Vero Beach , Florida. on Tuesday . June 12 , 2001 . Present were Caroline D . Ginn , Chairman ; Ruth Stanbridge , Vice Chairman , Commissioners Fran B . Adams , Kenneth R . Macht ; and John W . Tippin . Also present were James E . Chandler, County Administrator ; Paul G . Bangel , County Attorney ; and Patricia Ridgely . Deputy Clerk . 1 . CALL TO ORDER The Chairman called the meeting to order at 9 : 00 a . m . I INVOCATION Elmer Vogelsang delivered the invocation . I PLEDGE OF ALLEGIANCE Commissioner Macht led the Pledge to the Flag . 4 . ADDITIONS/DELETIONS TO THE AGENDA/EMERGENCY ITEMS None . June 12 , 2001 1 5 . PROCLAMATION - HONORING EDWARD " EDDIE " NETTO Chairman Ginn announced that she was moving item 7 . C . to this heading and read the following , which was accepted with thanks by Mr . Netto . i PROCLAMATION HONORING EDWARD NETTO Whereas . Edward Netto was born on May 30 , 1921 in Santa Clara , California , and also shared his birth year with famous "Roots' author, Alex Haley, and the Sacco and Vanzetti murder trial. His first eight years found America very prosperous under the able presidency of 'Quiet Cal Calvin Coolidge , who served as President from 1921 to 1929 , and Whereas. as an eight year old , the stock market crash on Black Tuesday, October 29 , 1929 did not greatly affect Eddie' s portfolio , and he survived the Great Depression, which ended with World War It , and Whereas. Eddie served his country in the United States Navy, along with many other brave men and women , and their great sacrifice resulted in an American victory in 1945, and Whereas, Eddie returned to Vero Beach where he saw the beginning and the ending of the cold War, and witnessed the launching of the world's first satellite, Russia 's Sputnik in 1957 , and Whereas, Eddie witnessed the election of the first Catholic President, John F. Kennedy, and his shocking assassination on Friday, November 22, 1963 , and he saw America initiate its space program with JFK's pledge to safely go to the moon and back in that decade, and Whereas , Edward witnessed Thurgood Marshall become the first African-Amencan Supreme Court Justice, in October 1967 , and Whereas, he witnessed jet travel in the early 60's and Neil Armstrong fulfill JFK's dream of walking on the moon on July 20, 1969 and retuming safely to earth, and Whereas, Eddie lived though the 'flower power era of the 1970's and survived, and witnessed the Panama Canal giveaway in September 1977 . He has witnessed the almost unbelievable technologic advances of the 80's and 90's , and Whereas, during the modem era from 1946 — 2001 , Eddie became an outstanding building contractor in Indian River County, doing it all: building single family homes, schools, churches , multi- family units as well as high rises, and Whereas, he was, and continues to be, an outstanding community supporter and volunteer in his unassuming, quiet manner, and as a Committee of One, Eddie persuaded sub-contractors to join with him in the construction of the first building for the Association of Retarded Citizens. As a principal volunteer, Eddie joined with others who saved and refurbished the Heritage Center, thereby preserving a Vero Beach treasure, and Whereas, Eddie continues to be a Fighting Indian Football Fan, and can be found among the loyal supporters at Vero Beach High School home games, and Whereas, he currently is serving on Indian River County's Space Needs Committee, lending his expertise as a general contractor, and he has been a particular blessing to Indian River County during his 58 years in our beautiful community, Now, therefore, I Caroline Ginn . Chairman of the Indian River County Commission , do hereby proclaim Saturday, June 2 , 2001 as Eddie Netto Day in Indian River County in recognition of his numerous and outstanding contributions to our community and loin with others in wishing him a very Happy Birthday. More specifically , the site . depicted in Figure 1 , is located approximately a quarter [Wile east of US I and = 180 feet north of 97" Lane . The request involves rezoning the property from RS - 1 . Single - Family Residential District ( up to 1 unit acre ) , to RM - 6 . Multiple - Family Residential District yup to 6 units/acre ) . The purpose of this request is to secure the necessary zoning to develop the site with multiple - family uses at a density that is consistent with the site ' s comprehensive plan land use designation . On May 10. 2001 . the Planning and Zoning Commission voted 5 to 1 to recommend that the Board of County Commissioners rezone the subject property from RS - 1 to RM - 6 . Existing Land Use Pattern The ± 10 . 2 acre subject property and land to the north are zoned RS - 1 . Land to the south and west are zoned RM - 6 . Dense vegetation exists throughout most of the subject property and surrounding properties . Some environmentally important estuarine wetlands may also be present on land to the north and south of the subject property . Although the county ' s zoning atlas depicts estuarine wetlands within the county as having various zoning designations , all environmentally important estuarine wetlands are deemed to be zoned Con - 2, Estuarine Wetland Conservation District ( up to 1 unit/40 acres ) . Most of the land surrounding the subject property consists of a combination of wooded uplands and wetlands of varying quality . The exception is the single - family homes southwest of the subject property , in the Tropicana Homesites and the Pelican Pointe of Sebastian subdivisions . Future Land Use Pattern The subject property and properties to the north and south are depicted as C- 2, Estuarine Wetlands Conservation - 2. on the county future land use map . Future Land Use Element Policv 1 . 7 , however, states that the exact boundaries of C- 2 designated areas are determined by environmental survey , and that any land which is depicted as C - 2 on the future land use map , but is determined by environmental survey not to be wetlands , will have the same land use designation as the contiguous adjacent property . Thus . according to an environmental survey , the subject property and properties to the north. south . and west , are designated L - 2 . Low- Density Residential - 2 . on the county future land use map . The L- 2 designation permits residential uses with densities up to 6 units/acre . That environmental survey also shows that the irregular northern . eastern , and western boundaries of the subject property are the edges of environmentally important estuarine wetlands that are designated C- 2 on the county future land use map. The C- 2 designation permits conservation uses . limited recreational uses , and residential uses with densities up to 1 unit/40 acres for on - site development or 1 unit/acre for transferable development rights . Environment The subject property and surrounding areas consist of densely wooded uplands and wetlands of varying quality . According to an environmental survey , some of the wetlands , delineated by the irregular eastern and western boundaries of subject property, are environmentally important estuarine wetlands . The subject property is within an "AE" 100 year floodplain . with a minimum base flood elevation requirement of nine feet NGVD . Utilities and Services The site is within the Urban Service Area of the county . Water lines from the North Countv Reverse Osmosis Plant and sewer lines from the North Regional Wastewater Treatment plant extend alone US 1 to within approximately one quarter of a mile of the subject property . Transportation System The subject property is part of a larger parcel that is bordered on the west by US 1 . Classified as a rural principal arterial road on the future roadway thoroughfare plan map, US I is four lane road with approximately 120 feet of public road right-of- way . Currently , there are no plans to expand this segment of US 1 . June 12 , 2001 16 { u �D J • Subject Property ' s Zoning History Past zoning practices of the county explain why the subject property is currently zoned RS - 1 . Because of its location near the Indian River Lagoon . the subject property was historically treated as riverfront land . The RS - 1 zoning of the subject property is related to its proximity to the Indian River Lagoon . Currently . zoning in the county is based on future land use designations depicted on a future land use map that is part of an adopted comprehensive plan . That . however , has not always been the case . Although zoning was established in the county in 1957 . the countv ' s first comprehensive plan was not adopted until 1976 . Not until 1985 was zoning made to conform to the county ' s comprehensive plan . ` Prior to 1985 . the entire subject property was zoned R - 3 . Multiple Dwelling Distnct . That zoning district allowed up to 14 units/acre . � ` In 1985 . a countywide rezoning effort was undertaken to make zoning in the county correspond to the 198 '. comprehensive plans land use designations . The 1982 plan designated the subiect propem as LD ( up to 6 units/acre [ . Land near the Indian River Lagoon , however, was designated as environmentally sensitive . The subject property fell into that category . Since the county at that time did not have a special zoning district for environmentally sensitive land . the subject propertywas down -zoned from R - 3 to RS - 1 . The RS - I zoning district allows residential development at a density of up to 1 unit/acre . That 1 unit/acre density was consistent with the then applicable 1 unit/acre density of the environmentally sensitive land use designation . When the current comprehensive plan was adopted in 1990, the subject property was given the C land use designation . Also at that time , a provision was added to the comprehensive plan that required the boundaries of the Conservation land use designations to be based on a site specific environmental survey of estuarine wetlands on a site . In 1991 . the county adopted Land Development Regulations ( LDRs ) which created the Conservation zoning districts . Those Conservation distracts apply to environmentally important areas such as estuarine wetlands . Although not depicted on the countv ' s zoning atlas , these districts are established when development is proposed for a site containing estuarine wetland or xeric scrub habitat . The boundaries of the conservation zoning districts (like the boundaries of the conservation land use designations ) are then based on a site specific environmental survey of the proper . In this case , a recently completed site specific survey shows that the boundary between the uplands/non -estuarine wetlands and the estuarine wetlands does not coincide with the current RM - 6/RS - 1 zoning district boundary . In fact, the environmental survey shows that . in the area of the subject proper . most of the RS - 1 zoned area actually contains uplands and non -estuarine wetlands . Those uplands and non -estuarine wetlands constitute the subject property ( the boundaries of the subject property were specifically drawn to include uplands and non -estuanne wetlands , and to exclude estuarine wetlands ) . Because the subject proper contains onlv non - estuarine wetlands and upland habitat, the subject property is eligible to be zoned consistent with the L- 2 land use designation ( up to 6 units per acre ) established by the comprehensive plan . Although the estruarine wetlands north , east, and west of the subject property would remain zoned RS - 1 in the zoning atlas , those estuarine wetlands are deemed to be designated C- 2 . Conservation - 2 . and zoned Con - 2 , Estuarine Wetlands Conservation District ( up to 1 uniU40 acres t . For development purposes , the Con - 2 zoning district applies . June 12 , 2001 17 Ply 1 P 'Z3 4 This information is important because it indicates that the subject property is currently zoned RS - I because of a past broad brush approach to designating environmentally sensitive land . Since the underlying comprehensive plan designation is L- 2 , the subject propertv is eligible to be rezoned to anv residential district up to the requested RM - 6 . ANALYSIS In this section , an analysis of the reasonableness of the request will be presented . Specifically , this section will include : • an analysis of the request ' s impact on public facilities ; • an analysis of the request ' s compatibility with the surrounding area ; • an analysis of the request ' s consistency with the county ' s comprehensive plan ; and • an analysis of the request ' s potential impact on environmental quality . Impact on Public Facilities This site is located within the county Urban Service Area, an area deemed suited for urban scale development. The Comprehensive Plan establishes standards for: Transportation . Potable Water. Wastewater, Solid Waste . Stormwater Management , and Recreation ( Future Land Use Policv .1 The adequate provision of these services is necessary to ensure the continued quality of life enjoved by the community . The Comprehensive Plan and Land Development Regulations also require that new development be reviewed to ensure that the minimum acceptable standards for these services and facilities are maintained . Policv 3 . 2 of the Future Land Use Element states that no development shall be approved unless it is consistent with the concurrency management system component of the Capital Improvements Element. For rezoning requests . conditional concurrency review is required . Conditional concurrency review examines the available capacity of each facility with respect to a proposed project . Since rezoning requests are not projects , county regulations call for the concurrency review to be based on the most intense use of the subject property based on the requested zoning district . The site information used for the concurrency analysis is as follows : 1 . Size of Area to be Rezoned: ±10.2 acres ? . Existing Zoning District : RS- I , Single- Familv Residential District ( up to 1 unit/acre ) 3 . Proposed Zoning District: RM-6, Multiple- Family Residential District ( up to 6 units/acre) 4 . Most Intense Use of Subject Property under Existing Zoning District : 10 single- family units 5 . Most Intense Use of Subject Property under Proposed Zoning District : 61 single- family units Transportation As part of the concurrency review process . the applicant has submitted a Traffic Impact Statement ( TIS ) . The county ' s Traffic Engineering Division has reviewed and approved that TIS . A TIS reports the number of peak hour/peak season/peak direction trips that would be generated by the most intense use of the subject property under the proposed zoning district , and assigns those trips June 12 , 2001 18 c,, to impacted roads . Impacted roads are defined in section 910 . 09t41 ( b ( 3 of the counn ' s LDRs a � roau �� j � segments which receive tive percent ( 511-( ( or more of the project traffic or fifty ( 50 ) or mor: project trips . whichever is less . .According to the approved TIS . the existing level of service on impacted roadways would not be lowered by the traffic generated by development of 61 single - family units on the subject property . Water Centralized potable water distribution lines extend from the North County Reverse Osmosis Plant to within a quarter mile of the subject property . With the most intense use allowed under the proposed rezoning , the subject property will have a water consumption rate of 61 Equivalent Residential Units ( ERU ) . or 15 .250 gallons/day . This is based upon a level of service standard of 250 gallons/ERU/day . Since the North County Reverse Osmosis Plant currently has a remaining capacity of more than 1 . 500. 000 gallons/dav , the plant can accommodate the additional demand generated by the proposed zoning . Wastewater Centralized wastewater collection lines extend from the North Regional Wastewater Treatment Plant to within a quarter mile of the subject property . If a 61 unit residential project on the site connected to the regional sewer system , that project would have a wastewater generation rate of 61 Equivalent Residential Units (ERU ) , or 15 . 250 gallons/day . This is based upon a level of service standard of 250 gallons/ERU/day . Since the North Regional Wastewater Treatment Plant currently has a remaining capacity of approximately 180. 000 gallons/day , the plant can accommodate the additional demand generated by the proposed zoninc . Solid Waste Solid waste service includes pick - up by private operators and disposal at the county landfill . The county ' s adopted level of service standard for landfill capacity is 1 . 97 cubic vards/person/ vear. With the county ' s average of approximately 2 . 3 persons/unit . a 61 unit residential development would be anticipated to house approximately 140 people ( 2 . 3 X 61 ) . For the subject request to meet the county ' s adopted level of service standard of 1 . 97 cubic yards/person/vear, the landfill must have enough capacity to accommodate approximately 276 ( 145 X 1 . 97 ) cubic vards/vear . A review of the solid waste capacity for the active segment of the county landfill indicates the availability of more than 800,000 cubic yards . The active segment of the landfill has a 4 vear capacity , and the landfill has expansion capacity beyond 2010 . Based on the analysis . staff determined that the county landfill can accommodate the additional solid waste generated by the site under the proposed zoning district . Drainage All developments are reviewed for compliance with county stormwater regulations which require on - site retention , preservation of floodplain storage and minimum finished floor elevations . In addition . development proposals must meet the discharge requirements of the county Stormwater Management Ordinance . Any development on the subject property will be prohibited from discharging any runoff in excess of the pre - development rate . In this case , the minimum floor elevation level of service standard applies , since the property lies within a floodplain . Consistent with Drainage Policy 1 . 2 , "all new buildings shall have the lowest habitable floor elevation no lower than the elevation of the 100- year flood elevation as shown on the June 12 , 2001 19 F0G � i ' � Federal Emergency Management Agency ' s Flood Insurance Rate Map, or as defined in a more detailed study report. " Additionally , section 930.07 ( 2 ) of the county ' s LDRs requires that all residential development shall have the lowest floor ( including basement) elevated to six inches or more above the base flood level . Since the subject property lies within Flood Zone AE- 9 . which is a special flood hazard area located within the 100- year floodplain , any development on this property must have a minimum finished floor elevation of no less than 9 .5 feet above mean sea level . Besides the minimum elevation requirement, on -site retention and discharge standards also apply to this request . With the most intense use of this site , the maximum area of impervious surface under the proposed zoning. classification will be approximately 6 . 4 acres . The estimated runoff volume . based on that amount of impervious surface and the 25 year/24 hour design storm, will be approximately 296 . 729 cubic feet. In order to maintain the county ' s adopted level of service , the applicant will be required to retain approximately 56 . 873 cubic feet of runoff on - site . With the soil characteristics of the subject property , it is estimated that the pre -development runoff rate is 43 . 48 cubic feet/second . Based upon staffs analysis , the drainage level of service standards will be met by limiting off- site discharge to its pre -development rate of 43 . 48 cubic feet/second. requiring retention of 56. 873 cubic feet of runoff for the most intense use of the property , and requiring that all finished floor elevations exceed 9 . 5 feet above mean sea level . As with all development, a more detailed review will be conducted during the development approval process . ` Recreation A review of county recreation facilities and the projected demand that would result from the most intense development that could occur on the subject property under the proposed zoning district indicates that the adopted level of service would be maintained . The following table illustrates the additional park demand associated with the proposed development of the property and the existing surplus park acreage . Therefore . the concurrency test has been satisfied for the subject request. Consistency with Comprehensive Plan Rezoning requests are reviewed for consistency with all policies of the comprehensive plan . Rezoning requests must also be consistent with the overall designation of land uses as depicted on the Future Land Use Map, which includes agricultural , residential , recreational , conservation , and commercial and industrial land uses and their densities . Commercial and industrial land uses are located in nodes throughout the unincorporated areas of Indian River County . June 12 , 2001 10 0 • The goals . objectives and policies are the most important parts of the comprehensive plan . PoliCle > are statements in the plan which idemifv the actions which the county will take in order to direct the community ' s development. As courses of action committed to by the county , policies provide the basis for all county land development related decisions . While all comprehensive plan policies are important, sbme have more applicability than others in reviewing rezoning requests . Of particular applicability for this request are the following policies . Future Land Use Element Policies 1 . 1 I and 1 . 12 Future Land Use Element Policy 1 . 12 states that the L- 2 , Low - Density Residential - 2 . land use designation is intended for residential uses with densities up to six units/acre . In addition . Policv 1 . 11 states that these residential uses must be located within an existing or future urban service area . Because the subject property is located within an area designated as L - 2 on the count ' s future land use plan map and is located within the county ' s urban service area . and the proposed zoning district would permit residential uses no denser than six units/acre . the proposed request is consistent with Future Land Use Element Policies 1 . 11 and 1 . 12 . Future Land Use Element Policv 1 . 7 Future Land Use Element Policv 1 . 7 states that the exact boundaries of the C - 2 land use designation shall be determined by an environmental survey , and verified by the county environmental planning staff. Policv 1 . 7 also states that any land which is depicted as C - 2 on the future land use map , but is deternuned by environmental survey not to be wetlands . will have the same land use designation as the contiguous adjacent property . ` Such a survey has been conducted and verified for the subject property . That survey has determined that the subject property does not meet the criteria of C - 2 designated land . Therefore . the subject property has the same land use designation as the contiguous adjacent property - - L - 2 . Because the site ' s land use designation has been determined through the process described in Future Land Use Element Policy 1 . 7 , the request is consistent with that policy . Consistencv Summary While Future Land Use Element Policies 1 . 7 , 1 . 11 and 1 . 12 are particularly applicable to this request . other comprehensive plan policies and objectives also have relevance . For that reason . staff evaluated the subject request for consistency with all applicable plan policies and objectives . Based upon that analysis , staff determined that the request is consistent with the comprehensive plan . Compatibility with the Surrounding Area The requested RM- 6 zoning district is compatible with surrounding properties . In fact. the request is for a continuation of the existing zoning pattern from the south and west. While land to the west is owned by the applicant. other surrounding properties are large ( 20 acres or more ) tracts that can provide additional buffers , if necessary . Most land east of US 1 in this area of the county , particularly north of the subject property , consists of a mix of uplands and wetlands . Based on previous experience and the existing zoning pattern . it is likely that the wetlands on those properties will be conserved , while the uplands will be developed with multiple - family uses . The proposed rezoning is consistent with that development pattern . June 12 , 2001 21 For those reasons , multiple -family development is appropriate for the site , and is anticipated to be compatible with surrounding areas . Potential Impact on Environmental Quality Environmental impacts of residential development on the subject property would be essentially the same under either the existing or the proposed zoning district . Multiple - family development . however, increases opportunities for open space preservation and for buildings to be located in areas with the least environmental impacts . In this case . the county ' s 10- 15 % native upland plant community set aside requirement would apply to development under either the requested or the existing zoning district . For these reasons , no significant adverse environmental impacts associated with this request are anticipated . CONCLUSION The requested zoning is compatible with the surrounding area, consistent with the comprehensive plan , meets all concurrency criteria. and will have no negative impacts on environmental qualit % . The subject property is located in an area deemed suited for multiple - family residential uses and meets all applicable rezoning criteria . For these reasons , staff supports the request . RECOMMENDATION Based on the analvsis , staff and the Planning and Zoning Commission recommend that the Board of County Commissioners approve this request to rezone the subject property to RM - 6 . Vice Chairman Stanbridge pointed out that after submission of the site plan , the environmental aspect will be scrutinized by the Corps of Engineers and the Department of Environmental Protection . Director Keating explained that this project has gone through the development review process . He advised of two items scheduled to be heard by the Planning and Zoning Commission at their next meeting . ANALYSIS : The subject rights - of wav were established with the Fellsmere Farms Company ' s Subdivision plat in 1913 for the purpose of providing access and drainage improvements to area properties . The plat did not specifically dedicate the rights - of- wav to the county or any other entitN . .Althou2h the county ' s interest in the rights of wav is not clear. the applicant seeks to ensure that anv possible county interest in the rights - of- wav is abandoned in order to "clear title " for a consolidated land holding . The St . John ' s has already obtained a deed from the Fellsmere Farms Nkater Control District for these rights of stay . The applicant is now requesting that the Countv abandon am interest i [ may have . - - Per guidelines established by the Board of County Commissioners , this petition was reviewed by all county divisions and utility providers having jurisdiction or potential interests within the rishts - of- way . All reviewm2 agencies and departments have recommended approval of the requested abandonment . The subject rights -of- way are not part of the roadway system as noted on the Countv ThorouLyhfare Plan , and are not needed for the thoroughfare system . Furthermore , the abandonment would not affect the right of convenient access to surrounding properties because those properties are owned by the petitioner and will be managed rather than developed . He responded to questions of Commissioner Adams and Vice Chairman Stanbridge about the location of the property . Steve Henderson , representing St . Johns River Water Management District, read a note from them on their intended use of the property as follows : The current conceptual plan for the property calls for the construction of a water management area with the primary goals being to decrease the nutrient levels of agricultural drainage before it is discharged and to provide water supply for irrigation . It is expected that the site will maintain depths of 3 to 6 feet . Drainage will be received from pumps and discharges will occur by both pumps and gravity . The water management area will decrease fresh water flow into the Indian River Lagoon and improve the water quality of water being discharged in the Blue Cypress Water Management area thus providing ecological benefits to both basins . The SJRWMD has initiated feasibility studies . Some of these studies confirm the feasibility of the conceptual plan . Project design is expected to begin in 2002 . Vice Chairman Stanbridge expressed her concerns for the record about the reservoir area of the Sebastian River watershed . She was concerned that SJRWMD may want to put our Indian River Farms water in that area and she had a great problem with that . She wanted assurance it will not be used as a reservoir area for the Indian River Farms water . Mr. Henderson will let Vice Chairman Stanbridge ' s feelings be known to the SJRWMD . The Chairman opened the public hearing and asked if anyone wished to be heard in this matter . There being none, she closed the public hearing . The Walker propeis one of two ownerships in the "gap " between the Simmons and Andre parcels trial m at were acquired by the County earlier this vear . The Walker purchase would bnng the total area of acquired lands to —96 acres . The overall project was approved in 1998 as a Flonda Communities Trust ( FCT ) 5W50 cost -share project . Ovster Bar Salt Marsh was added to the LAAC acquisition list in 1997 . The project is ranked 5th out of 14 sites on the 2001 LAAC acquisition list . County bond funds are available for the purchase under the first series S15 million bond issuance . In its application for state cost- share funding, the County chose to be the lead agency for pre-acquisition tasks and negotiations . Dunne the past year, the county's acquisition consultant, in coordination with count% staff. has conducted pre-acquisition tasks and negotiations . Since the seller recently accepted and executed a purchase contract Option Agreement, appraisal results and other confidential information can now be released . In accordance with the County's Land Acquisition Guide , and Section 125 . 355 of the Florida Statutes . appraisals can be released for public information once an option agreement is executed between a seller and the County . Regarding the Walker parcels . an option agreement has been executed (binding the seller to a negotiated purchase price) , and subsequently the appraisals were released from confidentiality . When a county exercises its confidentiality right in purchasing real property . Section 125 . 355 , F . S . requires that the county approve the purchase at a public meeting not less than 30 days after appraisals are released and public notice of the meeting is given . Indian River Count has been awarded a 50 % cost - share grant from the FCT for the purchase , including 50 % of pre-acquisition expenditures ( e . (.T . . environmental audit , surge} . appraisals ) . • Management Costs Besides cost share , management cost is always an issue with environmental lands acquisition . The FCT program , which is highly competitive state-wide . awards points for proiects based on the provision of resource -based public access and use facilities . In order to qualify for FCT cost-share funding . the Count obligated itself in its FCT application to provide limited access and resource - based facilities on the overall project property . Specifically . conditions of the Conceptual Approval Agreement include County provision of nature trails and a wetland boardwalk on the overall Ovster Bar Salt Marsh proiect property . Management of habitat Ie . (., . . exotics removal ) is also required under the cost- share agreement . Because the overall Oyster Bar Salt Marsh is nearby to Round Island County Park. which has existing parking and restroom facilities among other improvements , public access improvements on the subject parcels will be minimal . A bicycle path connection along S . R . AIA can be used for access to the properr from Round Island Park ( Riverside ) . Relating to long term management, the property will be incorporated into the county - wide park system and managed by the Counry Parks Division in coordination with count` environmental planning staff. olunteer groups will be asked to assist the Counn with certain aspects of property management such as nature trail up- keep and litter patrol . A management plan for the overall project was approved by the County Commission and the FCT when the Simmons and Andre parcels of the project were acquired . Addition of the subject parcels will have minimal effect on management commitments already made by the County in acquiring the Simmons and Andre parcels . Attached is a page of the approved management plan summarizing anticipated management costs of the overall Oyster Bar Salt Marsh project . Ap-praisals In accordance with County Land Acquisition Guide and FCT procedures. two independent appraisals were obtained to determine an approved appraised value . The " approved appraised value . " per State and LAAC Guide procedures , is the higher value of the two appraisals , or 1200 o f the lower of the two appraisals if the appraisals diverge by more than 20"o . In this case . the appraisals diverged by 250 u . so the latter approach ( 120 `; o of the lower appraisal ) was used to established the approved value . The FCT requires that the two obtained appraisals be reviewed and approved by a third, independent review appraiser. ANALYSIS Appraised Value As with all LAAC site purchase negotiations , staff' s objective is to negotiate a purchase price at or below the approved appraised value, and staff has fulfilled that objective in this case . Notwithstanding , the negotiated purchase price of the Walker parcels is above the average of the two appraisals . Because the negotiated purchase price is higher than the average of the appraised values , approval of the Walker land purchase will require a " super-majonty" (4 out of 5 ) vote of the County Commission . The appraisals of the Walker parcels were based on estimates of upland and wetland acres. short of a formal survey that will be required prior to closing . The option agreement references that if upland wetland acreage estimates change based on the survev, thus affecting property value, the seller ( or the County ) may opt not to sell or buy under the current option . Thereis a septic tank to serve a new home and a line has been run from the pole barn to that septic tank and a lift station or pump has been installed . He understood that was approved by the Health Department for a washing machine in the pole ' barn . The neighbor had pulled an after- the- factlumbin P g permit which has not been closed out because there has not been a call for a final inspection . Our plumbing inspector will be going out to determine if a bathroom exists in the pole barn and if it is tied in properly to the septic tank. The plumbing inspector went out the day before the meeting ; but the gate was x � locked so the property owner was left a notice that an inspection is to be made . It appears that the neighbor has been living in the pole barn , however, tangible documentation is necessary in order for it to be presented to the Code Enforcement Board ; staff is pursuing that documentation . Mr . Steele will meet with Mr . Keating to go through the video to determine if it can be used to substantiate whether someone is living there or not . Mr. Steele appreciated Administrator Chandler ' s assistance in trying to resolve this quickly . Keating wished to add several things to the record . He advised that the neighbor , Mr . Downing, is building a house on the property and has put in a septic tank for theprincipal residence . Building a barn prior to the house is allowed on an agricultural piece of property . He is allowed to live on the property , not in the barn , but in an RV . The County allows "watchman ' s quarters " and he was given a temporary use permit ( one -year limit) in February . He got an after-the - fact permit to put IT plumbing in the pole barn . The County does allow electric and plumbing in pole barns . The issue is that the plumbing has not been inspected ; that permit , pulled in April , is good for six 1 51, IT months . Usually a building inspection is not performed unless it is called in but staff is now attempting to gain access to inspect the plumbing . When Code Enforcement Officer BettyI IT Davis began inspecting , on April 11 `h , Mr . Downing advised her that he was not living in the barn . With conflicting statements , Director Keating ' s position has been that evidence was necessary before taking the matter to the CEB . What might complicate this is that Mr . Downing could be living in the RV and using the barn occasionally for work or ancillary activities . In order to prove it to the CEB , proof must be simple , clear, or easily determined whether or not someone is living in the barn . Director Keating then responded to several questions of the Commissioners . Ty ITT, Commissioner Adams thought staff would come to a resolution quickly on the sewage issue , which was Mr . He hoped the Master Plan would serve as a tool and an effective compilation of data to aid the County . The Civic League will solicit and coordinate support resources from the Gifford citizens . He thanked the Board for allowing him to come before them to share the concerns . Commissioner Macht suggested a meeting be scheduled with General Services Director Thomas W . Frame , Main Library Director Mary Powell , himself, and a designee from the Progressive Civic League to discuss the branch library in Gifford . Other Commissioners agreed this was a good suggestion . Vice Chairman Stanbridge thought Director Frame would soon be coming to the Board with some available land for the clinic and she hoped Governor Jeb Bush would not cut the '/2 million dollars from the budget . A lot of work has been done with the Small Area Plan which will be used for other communities in the county . She thought the Gifford community might be the next Front Porch Florida Community which would bring other opportunities . The Progressive Civic League has done an excellent job in coordinating all this work and actually going house - to - house to complete the survey work . Health Department Administrator Jean Kline did an excellent survey on social services which will be part of the documentation . The Small Area Plan identifies Gifford as an important part of Indian River County . � � Mr . Woolfork credited the many citizens who have helped tremendously in the effort . He offered the Commissioners a copy of the video of properties taken during their survey . The League has been working cooperatively with everyone who has helped in this effort and he credited Vice Chairman Stanbridge as being their " drum majorette " . The County closed the purchase in August 1998 . under the premise that it will proceed to obtain cost - share reimbursemegt under the State Conservation and Recreation Lands ( CARL ) pro _ram . Prior to county purchase of the propem' . in 1995 . the Counn executed a 'Alulti - Pam Acquisition Agreement " with the Division of State Lands ( DSL ) for the State to buy the propem for inclusion in the ".Archie Carr Sea Turtle Refuge " project under the CARL program . The Agreement is for 50 `So cost - share of the approved appraised value . including 500o cost - share of acquisition costs . with the exception of appraisals , which were paid for with County bond funds . The DSL has completed its review and acceptance of appraisals and surveys of the Spallone propem• , and is now ready to schedule the project reimbursement for final Governor and Cabinet approval . In order to finalize reimbursement and closing with the State . attached is an Option Agreement for Saie and Purchase of the Spallone propem from the County to the State , for the Board ' s approval consideranon . ANALYSIS The attached Option Agreement is comparable to other option contracts that the Counn has executed ( i . e . . the Fischer- St . Sebastian River property option contract ) as part of cost - share agreements with the State for the purchase of environmental lands . Attached is an August 16 , 2000 memorandum from the Counn attornev regarding his re % ie « of the simiia- Fischer propem Option that was subsequently approved by the Board . The .August 2000 memorandum is relevant to the Spallone Option, in that it contains the same provisions that are the subiect of the atiorric ' s IT memorandum . In order for the Board to make an informed decision , the Counn aaorne% s memorandum summarizes certain provisions of the Option that run in favor of the State ( and not in favor of the Counn I . County planning staff s position is that the risks to the County under the provisions of the Option are minimal , and that the Counn should consider moving forward with approval of this standardized Option .Agreement . Interest Conveved ; Right of Re-entry When the Counry executed the Multi - Pam,- Acquisition Agreement in 1995 . and when the Board approved purchase of the Spallone tract in 1998 and directed staff to seek cost- share reimbursement , it was understood that the CARL program policy at that time was that the State would receive full title to the propem , and that the County would retain an interest in the form of a "right of re- entrv" ( similar to what the Counn,- agreed to on cost- share of the Cairns tract and Fischer tract purchases ) . Since that time . the Counn has insttLated a change in the State ' s policy such that now the State is more amenable to shared title for new projects . However. since the Spallone tract was acquired under the previous policy and agreement. the attached Option A_Treement . as structured. will convey full title interest of the Spallone propem to the State . and contains a right of re - entry clause . Once Conveved to the State , the propem will become a part of the contiguous .Archie Carr National Wildlife Refuge. and will be managed by the U . S . Initially the plant capacity was 2 . 0 million gallons per day ( MGD ) . The plant has undergone three expansions since the initial construction . The current permitted capacity is 8 . 57 MGD . Camp Dresser & McKee Inc . (CDM ) was authorized in December 7 , 1999 , under Work Authorization No . 10 . to perform engineering services to evaluate membrane process optimization on all four skids at the South County RO Plant. The CDM investigative report dated March 2001 reports that the membranes at the South County RO Plant have decreased in performance since installation . It is typical for membrane performance to diminish over time . The CDM Report also included a membrane and piping replacement specification . The staff of the Department of Utility Services has requested from CDM a Work Authorization to provide technical assistance , including but not limited to , evaluation of bids , shop drawing review , and construction observation for the membrane and piping replacement project. These professional services will be requested and paid for on an ' as -needed ' basis , based on hours approved by staff ( see attached t Work Authorization No . 17 ) .
