PROCLAMATIONS AND PRESENTATIONS PROCLAMATION DESIGNATING THE MONTH OF APRIL, 2002 AS NATIONAL CHILD ABUSE PREVENTION MONTH IN INDIAN RIVER COUNTY (EXCHANGE CLUB CENTER FOR THE PREVENTION OF CHILD ABUSE OF THE TREASURE COAST, INC. [CASTLE]) The Chairman presented the following Proclamation to Jacqueline Isles who accepted on behalf of the Exchange Club: APRIL 2, 2002 -2- • PROCLAMATION DESIGNATING THE MONTH OF APRIL, 2002 AS NATIONAL CHILD ABUSE PREVENTION MONTH IN INDIAN RIVER COUNTY WHEREAS, child abuse is a serious and growing problem affecting over 3,620 children on the Treasure Coast, 75,000 children in the state of Florida annually, and more than 3.2 million nationally, including more than 1,000 abuse -related tragic fatalities; and WHEREAS, this societal malignancy known as child abuse respects no racial, religious, class or geographic boundaries and, in fact, has been declared a national emergency; and WHEREAS, every child deserves to live in a safe. permanent and caring family, knowing that children from stable, healthy home environments are better prepared for school, have a significantly better academic future and are less likely to become involved in drugs and crime; and WHEREAS, the CASTLE of the Treasure Coast, incorporated in 1981 as the Exchange Club Center for the Prevention of Child Abuse of the Treasure Coast, Inc., was the first center in the country created for the sole purpose of bringing awareness to, and breaking the cycle of, child abuse, qnd has become the model for a network of over 100 such agencies throughout 27 states, all working win the battle against the devastating pain and lifelong results of child abuse; and WHEREAS, the CASTLE (which stands for Child Abuse Services, Training and Life Enrichment) through its support of parent aide programs, parenting classes, educational programs and community service activities is making significant progress in stopping this crime against families and children. NOW, THEREFORE, BE IT PROCLAIMED BY THE INDIAN RIVER COUNTY BOARD OF COUNTY COMMISSIONERS that the month of April, 2002, be designated as NATIONAL CHILD ABUSE PREVENTION MONTH in Indian River County, and all citizens are urged to use this time to reflect upon, better understand, recognize and respond to this grievous crime against defenseless children. DESCRIPTION AND CONDITIONS Consistent with state requirements, Indian River County prepared and adopted its Local Housing Assistance Plan (LHAPlan) in 1993. The LHAPlan not only qualified the county to receive State Housing Initiatives Program (SHIP) funds, but also has served as the policy and procedural guide for administering the SHIP program. At this time, staff is proposing minor changes to the county's LHAPlan. One change will enhance the use of SHIP funds as a match for Community Development Block Grant applications generally and the Gifford Housing CDBG application specifically. The other proposed amendment is a minor change to incorporate a state monitoring requirement for SHIP rental rehabilitation projects. Since June of 1993, the county has provided 518 SHIP loans to individual applicants who applied for assistance. According to state rules and regulations, as well as the county's requirements, SHIP APRIL 2, 2002 -26- Ei 1(fin q— J.i funds may also be used to supplement or match other state and federal funds On October 23, 2001, the Board of County Commissioners authorized Community Development Department staff to apply for a Housing Rehabilitation Community Development Block Grant (CDBG) for the east Gifford area. As part of the CDBG application, there is a need for a local contribution. According to applicable regulations, SHIP funds may be used as a CDBG program match and considered as a local contribution. ANALYSIS One of the goals of the county's local housing assistance plan is to maintain the county's existing affordable housing stock and to repair substandard housing units. A source of funds for those activities is the county's SHIP rehabilitation assistance program. Another source of funding is the CDBG program. The CDBG program however, involves a competitive application process. In order for the county to receive funding, the county must maximize its application points. Using up to $350,000 of the SHIP rehabilitation funds from FY 2002-03 and FY 2003-04 as a match for the Gifford. Housing CDBG application will provide the county's CDBG application with additional points. Currently, the county's SHIP rehabilitation loans are available to both very low and low income households. Although deferred, these loans must be paid back when the assisted unit is sold. SHIP Rehabilitation grants, however are currently available only to very low income households. A rehabilitation grant must be paid back if the assisted unit is sold less than 10 years from the date the grant is closed. After 10 years, the grant will be forgiven. At this time, staff proposes to change the county's LHAPIan to allow SHIP rehabilitation grants to be provided to low income households, but only when the SHIP rehabilitation grant is a match for another housing program such as CDBG. Staff feels that more Gifford residents will be willing to participate in the CDBG program if the SHIP assistance is in the foam of grants. Another proposed change to the LHAPlan is a minor clean-up amendment to the plan to make it clear that, consistent with state requirements, all rental assisted units must be monitored for 15 years to ensure rent affordability and income eligibility for households occupying their units. Revisions to the plan are shown on pages 29 and 30 of the plan (copy attached). Deletions are shown as etruck thru and additions are shown as underlined. ALTERNATIVES With respect to the revised Local Housing Assistance Plan, the Board of County Commissioners has three alternatives. These are: adopt the revised plan adopt the revised plan with changes reject the revised plan Staff supports the first alternative. Staff also recommends that the Board of County Commissioners set aside up to $350 000 of SHIP funds from FY 2002-03 and 2003-04 as a match for the county's CDBG application. ATTACHMENTS Adoption Resolution (including revised pages 29 and 30 of the LHAPIan) Commissioner Ginn asked for an explanation of Item B(3) on Page 42 of the backup, and Community Development Director Bob Keating noted that most of the assistance provided under SHIP funds is for downpayment loans with deferred payments. However, the regulations allow for providing rehabilitation loans and grants for persons with very low incomes. Several months ago the Board approved a Community Development Block Grant (CDBG) for housing rehabilitation in the Gifford area. In order the maximize the points earned, SHIP funds are used as matching funds to be given as a grant rather than a loan because of the reluctance of residents to apply for loans. Affordable Classification Timeframe Housing units whose owners receive funds from the IRCLHAProgram Rehabilitation Grant Strategy Program shall be occupied by the same qualified eligible household who received the assistance for a period of not less than ten years (10) years. The grant will continue to be funded 75% from the state and 25% from the county. The budgetary impact on the county will not exceed 553,108.00. Staff has requested all matching funds for the 2002/2003 fiscal year to be made by the grant applicants rather than the Board of County Commissioners. The Board of County Commissioners would have to match the Substance Abuse Council portion since the grant requirement recommended that the Board of County Comrrussioners set up the council to administer the grant. Additionally, the Board of County Commissioners will provide the match for the Multi -Agency Drug Enforcement Unit (M A C E) grants, since MACE is comprised of local governmental entities. The facility has been given approval and is operating under the Florida Department of Environmental Protection (FDEP) permit, in compliance with Florida Administrative Code, Chapter 62-640, to properly treat and dispose of domestic wastewater. The Customer shall provide all transportation of residuals, and will be charged the prevailing rates as shown on the Schedule of Water and Sewer Rates, Fees, and Charges, and attached to the Agreement. Staff has made the changes it was directed to make and the Board is now to adopt the revised ordinance (see attachment 42) and teznzinate the moratonum. ANALYSIS In accordance with the Board's direction at the March 19, 2002 hearing, the following ordinance revisions have been made: 1) The citation in ordinance Section 3(b)(7) has been corrected to read 971.44W (see page 17 of the revised ordinance) 2) The requirement for surrounding property owner mailed notice now specifies that county staff will mail the notice (see page 28 of the proposed ordinance). 3) The provision that allows attached .facilities on pre-existing buildings and structures now specifies that attachments can be made to industrial, hotel, multi- family, institutional, and public buildings and facilities as well as commerciaUindustrial buildings (see pages 32 and 33 of the revised ordinance). Thus, the interim ordinance has been revised and is ready for adoption. Along with adoption of the ordinance, the moratorium needs to be tezminated to allow applications to be submitted and processed under the new ordinance. As previously discussed, in upcoming months the Board will review and adopt a wireless master plan and then adopt a "final" wireless facilities ordinance. The final ordinance will allow for further adjustments to the subject interim ordinance, including a requirement that applicants use "state of the art" and "least obtrusive" technology for new facilities. RECOMMENDATION Staff recommends that the Board of County Commissioners: 1) Adopt the attached wireless telecommunications facilities revised ordinance, and 2) Teuzzinate the moratorium on applications for new towers and related facilities to allow submittal and processing of applications under the new ordinance. Planning Director Stan Boling stated that this is an interim ordinance which can be revised after adoption of the Wireless Master Plan. The purpose and intent of these regulations are to: (a) Promote the health safety and general welfare of the public by regulating the siting of wireless communication facilities, including satellite earth stations; and (b) Minimize the impacts of wireless communication facilities on surrounding areas by establishing standards for location, structural integrity and compatibility: and (c) Encourage the location and collocation of wireless communication equipment on existing structures thereby minimizing new visual, aesthetic and public safety impacts, effects upon the natural environment and wildlife, and to reduce the need for additional antenna -supporting structures. and (d) Accommodate the _growing need and demand for wireless communication services; and (e) Encourage coordination between suppliers of wireless communication services in Indian River County; and (0 Respond to the policies embodied in the Telecommunications Act of 1996 in such a manner as not to unreasonably discriminate between providers of functionally equivalent personal wireless service or to prohibit or have the effect of prohibiting personal wireless service in the County, and Ig) Establish predictable and balanced regulations governing the construction and location of wireless communications facilities, within the confines of permissible local regulation, and APRIL 2, 2002 (h) Establish review procedures to ensure that applications for wireless communications facilities are reviewed and acted upon within a reasonable period of time. The ro'ection based u on a • • • -56- o=� (G-3) Geographic Search Area means an area designated by a wireless provider or operator for a new base station facility, produced in accordance with generally accepted principles of wireless engineering. (1I--1) Horizontal Zone means an area longitudinally centered on the perimeter of a private airport's runway that extends outward from the edge of the primary surface a distance equivalent to five thousand two hundred and eighty (5,280) feet. (L-1) Lattice means a style of antenna -supporting structure that consists of vertical and horizontal supports with multiple legs and cross -bracing, and metal crossed strips or bars to support antennas. (M-1) Monopole means a style of free-standing antenna -supporting structure that is composed of a single shaft usually composed of two or more hollow sections that are in turn attached to a foundation. This type of antenna - supporting structure is designed to support itself without the use of guy wires or other stabilization devices. These structures are mounted to a foundation that rests on or in the ground or on a building's roof. (P-1) Personal Wireless Service means commercial mobile services, unlicensed wireless services, and common carrier wireless exchange access services as defined in the Telecommunications Act of 1996. (P-2) Primary Surface means the area extending a distance of fifty (50) feet to both sides of the centerline of a private airport's runway, and running the distance of the runway. (P-3) Public Antenna -Supporting Structure means an antenna -supporting structure, appurtenances, equipment enclosures, and all associated ancillary structures used by a public body or public utility for the purposes of transmission and/or reception of wireless communication signals associated with but not limited to• public education, parks and recreation, fire and police protection, public works, and general government. (R-1) Radio Frequency Emissions means any electromagnetic radiation or other communications signal emitted from an antenna or antenna -related equipment on the ground, antenna -supporting structure, building, or other vertical projection. (R-2) Replacement means the construction of a new antenna -supporting structure built to replace an existing antenna -supporting structure. (S -I) Satellite Earth Station means a single or group of satellite parabolic (or dish) antennas. These dishes are mounted to a supporting device that may be a pole or truss assembly attached to a foundation in the ground, or in some other configuration. A satellite earth station may include the associated separate equipment enclosures necessary for the transmission or reception of wireless communications signals with satellites. (S-2) Stealth Wireless Communications Facility means a wireless communications facility, ancillary structure, or equipment enclosure that is not readily identifiable as such and is designed to blend into its surroundings and be aesthetically compatible with existing and proposed uses on a site and the surrounding_ area A stealth facility may have a secondary function;. Examples of stealth facilities include, but are not limited to the following: church steeple, bell tower, spire, clock tower, cupola light standard, flagpole with a flag, or tree APRIL 2, 2002 (W-1) Wireless Communications means any personal wireless service, which includes but is not limited to, cellular, personal communication services (PCS) specialized mobile radio (SMR), enhanced specialized mobile radio (ESMR) andpaging rvzretess communication Facility (WCF) means any staffed or unstaffed commercial facility for the transmission and/or reception of radio frequency signals or other wireless communications, and usually consisting of an antenna or group of antennas, transmission cables, and equipment enclosures, and may include an antenna -supporting structure The following developments shall be considered as a Wireless Communication Facility: developments containing new or existing antenna -supporting structures, public antenna -supporting strictures, replacement antenna -supporting structures, collocations on existing antenna -supporting structures, attached wireless communications facilities, stealth wireless communication facilities, and satellite earth stations. Sec. 3 Applicability. (a) Except as provided for in subsection (b) below, this section shall apply to development activities including installation, construction, or modification to the following wireless communications facilities: (1) Existing antenna -supporting structures; and (2) Proposed antenna -supporting structures; and (3) Public antenna -supporting structures; and (4) Replacement of existing antenna -supporting structures; and (5) Colocation on existing antenna -supporting structures; and (6) Attached wireless communications facilities; and (7) Stealth wireless communications facilities; and (b) The following items are exempt from the provisions of this section [971.44(5)], notwithstanding any other provisions contained in land use regulations of Indian River County: (1) Amateur radio antenna supporting strictures and antennas as provided in Florida Statutes 125.561 (2) Satellite earth stations that are two (2) meters or less in diameter and which are not greater than thirty-five (35) feet above grade; and (3) Regular maintenance of any existing wireless communications facility that does not include the placement of a new wireless communications facility; and (4) The substitution or change of existing antennas or antenna panels or other equipment on an existing antenna -supporting structure provided the substituted antennas or equipment meet building code requirements APRIL 2, 2002 (including windloading) and provided such change does not increase the overall height of the stricture; and (5) Any existing or proposed antenna -supporting structure, antenna or antenna arrays -with an overall height of thirty-five (35) feet or less above ground level in non-commercial or non -industrial zoning districts or seventy (70) feet or less above ground level in commercial or industrial zoning districts; and A government-owned wireless communications facility, upon the communications declaration of a state of emergency by federal, state, or such local as government, and a written determination of public necessity by the Director of are Public by Safety: except that such facility must comply with all Commissions and federal in accordance and state requirements. Sec. 5. Development Standards. These standards shall apply to the following types of Wireless Communications Facilities: (a) New Non -stealth Antenna Supporting Structures. (1) Approval criteria for new antenna -supporting structures: a. Setbacks. 1. Any new antenna -supporting structures, equipment enclosures and ancillary stnictures shall meet the minimum setback requirements for the land use district where they are located, except that where the minimum setback distance for an antenna supporting structure from any property line is less than the height of the proposed antenna -supporting structure, the minimum setback distance shall be increased to equal the height of the proposed antenna supporting structure., unless the antenna -supporting structure ;has been constructed using "breakpoint" design technology, in which case the minimum setback distance shall be equal to 110% of the distance from the top of the structure to the "breakpoint" level of the structure. For example, on a 150 foot tall monopole with a "breakpoint" at 100 feet, the minimum setback distance would be 55 feet (110% of 50 feet, the distance from the top of the monopole to the "breakpoint". However, in all instances, the minimum setback distance from any occupied residence shall be at least 300% of the height of the entire proposed structure. Certification by a Florida professional engineer of the "breakpoint 'design and the design's fall radius must he provided together with the other information required herein from an applicant except for one vertical structure less than 4 inches in diameter which extend no more than ten (10) feet above the antenna support structure, antenna, and antenna array and matches the color of the antenna and support structure. APRIL 2, 2002 The overall height of any antenna -supporting structure, antenna and/or antenna array, excluding those related to amateur radio, shall not be greater than one -hundred and fifty (150) feet. Height for all purposes in this Section shall mean the linear distance from the ground to the highest physical point on the Wireless Communications Facility except for one vertical structure less than 4 inches in diameter which extend no more than ten (10) feet above the antenna support structure, antenna, and antenna array and matches the color of the antenna and support structure. APRIL 2, 2002 c. Construction. New antenna -supporting structures shall have a monopole type construction only, and shall not be guyed or have a lattice type construction. d. Structural Integrity. 1. The entire antenna -supporting structure and all appurtenances shall be designed pursuant to the wind speed design requirements of ASCE 7-95, including any subsequent modification to those specifications; and applicable building code requirements; and 2. The new antenna -supporting structure shall be designed to accommodate the maximum amount of wireless communications equipment, including that of other wireless communication service providers. The exact amount of potential additional equipment to be accommodated shall be agreed upon during a pre - application conference and recorded in the Letter of Understanding resulting from the conference In all cases, the minimum number of collocated facilities on a new antenna -supporting structure between 80 and 119 feet tall shall be two (2), and for a structure between 120 and 150 feet tall shall be three (3). Lighting. New antenna -supporting structures shall be illuminated in accordance with FAA requirements to provide aircraft obstruction lighting, where required. Any such illumination shall be by red lighting unless otherwise directed by the FAA. Louvers or shields may be required by the county to keep lighting from shining down on surrounding properties. f. Colocation Feasibility. 1. No antenna -supporting structure shall be permitted unless the applicant demonstrates that no existing wireless communications facility can accommodate the appfcant's proposed facility; or that use of such exist'ng facilities would prohibit personal wireless services in the area of the County to be served by the proposed antenna -supporting structure. 2. Evidence submitted to demonstrate that no existing wireless communications facility could accommodate the applicant's proposed facility may consist of any of the following: APRIL 2, 2002 (i) No existing wireless communications facilities located within the geographic area meet the applicant's engineering requirements. The following attributes shall be considered from vantage points at adjacent properties, roadways and occupied structures: (i) Height and location; and (ii) Mass and scale; and (iii) Materials and color; and (iv) Illumination; and - (v) Existing and proposed vegetation and intervening structures. An applicant shall demonstrate through the photo - simulation requirements under Subsection (2)(i) hereinbelow that the project design employs each of these attributes in a manner that minimizes adverse effects to the greatest extent feasible to achieve the wireless service capabilities demonstrated to be necessary under subsection 5(a)(1 )n. (2) Submittal requirements for new non -stealth antenna supporting structure applications: APRIL 2, 2002 a. A completed application form and any appropriate fees; and b. Three (3) sets of signed and sealed site plans; and c. A property card for the subject property from the Indian River County Property Appraiser's Office or a tax bill showing the ownership of the subject parcel; and d. A form indicating that a property and/or antenna -supporting structure's owner's agent has authorization to act upon their behalf (if applicable); and e. A signed statement from the antenna -supporting structure's owner or owner's agent stating that the radio frequency emissions comply with FCC standards for such emissions; and f. Proof of an FCC license to transmit and/or receive radio signals in Indian River County; and g. Prior to issuance of a building permit, azo stamped or sealed structural analysis of the proposed antenna -supporting structure prepared by a licensed Florida engineer indicating the proposed and future loading capacity of the antenna -supporting structure - and New antenna -supporting structures shall be configured and located in a manner that shall minimize adverse effects including visual impacts on adjacent properties. The applicant shall demonstrate that alternative locations configurations, and facility types have been examined and shall address in narrative form the feasibility of any alternatives that may have fewer d averse effects on adjacent properties than the facility, configuration, and location proposed. 2. The following attributes shall be considered from vantage points at adjacent properties, roadways and occupied structures: (i) Height and location; and (ii) Mass and scale; and (iii) Materials and color; and (iv) Illumination; and - (v) Existing and proposed vegetation and intervening structures. An applicant shall demonstrate through the photo - simulation requirements under Subsection (2)(i) hereinbelow that the project design employs each of these attributes in a manner that minimizes adverse effects to the greatest extent feasible to achieve the wireless service capabilities demonstrated to be necessary under subsection 5(a)(1 )n. (2) Submittal requirements for new non -stealth antenna supporting structure applications: APRIL 2, 2002 a. A completed application form and any appropriate fees; and b. Three (3) sets of signed and sealed site plans; and c. A property card for the subject property from the Indian River County Property Appraiser's Office or a tax bill showing the ownership of the subject parcel; and d. A form indicating that a property and/or antenna -supporting structure's owner's agent has authorization to act upon their behalf (if applicable); and e. A signed statement from the antenna -supporting structure's owner or owner's agent stating that the radio frequency emissions comply with FCC standards for such emissions; and f. Proof of an FCC license to transmit and/or receive radio signals in Indian River County; and g. Prior to issuance of a building permit, azo stamped or sealed structural analysis of the proposed antenna -supporting structure prepared by a licensed Florida engineer indicating the proposed and future loading capacity of the antenna -supporting structure - and h. One original and two (2) copies of a survey of the property completed by a licensed Florida engineer which shows all existing uses, structures, and improvements; and i. Three (3) copies of a vegetation survey or Habitat Evaluation Index (HEI); and j• Photo -simulated post construction renderings of the proposed amenna-supponmg structure, equipment enclosures, and ancillary structures coverage of existing wireless as they would and that look after construction from to demonstrate radio locations to be determined during the area, coverage prediction, and design pre -application a certification conference (but shall, at a minimum include radiofrequency engineer that rendenngs the from the vantage point of any adjacent roadways and occupied commercial or residential structures), as well as photo - simulations of the antenna supporting structure after it has been fully developed with antenna structures (applicant may assume for the purpose of the simulation that other antenna structures on the facility will resemble their proposed structure in size and design), and k. Prior to issuance of a building permit, proof of FAA compliance with Subpart C of the Federal Aviation Regulations Part 77, Objects Affecting Navigable Airspace; and 1. A signed statement from the antenna -supporting structure owner agreeing to allow the colocation of other wireless equipment on the proposed antenna -supporting structure; and m. If required by the United States Fish and Wildlife Service a letter indicating that the proposed antenna -supporting structure and appurtenances are in compliance with all applicable federal rules and regulations; and n. Replacement antenna -supporting structures, antennas and/or antenna arrays shall not exceed the height requirements set forth in §5(a)(1)b. or 110% of the height of the antenna -supporting structure it is replacing, whichever is greater: d. Construction. Subject to the height provisions above: 1. Replacement antenna -supporting structures, antennas and/or antenna arrays with an overall height of one - hundred and seventy five (175) feet or less shall have a monopole type construction. 2. Replacement antenna -supporting structures with an overall height of greater than one -hundred and seventy five (175) feet, may be of the same construction type as the structure being replaced. APRIL 2, 2002 e. Landscaping. An average of one canopy tree (minimum height of twelve (12) feet with six-foot spread at time of planting) and two (2) understory trees (minimum height of eight (8) feet at tin -ie of planting) shall be provided for every thirty (30) feet of the tower base/accessory structures' opaque fenced perimeter. Credit shall be given for existing tree located between the tower base perimeter and adjacent , areas that are being buffered. The required trees shall be planted in a pattern to maximize screening of the base area of the tower from the view of adjacent road rights-of-way and adjacent residentially designated or residentially used properties, without conflicting with any guy wires. Trees credited or planted to meet this screening requirement shall be located on property under the control of the applicant to ensure that the screening trees are preserved and maintained. Shrubs and understory trees used to make the fencing opaque shall be planted on the outside fence perimeter. Alternative landscaping plans which provide for the same average canopy and understory trees but propose alternative siting on the parent tract of the proposed facility may be considered and approved by the Planning Director, provided the proposed alternative maximizes screening as provided above. (2) Submittal requirements for replacement antenna -supporting structure applications: a. For a proposed replacement antenna -supporting structure application to be considered complete, it shall contain the same submittal materials required as indicated in Section 5(a)(2) a. through i., k., 1. and n (1) through (4). (c) Colocations on an Existing Antenna -Supporting Structure. (1) Approval criteria for colocations on existing antenna -supporting structures: a. For a colocation on an existing antenna -supporting structure to be approved, it shall meet with approval cntena h. through j., and 1. as indicated in Section 5 (a) (1), as well as the following: b. Height. A colocation on an existing antenna -supporting structure shall not increase the overall height of the antenna - supporting structure, antenna and/or antenna array beyond that allowed under Section 5(a)(1)b. c. Structural Integrity. Any colocation on an existing antenna -supporting structure shall meet building code requirements (including windloading). (2) Submittal requirements for colocation on an existing antenna - supporting structure applications: APRIL 2, 2002 a. For a colocation on an existing antenna -supporting structure application to be considered complete, it shall contain submittal materials a. through f. and n.(1) through (4) as indicated in Section 5 (a) (2), as well as the following: 1. A stamped or sealed structural analysis of the existing antenna -supporting structure prepared by a licensed Florida engineer indicating that the existing antenna - supporting structure as well as all existing and proposed appurtenances meets building code requirements (including windloading) for the antenna -supporting structure. 2. A copy of the lease or sublease between the owner of the antenna -supporting structure and the applicant seeking to place additional wireless equipment on the structure. Clauses related to lease term or rent may be deleted or censored. (d) Attached Wireless Communications Facilities. (1) Approval criteria for attached wireless communications facilities: a. For a proposed attached wireless communications facility to approved, it shall meet with the approval criteria h., i., and 1 as indicated in Section 5 (a) (1), as well as the following: b. Accessory Use. An attached wireless communications facility shall be an accessory use as defined by Section 901.03 in the Land Development Regulations; and The antenna, antenna array, attachment device, equipment enclosure and/or any ancillary equipment shall not extend above the highest point of the building by more than seventy (70) feet and 2. Existing or proposed attached wireless communications facilities which project more than seventy (70) feet above the highest point of the building upon which it is mounted shall be considered as an antenna -supporting structure and subject to the provisions for these types of uses pursuant to Section 5 (a); and d. Construction. Attached facilities may have a guyed, lattice, or monopole type construction, but in no case shall a lattice type construction exceed a height of ten (10) feet from the base of the attached facility; and Color. All attached antenna or antenna arrays, equipment enclosures and ancillary equipment visible from outside the building where they are located shall be painted so as to blend in with the building where they are placed; and APRIL 2, 2002 f. Screening and Placement. Attached wireless communications facilities shall be screened by a parapet or other device so as to minimize its visual impact as measured from the boundary line of the subject property Attached facilities shall be placed in the center of the building where reasonably possible so as to further minimize visual impact: and 2. An attached wireless communications facility shall be attached only to a commercial/industrial, industrial, hotel, multifamily, institutional, or public building or facility. (2) Submittal requirements for attached wireless communications facility applications: a. For a proposed attached wireless communication facility application to be considered complete, it shall contain submittal materials a through f., h. and n. (1) through (4) as indicated in Section 5(a)(2). (e) Stealth Wireless Communications Facilities. (1) Approval criteria for stealth wireless communications facilities: a. Setbacks. 1. Stealth facilities shall meet the minimum setback requ'rements for the zoning district where they are located for the type of structure used or simulated. Stealth wireless communications facilities shall not exceed one hundred fifty (150) feet in overall height The county may limit the height of a proposed stealth facility to ensure that the facility is not readily identifiable as a wireless facility, blends into its surroundings, and has the appearance of an allowable and customary structure on site (e.g. church steeple, flagpole w. th flag, light standard tree). c. Construction. No stealth wireless communications facility shall be guyed or have lattice type construction. d. Accessory Use. A stealth facility shall be an accessory use as defined by section 901.03 in the Land Development Regulations. e. Structural Integrity. The stealth facility shall be designed to meet all building code requirements (including windloading). APRIL 2, 2002 f. Aesthetics. No stealth facility, whether fully enclosed within a building or otherwise, shall have antennas, antenna arrays, transmission lines equipment enclosures or other ancillary equipment that is readily identifiable from the public domain as wireless communications equipment. (2) Submittal requirements for stealth wireless communications facilities: a. For a proposed stealth wireless communications facility application to be considered complete, it shall contain submittal materials a. through j. and n. 1 through 4, contained in Section 5(a)(2) as well as a photo -simulated post construction renderings of the proposed stealth facility, equipment enclosures, and ancillary structures as they would look after construction from the public domain. Said photo - simulations must demonstrate that the placement, design and height of the proposed facility satisfies the definition of `Stealth Wireless Communications Facility". b. For a proposed stealth wireless communications facility that is not ground -mounted the Planning Director may waive certain submittal requirements to reflect the necessary documentation required to demonstrate compliance with the provisions of this chapter. c. For a stealth wireless communications facility proposed to exceed a height of 70 feet, the applicant shall satisfy the informatio 1a1 and technical analysis required under section 5(a)(2)n. Sec. 6. Expert Review. Where due to the complexity of the methodology or analysis required to review an application for a wireless communication facility requiring special exception use approval or a radio frequency analysis, the Planning Director may require a technical expert review by a third party expert, the costs of which shall be borne by the applicant, which sum shall be in add'tion to site and special exception use fees Applicant shall submit a deposit of plan $2,000.00 towards the cost of such technical review upon notification from the Planning Director that a technical review is required, and shall remit any outstanding balance to the County for such review (not to exceed a total cost of $3,000.00) to issuance of a building permit The technical expert review shall _prior be completed within 45 days of county staff receipt of a complete application and technical analysis and justification from the applicant. APRIL 2, 2002 -76- DESCRIPTION & CONDITIONS: On August 19, 1981, the Board of County Commissioners adopted a development order (D.O.) approving the development of regional ( impact (DRI) at that time as Village Green West and Village Green South p That DRI approval allowed development of 1,448 mobile homes on 317.5 acres of land located south of S.R. 60 and west of 82nd Avenue. Currently, the DRI project area includes the Countryside and Vero Palms mobile home parks (see attachment #1 In 1994, the D.O. Owas amended to reduce the total number of residential units on the 317.5 acre site to 1,283, said units to consist of 1,163 mobile homes and 120 single f family homes were approved for a 46.55 acre portion of the overall Dr a project amity homes. The 120 single - as "Sable Trace". That "Sable Trace" project was never developed, andte the vacant 46.55 ac eonown site was sold to another developer Now, the current developer of that 46.55 acre site, Blue Water Realty (LLC), is requesting a change to the D.O. to allow a mix of single-family rather than single family homes only. That approval was for the Bluewater Subdivision Phase 1, granted which approved 56 single family lots on the 24.01 acre RS -6 zoned portion of the 46.55 acre tract. As proposed, the Phase 2 RNIH-s zoned 22.54 acre portion of the 46.55 acre tract will not be developed until site plan and subdivision approval are obtained in the future for 64 mobile home Lots. • Determination: Not a Substantial Deviation Request Both county and T.C.R.P.C. staff have concluded that the proposed change will not create any additional impacts (see attachment #3), and that under FS 380.06 the request should not be treated as a substantial deviation. APRIL 2, 2002 -89- �2 Mark Grossman, 9960 86th Street, President of Vero Lake Estates Property Owners Association, stated that the Property Owners Association is very pleased with the response they have received since their last appearance before the Board. There are several homeowners who now have a longer route to get home because of the dead-end streets created by the new canals. One of the homeowners, Mrs De Los Hoyos, has been affected in this way. She has a medical condition and some of her relatives who live close by have been assisting her. If this culvert on 97th could be installed without an additional cost to the residents, it would solve the problem the relatives are having in reaching Mrs De Los Hoyos. Commissioner Adams explained that Mr. and Mrs. De Los Hoyos came to see her and explained the problem. In this particular instance, we have separated a family and created a hardship for the family members going back and forth to care for Mrs. De Los Hoyos. They had even attempted to raise the monies from their neighbors but have been unsuccessful. The request is for one culvert at this particular intersection to restore these residents to their previous ease of access to one another. Upon questioning regarding labor costs, Public Works Director Jim Davis stated that the $8900 includes the labor. The State of Florida is making the monies available under a 319 Grant Program. BACKGROUND: On October 19 2001, a Cost Share Agreement Between the St. Johns River Water Management District and Indian River County for Indian River County Citrus Best Management Practices was signed, Contract # SE660AA, (Attached). This is a fourteen (14) month contract for $50,000 to cost share a maximum of 75% for each Citrus Best Management Practices (BMP's) for three (3) specific priorities. The $50,000 will assist in improving water quality in the Indian River Lagoon by the use of a cost -share mechanism through the Indian River Soil and Water Conservation District and USDA (United States Department of Agriculture) Natural Resource Conservation Service (MRCS) to allow citrus growers to implement Best Management Practices (BMPs). These conservation practices are designed to achieve the greatest agronomic efficiency in food and fiber production, while limiting the offsite effects of agricultural operations and simultaneously maintaining an economically viable farming operation for the grower. APRIL 2, 2002 Li A -92- Mai The procedure is as follows: • The grove owner (Cooperator) submits an application to the Indian River Soil and Water Conservation District (IRSWCD). • The cooperator meets with the water quality extension agent (Liberty Scotto) and reviews the BMP's and their importance to the Indian River Lagoon. • After IRSWCD staff reviews the application, the application is scored based on defined criteria along with preliminary plans and cost estimates • The St. Johns River Water Management District personnel are consulted to insure that the submitted proposals confoini to their funding guidelines. • The IRSWCD staff prepares a recommended list of eligible projects to be submitted to the Board of County Commissioners for approval by the Board, and for cost share funding upon completion of proposed BMP's. • After acceptance of the recommended list by the Board of County Commissioners, LRS WCD/NRCS staff prepare a Conservation Plan and fully developed engineering design, before installation of BMP's may proceed. • The cooperator shall enter into a grant contract with Indian River County. Installation of the BMP may proceed. • Upon completion of the installation of the BMP, the IRSWCD/NRCS staff determines and certifies if it complies with the plans and specifications as approved. • Once certified as complete, the cooperator prepares invoices of the expenditures and submits them to Indian River County through the IRSWCD. • The cooperator receives reimbursement from the County upon authorization by the IRSWCD. • The County submits for reimbursement of the funds from the St. Johns River Water Management District on a quarterly basis. RECOMMENDATION: Staff recommends approval of the prioritized list of projects submitted by the IRSWCD entitled Applicant ScoreSummary, attached. BACKGROUND: Effects of stonuwater runoff carrying pollutants from all land uses into our river, lakes and estuaries have become a national problem. The citrus community came forward in 1998 and began working on what is now know as the Water Quality/Quantity BMPs for Indian River Area Citrus Groves. The growers have adopted this manual, and best management practices are being implemented when economically feasible. In an effort to increase the number of acreage under BMP implementation, Liberia Scotto, Water Quality Agent, Indian River County Cooperative Extension Service, requested funding from the Honda Department of Agriculture and Consumer Services (FDACS). The FDACS is making $750,000 available over a 3 -year period at $125,000 per year to be used in Indian River County APRIL 2, 2002 • -96- L • to allow citnis growers to implement Best Management Practices (BMPs). An advance of 25% ($62 500) of the first year funds will be dispersed to the County at the execution of this contract. The balance will be paid upon submission of invoices and other supporting documentation after the implementation and certification of the BM -Ps. These conservation practices are designed to achieve the greatest agronomic efficiency in food and fiber production, while limiting the offsite effects of agricultural operations and simultaneously maintaining an economically viable farming operation for the grower. The $750 000 will assist in improving water quality in the St. Johns River and Indian River Lagoon watersheds by the use of a cost -share mechanism through the Indian River Soil and Water Conservation District and USDA (United States Department of Agriculture) Natural Resource Conservation Service (NRCS). The costshare procedure is as follows: Indian River Soil and Water Conservation. District (IRSWCD) accepts applications for costshare. • Applicants attend an educational function provided by the Water Quality Extension Agent (Liberta Scotto) or other University ofFlorida faculty pertaining to Citrus BMPs. IRSWCD staff reviews applications and conducts assessments of groves to identify best management practices eligible for costshare. • Applicants provide preliminary design and cost estimates to the IRSWCD. • IRSWCD prepares a recommended Est of eligible projects to be submitted to the Board of County Commissioners for approval by the Board, and for funding upon completion of proposed BMP's. Applicant shall enter into a grant contract with Indian River County. Installation of the BMP, as specified, may proceed. • Upon completion of the installation of the BMP, the IRSWCD/NRCS staff detetnlines and certifies if it complies with the plans and specifications as approved. Once certified as complete, the applicant prepares invoices of the expenditures and submits them to Indian River County through the IRSWCD. • The applicant receives reimbursement from the County upon authorization of the IRS WCD. • The County submits for reimbursement of the funds from the Florida Department of Agriculture and Consumer Services. Mr. Williams brings out a couple of pertinent facts. First, Mr. Ray Choquet who is the current on-site custodian is retiring effective April 25, 2002. Secondly, the library will increase its area by approximately 50 % to over 25,000 square feet. The size of the library with its expansion and the six days a week operation make it inefficient to continue in-house custodial services. With the retirement of Mr Ray Choquet, now is the ideal time to consider placing this facility under our contract custodial provider Cleanlv,et USA. The position presently held, would not be replaced providing a shift to a potentially lower cost. At the request of the County CleamNet has provided a quote to undertake this custodial responsibility to the end of this fiscal year. CleanNet has quoted a price of $2,268 per month Annualized that is equivalent of $27,216. As Mr. Williams has shown, comparable staff costs with an additional part-time helper of twenty hours a week is $42,854 utilizing the current position. Even if both the full time and part-time positions were basic entry level, the cost would still exceed $31,000 annually. RECOiMMENDATION: Considenng the excellent service that is obtained from CleamNet and the reduced cost in operations, staff would recommend that custodial position presently held by Mr. Ray Choquet be dropped upon his retirement; that the CleanlNet USA cost proposal be accepted until the end of this fiscal year at a monthly rate of $2,268. Joyce Johnston -Carlson, Director, Human Servic% Subject: Request for exception to the 120 day due date or audit for the H.0 P E, Project Date: March 13, 2002 The H.O.P E Project is a funded program under the Children's Services funding process. Rev. Burson is asking for an extension until June 30, 2002 of your rule that audits are due to the county 120 after the end of the first year of operation. I have attached a copy of the letter they sent and the reasoning behind the request and letters from two schools who have had students attend the H.O.P.E. Project. The budget office and I would recommend that any funding of grants to the H.O P E program for the 2002-2003 year would be contingent upon a submission of a clean audit. I have monitored this program 5 times for the past 15 months. The program is making a difference in the behavior of the children H O.P.E. has worked with in the past year. We should have some clear statistics from school board records to show improvement in behavior within the next 2 to 3 months. There have been several problems with H.O P E getting their audit and I believe these have been solved. I would recommend your approval of this item. Human Services Director Joyce Johnston -Carlson explained that this is one of the agencies under the Children's Services grants. They are asking for an extension on the date for filing their audit. This is an unusual situation and Reverend Burson and his wife are here to answer any questions you might have. She understood that Assistant County Administrator Joe Baird has provided the Board with copies of communications setting forth several problems they have had in applying for reimbursements. It was her understanding that those problems have now been solved. This group has stepped forward and done an APRIL 2, 2002 -101- o7) ,., 11 • excellent job for the children and they have been extremely cooperative in complying with any requests made of them. At a meeting several weeks ago their bookkeeper, Commissioner Macht and Budget Manager Jason Brown were present and the records were in order at that time. The group has submitted several letters to indicate the positive effects their program has been having. Research has shown that the program has about 70% positive results upon the young people who have been through the program and the behavioral problems have not recurred. Commissioner Ginn questioned the number of children served by the program, and Ms. Johnston -Carlson stated there were 115 the first year, and they have had 160 since the beginning of school this year. Commissioner Ginn then questioned the insurance for the program which is written through the Progressive Civic League. Assistant County Administrator Joe Baird stated that the insurance certificate should be for Northside Agape Ministries. Also, the Board has a firm policy about receipt of the audits within the allotted time. Commissioner Adams questioned who the checks are written to, and Budget Manager Jason Brown stated that Northside Agape Ministries receives the. reimbursements. Mr Baird noted that the program's application and contract were all issued in the name of Northside Agape Ministries. Project HOPE does not exist as a legal entity. Commissioner Ginn sympathized with the project's problems but emphasized that the policies are in place to protect the public's money. Reverend Henry Burson expressed his appreciation for the forum and his regret for the misunderstanding on their part as to the correct legal name for the program. This is a very young program and there are only 2 or 3 like it throughout the state. The School Board APRIL 2, 2002 -102- does not have a program to deal with these youngsters and most of them would be unsupervised were it not for this program. There is a tremendous need for the program throughout the state and St Lucie County's program is so successful that their county is funding their program. The program has received accolades from parents, the public and the School Districts. Over 60% of the kids served by this program are Caucasian and many are from Fellsmere and Roseland, as well as Vero Beach. These children get credit for the work done through the program and they do not fall behind the other students. There is an exception to every rule and he continued with an explanation of the events leading to their need for extra time to supply their audit. Northside Agape Ministries did not have the funds to pay for an audit and at no time was any money for Project HOPE co -mingled with monies belonging to Northside Agape Ministries. Their accounts are at different banks and an audit of Northside will not show any HOPE funds except for payroll taxes reimbursed to Northside by Project HOPE They are just learning all the financial rules but they are committed to their work and hope to be able to comply with the rules in the future. Dave Pearson, 235 Coconut Palm Road, bookkeeper, stated that he has been offering his services to Project HOPE and will assist them in getting their audit completed. Commissioner Adams commented that the Board has to balance the positive effects of the program with their responsibilities to the public. She suggested that Children's Services could withhold a portion of the program's funding until the audit is submitted and found to be in order. After discussion regarding the confusion in the legal name of the program, Commissioner Macht noted that the project has now applied for 501(c)(3) status in its own name which should solve the problem. APRIL 2, 2002 -103- 7A 1a vb • Mr. Baird reiterated that the audit will have to be on Northside Agape Ministries as that is the entity which has a contract with the County. County Administrator Jim Chandler then explained that the audit due is for the first year of funding in the amount of $25,000. The program is now into the second year of funding in the amount of $75,000. He also confiiuned that the audit must be supplied on Northside Agape Ministries. Commissioner Ginn noted that she had questioned many of these procedures when Children's Services began and emphasized that she felt the regulations are far too lenient. She suggested using $5,000 of the funds allocated to the program to hire someone to straighten out the problems. Mr Pearson appreciated hearing the Commissioners' points of view and stated that it is his intention to assist the program with the various issues involved. He knows that the accountants are more than willing to prepare the audit required. They are simply asking for an extension until after April 15' as this is their busiest time of year. They have assured everyone that each dollar can be accounted for and the only problems are technical. He talked to Chip Jacoby and Rebecca Colton and they have assured him they will start the process within days after the tax season is over. MOTION WAS MADE by Commissioner Ginn to allocate $5,000 from the program's funds to straighten out the problems. THE MOTION DIED FOR LACK OF A SECOND. Discussion ensued regarding the due date for the audit and the various solutions previously discussed. APRIL 2, 2002 -104- Commissioner Macht stated that this is an excellent program and agreed that it is ridiculous for the School District to suspend these kids and not fund a program for them, but the alternative is to turn the children loose on society. He asked the Board to find a way to preserve this program which was very carefully considered by a number of very responsible citizens on the Children's Services Advisory Committee. Commissioner Tippin said "amen" to Commissioner Macht's comments and agreed there is a need to make an exception for these kids. He suggested an extension of 30 days. Rene Renzi, 340 East Waverly Place, expressed her frustration with the "nitpicking" over this $25,000 and stated that, if the program is doing a good job, the Board should do something positive for it. Reverend Burson emphasized that there has been no co -mingling of the funds; there is no hidden agenda; they have been totally honest with the funds; and he did not want the public to get the impression over the air waves that there had been any wrongdoing. Commissioner Macht stated that the program is also being funded by the Richardson Foundation and the Johns Island Foundation. He asked Administrator Chandler for a suggestion to solve this problem and stated that this is a start-up organization by a "man of the cloth" who does not possess the necessary accounting skills. APRIL 2, 2002 MOTION WAS MADE by Commissioner Macht, SECONDED by Commissioner Tippin, to grant an extension of time to Project HOPE to file their audit. -105- • MOTION WAS AMENDED by Commissioner Macht, SECONDED by Commissioner Tippin to allow Project HOPE until June 1St, 2002, to file the required audit. Administrator Chandler noted that there will be 2 audits due; one for the first $25,000 funded and one for the second $75,000 funded. Commissioner Macht also noted that, as of now, this project is no longer a start-up project and they must now comply with all the regulations. He expressed his appreciation for people who have the perception to step into an area of need and act to solve a problem which has been dumped on society. Reverend Burson clarified that the audit must be through Northside Agape Ministries. Commissioner Ginn advised Reverend Burson that when County money is accepted you then become subject to the Sunshine Law and the Florida Public Records Law. County Attorney Paul Bangel clarified that a paragraph in the present agreement states that the entity must comply "if applicable". Chairman Stanbridge commented that these agencies should examine these contracts closely with an eye to avoiding any future such problems.
