ATTEST: V � , i cu. r TUESDAY, MARCH 24, 1953 The Board of County Commissioners of Indian River County met at the Court House In a Special Meeting held at 9:00 o'clock A. M., Tuesday, March 24, 1953 with the following members present: W. C. Graves, Jr., Chairman; Aubrey L. Waddell; J. J. P. Hamilton; H. C. Watts; and Allison Warren. Also present were E. E. Carter*, Road and Bridge Superintendent; S. N. Smith, Jr., Attorney; Homer Fletcher, Tax Assessor; Mr. Ballou, Auditor; and Katherine Morrison, Deputy Clerk, W. C. Graves, Jr., Chairman, called the meeting to order and stated that this meeting was called by Sherman Smith, Jr., Attorney, for the purpose.of discussing Special Legislation Acts to be brought up in the next session of Legislature in Tallahassee. He then turned the meeting over to Sherman Smith, Jr. Mr. Smith stated that the first proposed Bill for Legislation that he had in mind was the setting up of a building permit system. After considerable discussion, it was moved by Commissioner Watts, seconded by Commissioner Waddell and carried, that the following Bill be presented for legislation. A bill to be entitled An Act AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS CF INDIAN RIVER COUNTY, FLORIDA, TO ADOPT REGULATIONS PRESCRIBING BUILDING SET -BACK LIFE S FROM ANY ROAD, STREET OR HIGHWAY, EXISTING OR PROPOSED, IN INDIAN RIVER COUNTY, FLORIDA, LYING OUTSIDE THE LIMITS OF ANY MUNICIPALITY OF SAID COUNTY AND PROVIDING THAT NO BUILDING PERMIT SHALL BE ISSUED EXCEPT IN ACCORDANCE WITH SUCH REGULATION AND PROVIDING THAT NO BUILDING OR STRUCTURE SHALL BE ERECTED OR MAINTAINED WITHIN ANY BUILDING SET -BACK LINE SO ESTABLISHED. It was also decided that a set fee of $2.00 per thousand for all County building permits be authorized. After considerable discussion, it was moved by Commissioner Hamilton, seconded by Commissioner Warren and unanimously carried, that Sherman Smith, Jr. present the following Bill -for Legislation. A bill to be entitled An Act AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY TO PROCURE AND PAY PREMIUMS ON LIABILITY INSURANCE AGAINST TORT. ACTIONS: REQUIRING INSURER TO WAIVE DEFENSE OF GOVERN - I 1W 1 1 0 u 0 1 1 0 7 303 MENTAL IMMUNITY IN ANY SUIT BROUGHT AGAINST COUNTY: WAIVING GOVERNMENTAL IMMUNITY ONLY TO EXTENT OF • INSURANCE CARRIED. A platting law was next discussed and upon Motion of Commissioner Waddell, seconded by Commissioner Watts and unanimously carried, the following is to be introduced for legislation: A bill to be entitled An Act PERTAINING TO PLATS AND PLATTING OF LA NDS IN INDIAN RIVER COUNTY, FLORIDA, AND DEFINING THE SAME: REQUIRING THE APPROVAL OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AND THE GOVERNING BODY OF EACH MUNICIPALITY IN INDIAN RIVER COUNTY, FLORIDA, TO PRESCRIBE DRAINAGE FACILITIES, THE WIDTH OF ROADS, STREETS, ALLEYS AND OTHER THOROUGHFARES, AND SETBACKS THEREFROM: MAKING CERTAIN REQUIREMENTS A is PREREQUISITE TO APPROVAL OF PLATS: AUTHORIZING BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AND GOVERNING BODY OF EACH MUNICIPALITY IN SAID COUNTY TO ADOPT RULES AND REGULATIONS TO EFFECTUATE PROVISIONS AND PURPtS ES (F THIS ACT; REPEALING ALL LAWS AND PARTS OF LA WS IN CONFLICT HEREWITH. After considerable discussion, upon Motion of Commission Waddell, seconded by Commissioner Watts and carried, the following Bill is to be introduced by Sherman N, Smith, Jr. in the Florida Legislature: A bill to be entitled An Act TO AUTHORIZE AND EMPOWER THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, TO GRANT EASEMENTS AND FRANCHISES FOR RIGHTS OF WAY OVER, IN. AND UPON AND ACROSS COUNTY ROADS FOR THE MAINTENANCE OF PIPES, POLES AND LINES FOR THE TRANS- MISSION AND DISTRIBUTION OF WATER, GAS, ELECTRIC POWER AND FOR TELEPHONE AND TELEGRAP H PURPOSES, UNDER SUCH CON- DITIONS AND WITH SUCH LIMITATIONS AS SAID BOARD MAY, IN • ITS DISCRETION, IMPOSE, AND RATIFYING AND CONFIRMING ALL EASEMENTS AND FRANCHISES HERETOFORE GRANTED BY SAID BOARD FOR SAID PURPOSES, Upon Motion of Commissioner Hamilton, seconded by Commissioner Warren and carried, the following is to be introduced for legislation: A bill to be entitled An Act TO AUTHORIZE AND EMPOWER THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, TO LEASE ANY REAL OR PERSONAL PROPERTY BELONGING TO SAID COUNTY NOT NEEDED FOR COUNTY PURPCSES, PROVIDING FOR THE PROCEDURE IN MAKING ANY LEASE THEREOF, AND RATIFYING AND CONFIRMING ALL LEASES HERETOFORE GRANTED BY SAID BOARD, Upon Motion of Commissioner Waddellq seconded by Commissioner Hamilton and 0 carried, the following bill is to be introduced for legislation: A bill to be entitled An Act TO ABOLISH JUSTICE DISTRICTS IN INDIAN RIVER COUNTY, FLORIDA, AND PROVIDING FOR A REFERENDUM. UpanMotion of Commissioner Hamilton, seconded by Commissioner Waddell, and unainimously carried, the following several bills are to be introduced in the Legislature: "A bill to be entitled An Ac•t TO MAKE IT UNLAWFUL FOR LIVESTOCK TO RUN OR ROADS AT LARGE IN INDIAN RIVER COUNTY, FLORIDA: TO PROVIDE FOR THE IMPOUNDING AND SALE OF ANY LIVESTOCK RUNNING AT LARGE: TO PROVIDE THAT PERSONS DAMAGED BY SUCH LIVESTOCK RUNNING AT LARGE MAY RECOVER DAMAGES THEREFOR FROM THE OWNER OF SUCH LIVESTOCK AND TO PROVIDE PENALTIES FOR THE VIDLATION OF THIS ACT." "A bill to be entitled An Act AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS OF INDJA N RIVER COUNTY, FLORIDA, TO INDEPENDENTLY REGULATE BY RESOLUTION THE HOURS OF SALE OF ALCOHOLIC BEVERAGES WITHIN INDIAN RIVER COUNTY, FLORIDA, INCLUDING ALL MUNICIPALITIES AND TO PROVIDE PENALTIES FOR THE VIOLATION THEREOF." "A bill to be entitled An Act FIXING THE LAST DAY ON WHICH CANDIDATES FOR NOMINA71ON FOR COUNTY OFFICES IN INDIAN RIVER COUNTY, FLORIDA, SHALL QUALIFY FOR POLITICAL PARTY NOMINATION IN THE PRIMARIES," "A bill to be entitled An ,Act FIXING THE COMPENSATION TO BE PAID TO AND RECEIVED BY MEMBERS OF BOARDS OF COUNTY COMMISSIONERS IN AND FOR EACH COUNTY HAVING A POPULATION OF MORE THAN ELEVEN THOUSAND, FOUR HUNDRED SIXTY (11,460) AND NOT MORE THAN ELEVEN THOUSAND, EIGHT HUNDRED EIGHTY (11,880) ACCORDING TO THE LAST FEDERAL CENSUS AND PRO- VIDING FOR THE PAYMENT OF EXPENSES OF SUCH BOARD MEMBERS. "A bill to be entitled An Act PRESCRIBING THE AMOUNT AND AUTHORIZING THE COMPENSATION TO BE PAID TO AND RECEIVED BY EACH MEMBER OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AND PROVIDING FOR THE PAY- MENT OF EXPENSES OF SUCH BOARD MEMBERS. After considerable discussion, upon Motion of Commissioner Waddell, seconded by Commissioner Hamilton and unanimously carried, Sherman N. Smith, Jr. was authorized to present Motions to Repeal the following laws: Act 922114, Laws of Florida, 1943. Outstanding State held Tax Certificate Law. Law establishing delinquent bond, 1935. Law fixing Tax Assessors Fees passed in 1935. Law of 1927 authorizing County Commissioners to employ traffic officers. Law establishing the Vero Beach Inlet District. Act of 1935 with respect to distribution of gasoline taxes. Law relating to the distribution of race track funds. Sherman N. Smith, Jr. now turned the meeting back to the Chairman W. C. Graves, Jr. 40 11 0 U 0 1 1 0 1 1 0 i n 1 Garbage disposal in the County was brought under discussion and a Committee consisting of Commissioners Watts, Waddell and Carter was appointed to check up on the best location for a County dump in Fellsmere, Gifford, and other parts of the County. It was agreed by the Commissioners that each of them would look around in their Districts for any County owned land that might be used as County dumps. Douglas Baker, Clerk was asked to put a Notice in the paper stating the location of all County Dumps, and to ask Sheriff O'Steen to arrest any persons caught dumping garbage along roads or canals or any place other than County or City dumps. Commissioner Waddell and Commissioner Warren were appointed a Committee to con - tact the new County Health Doctor and see why he has not been at the Clinic on Clinic days and find out why he has not taken more interest in his work in this County. The Commissioners asked Sherman N. Smith, JLC,, Attorney to see Mr. Jewett about the appraisal of Arendas and Claggett's property on U. S. 1 Highway. Commissioner Hamilton brought before the meeting the need for colored rest rooms in the Court House. After considerable discussiob, Commissioners Waddell, Allison Warren and W. C. Graves, Jr., together with E. E. Carter, Road and Bridge Superintendent, were appointed as a committee to see an architect about draining up a design and figuring out the best place for, and the cost of putting in, colored nest rooms in the Court House. Upon Motion of Commissioner Watts, seconded by Commissioner Waddell and carried, the Board accepted the Bid of the Square Deal Machine and Supply Company for a 2 cylinder Concrete Mixer at a price of $1570.00 less a.5% discount for cash payment. The mixer to be equipped with power loader. Notary Public Bond for Eloise D. Dewitt and Notary Public Bond for Alex J. Snow, each in the sum of $500.00 with the St. Paul Mercury Indemnity Company as surety were approved March 6, 1953 by Douglas Baker, Clerk Circuit Court as provided by law. Notary Public Bond for Arthur L. Tameling in the sum of $500.00 with the American Surety Company as surety was approved March 14, 1953 by Douglas Baker, Clerk Circuit Court as provided by law. Notary Public Bond for F. D. Bush in the sum of $500.00 with the American Auto Surety Company as surety was approved March 19, 1953 by Douglas Baker, Clerk Circuit Court as provided by law.
