HomeMy WebLinkAbout10/6/19531 0 1 11 0 RESOLUTION -- Adopting Tentative Budget Commissioner Waddell introduced the following Resolution and moved its adoption, to -wit: WHEREAS, the Board of County Commissioners did receive and examine and tenta- tively adopt a proposed budget of excess receipts and their expenditure for the fiscal year ending..September 30, 1953; and, WHEREAS, this Board did cause a summary.statement thereof to be advertised one 0 time in a newspaper of general circulation published in Indian River County, Florida, to -wit: In the issue of September 17, 1953, of the {hero Beach Press Journal, as will more fully appear' by proof of publication thereof filed in the minutes of this Board; -and, WHEREAS, this Board did.meet at the time and place stated in said advertisement for the purpose of hearing requests and complaints of the public regarding said supplemental budget and for the purpose of holding a public hearing and.making whatever revisions in the budget it may beem necessary; Now, therefore, BE IT RESOLVED that the Board of County Commissioners of Indian River County, Florida, does herewith tentatively adopt said supplemental budget for the fiscal year ending September 30, 1953, in the form as heretofore tentatively adopted and duly advertised. BE IT FURTHER RESOLVED that said supplemental budget shall be filed in the office of the County auditor as a public record and the Clerk hereof shall transmit two copies of the supplemental budget as adopted to the Comptroller of the State of Florida and said supplemental budget shall be considered as finally adopted and as official upon approval as to form by the Comptroller. Upon being duly seconded by Commissioner Warren, the same was unanimously adopted. It is agreed that all members and representatives of the Board who could, should attend the Mid -Winter Converence of the State Association of County Commissioners to be held at hinter Haven October 10 11 and 12th, expenses to be paid by the County. C. hiatts introduced the following Resolution and moved its adoption, as follows, to -wit: WHEREAS, the Board of County Commissioners, acting for and upon behalf of Indian River County, Florida, and the State Road Department of Florida have heretofore entered into an Agreement for advance funds for acquisition of rights of way for that certain State Road oK portion designated as Section 8801-691, State Road 5; and, WHEREAS, the Board of County Commissioners has consummated agreements for obtaining said rights of way with the parties hereinafter named, which said agreements and payments are in the opinion of said Board fair and reasonable and based upon full and careful consideration of the market value of the land and/or improvements to be taken, Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida that this Board does herewith request, instruct and direct the State Road Department of Florida to pay to the parties hereinafter named the sums of money hereinafter set forth for each, all to be charged in accordance with said Agreement as a part of said advance, as follows, to -wit: 1. Upon being duly seconded by Commissioner Waddell, the same was unanimously adopted. - - - - - - - - - - - - - - - - - - - - - E S L L U T I 0 N - -- P L A T On Motion of Commi ssioner Watts, s econded by Commissi oner Wad:del.l.,, the follow - ing Resolution was adopted. 1 1 0 0 353 WHEREAS, Chapter 29155, -Laws of Florida, Acts of 1953, requir.es the approval of the Board of County Commissioners of Indian River County, Florida, of any proposed plat of lands in Indian River County, Florida, outside the .limits of any municipality; and, WHEREAS, said Act authorizes the Board of County Commissioners to adopt rules .and regulations pertaining to the platting of lands in Indian River County, Florida; Now, • 1 0 1 0 and regulations. 2. Any and all streets or roads shown upon any plat shall have a right of way of not less than the building setback line, if such a building setback line has been e,stab- lished by this Board for the road, street or highway upon.which the platted lands abut. 3. All public roads shown or proposed upon the County system of existing and proposed public roads shall have a right of way width not less than that shown or proposed upon the County plan of public roads. 4. The right of way for State Road 5 from the South City Limits of the City of Vero Beach to the South County Line shall be. the right of way set forth and contained in the right of way map of the State Road Department of the State of Florida, Section 8801-150-191-206, which said right of way map is recorded in the office of the Clerk of the Circuit Court of Indian River County, Florida, in Plat Book 3, page 26. The right of way for the remainder of State Road 5 through Indian River County shall be 120 feet. 5. The right of way for State Road AIA shall be 100 feet, that is, 50 feet on either side of the present existing center line of said road from the South City-Lirpits of the City of Vero Beach to the South County Line. The right of way for said road from the North City Limits of the City of Vero Beach to the North Limits of Indian River County shall be 100 feet, that is, 50 feet on either side of the center line as it exists on the ground of the proposed realigning, widening and extension of said road. 6. The right of way for State Road 60 shall be 100 feet, that is, 50 feet on either side of the center line of said road as the same now exists. 7. The right of way for State Road 512 shall be 100 feet, that is, 50 feet on either side of the center line of said road as the same now exists. 8. All other streets, roads and highways shall have a right of way width of not less than 70 feet. 9. No block shall exceed 660 feet in length. 10. All streets, highways or roads shall be laid out so that they will be con- tinuations of existing streets, highways or roads or extensions of proposed st-reets, highways or roads. 11. All,streets, highways or roads shall be laid out 'to the adjoining property , and shall not be blocked by lots or otherwise aid no blind or dead-end streets, roads or high- ways shall be laid out. 12. Where any.street is curved, the curves therein shall be long, easy curves well laid out and no setoffs or abrupt, reverse curves shall be allowed. 13. The rear of all lots shall have an alley of not less than 15 feet in width or a 10 foot easement shall be reserved along the rear of abutting lots for public utilities. therefore, BE IT RESOLVED by Board County Commissioners of Indian River County, the of Florida, that this Board does herewith adopt the following rules and regulations ,under the authority of said Act, to -wit: 1.. No plat or map depicting t -he division or subdivision of lands in Indian River County, Florida, shall be approved.or recorded in the public records of said County except pursuant to Chapter 29155, Laws of Florida, Acts of 1953, and pursuant to these rules • 1 0 1 0 and regulations. 2. Where said lands abut on the limits of any municipality, all streets, roads and highways' shall coincide with the plan of said municipality. 19..Before any proposed subdivision is staked out or laid out upon the ground,; the proposed plat shall be submitted to the Board of County Commissioners or :its duly author- ized representative for its tentative approval, together with the supporting data required by this Resolution and Chapter 29155, Laws of Florida, Acts of 1953, and if the Board or its 14. Details showing the provisions for drainage of the lands and coinciding of drainage facilities with adjacent lands may be shown on the plat or may be set forth by separate statement attached to the plat. The name or number of all roads, streets and high- ways shall be shown upon the plat. If the County system of public roads shows a name or number for any street, highway or road, then such name or number shall be shown upon the plat.; If no name or number is so shown on the County plat, then any name or number may be used pro- vided said name or number does not exist on any other street, highway or road in Indian River County. 22. The dedication of allstreets, highways or roads and -other ways or ease- ments shown upon the plat shall be.to the public unless the Board shall determine that public 15. No single lot shall be laid out having a width or frontage of less than 50 feet nor having a depth of less than 100 feet. each mortgage or other lien on said lands. 16. The grades of all roads, streets, alleys and other 'i rights of .way may be designated on the plat or by separate instrument attached thereto. 17. The elevations of the several portions of the land shown on the plat shall be shown by contour lines or by.separate instrument attached thereto. Sea level datum shall be used. If no established sea level bench exists within 1 mile of the property, the County will establish a sea level bench on a public road within 1 mile of the lands to be subdivided. 18. Where said lands abut on the limits of any municipality, all streets, roads and highways' shall coincide with the plan of said municipality. 19..Before any proposed subdivision is staked out or laid out upon the ground,; the proposed plat shall be submitted to the Board of County Commissioners or :its duly author- ized representative for its tentative approval, together with the supporting data required by this Resolution and Chapter 29155, Laws of Florida, Acts of 1953, and if the Board or its duly authorized representative finds that said proposed plat conforms thereto, it shall tenta- tively approve the same, whereupon the lands shall be staked out and laid out on the around as provided by law and all streets, highways, roads, drainage facilities and other improvements shown or indicated on the plat or proposed by the developer shall be done and.completed and upon the completion thereof said tentatively approved plat shall be presented to the Board of County Commissioners for final approval and acceptance. 20. All streets, roads and public ways shall be constructed in accordance with the County's specifications and plan. 21. Should final.approval by the Board of County Commissioners of any plat be desired, the Board will approve the same upon compliance with all of the provisions of this . Resolutidn and Chapter 29155, Laws of Florida, Acts of 1953, and prior to the completion thereaf of the streets, highways, roads, drains and other improvements required, upon -the owner enter- ing into bond with the County with good and sufficient surety approved by the Board conditioned' upon the construction and completion of the same within such time as the Board may require. 22. The dedication of allstreets, highways or roads and -other ways or ease- ments shown upon the plat shall be.to the public unless the Board shall determine that public rights of way are not required in the County plan of public roads and all such dedications j shall be signed by the owner of said lands, his or her spouse, if married, and the holder of each mortgage or other lien on said lands. 23. The endorsement of the approval of this Board of each plat shall be in- scribed thereon and signed by the duly authorized representative of this Board. 24. The original tracing and one cloth print of said pkat as finally approved and recorded shall be furnished to the Clerk of the Circuit Court. One blue print shall be furnished to the Board.of County Commissioners and one blue print shall be furnished to the County Tax Assessor. 25. Where unusual circumstances or hardships exist, the Board will consider 40 the request of the developer for a variance from these rules and regulations. RESOLUTION --- Abandonment by Husband and Father of his Wife and children. r ' WHEREAS, the Board of County Commissioners is charged by law with the adminis- tration of the public welfare funds of said County; and, WHEREAS, this Board has made note of the increased demands upon said funds caused in large part by the abandonment by a husband and father of his wife and children; and', WHEREAS, Chapter 27996, Laws of Florida, .octs of 1953, authorizes and prescribes the method for civil proceedings to compel the support of dependent wives and children within and without the State of Florida; and, WHEREAS, said Act makes it the duty of the State's Attorney in each judicial circuit of. the State of Florida to enforce the provisions of said Act and to represent the Petitioner in all proceedings instituted thereunder unless the Petitioner shall engage a private attorney; and, WHEREAS, it is the considered judgment and opinion of this Board that full and effective use of the provisions of said Act must be made in order to compel those having legal responsibility for the maintenance of their dependents to perform such duty when financially able to do so; Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, as follows: 1. That this Board does herewith request the Sheriff, the County Judge, the County Prosecuting Attorney, the County Welfare Representatives and Representatives of the State Welfare Board to advise all parties seeking financial aid and assistance from Indian River County of the provisions of the above Act. 2. That this Board does herewith adopt as its policy the rule that all parties seeking financial assistance for dependents of a person financially able to support such depen- dents but who has failed or refused to do so shall be required to institute civil or -criminal proceedings or both against any father or mother who has abandoned his or.her minor child and to prosecute such proceedings to final conclusion. 3. That financial aid and assistance will be discontinued in each instance where such policy is not fully complied with. 4. That in instances where said dependents are destitute and a charge upon the County and such dependents do not have the funds necessary to pay the actual Court costs of such proceedings, that the County will consider the application of such person for financial assis- tance of the County in the paying of such costs. That such requests should be accompanied by a letter from the State .-attorney or his assistant that such person has made all preparation for the institution of such proceedings except only the payment of, costs, stating the amount thereof. 5. That the Honorable Murray Overstreet, State d.ttorney of this circuit, and his assistant, the -Honorable Thad Carlton, are herewith respectfully requested to institute such proceedings when authorized by law and to vigorously prosecute the same to conclusion. ....That a:; certified.. copy of this.. Resolution be, furnished_ to,' all parties ' Upon motion of Commissioner Waddell, seconded by Commissioner Watts and carried, the foregoing Resolution was unanimously adopted. RESOLUTION --- School Inspection Boards for November 3rd, 1953 Election, Upon Motion of Commissioner Hamilton and seconded by Commissioner Waddell, the following Resolution was unanimously adopted: WHEREAS, pursuant to law, an election is to be held in Special Tax School District No. 1, of Indian River County, Florida, on November 3, 1953; and, WHEREAS, the Board of Public Instruction of Indian River County, Florida, has heretofore adopted a Resolution calling said election; and, WHEREAS, the School Code of the State of F1`:orida provides that the Board of Public Instruction shall designate the number of inspection boards for each precinct and appoint the inspection boards, and the General Election Laws of the State of Florida provide that the number of inspection boards for each precinct and the inspection boards shall be determined by the Board -of County Commissioners; and, WHEREAS, the Board of Public Instruction of Indian River County, Florida, in special meeting on this date (October 6, 1953), has by Resolution determined the number of inspection boards necessary for each precinct, and has appointed the personnel of the inspection boards; NOW THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Indian River County, Florida, that this Board does hereby ratify, approve and confirm the number of inspection boards for each precinct and the personnel of the inspection boards heretofore determined and r appointed by the Board of Public Instruction of Indian River County, Florida, for the election to be held in Special Tax School District No, 1, Indian River County, Florida, on November 3, 1953; and, BE IT FURTHER RESOLVED, that this Board does herewith determine the number of inspection boards for each precinct and does hereby appoint the personnel of the inspection boards as heretofore determined and appointed by the Board of Public Instruction of Indian River 0 County* Florida, for the election to be held in Special Tax School District No. 1, in Indian River County, Florida, on November 3, 1953. BE IT FURTHER RESOLVED, by this Board that the form of ballot prepared by the Board of Public Instruction of Indian River County, Florida, for the election to be held in Special Tax School District No. 1, on November 3, 1953, be and the same is hereby ratified an -d approved, and the Superintendent of Public Instruction of Indian River County, Florida, is hereby directed tocause said form of ballot to be published in a newspaper of general circula- ,tion in Indian River County, Florida, as required by law. RESOLUTION --- Easement Deed to State re; Job 206, Sec, 8801, State Road 5. On Motion of Commissioner Watts, seconded by Commissioner Hamilton, the follow- ing Resolution was adopted. WHEREAS, the State Road Department has located and proposes to construct a 0 1 1 0 1 1 0 0 1 i 0 0 357 ;; drainage ditch necessary in connection with construction of Job 206 of Section 8801, State s Road 5, and WHEREAS, a portion of said ditch is located upon lands now owned by Indian River County and request having been received to grant the State of Florida the easement, license and right to enter upon, excavate, construct and maintain said portion of the said drainage ditch over, thraugh and across said -lands of Indian River County and said request having been duly considered. NOW, THEREFORE BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that the Chairman and Clerk of said Board be and they are hereby authorized and -directed to -make, execute and deliver to the State Road Deparknent an easement Deed granting the State of Florida the easement, license and right to enter upon,e xcavate, construct and maintain an outfall drainage ditch over, through and across the following de- scribed lands now owned by Indian River County, Florida, to -wit: The North 25 feet of Government Lots 7 and 8 of Section 7, Township 33 South, Range 40 East BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded forthwith to the State Road Department at Fort Lauderdale, Florida. Upon Motion of Commissioner Waddell, seconded by Commissioner Watts°and carried, Letters of Agreement were authorized relating to obtaining right of way'deeds-on State Road 5, Section 8801-691 as follows: October 6, 1953 Mr. & Mrs. T. R. Tuesday, November 3, 1953, with the following members present: Commissioners W. C. Graves, Jr., Chairman; Aubrey L. Vaddell, J. J. P. Hamilton, H. C. Watts and Allison Warren. Also present were E. E. Carter, Road and Bridge Superintendent, Sherman N. Smith, Jr., Attorney; L. B. O'Steen, Sheriff; and Douglas Baker, Clerk. Minutes of October 6th regular meeting were read and approved on Motion of Commissioner Hamilton, seconded by Commissioner Watts and carried. Mr. H. E. Kjorswick submitted a plat of Sebastian River property covering Ercildoune Heights Subdivision. Commissioner Watts, Attorney Smith and Road and Bridge Super- intendent Carter were appointed a committee to investigate with power to act in order that the matter can be disposed of within thirty days if possible. The County agrees to pay for the Deed to right-of-way. Notary Public Bord for William Kyrle Simms in the sum of $500.00 with St. Paul Mercury Indemnity Company as surety was approved by Douglas Baker, Clerk of Circuit Court, on October 13th, 1953. • 1 1
