Session at the County Commission Chambers , 1840 25 `' Street, Vero Beach, Florida , on
Tuesday, August 14 , 2001 . Present were Caroline D . Ginn , Chairman ; Ruth Stanbridge ,
Vice Chairman ; Commissioners Fran B . Adams ; Kenneth R . Macht ; and John W . Tippin .
Also present were James E . Chandler, County Administrator ; Paul G . Bangel , County
Attorney ; and Patricia Ridgely , Deputy Clerk ,

The Chairman called the meeting to order at 9 : 00 a . m .

Vice Chairman Stanbridge delivered the invocation .

Administrator Chandler introduced Erik Olson the new Utilities Department Director
who brings 20 years of solid utilities experience . Administrator Chandler commented how
pleased he was to have Mr . Olson with the County .

SUBJECT: Request for Termination of Able Ambulance ' s C . O . P . C . N . Class B & E Designation
The Department ofEmergency Services has been notified by Able Ambulance of their intent to terminate nI
emergency transport in Indian River County . Pursuant to Chapter 304, Section 304. 10, of the Indian River
County Code of Ordinances, Mr. Gary Burdsall, President of Able Ambulance, has submitted written
notification to terminate their Certificate of Public Convenience and Necessity (COPCN) for Class B & E
ground transports . <
It is my understanding that Able Ambulance is terminating all business activity and selling their entire fleet of
ground transport vehicles. The company has already ceased all ground transport activity in Indian River
County . Since Mr. Burdsall ' s announcement, staff has received requests from two (2 ) companies for
C . O .P . C . N. applications. These companies plan to submit applications to replace the service provided by Able
Ambulance following the guidelines contained within Chapter 304 .

Utility Services recently purchased a book titled Water Distribution Modeling, by Haestad Methods . In the
back o each chapter in the book is a set of exercise problems . which may be worked and submitted to
Haestad Methods for obtaining CEU. Haestad Methods also has a web site ( ww-w.haestad. com) where
people can test their knowledge of engineering and hydraulics by taking a monthly quiz. A high enough
score entitles the participant to miscellaneous prizes and gifts. The Department of Utility Services recently
received a voucher for grading exercise problems ( see attached copy) , which can be used for acquiring
CEU . The purpose of this agenda item is to request approval to utilize the voucher for obtaining CEU .
ANALYSIS
Of the eight CEU, four CEU have to relate to the licensee ' s areas of practice and four hours shall
relate to the rules of the Board (refer to attached BPE section) . The gift voucher grants a participant $300
worth of problem grading. The cost to receive 4 .5 CEU from the exercise problems is 5225 ( see attached
exercise problem instruction sheet). Therefore, the gift voucher could be used to obtain the total required
CEU needed to satisfy the area of practice requirement for a licensee. The normal method of obtaining
CEU is to attend accredited seminars. A typical seminar cost $900, and qualifies the participant for 1 .2
CEU (see attached copy of brochure for future seminars) . To obtain the required 4. 0 CEU needed to
satisfy the area of practice requirement, a licensee would have to attend three seminars at a total cost of
$2, 700 . The expense of travel will likely increase the total cost to well over $3 ,000 , which will be saved
by utilizing the gift voucher.
RECOMMENDATION
The staff of the Department of Utility Services recommends that the Board of County
Commissioners accept the gift voucher from Haestad Methods as a donation, and allow staff to utilize the
voucher for obtaining CEU credits for Professional accreditation .

RECOMMENDATION :
Authorize the Chairman of the Board of County Commissioners to execute the
Resolution accepting the right-of-way dedication and cancelling certain taxes
upon publicly owned lands , and the Clerk to send a certified copy of same to the
Tax Collector so that any delinquent or current taxes can be cancelled .

It is requested that the data herein presented be given formal consideration by the Board of County
Commissioners at its regular meeting of August 14, 2001 .
BACKGROUND :
GHA Grand Harbor Ltd. , the developer of the Grand Harbor DRI (Development of Regional
Impact) project, has applied for changes to the Grand Harbor development order (D. O. ) . The
proposed changes involve certain traffic conditions and extension of certain completion timeframes.
Pursuant to Florida Statues 380. 06 and in coordination with the applicant, staff recommended and
the Board approved an August 14, 2001 public hearing date to consider approval of the application.
However, due to scheduling conflicts, the applicant has proposed (with staff concurrence) that the
August 14, 2001 public hearing be `opened" and continued without action until the September 4,
2001 Board meeting.
ANAi ,YSM :
On July 3 , 2001 when the Board set the August 14th public hearing date, it appeared there would be
sufficient time for the applicant to secure "no objection" determinations from FDOT and the
Treasure Coast Regional Planning Council (TCRPC) . Due to summer scheduling conflicts, the
applicant has found that the "no objection" determinations cannot be obtained in time for the August
14th hearing . However, the applicant believes that such determinations can be obtained in time for
a September 4th public hearing.
Florida Statutes 380. 06( 19)(f)3 . allows for deferral of the public hearing date for the application
because the developer is requesting an extension. Therefore, to allow sufficient time for the applicant
to coordinate with FDOT and TCRPC, the Board needs to open the August 14th public hearing and
August 14 , 2001

continue it to a time certain. In staffs opinion, a September 4th, 20012 9 : 00 a. m. hearing would
accommodate the review process and the applicant ' s request. Full analysis and back-up will be
provided to the Board for the September 4th hearing.
RECOMMENDATION;
Staff recommends that the Board of County Commissioners open the August 14, 2001 public hearing
for the Grand Harbor Notice of Proposed Change request and immediately continue the public
hearing to 9 : 00 a.m . at the September 4, 2001 regular Board meeting.

DESCRIPTION AND CONDITIONS
The County Engineering Division takes part in the FDOT Local Agency Program (LAP ) where
Agreements are entered into between the entities for the participant to design and construct projects
and the FDOT reimburses the Local Agency (County) for the work . Currently, staff has three of
these Agreements with the FDOT to provide up to 5683 . 000 . 00 of funding for the above stated
project sites . ( This total includes an estimated 8165 ,000. 00 for improvements to the FEC Railroad
for the sidewalk crossing . ) Staff has prepared construction plans , contract documents ,
specifications , and recently bid the three projects as one .
Bid Opening Date : July 25 , 2001
Advertisement Dates : July 3 and 10, 2001
Bids Received : Three (3 )
Staff has considered making all the sidewalks 6 " thick. The cost difference between 4 " and 6 " is
considered minimal but will reduce future maintenance costs for damage repairs made by vehicles
driving across them .
Tim Rose Contracting, Inc . submitted the low bid in the amount of 5531 , 191 . 95 . Staff is of the
opinion that the bid is reasonable.

The Florida Department of Transportation (FDOT) has signed Agreements with the County to
provide $ 683 , 000 . 00 towards construction of these sidewalks by means of reimbursement when

BACKGROUND:
On March 06, 2001 the Board of County Commissioners awarded Bid No . 3045 to Treasure Coast
Contracting ( see attached agenda item and minutes-Attachment 1 ) in the amount of $75 ,982 .22 to provide water
service and fire protection to the above referenced project. The project is now complete and the Department of
Environmental Protection has issued clearance to begin connecting customers . The Department of Utility
Services is now prepared to make final payment to the Contractor.
ANALYSIS :
The Contractor was previously paid $58,029.97 for 76.4% of the original construction cost. The bid
quantities used during the bidding process are based on estimated quantities . Change Order No. 1 adjusts the
estimated bid quantities based on actual quantities installed. Change Order no . 1 results in a net reduction of
$8 .622 .47 . Change Order No 1 is presented as Attachment-B .

The change order reduction ($8 , 622 .47) results in an 11 .3 % decrease to the originally approved contract
and adjusts the final contract amount to $67,359. 75 . Utilities staff is now requesting final payment to Treasure

RECONUgENDATION:
The staff of the Department of Utility Services recommends that the Board of CountyCommissioners

BACKGROUND :
On December 12 , 2000 , the Indian River County Board of County Commissioners approved
Resolution III , No . 2000- 152 , for the preliminary assessment roll on the above-referenced project .
Construction of the project has been completed. Owners have been notified and connections have begun .
Staff is requesting the Board ' s approval of the final assessment roll . ( See attached minutes
-
ATTACHMENT 1 ) of the above referenced meeting .
ANALYSIS :
The preliminary assessment was for an estimated cost of 5100 , 343 . 00 , which equated to SO 283264
( rounded) per square foot of property assessed . The final project cost and assessment ( see attached
Resolution IV and the accompanying assessment roll-ATTACHMENT 2 ), is in the amount of S77 ,927 . 00
which equates to a cost of 50 .219985 (rounded) per square foot. The final assessment is S 0 . 0633 per
square foot or 22 . 34 % less than the preliminary assessment.
RECOIIUWENDATION :
The staff of the Department of Utility Services recommends that the Board of County Commissioners
approve adoption of Resolution IV, which is attached, and authorize the Chairman to execute same .

WHEREAS , on Tuesday, December 12, 2000, the Board held a public hearing at which
time and place the owners of property to be assessed appeared before the Board to be heard
as to the propriety and advisability of making such improvements; and
WHEREAS , after such public hearing was held the County Commission adopted
Resolution No. 2000452, which confirmed the special assessment cost of the project to the
property specially benefited by the project in the amounts listed in the attachment to that
resolution ; and
WHEREAS , the Director of Utility Services has certified the actual "as-built " cost now
that the project has been completed is less than in confirming Resolution No. 2000452,
NOW, THEREFORE , BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows :
1 . Resolution No. 2000452 is modified as follows : The due date for the referenced project
and the last day that payment may be made avoiding interest and penalty charges is ninety
days after passage of this resolution .
2. Payments bearing interest at the rate of 6. 75% per annum may be made in ten annual
installments , the first to be made twelve months from the due date . The due date is the
date of passage of this resolution .
3 . The final assessment roll for the project listed in
Resolution on No. 2000- 152 shall a be
as
shown on the attached Exhibit "A. "
4 . The assessments , as shown on the attached Exhibit "A, " shall stand confirmed , and will
remain legal , valid , and binding first liens against the property against which such
assessments are made until paid .
5 . The assessments shown on Exhibit "A, " attached to Resolution No. 2000- 152, were
recorded by the County on the public records of Indian River County, and the lien shall
remain prima facie evidence of its validity.

UPDATE
Vice Chairman Stanbridge advised that the United States Coast Guard application for
Lost Tree will not be issued as long as the environmental resource permit is not issued by the
State .
Chairman Ginn advised that she had been out recently in a pontoon boat and they tried
to get into McCullers Cove on the north side of the northernmost inner ( Lost Tree ) islands ,

but the pontoon boat got hung up several times . She planned to contact the USCG and relate
her experience .
