it makes sense to install a PBX (Private Branch Exchange) or some other type of telephone system. In smaller offices (e.g. fire stations, branch Utility offices, etc.), it generally is more economical to install ESSX. With ESSX, the user gets not only the lowest cost dial tone available, but also PBX-like features such as call pickup, call forwarding, three-way calling, abbreviated dialing to other ESSX stations, etc. i If Indian River County agrees to a new 5-year contract for the CENTREX service, and makes no changes in deployment strategy, our monthly costs will increase from $ 12, 149. 83 to $ 12,629.92. If, however, we convert some of our existing regular business lines to CENTREX, we will actually reduce our monthly billing. One of the bonuses of the new CENTREX offering is the inclusion of up to 30 custom features at one low price rather than a charge for each feature that is added to a line under the ESSX contract. Another new offering is CENTREX CONTROL, a GUI (Graphical User interface) based program for customer control of feature deployment. With this package, Indian River County could do most of the programming of the lines and eliminate some of the service order charges that we generally incur throughout the year as we have to make changes to existing ESSX stations. This would greatly enhance our flexibility in customizing our communications network. Under CENTREX, many of the features that we would have liked but did not get because of the additional cost , such as CALLER-ID, will now be included. Indian River County only has ESSX service in the area served by BellSouth's Vero—Main Central Office. Although we could have instituted ESSX in the Sebastian, Beachland, and Fellsmere Central Offices, we did not have enough telephone stations to justify the cost. Under the current CENTREX offering, for a limited time. installation charges are waived for activation in these additional Central Offices, and it would now be economically advisable to initiate CENTREX in Sebastian, Beachland (Vero Beach Exchange on barrier island), and Fellsmere. BellSouth is also waiving 5 months of the common equipment charges for the Vero-Main conversion. Depending on the final deployment strategy, Indian River County could save as much as $2,000 per year based on current usage. There may be some regular business tines that we do not want to change to CENTREX; this would have to be determined departmentally. No other solution appears to warrant consideration since the circuit cost of all alternatives known to Staff are higher than CENTREX and would generally require large expenditures for new equipment. RECOMMENDATION : Staff recommends that the Board authorize the Chairman to sign the attached agreements for the provision of services from BellSouth under the CENTREX offering. BACKGROUND INFORMATION: On October 10, 2000, the Board of County Commissioners authorized the Request for Qualifications (RFQ-3027) for architectural services for the Health Department Building expansion to accommodate expanded dental services. Accordingly, the RFQ was published in the Press Journal on October 26 and November 2, 2000. In addition, DemandStar. com broadcast the RFQ commencing on October 27, 2000 and was received by 351 vendors. In response to these solicitations, seventeen vendors contacted the Purchasing Division and requested or picked up copies of the RFQ . Subsequently, on Friday November 17, 2000, the deadline for submitting responses, only one response was submitted . That response was from the Vero Beach firm, Edlund & Dritenbas Architects, P. A. RECOMMENDATION : Since there is only one firm that responded, there is no way to prepare a shortlist of three firms from which to negotiate an agreement for the requested design. In light of the need to move forward with this project, it is recommended that Edlund & Dritenbas be selected as the firm with which to negotiate an agreement for the need expansion design . Upon successful negotiations, a proposed agreement shall be brought back to the Board for its consideration. A drainage retention parcel is needed at the southwest comer of 58°i Avenue and 5'" Street SW in conjunction with the 58h Avenue , Phase II Improvement Project. The owner has executed a Developer's Agreement through which the 1 . 5 acre parcel can be acquired by the County. The developer would be allowed to join and expand the pond at a later date when the remainder site is developed , if desired . This request was presented to the Board on September 19 , 2000 , and was approved without a reverter clause then contained in the agreement. The agreement has been revised , deleting the reverter clause from item #2 . At the request of Laurel Builders , however, two statements have been added to item #3 , wich address repairs in case the grove irrigation is damaged , and compliance with State Citrus Canker Regulations. At the suggestion of Will Collins , we also added one statement to item #7 which requires Laurel Builders to give the County a permanent drainage easement in the event the property is re-conveyed to Laurel through the option given in item #6 . The purchase price of the AA zoned land is $27 , 000 . 00 , or $ 18 ,000 .00 per acre . This price-per-acre is comparable to other similar parcels the County has acquired based upon appraisals or evaluations . There are no appraisal or attorney fees in the subject' s case . DECEMBER 5 , 2000 BK 1 16 PG 309 - 67 - In addition to compensation for the land , the Developer is requiring that the County construct two median openings along the half mile frontage of Kings Highway between Oslo Road and 5"' Street SW. On the remainder of the project, only one median opening will be constructed on the half mile stretch between east-west side streets. This Developer's Agreement with Laurel Homes is one of seven (7) acquisitions remaining on the Kings Highway project. Including the Laurel Builders property, four parcels are still needed for road right-of-way, two are needed for both road right-of--way and stormwater ponds , and one (Laurel ) is needed for a stormwater pond . AND STAFFED ENVIRONMENTAL ENGINEER BY : DEPARTMENT OF UTILITY SERVICES SUBJECT: ST, JOHNS RIVER WATER MANAGEMENT DISTRICT ALTERNATIVE WATER SUPPLY GRANT APPLICATION FOR REDUCTION OF REVERSE OSMOSIS CONCENTRATE INTO THE INDIAN RIVER LAGOON BACKGROUND Reverse Osmosis (R.0) Treatment Facilities cleanse water by separating dissolved minerals and other undesirable particles from the deep ground (Floridan Aquifer) water through the use of filtering membranes. The reject water, or "concentrate" is then discharged as non-Publicly-Owned- Treatment-Works (POTW) industrial wastewater into the Indian River Lagoon. The Department of Environmental Protection (DEP) has put increasing pressure on permittees of R.O. Treatment Facilities to eliminate concentrate discharge into the Lagoon, which is classified as an Outstanding Florida Water (OFW). Presently, the Department of Utility Services has two ILO. facilities with concentrate discharges into the Lagoon, one directly into the OFW. On December 7, 1999 the Board of County Commissioner; authorized the County' s water treatment continuing services consultant Camp Dresser and McKee, Inc. (CDM) to develop alternatives for disposal of R.O. concentrate. The report was presented to the County' s Utility Advisory Committee on June 1 `, 2000 and has since been finalized (see attached exerpts). Each year St. Johns River Water Management District (SJRWMD) allocates funds appropriated by the federal government to assist public and private entities to develop ways of providing alternative water supplies for various uses. In 1997 and 1998, Indian River County was successful in obtaining $75,000.00 and $ 100,000.00, respectively, to help fund construction of the North County R. O. Facility (NCRO). This year SJRWMD has $500,000.00 available for funding alternative water sources throughout their district. The Departmentof Utility Services is exploring several altematives outlined in CDM ' s report, a new R.O. membrane process that will reduce the amount of concentrate discharge from the NCRO, mixing a portion of the concentrate with reclaimed water and using another portion to produce liquid chlorine bleach for disinfecting wastewater. The Department of Utility Services is requesting the Board Of County Commissioners to authorize applying for the grant, with a tentative commitment of matching funds to implement the pilot project. ANALYSIS Grant applications will be submitted to SJRWMD for two projects. One project will involve supplementing reclaimed water with concentrate for irrigation purposes . The second project will comprise adding 'a third stage to the R. O. process to extract additional potable water and reduce the quantity of concentrate discharged to the OFW (see attached grant applications). DECEMBER 59 2000 BK 1 16 PG 315 - 73 - The concentrate discharge from the R.O. process will be routed to the North Regional Wastewater Treatment Facility (NRWWTF). A portion will be mixed with reuse water and supplied to golf courses for irrigation. Implementation of this use could reduce the concentrate discharge into the Lagoon by 37,000 gpd (from 750,000 gpd to 713 ,000 gpd), or 5%, adding to the irrigation quality water available. Implementation of the third stage membrane will be conducted in two phases. The first phase will involve setting up a pilot plant to determine the appropriate type of membrane to optimize the amount of potable water recovery. Another portion of the concentrate will be routed through the pilot plant. Based on discussion with various membrane consultants, it may be feasible to recover an additional 10% of permeate (from 80% to 90% plant efficiency), which would reduce the volume of concentrate by 50%. The pilot plant will be constructed in a mobile unit and located at NRWWTF for the study. The mobile unit will allow for the pilot plant to be relocated to other facilities in the future. - Successful implementation of the third stage membrane process could result in approximately 441 ,000 (based on a 15% blend ratio) gallons per day (gpd) of additional potable water produced. Furthermore, this could reduce the amount of concentrate discharged into the Indian River Lagoon by 375,000 gpd. The concentration of the brine discharged into the river will be twice as high as what is presently being discharged. The modified discharge into the river will have to be permitted by the DEP. Implementation of the full scale, third stage membrane process at NCRO is estimated to cost $ 1 .2 million. Staff anticipates that it will take approximately one year to evaluate the data to determine if the full scale, third stage is feasible. At that time staff may request approval to apply for another grant and proceed with the project. Implementation of the pilot to convert concentrate to liquid bleach for disinfection will be pursued next grant cycle depending on the success of the 3'd Stage membrane pilot. With this delay comes the danger that some of these lots will be developed or at least cleared. I have attached a copy of a newspaper article where a clearing has occurred. On Friday, I met with Joe Baird, Bob Keating, and Roland De Blois, to see if it would be possible for the County Commissioners to assist the Pelican Island Elementary ECHO Troop by providing a short term loan to be reimbursed from the USFWS grant expected early next year. This loan would only be used to option the remaining lots and an interlocal agreement would be necessary with the School Board concerning the reimbursement. The discussion of these lots and the interlocal agreement has been placed on the School Board agenda for December 12th. Roland will be available to go over the details with us at Tuesday' s meeting.
