Now the developer has completed construction of some of the required Phases V and VI subdivision improvements , is requesting final plat for approval for Phases V-VI, and has submitted the following : 1 • A final plat for Phases V- VI in conformance with the approved preliminary plat, and 2 • A cost estimate for the remaining required improvements, and � • A contract for construction of the remaining required improvements . ANALYSIS : Some of the Phases V and VI subdivision improvements have been completed, and the developer proposes to bond-out for construction of the remaining required improvements to proceed with final plat approval . The format of the financial security has been approved by the County Attorney' s Office. and unit costs for construction items have been approved by Public Works , Utility Services. and Planning. The developer has also submitted a copy of the Contract for Construction of Required Improvements . All subdivision improvements are privately dedicated with the exception of the utility system, which will be separately warranted through the Department of Utility Services . Based on submission of the previously referenced contract and security, all requirements for final plat approval are satisfied . RECOMMENDATION: Staff recommends that the Board of County Commissioners grant final plat approval for Island Club Riverside, Phases V-VI . and authorize the Chairman to sign the Contract for Construction and accept the security that guranantees the contract. Planning Director Stan Boling advised that this site is Phases V and VI of the development . Phase IV included the wrongful tree removal along Jungle Trail . The developer has agreed to replace 5 large Live Oaks to be installed by tomorrow . There is a $ 119 , 000 bond in place for 5 years to protect the integrity of these trees . There is also another $ 35 , 000 being held for the remaining buffer landscaping of Phase IV . Once normal landscaping is installed, then it is a matter for Code Enforcement if it is not maintained . This item is a bonding out request for the final plat for Phases V and VI . The Live Oaks have been installed for Phase IV but we have not yet received written confirmation from the arborist . After further discussion, Environmental Chief Roland DeBlois noted that the developer has complied with all requirements as far as staff is concerned and it is appropriate to allow him to move forward . ANALYSIS Arbor Trace Development, Inc . has been paid $ 140,204 .61 for utility work performed to date . The work performed to date includes design, permitting and construction services. The Developer' s Agreement compensated each owner for extension of County utilities (water and force main). The Woodmere Project incorporated verbiage in the approved Agreement, which provided provisions that allowed the Developer to complete the proposed utilities identified in the Jerry Smith Warehouse Project. The Woodmere Development was dependent upon utilities being extended by the Jerry Smith Warehouse Development. This was incorporated to ensure that the Woodmere Development would not be impacted by failure of the Jerry Smith Warehouse Developer to extend the necessary utilities along their project with the Term of the Agreement. Should Jerry Smith delay their construction then the Woodmere Trade Center Development would be unable to complete their project. The construction portion of the Jerry Smith Developer' s Agreement had not commenced and had created construction delays for the Woodmere Trade Center Project. Therefore Staff, pursuant to the Developer' s Agreement and Board approval, instructed the owner of the Woodmere Trade Center to further extend utilities (water and force main) along High Street to the intersection of CR-512. The Work completed to date under the Jerry Smith Warehouse Developer' s Agreement included survey, design, and permitting through FDEP. Construction of utilities had NOT commenced and was delayed. Compensation to Jerry Smith for work completed to date has been paid in full . MAY 19 2001 -43 - The Work completed under the WOodmere Trade Center Project include the original scope-of-work outlined in the Woodmere Trade Center Developer' s Agreement PLUS the additional utility the Jerry Smith Warehouse Developer's Agreement work outlined in The amount of funds expended between both projects remain under budget and all work required by each Agreement has been satisfied. The total allowable compensation per the Jerry Smith and the Woodmere Trade Center Developer' s Agreements and the Developer ' s share per line extension fees was $77,243 . 88 (see attached developer' s agreement). The total final required compensation is $72, 844. 98 , a saving to the County of $4,398.90. We are now prepared to release frnal payment to the developer. RECONVIMNDATION The staff of the Department of Utility services recommends that the Board of County Commissioners authorize final payment to Woodmere Trade Center in the amounts tabulated below. UW-00-19-DS RESOLUTION III- PUBLIC HEARING BACKGROUND On April 3 , 2001 , the Indian River County Board of County Commissioners approved Resolutions I (2001 -037) and Resolution II (2001 - 038 ) . Resolution I contained the preliminary assessment roll describing the project and cost . Resolution II set the date of the public hearing for the subject project. Property owners have been notified of the public hearing by mail . Resolution I (2001 -037 ) was published in the Vero Beach Press Journal on April 9 , 2001 . ( see attached Agenda Item and Implementation of the above meeting-Attachment 1 , Plat Map- Attachment 2, Estimated Project Cost-Attachment 3 , Preliminary assessment summary and Preliminary Assessment Roll-Attachment 4 ) . On April 23 , 2001 at 7 : 00 p . m . an informational meeting was held for the benefit of the property owners, in the Indian River County North County Library. ANALYSIS Along the West side of US Highway One, there are 97 properties, between the Wal -Mart Super Center and County Road 512, which may benefit from this proposed water line Extension . In most water assessment projects, properties along both sides of a waterline ( typical street situation) share proportionately in the project cost . In this proposed project, which is bordered by U. S . Highway No . I and the FEC Railway, this is not the case. Properties on one side only will be responsible for the project cost. The attached map (ATTACHMENT 2 ) displays the area to benefit from the assessment project. The total estimated project cost and amount to be assessed, including engineering construction and administration is S 677,406 . 00 . (rounded) The estimated cost per square foot is S 0 . 352168 (rounded ) . This project is to be paid through the assessment of property owners along the proposed water line route. This portion of the project is different in that it is not a petition project . It is more of an economic development project which has come into being because of corridor development . This is a fairly costly project, costing half again as much as others seen lately . It is assessable only on one side of US # 1 as the east side of US # 1 already has water . There are also a lot of sidewalks and surface features to go around . Manager of Assessment Projects Dan Chastain noted that he had received a request late yesterday on the FEC railway property for an additional reduction in square footage . FEC will provide a survey which will show that the FEC property has 3 , 964 square feet less than the Property Appraiser ' s records show at 100 , 623 square feet . Segal distributed a handout ( COPY OF WHICH IS ON FILE WITH THE BACKUP FOR TODAY ' S MEETING) showing that the front of the property is on a sand ridge , while the rear is almost entirely wetlands . Mr . and Mrs . Collins have included an environmental study in the handout which shows the sand pine scrub and wetlands . This property was purchased prior to the application of any wetlands issues . Any mitigation on this property would take , at a minimum , 4 acres , and potentially 10 acres . Mr . and Mrs . Collins have no intention of developing the land at this time as wetlands mitigation would be cost prohibitive and they are asking that the rear half be removed from the assessment . The FEC Railway has created a system that acts like a dam , blocking the drainage on this property . Mr . and Mrs . Collins are asking for a 50 % reduction in the assessment as only 50 % of the land will benefit from the project . Commissioner Adams questioned the square footage of the property, and Mr . Segal responded that it was approximately 200 , 000 square feet . Mr . Chastain noted that the survey of the Collins property would show approximately 148 , 916 square feet which would lower the assessment a little . Chastain believed it could be removed if it could be determined that that portion could never be developed . Mr . and Mrs . Segal felt they would be open to discussing such an easement , Commissioner Adams questioned whether the property is located in the Ocean Breeze If Heights Subdivision, and Mr. Chastain responded that there is a small parcel on the south part of Block 9 , Lots 4 to 12 inclusive ; almost the whole of Block 8 , Lots 1 to 22 included ; and the abandoned Park Avenue , together with Lot B , Block 5 , Mr . Segal stated that Mr. and Mrs . Collins have no interest in receiving more relief than they are entitled to , but they would probably have to commit a portion of the uplands in order to protect the wetlands . Commissioner Stanbridge felt sure that St . Johns River Water Management District would produce some delineations which could be helpful , Commissioner Adams questioned what a $ 35 , 000 reduction in the Collins ' assessment would do to the other assessments , and Mr . Utilities Director Don Hubbs questioned whether the proposed reduction in the Collins assessment was predicated on a conservation easement or simply a delineation of the wetlands . G . M . Knowles , 13850 CR- 512 , Fellsmere , protested the cost of the project and stated that he had a commercial building in Lake Worth with 125 feet of road frontage and the cost of obtaining water was $ 3500 on a very busy road . It did not seem possible that it would cost $ 8500 in Fellsmere . He also questioned whether an easement donated to the City of Sebastian for utilities several years ago would be included in the assessment . Mr . Chastain stated that he had spoken with Mr . Knowles and the project does cost more than the average project but it is hoped that the benefits will also be above average . Chairman Ginn questioned whether the square footage has been reduced by the size of the easement , and Mr . Chastain responded that it had not . That easement runs all along these properties and all the properties have the same easement . Carmon Strobel , 1605 US # 1 , Sebastian , questioned what square footage has to do with water usage and felt that an assessment based on road frontage would be more equitable . He also questioned why Sebastian cannot get a grant to assist in this water project as was obtained in Fellsmere . Utilities Director Don Hubbs noted that the assessment is divided into equal shares whether it is based on front footage or square footage . Odd shaped parcels make it more difficult but square footage works because the full gain to the property is proportional to the size of the property . Also , Fellsmere was able to obtain a grant to assist in their water project because it is an economically depressed area . Sebastian could not qualify for such a grant . Mrs . Donald Ferguson , 578 Grace Street, Sebastian, a member of Sebastian River Baptist Church , wanted to know why the Church should have to pay more because someone with an attorney got a reduction . He emphasized that there are many seniors who have lost their homes through their inability to pay their property taxes and that many of them are having great difficulty now with purchasing prescription medications . Commissioner Adams stated that Charles Hutchinson has made a study and has some big concerns about this program . The matter will be brought back before the Board at their May 15 `h meeting . She suggested that Mr . McDougald ask seniors to appear to express their concerns at that time . Chairman Ginn stated that her concern is with the persons who make just a few dollars more than the upper limit of $ 20 , 000 . Commissioner Macht emphasized that senior citizens can appear to state their concerns but the younger people who are out working will not be here to express their concerns . They will be working to provide for their families and will not be able to take time off to appear . There is no help for young families and there are many kinds of help available to seniors . He felt that he could never add another burden to the young families already overburdened . This agreement provides procedures that allow adequate response, invoicing, and reimbursement when Indian River County BCC personnel and assets respond to disasters in Florida. Along with the County, all Indian River County municipalities also approved the original 1994 agreement . Since 1994, Florida has experienced numerous disasters such as Hurricane Erin, Hurricane Opal, 1998 brush fires, etc . During these events, it was discovered that all governmental entities needed to be included in the agreement . Currently, only state, county, and municipal governments are included in the agreement . Therefore, the updated agreement allows the inclusion of all independent governmental districts such as Water Management, School, Mosquito Control, Hospital, etc . The only modifications in the new agreement are associated with enhancing reimbursement procedures for Indian River County. All other procedures within the agreement are identified in the County ' s Comprehensive Emergency Management Plan . The agreement does not require any new financial commitments by the County and does not commit the County to any guaranteed response during disasters . Change Order No. 2 deducts ($2, 720. 00) for deleting the installation of concrete bumper guards , at the original bid price. This amount, added to the current contract amount, results in a new contract amount of $635 , 789 . 19 . Sheltra has requested , and is entitled to , a full release of retainage . All work has been completed , deficiencies corrected , and all warranties , as-built drawings , and other contract required close-out documentation have been submitted . One payment is outstanding to a subcontractor, Orlando Paving Company, in the amount of $41 , 107 . 67, with which Sheltra has no dispute and fully intends to pay. In order to facilitate the close-out of this contract, we will issue a joint check to Sheltra and OPC for that amount. COMPLETION DATE Work under this contract was Substantially Complete on August 18 , 2000 . Sheltra Construction has requested a time extension to bring the contract completion date into agreement with this actual completion date . A total of 201 days are requested in compensation for extra manpower and equipment costs expended to rework the existing pavement prior to it being repaved . The repaving was paid for with a negotiated share of the costs being bome by each of the parties involved . The time extension credit is for the additional efforts expended by Sheltra , beyond their portion of that work . However , by letter dated March 23 , 2001, the US Fish and Wildlife Service indicated it could not authorize the additional work due to sea turtle nesting concerns . Change Order No . 2 credits the County for the cost of the additional 650 tons of sand that was not delivered and placed . This results in a contact price reduction of $ 6 , 500 . 00 . The owner has executed a contract at a purchase price of $ 154 , 000 , or an average of $ 17 , 381 . 49 per acre for the I -L zoned parcel . This negotiated price is based upon $25 , 000 per acre for upland areas , and $ 10 , 000 per acre for wetland/environmentally- sensitive areas . An appraisal performed for the County placed the value at $ 140 , 500 (the County' s offer amount ) , or an average of $ 15 , 857 . 79 per acre . While the negotiated price for the land is within 10 percent of the County' s offer, the Seller conditioned the counter-offer on the further condition that the County agrees to clear Seller' s remainder property (except for a 20 foot buffer along the east side ) . This would consist of 13 . 37 acres to be cleared at a cost of approximately $ 3 , 000 per acre , or an additional $40 , 110 in addition to land cost. This work would be performed by the Road and Bridge Division . The Property Owner has agreed to allow the County to use the cleared remainder for staging the drainage system construction , temporary fill stockpile , and related uses . There are no further appraisal or attorney fees . A 12" diameter master planned water main is scheduled to be constructed along Old Dixie Highway from 65`h Street to 49th Street on an as- needed basis driven by development ( see attached copy of master plan map) . Doctor Roof, Inc . has agreed to participate in a developer' s agreement with the County to construct the master planned line and related appurtenances to serve his facility . The water main installation will comprise constructing approximately 3 , 040 linear feet of 12 " PVC and 160 linear feet of 12" DIP along the eastern Old Dixie Highway right-of-way, a point approximately '/< mile south of 65`h Street to the southwest corner of the project. JAMES R AND PHYLLIS PARKS, have agreed to enter into a cost sharing agreement with the County to construct the master planned water main. Attached is a proposed developer' s agreement with JAMES R. AND PHYLLIS PARKS for reimbursement of a portion of the subject water main . The Developer' s Agreement is stipulated to reimburse the Developer for the County ' s share of the water main based on itemized invoices of installed materials on a percentage complete basis- less 10% retainage, monthly with final payment and release of retainage at the time said facilities are dedicated to the County ( SC — I of attached agreement). Developer will be required to post a 225% payment and performance bond prior to issuance of Utility Construction Permit ( SC — 14 of attached agreement) . GINN - REPORT ON TRIP TO TALLAHASSEE REGARDING HABITAT CONSERVATION PLAN AND GERSTNER AND SUMMERPLACE SEAWALLS Chairman Ginn stated that her trip had been to seek some resolution to the Gerstner seawall matter . In talking with staff from the Department of Environmental Protection , there is some disagreement as to the terms of the Habitat Conservation Plan . She wanted to be certain that her understanding that the Plan would mitigate the initial takes from the Gerstner and Summerplace seawalls was correct . Commissioner Adams confirmed that the HCP encompasses all 22 miles of Indian River County coast line and , in return , the Gerstner and Summerplace seawalls were allowed to be completed . Chairman Ginn commented that there had been some discussion from DEP staff that the seawalls might have to be moved . Commissioner Adams stated that the issue of private property rights has been an issue from the "get- go" . The seawall is 6 feet landward of the original permit specifications and it has been an ongoing battle for 3 and '/2 years . He felt the whole matter has become a political issue when it should be a professional issue . He believed that Emergency Services Director Doug Wright can handle the matter and that he will bring recommendations back to the Board in a professional manner, removing this issue from the political arena .
