HomeMy WebLinkAbout1/9/1953FRIDAY, JANUARY 9, 1953 The Board of County Commissioners of Indian Riker County met at the Court House in regular adjourned meeting at 9:00 o'clock A. M., Friday, January 9, 1953, with the follow- ing members present: Commissioners W. C. Graves, Jr., Aubrey L. Waddell, H. C. Watts, P. Hamilton and Allison Warren. Also present were S. N. Smith, Jr., Attorney, L. B. O'Steen, Sheriff; E. E. Carter, Road & Bridge Superintendent and Douglas Baker, Clerk. Minutes of December 2, 1952, were read and approved on Motion of Commissioner Waddell, seconded by Commissioner Hamilton and carried. Minutes of January 6, 1953, were read and approved on Motion of Commissioner Hamilton, seconded by Commissioner Waddell and carried. All old business having been taken care of, Chairman Graves then turned the meeting over to Sherman N. Smith, Jr., Attorney, who asked for nominations for Chairman. W. C. Graves, Jr. was nominated by Commissioner Waddell. Commissioner Warren then moved that the nominations be closed and a unanimous ballot cast in favor of Commissioner Graves as Chairman for the ensuing year, which was duly seconded and carried. - Chairman Graves then took over the Chair. The next order of business was to elect a Chairman pro tem and on motion of Commissioner Hamilton, seconded by Commissioner Warren and carried, Aubrey L. Waddell was elected to serve as Chairman pro tem for the ensuing year. On Motion of Commissioner Hamilton, seconded by Commissioner Matta and unani- mously carried, all other County Officers and employees were re-employed, salaries as follows: NAME POSITION SALARY PER MONTH Sherman N. Erickson, Attorney at Law, requesting that should the County Commissioners find it advisable to engage a new County Attorney in the near future, he would appreciate being considered for the position. On Motion of Commissioner Hamilton, seconded by Commissioner Waddell and carried, the application of Mr. Erickson was ordered filed and he was advised the Board would be glad to consider same at such time a change was made. Commissioner Warren, Chairman of the Road and Street Sign Committee, reported that signs had been ordered and word received that same had been shipped on December 4th. 40 D 1 0 1 17J 1 1 0 Albert 'Guy' Sullivan, City Fire Chief, appeared before the Board on behalf of the Fire Department and reported the County fire truck was six or seven years old and requested the County purchase a new chassis and cab and have the pumps repaired. Mr. Sullivan was advised that after receiving a financial report from the Clerk further consideration would be given in the matter. Walter T. Erickson, Attorney, appeared before the Board in behalf of Clifford Lamar asking that he be parolled to him or some other responsible person for the balance of his sentence. He had been put,in jail on a drunk charge. The Board decided to parole Mr. Lamar for the balance of his sentence to Walter Erickson with the understanding that if Mr. Lamar should take a drink he will be picked back up for the balance of his term and not be allowed to work. This motion was made by Waddell and seconded by Commissioner Hamilton and carried. Sheriff L. B. O'Steen appeared before the Board and requested the Board adver- tise for bids on steel for the first story of the new jail. On Motion made by Commissioner Warren, seconded by Commissioner Hamilton and carried, Attorney S. N. Smith, Jr. was requested to prepare a notice inviting bids for this equipment. Rev. C. W. Owens; Mr. Jennings, Sanitary Officer of the County Health Department; C. C. Massey and T. R. Cadenhead, appeared before the Board and stated that they had a sanitary problem around Wabasso and asked if they might be given some land for a County Dump. The Board asked Ed Carter to check on land and report to the Board as to where would be a good place for a dumping ground. They also stated that they would like to have, and needed, a caution light or at least some good signs at the school crossing and Graves Packing House on the Highway in Wabasso. Mr. Carter was asked to contact the State Road Department with regard to this matter. Major Mason appeared before the Board and told them that the American Legion and other factions had planned to hold a County Fair here to be held the last week in March, containing exhibits from the schools, farm products, fruit, etc. Homer Fletcher appeared before the Board and the following described assessments on the 1952 Tag Roll were approved for corrections. Tract B, Ocean Corporation S/D All were corrected for the following reason: Construction of building not advanced sufficient- ly for taxable purposes on January 1, 1952. Bond of E. W. Vickers, member Mosquito Control Board in the sum of $59000.00 with National Fire Insurance Company of Hartford, was filed with Douglas Baker, Clerk of Circuit Court, December 30,, 1952, as provided by law. Notary Public Bond for Grace W. Richardson in the sum of 0500.00 with American Fire and Casualty Company as surety was approved January 2, 1953 by Douglas Baker, Clerk as provided by law. r282 On motion of Commissioner Hamilton, seconded by Commissioner Waddell and carried, the Board discontinued publication of the County Warrant List each month and instructed appointments had been filed with him. Clerk Baker accordingly, with the understanding a small legal notice would be published in NANE� lieu thereof advising the public that a copy of the warrant lists would be posted on the RESIDENCE bulletin board in the Court House each month. Gerald Adams Marcel A. Boudet, County Agent, presented a narrative report from December 1, Sebastian, 1951 to November 30, 1152 and a plan of work report from January 1, 1953 to December 31, 1953, Myrtle Tillis 4 which were revie* by the Board and ordered filed with the Clerk. Florida Mrs. Anne Christensen, County Welfare Case Worker appeared before the Board Marvin L. ging and gave a report of her activities for the Month of December, 1952, which report was ordered Vero Beach, filed with Clerk Baker. On Motion of Commissioner Hamilton, seconded by Commissioner Waddell and 5 carried, the Board authorized and instructed Sheriff O'Steen to have prepared a sign relating Florida to visiting hours for the Jail, said.visiting hours to be determined by the Sheriff. Charlie Garbett 2A Winter Beach, The Board authorized Douglas Baker, Clerk, to deposit the balance of the registry of Circuit Court funds in the sum.of $7,035.55 in. the Road and Bridge Fund regarding Condemnation Suit #3398. Florida The following Confederate pensioner of Indian Rimer County was approved: S. T. Joyce -NO.KM ADDRESS Vero Beach, 2767 Mrs. AnAie Ruffner Roseland, Florida On Motion of Commissioner Waddell, seconded by Commissioner Hamilton, it was moved that Ed Carter as representative of the Board approving plats, shall require a right- of-way width of 80 feet for all marsh areas and 70 feet right-of-way widths as to the remainder of the County on all future plats dedicated. Hanson filed a Petition before this Board on the 2nd day of December, 1952, at a meeting of said Board requesting this Board to adopt a Resolution closing, vacating and abandoning the following streets and renouncing and relinquishing the rights of Indian River County, Florida, or the public in and to the following described streets, to -wit: Osceola Street from Wauregan Avenue to the railroad; Harrison Street from Manatee Avenue to the railroad; Spring Street from Manatee Avenue to the railroad; Lake Street from Manatee Avenue to the railroad; Lime Street from Manatee Avenue to the railroad; Maple Street from Manatee Avenue to the railroad; Beach Street from Manatee Avenue to the railroad.; All according to the plat of Wauregan as recorded in Plat Book 1, pages 178 and 179, in the office of the - Clerk of the Circuit Court of St. Lucie County, Florida, Motion for adoption of the Resolution was duly made by Commissioner Waddell and unanimously carried. • Commissioner Waddell introduced the following resolution and moved its adoption, to+wit: R E S O L U T I O N- SECONDARY ROADS now situated in Indian River County, Florida. 2. That this Board has published notice thereof one (1) time in the Vero Beach Press Journal, a newspaper of general circulation in Indian River County, Florida, said publication being published at least two (2) weeks prior to the date stated therein for a public hearing. 3. That those streets above described are not State or Federal roads main- tained by the State of Florida and that said streets are not located within the incorporated limits of any municipality and are located in Indian River County, Florida. 4. That apublic hearing thereon has been held by the Board of County Comm- issioners in the office of said Board in the Indian River County -Courthouse, Vero Beach, • Florida, on January 9, 1953, at 10:00 o'clock A.M., the meeting of January 6 having been adjourned to January 9, at which time persons interested were heard; and, BE IT FURTHER RESOLVED that this Board does herewith close, vacate and abandon any public or private street, road, alley -way -or other place used for travel and all portions thereof and does herewith renounce and discla-im any right of Indian River County, Florida, and the public in and to all the lands delineated as a street, road or highway as the same pertain to the streets hereinbefore described. Motion for adoption of the Resolution was duly made by Commissioner Waddell and unanimously carried. • Commissioner Waddell introduced the following resolution and moved its adoption, to+wit: R E S O L U T I O N- SECONDARY ROADS YEAR 1953 STATE OF FLORIDA COUNTY RESOLUTION ON USE OF 80% SEVENTH CENT GAS TAX AND OTHER SECONDARY ROAD FUND COUNTY OF INDIAN RIVER WHEREAS, under Chapter 26,321 of the Extraordinary Session of 1949, known as the "Secondary Roads Assistance Act of 1949", the State Road Department will receive 80% of the proceeds of this County's prorata share of the Seventh Cent Gasoline Tax, to be used ex - elusively by the said department within this County, as directed by Resolution of this Board of County Commissioners, for one or more of the following purposes: Construction, recon- struction, maintenance and repair of State roads and bridges, the lease or purchase of bridges. connecting State roads, the acquisition of rights of wap for State roads, and the reduction of road and bridge indebtedness; and, WHEREAS,.the State Road Department has requested this County Board to desig- nate also the purpose for which, and the roads on which, this County's 80% surplus gas tax and Federal Aid Secondary allocations should be spent for construction and improvement; and, WHEREAS, the State Road Department is required by law to adopt an annual budget of maintenance and construction work designed to use all except ten percent of its anticipated income during the year, which budget must be set up in January and adopted in February of each year; and, WHEREAS, the State Road Department cannot prepare and adopt a budget until it has ascertained and determined the desire of the Board of County Commissioners in the form of a Resolution, as to how this County's Secondary Road funds should be used; Now, therefore, BE IT RESOLVED that the State Road Department of Florida is hereby requested and directed to use such funds on the following projects in the order of their designation as follows, to -wit: 1. LATERAL "B" (KING'S HIGHWAY) ROAD From the,Oslo, Road North on Lateral "B" (King's Highway) Road to State Road No. 508 a distance of approximately 9 miles. 2. SOUTH GIFFORD ROAD From S R D No. 505 at Northwest Corner of Southwest Quarter of Section 29 East to State Road No. 5 a distance of approximately 3.3 miles STATE ROAD RTO_. From South County Line at Southwest Corner Section 35, Township 33 South, Range 39 East, North to State Road No. 60, a distance of approximately 5.5 miles. 4. SOUTH WINTER BEACH ROAD From S R D No. 505 at Northwest corner of Southwest quarter of Section 81'Towaship 32 South, Range 39 East, East to State Road No. 5 a distance of approximately 2.6 miles. 5. ROSELAND ROAD From State Road No. 5 to State Road No. 512 a distance of approximately 5 miles. That said projects as above set forth are designated in the order of their priority as determined by this Board for the year 1953. BE IT FURTHER RESOLVED, that this direction as to use of such funds for 1953 shall remain in effect throughout the year unless revised or supplemented by mutual agreement between the Board of County Commissioners and the State Road Department, which revision or supplement shall result from some emergency or urgent need, and shall be in the form of a new County Resolution, the provisions of which are agreed to and accepted by the State Road Department; and that the tentative.schedule for use of Secondary Funds for 1953 be con- sidered in effect unless annual Resolutions amending same are filed by January 10th in that year. Manuel, Member, State Road Department from this District. adopted. to -wit: Upon being duly seconded by Commissioner Hamilton, the same was unanimously - - - - - - - - - - - - - - - - - R E S O L U T I O N- Primary Road ProJeo.t, s Commissioner Warren introduced the following resolution and moved its adoption, R E S O L U T I 0 N WHEREAS, the State Road Department of the State of Florida is now in process. of preparing its annual budget for the year 1953; and, WHEREAS, the Board of County Commissioners of Indian River County is vitally interested in the additions, extensions and improvements to the primary road system of the State of Florida in Indian River County, Florida; Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that this Board does herewith'respeotfully request the State Road Department of Florida to include and incorporate in its budget for the year 1953 for primary roads the following projects in Indian River County, Florida, to -wit: 1. The widening, extension and improvement of Florida State Road No. 5 on its present right of way into a modern and adequate four lane highway from the Overpass at the South County Line to the South City Limits of the City of Vero Beach. This project was in the 1952 budget of the State Road Department, identified as State Road 5, Section 8801-691, Indian River County, and it is requested that this item be carried over into the 1953 badget. Most of the right of way for this project has been obtained. 2. The widening, extension and improvement of Florida State Road N"o. 5 on its present right of wag into a modern and adequate four lane highway from the North City Limits of the City of Vero Beach to the North County Line. BE IT FURTHER RESOLVED THat a certified copy of this Resolution be furf.ished to the Honorable Richard H. Simpson, Chairman, State Road Department, and to the Honorable Thomas B. Manuel, Member, State Road Department from this District. Copy of Report #3824, which was made on the audit of the accounts of the officials of Indian River County listed on the Title Page, was presented to the Board in connection with the Provision of Section 125.09, Florida Statutes, and ordered filed as a part of the public records of Indian River County. Tho_severhl".bills and accounts against the County, having been audited, were examined and found correct, were approved and warrants issued in settlement of same. Such bills and accounts being on file in the office of the Clerk of the Circuit Court, the warrants.! so issued from the respective funds being listed in the Supplemental Minute Book, as provided by the rules of the State Auditor, reference to such record and the list so recorded being • made a part of these minutes. The County Depository filed its monthly statement, showing receipts and dis- hursements of the various funds, which having been audited, were found to be correct. There being no further business, on motion made, seconded and carried, the Board then adjourned. ATTEST: Monday , JANUARY 19, 1252 The Board of County Commissioners of Indian River County met at the Court House in a Special Meeting held at 10:00 o'clock A.M., Monday, January 19, 1953, with the follow- ing members present: W. C. Graves, Jr., Chairman; Aubrey L. Waddell and Allison Warren. Absent were J. J. P. Hamilton and H. C. -Watts. Also present were E. E. Carter, Road and Bridge Superintendent and -Douglas Baker, Clerk. Chairman Graves announced this meeting was called for the purpose of County road right-of-way matters and such other business as might be properly brought before the Board. It was moved by Commissioner Waddell, seconded by Commissioner Warren and carried, that Anna F. Smith, a widow, be paid the sum of $800.00 from the Road and Bridge Fund for right-of-way land in connection with the Lateral "B" road.
