Smith, Jr., Attorney, and Lather �e`Morriso'n Deputy Clerk.w, j The Chairman called the meeting to order and.announced the primary purpose of this meeting was to discuss right-of-way matters on State Road No. 5. j Mr. Bill goring of the firm of Merriman, Boring and Sutherland appeared before the Bo!prd and presented two plats; of Emerson Park. one, the regular plat and the other a plat i� shotvin;{g drainage facilities, etc.; Mr. Boring asked that the Board approve the plat and put up a Certified check in the amount of $1,000.00, until a satisfactory Performance Bond in the amount of $1,000.00 could be posted. The Board asked vh'e.rman N. That in each of your present water furrows leading into the, existing stream] described in this easement, the County will place 6 inch drainage tile underneath the access road alongside the ditch so that each of your water furrows will Amin directly into the drainage ditch in the easement. This will be done simultaneously with the construction of the drainage ditch so that there will be no impairment of your drainage of the grove. f 2. The plans of the State Road Department for the construction of this ditch L show three cross -overs across the drainage ditch to be placed in place of the three existing €E cross -overs you have across the existing stream. The County assures you that the cross -overs will be constructed. 3. Any Royal Palm trees located in the above described easement which require removing will be either moved by the County and placed along the new right of way for the new road or the County will remove the palm trees and pay you at the rate of $50.00 per tree. �! 4. Any live citrus trees located in this right of way which must be moved will be removed and the County will pay you at the rate of $35.00 per tree. 5. With respect to the artesian well which ivill be in the road right of way, the County will cut off this artesian well beneath the surface and will repipe this water under the road to your tenant house on the West side of the road. 6. S. 1 South of Vero Beach to the South County line. Motion was made by Commissioner Waddell, seconded by Commissioner Hamilton and carried that Sherman N.
